This paper focuses on evaluating Odera Oruka’s role as an expert witness in customary law for the Luo community during the Nairobi, Kenya-based trial in 1987 to decide on the place of the burial of S.M. Otieno. During that trial, an understanding of Luo burial and widow guardianship (ter) practices was essential. Odera Oruka described the practices carefully and defended them against misunderstanding and stereotype. He revisited related topics in several delivered papers, published articles, and even interviews and columns in (...) the Kenyan newspapers. The paper will raise the questions: How does Odera Oruka’s role as expert on Luo customs fit in with his sage philosophy project? In his testimony at the trial and subsequent public addresses and published work, does he accomplish two important goals, the first being defending African traditions against prejudice and anti-African bias, and secondly, does he champion reform of traditions when reform is needed? And, can Odera Oruka’s participation in the famous trial avoid seeming ethnic chauvinism and marginalization of women? My conclusion is that he achieves the first goal, but some problems remain in the achievement of the other goals. While he often asserted the need to evaluate traditions and to jettison those that have become unhelpful, in this context he evaluated traditions so strongly that the need for evaluation and possible change was muted. The Hebrew Bible is quoted and alluded to in 4QInstruction. There is an obvious similarity between the way the raz nihyeh of 4QInstruction and Lady Wisdom in Proverbs 8 function. This intertextual study investigates this phenomenon by comparing 4Q416 2 III 8-21 and 4Q417 1 I with Proverbs 8:12-21 and 8:22-31. It is concluded that apocalyptic influence changed the character of Lady Wisdom but not her essential function.

El autor intenta trazar aquí las relaciones entre la antigua literatura de sabiduría de Egipto, Grecia e Israel y mostrar cómo este género literario precede a la “filosofía”.

Reaching understanding is one of our central epistemic goals, dictated by our important motivational epistemic virtue, namely inquisitiveness about the way things hang together. Understanding of humanly important causal dependencies is also the basic factual-theoretic ingredient of wisdom on the anthropocentric view proposed in the article. It appears at two levels. At the first level of immediate, spontaneous wisdom, it is paired with practical knowledge and motivation ( phronesis ), and encompasses understanding of oneself (a distinct level of self-knowledge having (...) to do with one’s dispositions capacities, vulnerabilities, and ways of reacting), of other people, of possibilities of meaningful life, and of relevant courses of events. It is partly resistant to skeptical scenarios, but not completely. On the second and reflective level, understanding helps fuller holistic integration of one’s first order practical and factual-theoretic knowledge and motivation, thus minimizing potential and actual conflicts between all these components. It also participates in the reflective control whose exercise is needed for full reflective wisdom, the crucial epistemic-practical virtue or human excellence. (shrink)

The paper discusses Lehrer's pioneering approach to the topic of wisdom. His pithy proposal, that wisdom is preference of merit justified by an evaluation system and undefeated by error, fits well within the grand philosophical tradition of thinking about wisdom, offering a very clear and original formulation of its target. The first part of the paper puts it on a map of philosophical options concerning wisdom (anthropo-, theo- and cosmo-centric ones) and then raises questions about it: does preference have to (...) motivate, what is the relation between factual and evaluative knowledge in the evaluation system, and how is the objectivity of merit secured? The second part briefly develops an alternative proposal inspired by Lehrer's work. It is a two-level picture. Wisdom combines the virtues of the first-order production of decision and action (reliability and practical validity) with second-order reflective endorsement of the first-order picture. The first-order production yields phronesis-generated action-guiding desires which constitute practical wisdom in the narrow sense, and the second level the more refined and sophisticated wisdom of philosophers and their kin.
