Europska komisija je od 1995. do 1998. podupirala istraživački projekt »Temeljni etički principi u europskoj bioetici i biopravu« . Projekt se temeljio na suradnji 22 partnera iz većine država Europske unije. Cilj projekta bio je identificirati etičke principe povezane s autonomijom, dostojanstvom, integritetom i ranjivošću kao četirima važnim idejama ili vrijednostima za europsku bioetiku i biopravo. Važan sažetak BIOMED projekta bio je Prijedlog Smjernica Europskoj komisiji – Deklaracija iz Barcelone iz 1998. godine – koja je jedinstvena jer predstavlja (...) filozofsku i političku suglasnost stručnjaka za bioetiku i biopravo iz mnogih država. U ovome tekstu želimo usporediti Deklaraciju iz Barcelone sa nekim drugim novijim međunarodnim dokumentima o bioetici i biopravu. Povezat ćemo Deklaraciju iz Barcelone sa okvirom koji nude različiti međunarodni dokumenti i propisi o djelovanju u bioetici i biopravu. Posebno ćemo se usmjeriti na sličnosti i razlike sa Konvencijom o zaštiti ljudskih prava i dostojanstva ljudskih bića u pogledu primjene biologije i medicine, koju je prihvatilo Vijeće ministara 1996., te ćemo promotriti i UNESCOvu Deklaraciju o ljudskom genomu iz 1997. Dakle, Deklaracija iz Barcelone ne predstavlja samo europske etičke principe u bioetici i biopravu, nego ujedno pojašnjava i artikulira osnovne etičke principe koji se nalaze u središtu međunarodnog interesa za univerzalnu bioetiku i biopravo. The “Lošinj Declaration on Biotic Sovereignty” is a novelty in the consideration of the environment and life in general and a unique document on a global scale. Until the advent of the Declaration, the environment was usually considered in an instrumentalist way, following the prevailing techno-scientific paradigm. The Declaration introduces biotic sovereignty as the starting point for the debate on GMOs, from which the harmfulness or potential benefits of genetic engineering can be assessed. The protection of biotic sovereignty should be (...) one of the crucial values that European and Croatian citizens should defend in the upcoming struggle to change and probably drastically reduce the regulatory regime for genetically modified crops in the European Union and thus also in Croatia. In this paper, we highlight the importance of the “Lošinj Declaration on Biotic Sovereignty” in the context of the emergence of new gene regulation techniques that are becoming a threat to biotic sovereignty. We analyse the lobbying process against the ruling C-528/16 using the example of the scientists united in the network EU-SAGE. The central part of the paper analyses the controversy over a new European Commission study on new genetic techniques and the political context of the conflict between the European Commission and the European Parliament over the authorisation of new seed varieties of genetically modified crops. Pitanje izgrađuje li Europa politički identitet ili ostaje zajednica drugog reda odredit će put europske integracije. Uvjet političkog identiteta je zasigurno europska javnost; na taj način su građani sposobni prihvatiti odluke europskog političkog sustava sudjelujući u relevantnim raspravama. Tri koncepta javnog će poslužit će pri razumijevanju europske javnosti kao međusobne povezanosti zajednice temeljene na mrežama. Nadopunjavanje »javne sfere« »javnim diskursom« odražava nastojanje nadilaženja nacionalnih ideja: ne govorimo o jednoj europskoj javnosti, nego je ona zamišljena kao mreža parcijalnih nacionalnih javnosti, (...) koje izviru iz događaja koje imaju određen značaj za Europu. Tako se europski identitet može stvoriti fokusiranjem političkih interesa građana na teme od zajedničkog značaja. (shrink)

Straipsnyje nagrinėjamas Lietuvos Respublikos darbo ginčų instituto reformavimas ir kaita Nepriklausomybės laikotarpiu atskirų Europos Sąjungos valstybių patirties kontekste. Darbo ginčų reforma Lietuvoje minimu laikotarpiu vyko keliais etapais, iš jų paskutinysis, prasidėjęs 2013 m. sausio 1 d., pakeitė darbo ginčų komisijų organizavimo tvarką, šias komisijas pradėjus kurti teritoriniu principu, prie veikiančių Valstybinės darbo inspekcijos teritorinių padalinių, nustačius, kad į darbo ginčų komisiją su skundu gali kreiptis ne tik darbuotojas, bet ir darbdavys, įvedus kitas naujoves. Tačiau šie pokyčiai vis dar neatspindi europinių (...) tendencijų, kiek įmanoma mažiau institucionalizuoti ikiteisminę individulių darbo ginčų nagrinėjimo tvarką. Straipsnyje akcentuojama mintis, jog darbo ginčų instituto reforma laikytina nebaigta ir, tikėtina, bus tęsiama, remiantis pažangiausia kai kurių ES valstybių praktika šioje srityje, tačiau išlaikant nacionalinį teisinio reguliavimo ypatumą. Out-of-court proceedings or alternative dispute resolution (ADR) is a peaceful, voluntary alternative method for settling disputes without litigation in the court. ADR institutions usually use a third party to help the consumer and the trader to reach a solution. The main purpose of this article is to share the main insights and experience about the out-of-court proceedings in various countries and European Union Member States, to discuss the most important problems concerning ADR and propose possible solutions of these problems. First (...) of all, in this article, ADR is presented and its main advantages are outlined. For example, ADR institutions are indeed a low-cost and quick alternative for consumers for settling disputes with businesses. ADR mechanisms are highly diverse. There are public and private institutions as well as institutions established on the basis of cooperation between the public sector and the industry or consumer organizations and the industry. Although there is a high correlation between the nature of the institution and the funding, i.e. private institutions are usually financed by the industry and public institutions by public funds, ADR bodies established by public law can also be financed by the industry (especially in highly regulated markets). In the majority of the institutions, the participation of the industry in the ADR procedure is voluntary. (shrink)

Croatia’s accession to the EU brought changes in educational policies by introducing the concept of the European Dimension in Education. EDE has successfully found its way into the new Croatian national curriculum, however, there has been no comprehensive analysis of whether it has been introduced into teaching materials. Therefore, the aim of this paper is to determine if the European Dimension in Education is present in geography textbooks for primary schools, as well as to explore how it is represented in (...) them. The results of research show that the idea of the European Dimension in Education is most commonly present in terms of factual knowledge about Europe, which does not motivate teachers and pupils to actively and critically discuss issues related to Europe and the European Union. Pristupanje Republike Hrvatske članstvu u Europskoj uniji, donijelo je, između ostalog, promjene u obrazovnim politikama putem koncepta europske dimenzije u obrazovanju. Koncept europske dimenzije u obrazovanju uspješno pronalazi svoje mjesto u Nacionalnom okvirnom kurikulumu, međutim ne postoje detaljnije analize putem kojih bi se utvrdilo je li ovaj koncept prepoznat i u nastavnim materijalima, točnije u udžbenicima. Stoga je cilj ovog istraživanja utvrditi je li i na koji način europska dimenzija u obrazovanju prisutna u udžbenicima geografije za osnovnu školu. Rezultati istraživanja pokazali su da je ideja europske dimenzije u obrazovanju dominantno prisutna u obliku činjeničnog znanja o Europi što nastavnicima i učenicima ne pruža dovoljno mogućnosti za razvoj stavova i kritičkog osvrta na spomenute teme. Metageografijska kategorija Zapada svoju kurentnost u medijskom i akademskom diskursu najviše duguje temeljnoj longitudinalnoj podjeli u odnosu na Istok. Prostorno-vremenska univerzalizacija svjetske povijesti pritom je arbitrarna, izvorno europska konstrukcija. Tragamo li za podrijetlom modernoga pojma Europe i europskog identiteta, otkrivamo u kojoj je mjeri islam čimbenik njihova nastanka. Ranonovovjekovni europski humanisti reaktualiziraju antičke konstrukcije Istoka i Zapada – ili Europe i Azije – u smislu čvrstih kulturalnih i političkih granica. Ipak, oni pritom ponajviše započinju sekularizaciju kršćanstva kao srednjevjekovnog oblika (...) zapadnog jedinstva. Kako je rečeni identitet bitno oblikovan u križarskim ratovima, prirodno se nameće situiranje teme u uži, južnoeuropski i mediteranski kontekst odnosa različitih tradicija. Promišljanje diskursa filozofije povijesti o križarskim ratovima u ovom se radu nastoji povezati s novijim postignućima postkolonijalne teorije i medievistike.Metageographical category of the West retains its currency in the media and in academic discourse mainly due to the fundamental longitudinal divide severing the West from the East. The spatio-temporal universalisation of World History is at the same time an arbitrary, originally European construction. If we investigate the origin of the modern notion of Europe and the European identity, we realize the extent to which Islam was a factor in their creation. Early modern European humanists rediscovered ancient constructs of East and West or Europe and Asia as hard cultural and political boundaries. However, in so doing they have primarily begun the secularization of Christendom as the medieval form of western unity. Because the aforesaid identity was essentially formed during the Crusades, it is quite natural to situate this subject within narrower, Southern-European and Mediterranean context of relations between different traditions. This paper endeavours to link the reflection on the given portion of the discourse of the philosophy of history with the recent results of postcolonial theory and medieval studies. (shrink)

Pristupanje Republike Hrvatske članstvu u Europskoj uniji, donijelo je, između ostalog, promjene u obrazovnim politikama putem koncepta europske dimenzije u obrazovanju. Koncept europske dimenzije u obrazovanju uspješno pronalazi svoje mjesto u Nacionalnom okvirnom kurikulumu, međutim ne postoje detaljnije analize putem kojih bi se utvrdilo je li ovaj koncept prepoznat i u nastavnim materijalima, točnije u udžbenicima. Stoga je cilj ovog istraživanja utvrditi je li i na koji način europska dimenzija u obrazovanju prisutna u udžbenicima geografije za osnovnu školu. Rezultati (...) istraživanja pokazali su da je ideja europske dimenzije u obrazovanju dominantno prisutna u obliku činjeničnog znanja o Europi što nastavnicima i učenicima ne pruža dovoljno mogućnosti za razvoj stavova i kritičkog osvrta na spomenute teme. The author will look at aspects of thinking about the idea of Europe at the crossroads of the digital and post-digital epochs – through Edgar Morin’s text Thinking Europe and Guy Debord’s Comments on the Society of the Spectacle, published in the late 1980s, in an attempt to understand their fundamental positions and implicit views on how to approach and pursue something like the political and supranational union of European countries in parallel with the rapid development of digital technologies and (...) new media, which fundamentally change our experience of the world. The very idea of a united Europe appears here as a Kantian “suspicious pleonasm”, whose value is questioned today, especially with the development of new global policies and post-cultural virtual environments that make – notions such as Europe, the Mediterranean, and the Western world – only artifacts of decadent Occidental cultures whose real ruins are overshadowed by an overly real spectacle of virtual abundance. Environmental issues are very relevant today, so this Paper analyses the very beginning of the formation of environmental awareness, questioning its basic determinants – both in time and space and in the causes and consequences of human action on the environment as one of the fundamental elements for any historical research. The paper also offers a brief comparative review of the situation in the Republic of Croatia and finally opens ground for future discussions primarily in the evaluation of progress and (...) development of environmental events in relation to those that this study detected as initial. After the Provisional Basic Law (Provisional Constitution) had been adopted on 11 March 1990, it soon became clear that it did not meet the new needs of the society and the state. It became clear that the new Constitution had to be drafted promptly. Its drafting was taking place at the time of heated discussions about various things, but especially about the structure of branches of state power, the empowerment thereof and their interrelations. The author of the article was a (...) member of the working group drafting the new Constitution. In his article, the author presents passages from the notes made by him about the sittings of the Provisional Commission for Drafting the Constitution and those of its working group. The notes disclose the variety of the views of the deputies and legal specialists and show the difficult way of emergence of the draft Constitution. This is confirmed by the time-line of drafting the Constitution. In 1990 and at the beginning of 1991, the first draft Constitutions were published, which had been drafted by the members of the societies of Lithuanian philosophers and lawyers, by the Lithuanian Democratic Labour Party, etc. Prior to the resolution of the Supreme Council of the Republic of Lithuania of 7 November 1990, a group of deputies was formed for drafting an outline of the concept of the Constitution. On 22 October 1991, the Council of the Seimas of the Lithuanian Sąjūdis Movement made a statement “On the Restoration of the Institution of the President of the Republic”. On 5 November 1991, the Supreme Council of the Republic of Lithuania adopted a Resolution “On the Development of the Lithuanian Constitutionalism”, whereas by its resolution of 10 December 1991 it formed the Provisional Commission for Drafting the Constitution. On 3 March 1992, the said Provisional Commission approved the draft Constitution that it prepared; it was submitted to the Supreme Council. Three members of the Provisional Commission had submitted alternatives to a number of articles of the Constitution. On 21 April 1992, the Supreme Council assented to the work done by the Provisional Commission and decided to publish the draft Constitution so that it could be discussed by the public. On 6 May 1992, the Lithuanian Sąjūdis Movement, the Democratic Party, the Christian Democratic Party, and the Lithuanian Nationalist Union formed a coalition for drafting an alternative draft Constitution; soon the press published the alternative draft Constitution prepared by the Sąjūdis Movement Coalition “For the Democratic Lithuania”. On 23 May 1992, the referendum on the restoration of the institution of the President of the Republic took place—that referendum did not approve the proposal. Thus, two alternative draft Constitutions appeared. The essential difference between those drafts was a different approach to the system of branches of state powers, their empowerment and their interrelation. The draft Constitution prepared by the Provisional Commission was based on the parliamentary republic form of governance, whereas in the draft prepared by the Sąjūdis Movement Coalition “For Democratic Lithuania” the model of half-presidential republic was dominant. In order to prepare a single draft Constitution, which could then be proposed for the referendum of the Nation, political and legal compromises were sought. For this purpose, the Group for the Adjustment of Constitutional Issues was formed. At the end of September and at the beginning of October 1992, one single (the so-called “compromise”) draft Constitution was prepared from the existing two alternative drafts. The Constitution of the Republic of Lithuania was adopted by the Nation in the referendum of 25 October 1992 and came into force on 2 November 1992. (shrink)

The article analyses the legal status of the natural gas market regulatory institutions in Lithuania and in the member states of the European Union. First, the authors assess the most important elements of the legal status of the natural gas market regulators in the EU member states, namely, the degree of autonomy (type of institution, appointment and dismissal procedures of management, duration of the terms of office, sources of funding) and the measures aimed at ensuring accountability, transparency, and prevention of (...) conflicts of interest. Second, the legal status of the National Control Commission for Prices and Energy, which carries out functions of regulation and control of the natural gas sector in Lithuania, is examined. Finally, the authors conclude that the imperfections in the regulation of the legal status of the Commission result in several negative effects and provide reasoned proposals regarding the improvement of the legal status of the Commission. The most significant moments of restoration of Lithuania’s statehood and its constitutional consolidation in the national legislation during the Atgimimas period (from the foundation of Sąjūdis on 3 June 1988) and the work of the Supreme Council of Lithuania (from February 1990 to October 1992) are discussed in this article. The author pays attention to the challenges of drafting the new Constitution – the main weapon in the political fight; the article declares the complexity of this process and mentions the (...) participating persons. The article analyses the process of adopting the fundamental legal acts, initiated by Sąjūdis, such as the Citizenship Law, the Political Parties Law, the Law on the Constitutional Court. The most important and relevant problems and aims of the Independent State’s first year legislation are discussed in the article. One of the first legal acts – the Regulation of the Supreme Council of the Republic of Lithuania, as well as considering about the functions of the officials and other staff of the Supreme Council, the functions of the Legal Department, the relations between the Supreme Council and its Legal Department are analysed. The article pays attention to the first steps of the Independent State, based on the Constitution of the Republic of Lithuania, adopted on 25 October 1992 by referendum. The restoration of the Presidential institution and the formation of the Constitutional Court is also discussed. The significant role of Professor dr. Juozas Žilys in drafting the most important legal acts, acting as preconditions for the restoration of statehood of our country and its constitutional consolidation is noted in the article. (shrink)
