Roman Ingardens frühe Schriften zur Erkenntnistheorie, die hier als Band 6 der von Rolf Fieguth und Guido Küng geleiteten »Gesammelten Werke« vorliegen, umfassen seine Dissertation über »Intuition und Intellekt bei Henri Bergson« und drei andere, zum Teil hier erstmals veröffentlichte Arbeiten aus der Frühperiode des hervorragenden polnischen Phänomenologen. Insgesamt bieten sie ein gutes Bild von dem auch für Ingardens Gesamtwerk sehr wichtigen und bisher nicht gebührend beachteten erkenntnistheoretischen Projekt, mit dem Ingarden in Anknüpfung an Edmund Husserl und andere Phänomenologen, aber (...) auch unter Verwendung eigener origineller Ideen die Möglichkeit einer autonomen Epistemologie nachzuweisen versucht. Przemysł farmaceutyczny oferuje coraz to nowe leki, które mają przedłużać życie osób cierpiących na nieuleczalne choroby. Innowacyjne terapie są często w jakimś stopniu skuteczniejsze, ale też (w co najmniej takim samym stopniu) droższe. Upoważnieni decydenci reprezentujący społeczeństwo muszą zatem rozstrzygać, które z nich będą finansowane ze środków publicznych. Jednym z głównych kryteriów, na których podstawie podejmuje się takie decyzje, jest stosunek dodatkowych kosztów, związanych z nową terapią, do czerpanych z niej dodatkowych korzyści. Dodatkowe korzyści, wynikające z nowych leków dla osób (...) śmiertelnie chorych, wydają się jednak często niezbyt wielkie w porównaniu do ich zawrotnych dodatkowych kosztów. Rodzi się zatem wątpliwość, czy refundacja tych leków, do której opinia społeczna skądinąd na ogół się skłania, daje się pogodzić z równie powszechnie akceptowaną zasadą ekonomicznej efektywności. Pewną próbą uzgodnienia tych postaw byłoby przyjęcie, że z pozoru niewielkie korzyści, przysparzane osobom zbliżającym się do śmierci — jak marginalne zwiększenie długości ich życia lub nieznaczne podniesienie jego jakości — w rzeczywistości mają większą wartość, ponieważ życie tych osób trzeba cenić wyżej. W przedstawianym artykule zastanawiam się nad tym, czy ta koncepcja jest do utrzymania — czy wartość życia wzrasta wobec bliskiej śmierci. (shrink)

The following text is a voice in the discussion around normative problems of innovative therapies. It particularly refers to problems related to the contribution of experimental therapies to the development of medical knowledge, also discussed in this issue in the article by Olga Dryla "Expanded access programs as a source of cognitive data.".

The subject of this article are the definitional and regulatory aspects of experimental (or innovative) therapies, understood either as new and unproven treatment methods that can be tested – and for this purpose used – also in clinical trials, or as applications of these new and unproven procedures in medical practice. After a short introduction, recalling one of the important sources of the concept of experimental or innovative therapy, which was the Belmont Report, I first discuss the problems related to (...) the definition of experimental therapy (as a new and nonvalidated medical procedure used to improve the patient's health), and then the controversial issues related to its regulation (including in particular the required control to which each such therapeutic intervention should be subject). Finally, I point out the importance of the discussions on experimental therapy reported in this article, conducted in other countries or in international contacts, for the necessary revision or reinterpretation of Polish regulations regarding therapeutic experiments. Przedmiotem tego artykułu jest zakres i charakter obowiązków, które w ujęciu Tomasza z Akwinu należą do szczególnej podklasy aktów dobroczynności lub czynienia dobra, noszącej u niego nazwę eleemosyna. Tłumacząc ten termin przez „pomoc potrzebującym” lub „pomoc w potrzebie”, biorę pod rozwagę pytanie, w jakich okolicznościach udzielanie tej pomocy jest według Tomasza działaniem obowiązkowym, a w jakich tylko zalecanym lub nawet niewłaściwym. W szczególności staram się ustalić, jak wiele z naszego osobistego dobra jego etyczna teoria każe nam przeznaczać na wspieranie innych, (...) nawet przy założeniu, że oni tego wsparcia potrzebują. This collection of 12 essays at the 100th anniversary of Roman Ingarden is to show the actuality of the outstanding Polish representative of twentieth century philosophy. The authors take up Ingarden's main philosophical topics and, accordingly, deal with phenomenological and ontological problems on the various modes of givenness and existence in the wide range of real and intentional being, true and fictional existence, and they devote particular interest to Ingarden's conception of reality as well as to his aesthetics and theory (...) of arts. The paper an analytical-interpretative commentary on several excerpts from I. Kant. The first one with an example of a doctor who thinks he knows his patient's illness deals with the concept of pragmatic faith. The author seeks to explicate this concept by giving three interpretations of Kantian example. In a further part of the paper the internal lie is defined as a sin which may fall part of any "believers not careful enough" of the titular faith. The first example is (...) this sin is an internal profession of faith in God ("just in case") without actual participation in it. The second example is a false worship to the Creator, the one that is motivated by fear or punishment. When interpreting these examples, the author refers to the Kantian distinction between homo noumenon (moral being) and homo phaenomenon (physical being). This distinction is related to the interdiction of using homo phaenomenon only as a means (an instrument to speak). (shrink)

The task of corrective justice in Aristotle’s ethics is the rectification of harms or injuries resulting from voluntary or involuntary interactions between persons. However, the scope of this form of justice is not clear. In its widest conception it would include all harms done to a person against her will and without her fault. According to a narrower conception, instead, it is only an injury caused by an unjust or wrongful action that requires compensation. But in fact Aristotle distinguishes several (...) concepts of unjust action. As a result, the narrower conception appears in various versions which are discussed in this paper. (shrink)

The topic of the article is the logical relation between things that are intrinsically good and things that are extrinsically good to value as such. Three main conceptions pertaining to this problem have been identified. In the first conception adverbs,,intrinsic” and,,extrinsic” specify which of the two meanings of the word “good” has been meant, and the terms “intrinsic value” and “extrinsic value” stand for two different meanings of the term “value”. In the second conception the two adverbs modify the meaning (...) of the term “valuable” so much that the intrinsic value and the extrinsic values turn out to be two different kinds of value, or two different cases of value. In the third conception the two adverbs modify the sense of the word “good” and both the intrinsic and the extrinsic value is only a component of value and not two separate entities. The subject matter of this article is the right to health as one of the moral rights granted to all human beings. In the first part, I provide an overview of selected international documents that consider health a human right and, in the second part, I investigate the most significant commentaries on these documents. Accordingly, I attempt to bring out and arrange in an order the main ethical claims contained in these documents and commentaries, discussing such issues as the kinds (...) of rights related to health, the conditions of access to health-related goods or the duties of the states implicated by the right to health.
