The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. We study a logic whose formulae are interpreted as properties of a finite set over some universe. The language is propositional, with two unary operators inclusion and extension, both taking a finite set as argument. We present a basic Hilbert-style axiomatisation, and study its completeness. The main results are syntactic and semantic characterisations of complete extensions of the logic.

Jan Franciszek Drewnowski był filozofem zaliczanym do środowiska szkoły lwowsko-warszawskiej, współtwórcą koła krakowskiego, oficerem wojska polskiego, pracownikiem wydawnictw technicznych. Drewnowski doktoryzował się u T. Kotarbińskiego, jego niedoścignionym mistrzem był Stanisław Leśniewski. Był jednym z pierwszych słuchaczy akademickich wykładów Leśniewskiego. Studiował na Wydziale Filozoficznym Uniwersytetu Warszawskiego: matematykę, logikę matematyczną i – jak to wtedy nazywano – filozofię naukową. Tam właśnie spotkał ks. Jana Salamuchę, który zaimponował Drewnowskiemu naukową erudycją, a intelektualną uczciwością skierował go od ateizmu ku katolickiej mistyce. W ten sposób (...) In this paper I will juxtapose the concept of the veil of ignorance – a fundamental premise of Rawlsian justice as fairness – and solidarity in the context of the organisation of a healthcare system. My hypothesis is that the veil of ignorance could be considered a rhetorical tool that supports compassion solidarity. In the concept of the veil of ignorance, I will find some crucial features of compassion solidarity within the Rawlsian concept of “reciprocity” – located between “impartiality” and (...) “mutual advantage”. I conclude that, even behind this “thick” veil, some essential, yet “particular” facts on health and wealth redistribution are available to decision makers. Lastly, I discover that by means of the assumption of self-interest in the original position the veil aims to convert egoism into empathy, thus invoking the solidarity of compassion that in turn could be translated into principles of the organisation of a healthcare system. On the basis of a case study of the integration of Haredi Jewish women into the Israeli high-tech industry, we explore how gender–religiosity intersectionality affects ultra-conservative women’s participation in the labor market and their ability to negotiate with employers for corporate work–family practices that address their idiosyncratic requirements. We highlight the importance of pious women’s affiliation to their highly organized religious communities while taking a process-centered approach to intersectionality and focusing on the matrix of domination formed by the Israeli state, (...) employers, and the organized ultra-orthodox community. We dub this set of actors “the unholy-trinity” and argue that it constructs a specific, religion-centric inequality regime that restrains women’s job and earning opportunities. At the same time, the “unholy trinity” also empowers women in their struggle to create a working environment that is receptive to their religiosity and what that commitment demands of them. (shrink)

The purpose of this paper is to provide an analytical framework – derived from the Herbert L.A. Hart’s philosophy of law – for the study of the phenomenon of habit and custom from the perspective of normativity. Its starting point is the Hart’s concept of “internal aspect of rules” as a necessary criterion for the rule’s normative character. The internal aspect exists in two forms: the “recognition” based on specific rules, and “acceptance”. The concept of acceptance reveals a difference between (...) habit and custom, by capturing the normative character of the latter. The formation of the customs – by way of unprecedented punishment of a rule’s violation – reveals the ambiguity of the term “sanction” as referring to not only the external aspect, but also to internal aspect of rules. The article offers an analysis of Józef Bocheński's studies of the concept of nation. Bocheński acknowledges that there are difficulties in defining a nation. After that he claims that he will attempt to propose a definition of the Polish nation. Nation is a social group centered around some cultural ideal. The analysis shows that Bocheński did not avoid serious logical problems. First of all, he constantly falls into a circular reasoning. Furthermore, it is called into question if it makes sense (...) to refer to a cultural ideal or ideology while defining a nation. Is not such an attempt essentially bound to become circular? A doubt is also raised whether nowadays, in the face of constant migration of people and cultural ideals, one can continue to reasonably talk about nations. (shrink)

From the perspective of philosophy of science and technologies, we firstly attend to the issue of the role of nanotechnologies within the evolution of technologies. We recognize their utmost importance in the respect that they are technologies of life itself. We further explain that the nano-level is the domain of intersection of the rules of quantum physics and traditional Newtonian physics. This is our starting point from which we discuss the issue of conditions under which minimizing things also changes their (...) functional essence. We use the example of the Drexler vs. Smalley debate to demonstrate the paradigmatic incomparability of the two perspectives and the physical-chemical and engineering-related limits of nanotechnologies. We discuss to what extent are the dangers and ethical implications emerging from Drexler’s contemplations real, be it what he calls the “grey goo” problem or the issues of molecular production. We regard certain problems linked to synthetic biology as more serious. We conclude our text with the consideration that the human civilization should think of the possibilities of nanotechnologies in the development of life as an existential challenge. (shrink)

This paper describes the process of reception of Catholic Modernism in Poland as well as the Polish contribution to this movement. It shows the Polish antimodernist perspective on modernistic thought. The neglect of Polish modernism was caused by the nationalistic character of the Polish theology and has resulted in absence of historical studies of Polish Catholic Modernism. Based on the results of archival and literature research the paper presents a variety of Polish Catholic Modernists and non-Catholic supporters of the modernist (...) thought. A unique place among Polish modernists belongs to Marian Zdziechowski (1861–1938) who was the only Polish participant of the international intellectual debate on the “modernisation” of Roman Catholicism. The paper analyses the development of Zdziechowski’s thought and shows that his main demand throughout the modernist debates was to create a new, more efficient apologetics, which would be grounded in the religious experience of the individual. Containing nearly all the material which has survived on Kalecki's activity - both theoretical and practical - from 1955 to 1964.

This is the first volume in a new, definitive, seven-volume edition of the works of Michal Kalecki, one of the twentieth century's most distinguished economists. Kalecki was one of the three contemporary economists to arrive at the conclusions publicized by Keynes, although Kalecki arguably presented these views even earlier than Keynes. Volume I contains Kalecki's writings on the theory of the business cycle and full employment. His seminal Essay on the Business Cycle Theory is preceded by his earlier theoretical studies (...) and followed by publications which developed and defended its main concepts and ideas. This volume also contains the 1939 book Essays in the Theory of Economic Fluctuations, the work which established his reputation. Also included are papers documenting his confrontation with Keynes's General Theory, including Kalecki's review of that work, and his various studies on the theory and policies relating to full employment, both the well known `Political Aspects of Full Employment' and `Three Ways to Full Employment', and those which have unfairly received less attention. The editorial comments and annexes at the end of the volume, besides giving valuable information on the background to the main texts, include illuminating exchanges of correspondence between Kalecki and Keynes, Joan Robinson, and others. The seventh volume of the Collected Works of Michal Kalecki, one of the twentieth century's preeminent economists, contains his empirical studies of the wartime and post-war economy in Britain and the USA, together with papers on the work of other economists and miscellanea.The first part of the book collects together his articles on the economic conditions of Britain during the Second World War, focusing on the rationing of consumption and war finance, and its post-war reconstructions. These articles are among Kalecki's (...) best known, and contributed significantly to his world renown as an economist. Part two contains studies of post-war America, comparing the economy with the situation before the War. Part three contains a group of articles under the title `Political economy and economists', and includes book reviews and essays on the study of economics. Part four collects essays on a variety of topics, including Polish economic planning, construction engineering, and the theory of numbers. As in previous volumes, editorial notes and annexes by Professor Osiaty'nski provide invaluable background information and explanatory glosses on the main text. Among other things, they reveal details of Kalecki's work for the United Nations.Since this is the final volume of the Collected Works, it concludes with a chronology of biographical information and a complete bibliography of Kalecki's writings from 1927 to 1987.
