  1. The World Republic, The State of States or The League of Nations? Kant’s Global Order Revisited.Ewa Wyrębska-Đermanović - 2019 - Con-Textos Kantianos 1 (10):27-42.
The article investigates the problem of Kant's proposal for a final global legal order. Kant expressed his stance very vaguely in the consecutively published texts On the Common Saying, Toward Perpetual Peace and The Metaphysics of Morals, which enabled numerous, often contradictory interpretations. The aim of the paper is to propose an alternative method of analysis of Kant's texts, which on one side reconciles textual discrepancies in his writings and on the other throws new light on many of the previous (...)

  • The Principles of Constitutional Reform.Jacob Weinrib - 2019 - Kantian Review 24 (4):631-651.
In legal orders around the world, commitments to democracy, liberalism and constitutionalism are increasingly eroding. Although political and constitutional theorists often lament this trend, they invariably adopt frameworks that are indifferent to these commitments. My aims in this article are both critical and constructive. As a critical matter, I will expose the indifference of the leading political and constitutional theories to the emergence, maintenance and refinement of liberal democratic constitutional orders. As a constructive matter, I will draw on Immanuel Kant’s (...)

  • Divine violence as non-violent violence: A critique of Judith Butler.Hayden Weaver - 2023 - South African Journal of Philosophy 42 (1):51-62.
The question of violence and how society can emancipate oneself from it has occupied many philosophers. Walter Benjamin attempted to answer this question in 1920 through the notion of divine violence. This idea has recently been resurrected by philosophers such as Jacques Derrida, Jürgen Habermas, Slavoj Žižek and Judith Butler. Divine violence is turned to as a means of emancipating society from systemic oppression and coercive law. However, it is a notion that has been met by major critiques. Most notable (...)

  • Permissive Laws and Teleology in Kant’s Juridical and Political Philosophy.Joel T. Klein - 2022 - Kantian Review 27 (2):215-236.
In this article I argue that the current readings of permissive law fall into hermeneutical difficulties and do not completely explain Kant’s complex use of the concept. I argue that the shortcomings of these interpretations can only be overcome by relating permissive law to practical teleology. That teleological thinking has a role in Kant’s moral thought by way of history is not new. Here, however, I argue that the system of rights itself is in some manner teleologically situated. This interpretation (...)
