The purpose of this study seeks to analyze the problem of Unity in Diversity as a Source of Politics and Cultural Identity of the Indonesian Nation in Legal Formation. In general, the process of establishing customary, national, regional and international law in various parts of the world no one knows even uses Bhineka Tunggal Ika as the source of legal formation. However, often the formation of law in Indonesia refers to the philosophical meaning of Unity in Diversity. The formulation of (...) the research problem: 1) What are the markers of Unity in Diversity in Legal Formation?; 2) Why is Bhineka Tunggal Ika so important in the Formation of Law in Indonesia?; 3) Is there a contribution of Bhineka Tunggal Ika in the formation of customary law? This research was completed using qualitative methods. All data in this study are descriptive which have been collected directly or indirectly. Data acquisition is optimized through a literature study. All data were analyzed qualitatively to solve the research problem. The results showed that: 1) Unity in Diversity can be a marker of Indonesian national cultural identity in Legal Pluralism; 2) Bhineka Tunggal Ika in the formation of state law is considered relevant as a political source that is able to accommodate Customary Law and Religious Law into State Law; 3) Unity in Diversity as the identity of Indonesian Nation Culture, as well as political sources, has contributed in the spirit of the formation of Customary Law in the midst of the times. The relationship between the physical body and the conscious human mind has been a deeply problematic topic for centuries. Physicalism is the 'orthodox' metaphysical stance in contemporary Western thought, according to which reality is exclusively physical/material in nature. However, in the West, theoretical dissatisfaction with this type of approach has historically lead to Cartesian-style dualism, wherein mind and body are thought to belong to distinct metaphysical realms. In the current discussion I compare and contrast this standard Western approach with an (...) alternative form of dualism developed in the Sāṃkhya-Yoga philosophical tradition, where matter and pure consciousness are held to belong to distinct and independent realms, but where the mind is placed on the material side of the ontological divide. I argue that this model possesses a number of theoretical advantages over Cartesian-style dualism, and constitutes a compelling theoretical framework for re-conceptualizing the mind-body problem. Comparative philosophy has been subjected to much criticism in the latter half of the last century, though some of these criticisms were appropriate and justified. However, in our present cultural milieu, where traditions and culture transcend their geographical boundaries, seeping through the global network of views and ideas, it seems to be a legitimate enterprise to understand one’s own traditions and culture through the critical lens of the ‘other culture’. It is such cross-cultural understanding that paved the way towards legitimizing (...) “human rights” as a universal discourse. So also, the discourse on “environmental ethics” has gained acceptance in a similar manner across cultures and traditions. The paper attempts at an understanding of “Indian Philosophy” as a theoretical practice by exemplifying the notion of “sādhanā” in the Yoga system of Indian Philosophy through a reading of the notion of ‘phenomenological reduction’ as espoused in the transcendental phenomenology of Husserl. Thus, we reject the claim that philosophy as a pure rational activity was unique to the West as proclaimed in some Eurocentric readings. It is pertinent to recall here that the Sāṅkhya philosophy, which the Yoga system accepts as an allied school of thought was atheistic in its origin and attempted to explain the universe in terms of an evolutionary theory—the “prakṛti pariṇāma vāda”. Philosophers sometimes hope that our discipline will be transformative for students, perhaps especially when we teach so-called philosophy of the body. To that end, this article describes an experimental upper-level undergraduate course cross-listed between Philosophy and Physical Education, entitled “Thinking Through the Body: Philosophy and Yoga.” Drawing on the perspectives of professor and students, we show how a somatic practice (here, hatha yoga) and reading texts (here, primarily contemporary phenomenology) can be integrated in teaching and learning. Like many other discussions regarding the nature of self-awareness in Classical Indian philosophical traditions, the commentators of Patañjali’s Yogaśāstra deployed the metaphor of light or luminosity to defend the position that consciousness is self-reflexive. In this paper I discuss the way the commentarial tradition of Classical Yoga misinterpreted Patañjali’s notion of self-reflexivity and articulate his account of self-awareness based on Vyāsa’s preferred metaphor of space (ākāśa). I also show how Patañjali´s notion of self-awareness could be understood in terms of (...) “spaciousness” by using Merleau-Ponty’s phenomenology of perception and Dan Zahavi’s studies on the first-person perspective. According to Yoga Philosophy though the right knowledge of any phenomena is based on direct cognition, inference or testimony but the cognizance conjured up by words without any substance is devoid of objectivity. The consciousness is an aspect of the ultimate reality or substance, which is functioning, and manifesting itself in five progressive stages at five levels. What we experience or sense as consciousness is the first to five level experiences and the phenomenal cognizance in these stages, which can (...) be described in words, is instrumental one and modification of our mind. Therefore the state of consciousness as we experience is an out come of the five mental modes, viz. valid knowledge, error, imagination, deep sleep and recollection. So cognizance conforming to a word/language is devoid of a phenomenal object. Since we may speak of the unicorn though there is no real phenomenal object as such and thus the word/words may produce cognition, even though its object is nonexistent. The real consciousness and the study of consciousness cannot be instrumental one. The Yoga Sūtra suggests that the direct and unwavering awareness is required and that pure consciousness is devoid of any thing known by way of perception, memory, imagination, reasoning and intuition. The Consciousness in Yoga Sūtra is characterized as one of the four states of consciousness namely Vitarka accompanied by reasoning, Vicāra accompanied by reflection, Ānanda accompanied by bliss and Asmitā accompanied by sense of pure being. And then, after transcending these states of consciousness the one enters into the realm of real consciousness, that is the purest and non-intentional state of the self or the Knower or the Consciousness itself.
