My aesthetic judgements seem to make claims on you. While some popular accounts of aesthetic normativity say that the force of these claims is third-personal, I argue that it is actually second-personal. This point may sound like a bland technicality, but it points to a novel idea about what aesthetic judgements ultimately are and what they do. It suggests, in particular, that aesthetic judgements are motions in the collective legislation of the nature of aesthetic activity. This conception is recommended by (...) its ability to explain some important but otherwise recondite features of aesthetic practice and, more importantly, by allowing us to ground the normativity of aesthetic judgement in the familiar normativity of practice. It also offers a more systematic way of understanding the rivalry between the ideals of aesthetic universality and diversity. (shrink)

This chapter develops and defends an account of reason: to reason is to scrutinize one’s attitudes by consulting the perspectives of other persons. The principal attraction of this account is its ability to vindicate the unique of authority of reason. The chapter argues that this conception entails that reasoning is a robustly social endeavor—that it is, in the first instance, something we do with other people. It is further argued that such social endeavors presuppose mutual respect on the part of (...) those participating in them. The account therefore yields a form of Kantian constructivism: we have an unconditional duty of respect for persons because such a duty is implicit in the very nature of reasoning. -/- . (shrink)

Many people find comparisons of the value of persons distasteful, even immoral. But what can be said in support of the claim that persons have incomparable worth? This chapter considers an argument purporting to show that the value of persons is incomparable because it is so great—because it is infinite. The argument rests on two claims: that the value of our capacity for valuing must equal or exceed the value of things valued and that our capacity for valuing is unbounded (...) in a very strong sense. After laying out this argument, I consider its implications for how we should regard each other. In particular, I suggest that it complicates efforts to understand morality as a system of principles. The young Hegel was entranced by the notion of intellectual intuition, and this notion continues to entrance many of Hegel’ commentators. I argue that Kant provided three distinct conceptions of an intuitive intellect, that none of these involve aconceptual intuitionism, and that they differ markedly from Fichte’s and Schelling’s conceptions of intellectual intuition. I further argue that by 1804 Hegel recognized that appealing to an aconceptual model, or to Schelling’s model, or to his own early model of intellectual intuition generates (...) inevitable and insoluble problems of question-begging. By incorporating several important points from Kant’s Transcendental Ideal into his reinterpretation of Kant’s Transcendental Deduction and Refutation of Idealism, Hegel’s mature discursive and conceptual account of ‘absolute knowing’ performs some of the functions Kant assigned to the intuitive intellect, though without invoking any such intuitive intellect. Schiller says that “it is only through beauty that man makes his way to freedom.” Here I attempt to defend a claim in the same spirit as Schiller’s but by different means. My thesis is that a person’s autonomous agency depends on their adopting an aesthetic identity. To act, we need to don contingent features of agency, things that structure our practical thought and explain what we do in very general terms but are neither universal nor necessary features of agency (...) as such. Without these things, the question of what to do for any individual would be underdetermined. The problem is that adopting such a contingent form of agency amounts to a restriction on what we can do, and so it is a prima facie threat to our autonomy. I will argue that one way, and indeed the only way, of meeting this challenge lies in aesthetic experience. Granting our capacity for aesthetic pleasure the authority to determine the particularities of our agency is compatible with autonomy because doing so means identifying with one’s capacity for pleasure in free and creative activity. Doing this allows us to be both particular sorts of agents and creatures regulated by the universalizing demands of reason. (shrink)

While discussions among philosophers often emphasize the ethical justification for banning bribery, policy-makers around the world are challenging it on the basis of its effects for economic development. In this paper we define bribery, trace recent efforts by the public, private, and civil society sectors to curb it, and attempt to answer the question: Will bribery become less common?

_Grounds of Pragmatic Realism_ shows Hegel is a major epistemologist, who disentangled Kant’s critique of judgment, across the Critical corpus, from transcendental idealism, and augmented its enormous evaluative and justificatory significance for commonsense knowledge, the natural sciences and freedom of action.

The charged debate on the ‘C‐S‐R‐ization’ of organizational practices seems to have produced two opposing and seemingly incompatible explanations for why organizations should engage in corporate social responsibility (CSR): one, the normative rationale based on an appeal to ethics; and the other, the instrumental rationale, based on an appeal to business pragmatism. This paper argues that a missing link in this debate is the failure to recognize that the normative and instrumental approaches to corporate social responsibility are underpinned by substantively, (...) differentiating, relative logics of emotional rationalism on the one hand, and instrumental rationalism on the other. The paper makes a case that for CSR as a management practice to be practicable and actionable within a sustainable business agenda, it will need to be stripped of its current normative undertone and reconstructed in the instrumentally, pragmatic (utlish) language of business. Otherwise, the whole concept of CSR may continue to dwell in the realm of abstract theorizing without yielding many beneficial and practicable outcomes. The paper concludes that such an approach that situates CSR within a pragmatic business lingua, rather than a non‐business lingua, will help in legitimizing CSR as a ‘neutral’ management practice. David Hume's Dialogues Concerning Natural Religion is a philosophical and literary classic of the highest order. Agrifood scholars have long investigated the relationship between farm size and a wide variety of social and ecological outcomes. Yet neither this scholarship nor the extensive research on farmworkers has addressed the relationship between farm size and job quality for hired workers. Moreover, although this question has not been systematically investigated, many advocates, popular food writers, and documentaries appear to have the answer—portraying precarious work as common on large farms and nonexistent on small farms. In this paper, we take on (...) this question by describing and explaining the relationship between farm size and job quality for hired farm workers. To do so, we draw on data from two independently conducted, mixed-methods case studies—organic fruit and vegetable production in California, and dairy farming in Wisconsin—each of which offers a different set of insights into the farm size-job quality relationship. In both cases, larger farms fared better than or no worse than their smaller-scale counterparts for most job quality metrics investigated, though many of the advantages of working on large farms accrue disproportionately to white, U.S.-born workers. We explain that these patterns stem from economies of scale, industrialization, firm size itself, the dominant class identities and aspirations of farmers and their peers, as well as farmers’ and immigrant workers’ fears of immigration enforcement. Traditionally, questions about the role of the arts in moral thought have focused on the arts’ role in the acquisition of new moral knowledge, the refinement of moral concepts, and the capacity to apply our moral view to particular situations. Here I suggest that there is an importantly different and largely overlooked role for the arts in moral thought: an ability to reconfigure the structure of our moral thought and effect what we might call a revolution in that framework. It is commonly argued that the fact that our universe is fine-tuned for life favors both a design hypothesis as well as a non-teleological multiverse hypothesis. The claim that the fine-tuning of this universe supports a non-teleological multiverse hypothesis has been forcefully challenged however by Ian Hacking and Roger White. In this paper we take this challenge even further by arguing that if it succeeds, then not only does the fine-tuning of this universe fail to support a multiverse hypothesis, but (...) it tends to favor a single-universe hypothesis instead. We examine topological dynamical systems on the Cantor set from the point of view of the continuous model theory of commutative C*-algebras. After some general remarks, we focus our attention on the generic homeomorphism of the Cantor set, as constructed by Akin, Glasner, and Weiss. We show that this homeomorphism is the prime model of its theory. We also show that the notion of “generic” used by Akin, Glasner, and Weiss is distinct from the notion of “generic” encountered in Fraïssé (...) theory. (shrink)

Research heuristics—implicit rules used to guide work on a scientific problem—are explored for their role in guiding psychological research. Work on the psychology of creativity is used to illustrate how heuristics have guided research. We examine the influence of three heuristics: the trilogy-of-mind heuristic, the emotions-as-moods heuristic, and the analysis-of-variance heuristic. This analysis of multiple heuristics provides a new way to understand the state of research on creativity. What is the nature of law and what is the best way to discover it? This book argues that law is best understood in terms of the social functions it performs wherever it is found in human society. In order to support this claim, law is explained as a kind of institution and as a kind of artefact. To say that it is an institution is to say that it is designed for creating and conferring special statuses to people so (...) as to alter their rights and responsibilities toward each other. To say that it is an artefact is to say that it is a tool of human creation that is designed to signal its usability to people who interact with it. This picture of law's nature is marshalled to critique theories of law that see it mainly as a product of reason or morality, understanding those theories via their conceptions of law's function. It is also used to argue against those legal positivists who see law's functions as relatively minor aspects of its nature. -/- This method of conceptualizing law's nature helps us to explain how the law, understood as social facts, can make normative demands upon us. It also recommends a methodology for understanding law that combines elements of conceptual analysis with empirical research for uncovering the purposes to which diverse peoples put their legal activities. Opposition within the organic agriculture community to a state regulatory initiative intended to close a loophole on the prohibition of stoop labor in California agriculture illuminates critical tensions around the “labor question” underpinning California's rapidly expanding organic sector. Through an exploration of the contradictions between the political economic realities of organic agriculture, the lived realities of farm workers, and the ideological framework of “agricultural exceptionalism” espoused in the organic community, this article challenges widely held assumptions that organic agriculture embodies a (...) more socially sustainable form of production. In the first part of this paper the marked differences between the stances of some philosophers of education who view the field as a self-contained discipline and MacIntyre's contrasting view are outlined and discussed, with the author seeing the greater merit in MacIntyre's position. This leads on to a review in the second part of the paper of the differences between MacIntyre and Dunne on teaching as a practice and on the range of issues that underlie these differences. Again, the (...) paper argues in favour of MacIntyre's claim that teaching is subservient to the good it serves, in this case the good of the learner and of the community. Criticisms are then made, however, of how MacIntyre conceives of the good of the community, and of its promotion by learning. In particular, his advocacy of partisan universities and his arguments for rationalising the rivalries between them are faulted. In its concluding part, the paper finds more merit in the pedagogical features of MacIntyre's late work Dependent Rational Animals, particularly the rationale advanced for educating independent practical reasoners. Since the end of the Cold War, there has been a substantial increase in the number of intrastate conflicts around the world. During the last two decades, there have been more than 125 violent conflicts resulting in 7 million deaths (Smith, 2003). Given the prevalence of these conflicts, the inability of some governments to resolve them, and the reluctance of multilateral institutions to intervene, multinational enterprises (MNEs) engaged in international ventures may find themselves in situations where they must respond to (...) violent conflict to minimize investment risk and to promote stability in countries where they operate. Research on business response to violent conflict has tended to treat conflict as a homogeneous problem, when in fact conflicts vary on several dimensions. The purpose of this article is to extend the research with a focus on how the characteristics of the conflict affect MNE intervention strategies. Drawing on insights from the research on conflict resolution and the risk that violent conflict poses to the firm, we develop a framework and propositions that provide guidance to MNEs confronting violent conflict with respect to existing projects or facilities. Toronto: University of Toronto Press, 1982. Pp. xi + 233. $28.50. Kenneth Dorter of the University of Guelph has given us a useful and unusual study of the Phaedo, which will attract the interest of a variety of Plato's readers. He provides the careful studies of (...) the dialogue's arguments for immortality to be expected in a sound commentary, paying close attention to the text as well as to recent scholarship, and displaying a good sense of argument. What gives the book additional interest, however, are its features as an interpretation of the Phaedo. Two stand out. First, Dorter wishes to give full weight not only to the logic of the arguments but also to the dramatic details of Plato's writing, believing these to be important in disclosing Plato's intentions. Secondly, he reads the Phaedo in light of a more general understanding of Plato's philosophy, especially the nature of the soul in its cosmic as well as individual aspects. Much of this is set out in a final speculative chapter, where Dorter seeks to make intelligible Plato's developing conception of soul by means of such notions as energy and poles of consciousness. Not every reader will be persuaded; but Dorter is to be commended for an attempt to move the discussion beyond the Phaedo and Plato's own vocabulary. The study gains its coherence from Dorter's belief that Plato's view of soul cannot support the ostensible aim of the dialogue, to provide reassurance of personal immortality. Although he has no doubt that for the Platonic Socrates there is "a meaningful sense in which we may be called immortal" (94, cf. 159), Dorter's analysis must be stretched to provide that sense. In part this is a result of his assessment of the arguments. The first, from reciprocity in nature, can at most show that, given the eternal nature of the world, soul and corporeality in general must continue to exist. The argument from recollection can point only to a non-empirical element in our knowledge ; that from the soul's kinship with the divine is best seen as an analogy developed to awaken within us a sense of eternity. The final argument, though containing fallacies (157), will support the conclusion that immortal soul is imperishable as long as soul is regarded as motive force in the universe, in the first argument's sense. In none of these discussions, then, can Plato's reasoning yield up personal survival. But there is another part to Dorter's case, underlying this conclusion. For Plato the individual human being is a composite of soul and body; so even if Plato were to prove the immortality of the soul he could never establish personal survival (63-64). It is not surprising then that Dorter is left with a doctrine of immortality either reduced to a "discovery of eternity within ourselves" (77), or else dissolved into a principle of enduring cosmic energy. So in neither case does it seem meaningful for Plato to say that we are immortal: the eternal which we sense is no more us than it is anything else. Although it is of course possible that Plato did not intend this consequence of his arguments, Dorter thinks otherwise. In support he invokes literary features of the dialogue to argue that Plato operates on one level for the less sophisticated (who wish to be persuaded of personal survival) and on another for the philosophically reflective reader. Dorter treats the textual evidence for this claim with an appropriate modesty, and tries to justify Plato's apparent duplicity as an attempt to convince the weak by a 'noble lie' (95-97). Nevertheless this leads Dorter to mix together too quickly for this reader popular religion, myth, and metaphor. To the fact that Plato does not espouse the language of popular religion literally, Dorter adds his own view of myth as an imaginative appeal to emotion that can be translated without loss into rational discourse (7, 165, a95). In this paper we highlight the racialized effects of agricultural labor laws on Southeast Asian family farmers in California’s Central Valley. We show how agricultural labor laws intended to protect farmworkers on industrial farms discriminate against and challenge small Southeast Asian refugee farmers. Hmong, Iu-Mien and Lao family farmers rely on cultural practices of labor reciprocity and unpaid help from extended family and clan networks to sustain the economic viability of their farms. This kind of labor sharing, a central tenet (...) of their customary farming practices, and a cornerstone of the American family farm ideal, is illegal in California agriculture. We examine the historical context that gave rise to agricultural labor regulations in California and the ways in which these regulations are both under-enforced and unevenly enforced, differentially impacting immigrant family farms, while failing to protect those for whom the laws were originally intended. In highlighting how employment and labor laws and their enforcement or lack thereof discriminate against Southeast Asia farms, this study illustrates how other “small family farms” reliant on volunteerism or labor-sharing arrangements, part of the emergent “sharing economy,” may be confronting similar legal conundrums to those faced by Southeast Asian farms. Psychotherapy holds out the promise of help for people who are hurting and in need. It can save lives and change lives. In therapy, clients can find their strengths and sense of hope. They can change course toward a more meaningful and healthy life. They can confront loss, tragedy, hopelessness, and the end of life in ways that do not leave them numb or paralyzed. They can discover what brings them joy and what sustains them through hard times. They can (...) begin to trust, or to trust more wisely. They can learn new behaviors in therapy and how to teach themselves new behaviors after therapy ends. They can question what they always believed was a given. They can find out what matters most to them, and how to stop wasting time. They can become happier, or at least less miserable. They can become better able, as Freud noted, to love and to work. They can learn how to accept and love themselves just as they are and accept others who are different from them. Our ethics acknowledge and affirm our profession's responsibilities. This book was written to help strengthen, deepen, and inform ethical awareness and the sense of personal ethical responsibility. Its job is to help you hold onto the ideals-including ethical ideals-that called you into the profession to begin with, to help you develop and fulfill those ideals. There will be so much-trust us on this-that tends to dull ethical awareness, to make ethics drift out of focus, to create barriers between you and your ideals, to replace ethics with pseudo-ethics and ethics placebos. Fatigue, endless paperwork, unrealistic expectations, illness, family crises, not being able to make ends meet, burn out, threats of job loss, insurance coverage that doesn't come close to meeting the needs of our clients, biases that have not been addressed, and so many other forces can pressure us into cutting ethical corners.
