Imagine you are walking through a park. Suddenly, a mugger points a gun at you, threatening to shoot you if you do not hand over your valuables. Is this an instance of domination? Many authors working within the neo-republican framework - including Philip Pettit himself - are inclined to say 'yes'. After all, the mugger case seems to be a paradigmatic example of what it means to be at someone's mercy. However, I argue that this conclusion is based on a (...) misleading, interactional account of domination that misconceives its structural character. Domination, I maintain, is a structurally constituted form of power. Whether the mugger in the park dominates you or not can only be established by analysing the wider power structures in which your interaction is embedded. (shrink)

This paper aims at renovating the prospects for social philosophy through a confrontation between pragmatism and critical theory. In particular, it contends that the resources of pragmatism for advancing a project of emancipatory social philosophy have so far been neglected. After contrasting the two major traditions in social philosophy—the analytical and the critical—I proceed to outline the main traits of a pragmatist social philosophy. By inscribing pragmatism within the tradition of social philosophy, my aim is to promote a new understanding (...) of pragmatism as one of the central Euro-American traditions in social and political philosophy, deserving to be on an equal footing with critical theory and political liberalism. And, furthermore, one whose critical and radical force may be of great help in the wake of the dismissal of the metaphysical certainties upon which the critical program of social philosophy had once set its hopes of social emancipation. This research uses a normative approach to examine the relationship between basic income and migration. The decisive variable is the effect of labour automation, which increases economic insecurities globally, leaving some nation states in a position to cope with this and others not. The insecurities will increase migratory pressures on one hand but also justify the introduction of basic income on a nation state level on the other. The normative guideline is the republican conception of freedom as non-domination. This is (...) used to justify a basic income, analyse how labour automation creates dominating structures and how borders dominate migrants seeking to move to countries which introduce a basic income. The result is that nation states that introduce a basic income to counter internal domination through labour automation, also have to look outside of their nation state. The imposition of borders in order to keep a basic income sustainable as well as labour automation itself, establish a form of domination over less developed countries and thus demand international regulation. RESUMEN Una de las principales aportaciones de Rawls fue su concepción de la justicia como algo predicable de la estructura social. La justicia, según él, es la primera virtud de la estructura básica. La tesis que se defiende en este artículo es que, si queremos una teoría de la justicia aplicable a nuestro mundo en globalización, tenemos que desarrollar una concepción de la estructura social diferente a la contemplada por Rawls. Con este fin, se expondrán las carencias de la ontología (...) social mantenida por Rawls para alcanzar una justicia adecuada a nuestro mundo en globalización y se propondrá, siguiendo a Nancy Fraser e Iris Marion Young, una alternativa más adecuada a la realidad que vivimos hoy. ABSTRACT One of Rawls' main contributions was his conception of justice as something predicable of the social structure. Justice, according to him, is the first virtue of the basic structure. The thesis defended in this article is that, if we want a theory of justice applicable to our globalizing world, we have to develop a conception of the social structure different to the one contemplated by Rawls. With this aim, we will discuss the shortcomings of the social ontology of Rawls to achieve justice appropriate to our globalizing world and will propose, following Nancy Fraser and Iris Marion Young, a more appropriate alternative to the reality we live today. During the last decades of the twentieth century, various social and philosophical changes pushed to problematize some of the fundamental ideas of the theory of justice. Among them is the relationship that until then was postulated between the ideas of justice, an ideal construction that the philosopher was supposed to elucidate, and injustice, a secondary concept understood as the absence of justice. The idea of the “priority of injustice” now appears as a fundamental starting point for many philosophers of diverse (...) traditions. In this article I will analyze the different meanings that this priority adopts in the main representatives of this “shift”, as well as their different ways of conceiving injustices, giving reasons to prefer some approaches to others. This “Copernican shift”, as I will attempt to show, entails transformations relevant to the idea of justice that no contemporary theory should ignore.Keywords: justice, injustice, ideal theory, democracy, justice as a process.
