Abstract

Resumo O autor propõe uma interpretação da noção hegeliana de normatividade tal como desenvolvida na introdução à Filosofia do Direito. Começa por construir uma relação entre a cientificidade da Filosofia do Direito e uma visão pragmatista da “ontologia social” . Em seguida, oferece uma reinterpretação da relação pretendida por Hegel entre o direito natural e o positivo . Em terceiro lugar, procura mostrar como Hegel procura pensar, através de sua noção de autodeterminação, uma relação intrínseca entre a autoridade normativa e as práticas compartilhadas . Em quarto lugar, tenta corroborar a sua proposta através de uma consideração das dimensões subjetiva e objetiva do conceito hegeliano de direito . Conclui, delineando as diretrizes gerais da crítica hegeliana à concepção moderna de normatividade prática . The text beggins, with a connection between the methodological framework of the Philosophy of Right and a pragmatist view of “social ontology” . Secondly, it offers a reinterpretation of the relationship, wanted by Hegel, between natural and positive law . Thirdly, it seeks to show the way Hegel intends to construct, through his notion of self-determination, the internal connection between normative authority and social practices . Fourthly, it tries to corroborate his proposal by the consideration of subjective and objective dimensions of Hegel´s concept of law . Finally, it concludes by delineating the main features of Hegel´s critique to the modern comprehension of practical normativity . Keywords : freedom, Hegel, normativity, practice, right
