For various reasons, that will be recalled and analysed throughout this paper, interdisciplinarity has become the keyword for any debate on legal education reform. However, what is meant by interdisciplinarity and how it should be achieved is open for discussion. Paradigms of “scientificity” of the law vary dramatically among legal cultures. Whereas in the US the advent of a more ‘substantial’ legal thought after the New Deal went hand in hand with the rise of the interdisciplinary paradigm, in Europe the (...) traditional assumption of law’s autonomy has repeatedly been challenged, eroded and adapted, but it still represents the bulwark of the orthodox approach to law and legal scholarship. In the Continent, mainstream legal scholarship does not take as its object the social reality, but only the gamut of rules recognized as binding norms. Coherent with this approach is a model of legal education built around certain axioms, such as the statist and nationalist attitude, the extreme compartmentalization among the various branches of law, and the blindness to its surroundings. Comparative law is one of the few disciplines that provide a different role model for a legal scholar who is apt to confront the challenges of complex societies. Keeping at a reasonable distance the authority paradigm, embodying the spirit of enquiry and cherishing the values of pluralism (both in terms of legal pluralism and cognitive openness), comparativists may give specific content to the paradigm of the jurist as a social engineer. Comparative law may therefore offer an invaluable contribution to the debate on legal education reform. (shrink)

The assumption that natural selection alone is sufficient to explain not only which traits get fixed in a population/species, but also how they develop, has been questioned since Darwin’s times, and increasingly in the last decades. Alternative theories, linked to genetic and phenotypic processes, or to the theory of complex systems, have been proposed to explain the rise of the phenotypic variety upon which natural selection acts. In this article, we illustrate the current state of the issue and we propose (...) a logical space based on phenotypic robustness that allows a classification of evolutionary phenomena and can provide a framework for unifying all these accounts. When the necessity of identity (NI) is combined with composition as identity (CAI), the contingency of composition (CC) is at risk. In the extant literature, either NI is seen as the basis for a refutation of CAI or CAI is associated with a theory of modality, such that: either NI is renounced (if counterpart theory is adopted); or CC is renounced (if the theory of modal parts is adopted). In this paper, we investigate the prospects of a new variety of (...) CAI, which aims to preserve both NI and CC. This new variety of CAI (CCAI, contingent composition as identity) is the quite natural product of the attempt to make sense of CAI on the background of a broadly Kripkean view of modality, such that one and the same entity is allowed to exist at more than one possible world. CCAI introduces a world-relative kind of identity, which is different from standard identity, and claims that composition is this kind of world-relative identity. CCAI manages to preserve NI and CC. We compare CCAI with Gibbard’s and Gallois’ doctrines of contingent identity and we show that CCAI can be sensibly interpreted as a form of Weak CAI, that is of the thesis that composition is not standard identity, yet is significantly similar to it. Fraser is one of the most important American philosophers and one of the leading figures of contemporary critical theory. From the 1980s to the present, Fraser has published on political philosophy and social theory, reflected upon feminism, justice, and capitalism, and has participated in public debates on current issues. The interview aims at retracing the main themes of her thought, underlining the persisting link which joins her understanding of political philosophy with social critique and public engagement. The interview also emphasizes (...) the developments of her thought, starting from her formation in the American New Left, the encounter with feminism and the neo-Marxist cultural critique of capitalism, and the discussion of Habermas’s thought. Also discussed is Fraser’s complex feministic theory and her post-Westphalian and three-dimensional model of global justice. Another crucial topic is the recent elaboration of an enlarged view of capitalism, based on a combination of Karl Marx and Karl Polanyi, aimed at highlighting its structural crisis tendencies: not only economic, but also ecological, political, and social. The recent debate on the crisis of liberal democracy, the emergence of populism, the Covid-19 pandemic, as well as the Ukrainian war, become an opportunity to test how a renewed critical theory of society can develop a social diagnosis of the time, without abandoning the task of a reconstruction of the emancipatory potential present in the existing social reality. Finally, Fraser recalls her link with the Italian philosophical tradition, stressing in particular her debt to Antonio Gramsci. (shrink)

The intention of this paper is to explore the way in which Löwith′s Das Individuum in der Rolle des Mitmenschen offers a contribution to the actual philosophic-moral debate about the specific moral status of personal relationships. An assumption is given in which Löwiths phenomenological analysis of the I-you-relation permits a new perspective on the question which is pointedly provoked in Honneth′s theory of recognition, namely how to deal with the tension between the universalistic issue of the Kantian morality of respect (...) and the particular demand of care and love in personal relationships. This paper aims to show how the mathematical content of Hilbert's Axiom of Completeness consists in an attempt to solve the more general problem of the relationship between intuition and formalization. Hilbert found the accordance between these two sides of mathematical knowledge at a logical level, clarifying the necessary and sufficient conditions for a good formalization of geometry. We will tackle the problem of what is, for Hilbert, the definition of geometry. The solution of this problem will bring out how (...) Hilbert's conception of mathematics is not as innovative as his conception of the axiomatic method. The role that the demonstrative tools play in Hilbert's foundational reflections will also drive us to deal with the problem of the purity of methods, explicitly addressed by Hilbert. In this respect Hilbert's position is very innovative and deeply linked to his modern conception of the axiomatic method. In the end we will show that the role played by the Axiom of Completeness for geometry is the same as the Axiom of Induction for arithmetic and of Church-Turing thesis for computability theory. We end this paper arguing that set theory is the right context in which applying the axiomatic method to mathematics and we postpone to a sequel of this work the attempt to offer a solution similar to Hilbert's for the completeness of set theory. He taught in Naples and Rome, then for the ten years 1939-1948 at the University of Pennsylvania. ABSTRACT This article aims to show how the originality of Jaeggi’s contribution to recent debates in critical theory clearly emerges if one compares her approach with what in many ways represents its antecedent and constant point of reference: namely, the critical theory of Axel Honneth. This comparison offers a privileged way of grasping the advantages of Jaeggi’s approach with respect to that of Honneth. At the same time, reversing perspective, it permits us to focus on some open problems in Jaeggi’s (...) critical theory, which deserve to be discussed with care. The negativistic, formal and procedural character of her critical theory, while on one hand shielding her approach from the risks to which the most recent theory of Honneth is exposed – historical teleologism and ethical substantialism – on the other hand exposes her approach to the risk of an excess of formalism and proceduralism, rendering it unable to tackle the central problem for any critical theory: namely, the link with a critical praxis and with the struggles for the emancipation of one’s own time. The work of Giorgio Agamben, one of Italy's most important and original philosophers, has been based on an uncommon erudition in classical traditions of philosophy and rhetoric, the grammarians of late antiquity, Christian theology, and modern philosophy. Recently, Agamben has begun to direct his thinking to the constitution of the social and to some concrete, ethico-political conclusions concerning the state of society today, and the place of the individual within it. In Homo Sacer, Agamben aims to connect the problem (...) of pure possibility, potentiality, and power with the problem of political and social ethics in a context where the latter has lost its previous religious, metaphysical, and cultural grounding. Taking his cue from Foucault's fragmentary analysis of biopolitics, Agamben probes with great breadth, intensity, and acuteness the covert or implicit presence of an idea of biopolitics in the history of traditional political theory. He argues that from the earliest treatises of political theory, notably in Aristotle's notion of man as a political animal, and throughout the history of Western thinking about sovereignty, a notion of sovereignty as power over "life" is implicit. The reason it remains merely implicit has to do, according to Agamben, with the way the sacred, or the idea of sacrality, becomes indissociable from the idea of sovereignty. Drawing upon Carl Schmitt's idea of the sovereign's status as the exception to the rules he safeguards, and on anthropological research that reveals the close interlinking of the sacred and the taboo, Agamben defines the sacred person as one who can be killed and yet not sacrificed—a paradox he sees as operative in the status of the modern individual living in a system that exerts control over the collective "naked life" of all individuals.
