La democrazia vive dello scambio tra opinioni in un contesto di libertà e pluralismo. Quando però nel dibattito pubblico comincia a farsi strada l’idea che le opinioni possano prescindere dai più elementari dati di realtà e possano essere supportate da “verità alternative” prive di ogni riscontro fattuale, viene meno ogni denominatore comune a tutti i discorsi sociali. Come ha sottolineato Hannah Arendt, la libertà di opinione scade a mera illusione se non viene garantita l’informazione obiettiva e i fatti non sono (...) più alla base delle opinioni. Le verità fattuali rendono possibile la discussione politica proprio perché ricordano agli esseri umani che esiste un limite invalicabile alla discussione, quello costituito da evidenze che non è possibile sconfessare né respingere. Anche se le procedure della persuasione politica non si prestano ad alcuna forma di validazione cognitiva, ciò non impedisce ad Arendt di riconoscere la necessità di un orientamento “veritativo” anche rispetto a quanto accade nella vita politica. The idea that the sovereignty of the nation-state has collapsed under the weight of globalization "and it is now an empty shell" has long been a conviction rooted in political and social sciences, which speak openly of an era of post-sovereignty. However, the sovereignty of the State finds an ultimate and indispensable bulwark in the defense and in the border control. But as things stand when sovereignty is «popular»? What principles the democratic state of law can appeal to practice an (...) immigration policy which unilaterally terminate the company to strangers? The thesis proposed in the article argues that the democratic theory does not consider, in this regard, any discretionary. If «the people is an aspiration, not a fact», as Benhabib argues, the regime of border control, to be democratically legitimate, should take into account both the perspective of insiders, and that of the outsiders. Generally speaking, political theory avoids considering the kind of damage suffered by he who lives excluded from any political community or perhaps sees such damage as a juridical and political phenomenon that is the loss of nationality. One must instead be aware that they who are compelled to live within the circumscribed space of a set of regulations, institutions and spaces that can be labelled under the umbrella term of camp are subject to a specific existential deprivation and not only (...) to a juridical damage. To justify this argumentation it is worth going back to Hannah Arendt's works where the condition of people without citizenship is understood under ontological-existential terms thus offering a wiser perspective to understand one's moral obligations towards stateless people and refugees.
