Este trabajo tiene por objeto el estudio del bien jurídico de la libre competencia en el mercado como posible bien jurídico digno de tutela penal. Al respecto se plantean dos problemas esenciales: el propio concepto de competencia y el respeto a los principios legitimadores del Derecho penal. Para no argumentar en abstracto, se analiza un problema político-criminal concreto: el delito de corrupción entre particulares como delito contra la competencia en el mercado. This study examines the relationship between cooperative business relations in small businesses and environmental protection, one of the most important policies of social responsibility in manufacturing. We reviewed the literature and carried out an empirical study of 930 small manufacturing firms in Spain. Results indicate that small businesses that maintain and improve their cooperative relations through business networking with universities, competitors, suppliers and customers spend more on environmental protection. This paper analyses empirical evidence of efforts to enable Spanish micro and small manufacturing companies to boost their labour productivity rates through the development of the main pillars of their corporate social responsibility policies. This study aims to develop new approaches and sensibilities towards work from an ethical, values and CSR perspective, showing how internal dimensions of CSR, such those related to relationships with employees and responsibility in processes and product quality, can improve labour performance and labour efficiency, thereby contributing (...) to a better society. The results of a sample of 929 small businesses indicate that the social responsibility policies that most contributed to a short-term increase in labour productivity are those related to internal aspects of the company, in particular its involvement in the quality of processes and products, promotion of innovation and employee care. However, the impact on labour productivity of CSR policies related to external factors, such as relationship with stakeholders and environmental concern, could not be empirically proven in this paper. Background In Spain, there has been great effort by lawmakers to put Advance Directives into practice since 2002. At the same time, the field of bioethics has been on the rise, a discipline that has spurred debate on the right of patients to exercise their autonomy. Despite all this, the implementation of ADs can be said to have failed in Spain, because its prevalence is very low, there is a great lack of knowledge about them and they have very little (...) impact on clinical decisions. The purpose of this article is to analyze and discuss the main reasons for the failure of ADs in Spain. Main body The main reasons why ADs have no impact on clinical practice in Spain have been fundamentally four: the training of health professionals about the end of life and AD is lacking; there has been no public process to increase awareness about AD, and therefore people know little about them; the bureaucratic procedure to document and implement ADs is excessively complex and cumbersome, creating a significant barrier to their application; in Spain, the remnants of a paternalistic medical culture continue to exist, which causes shared decision-making to be difficult. Conclusion Due to the four reasons mentioned above, AD have not been a useful tool to help honor patients’ autonomous decisions about their future care and, therefore, they have not achieved their objective. However, despite the difficulties and problems identified, it has also been observed that health care professionals and the Spanish public have a very positive view of AD. Having identified the problems which have kept AD from being successful, strategies must be developed to help improve their implementation into the future. (shrink)

This research presents an analysis of the learning strategies employed by students during confinement due to Covid-19 in the year 2021. The study sample consisted of 200 students from the Licenciado Benito Juárez García high school of the morning shift of the Benemérita Universidad Autónoma de Puebla. A survey was applied to measure the degree of satisfaction in relation to their use and impact on the acquisition of knowledge, allowing them to be more self-taught.The results show that the hypothesis (...) was partially fulfilled, since practice and organization are the learning strategies that most supported them in learning. This paper develops a media theoretical extension of the communicative view on corporate social responsibility by elaborating on the characteristics of network societies, arguing that new media increase the speed and connectivity, and lead to higher plurality and the potential polarization of reality constructions. We discuss the implications for corporate social responsibility of becoming more polyphonic and sketch the contours of “communicative legitimacy.” Finally, we present this special issue and develop some questions for future research.

Scholars are divided over the question of whether managerial aspirational talk that contradicts current business practices can contribute to corporate social responsibility (CSR). In this conceptual article, we explore the rhetorical dynamics of aspirational talk that either impede or foster CSR. We argue that self-persuasive CSR rhetoric, as one enactment of aspirational talk, can attract attention and scrutiny from organizational members. Continued adherence to this rhetoric, however, creates and perpetuates tensions that lead to a vicious circle of disengagement. A virtuous (...) circle, by contrast, requires a shift toward an agonistic rhetoric that transcends tensions by rearticulating aspirations in concurrence with situated understandings of responsible corporate practice. Our arguments contribute to a better understanding of how communication becomes constitutive of CSR and address the debate on decoupling between talk and action. (shrink)

This article looks into the process of searching for new forms of legitimacy among firms through corporate discourse. Through the analysis of annual sustainability reports, we have determined the existence of three types of rhetoric: (1) strategic (embedded in the scientific-economic paradigm); (2) institutional (based on the fundamental constructs of Corporate Social Responsibility theories); and (3) dialectic (which aims at improving the discursive quality between the corporations and their stakeholders). Each one of these refers to a different form of legitimacy (...) and is based on distinct theories of the firm analyzed in this article. We claim that dialectic rhetoric seems to signal a new understanding of the firm's role in society and a search for moral legitimation. However, this new form of rhetoric is still fairly uncommon although its use is growing. Combining theory and business examples, this article may help managers and researchers in the conceptualization of how firms make sense of their role in society and what forms of differentiation they strive for through their rhetoric strategies. In line with its institutional commitments and in order to strengthen the relevance of its business education program in addressing the persistent social challenges facing the Philippines, Mission University revised its Master of Business Administration curriculum in 2012. A core change in the curriculum was the incorporation of action research training and the requirement for graduation of implementing and defending an action research project. The introduction of action research, which is based on critical realist philosophy of science, was intended to (...) enable the university’s MBA graduates to become reflexive and humanistic agents of change in their work contexts through the application of observation, critical reflection, collaborative analysis and action and scholarly skills. The implementation of the action research requirement is beginning to yield positive results based on the types of projects implemented by the students and their resulting sense of efficacy in the workplace. Challenges in implementation include the need to further hone student skills in pursuing more emancipatory projects and the need to further orient faculty in the critical realist philosophy underlying action research, as distinct from traditional positivism. AntecedentsPrevious research on citizens’ reactions after terrorist events has shown that positive reactions can also emerge alongside pain and horror. Positive emotions have been widely associated with an abstract style of thinking. In the context of the Paris terrorist attacks in 2015, we explored Spanish citizens’ positive reactions – empathic concern, positive emotional climate, and esteem for humanity – and examined the relationships of these responses with an abstract style of thinking.MethodA longitudinal study was designed involving an online questionnaire that (...) was administered 10 days, 3 weeks, and 2 months after the attacks.ResultsEmpathic concern and personal distress toward Parisians decreased from the weeks following the attacks to 2 months later, with empathic concern always being more intense than personal distress. Emotional climate was perceived as more hostile than positive, although positive feelings persisted. People reported moderately positive esteem for humanity. Individuals with a more abstract style of thinking reported greater empathic concern, a more positive emotional climate, and more esteem for humanity.ConclusionsOur results support and extend previous research showing that abstraction enhances people’s resilience, even under traumatic circumstances such as those surrounding a terrorist attack. This paper deals with the interpretation and distribution of universal Free Choice (FC) items, such as English FC any or Spanish cualquiera. Crosslinguistically, universal FC items can be characterized as follows. First, they have a restricted distribution. Second, they express freedom of choice: the sentence You can take any card conveys the information that the addressee is free to pick whichever card she chooses. Under standard assumptions, the truth conditions of sentences like You can take any card are taken to (...) be captured by formalizations in which a universal quantifier ranging over individuals has wide scope over the possibility modal. The crucial observation that informs the account in this paper is that this type of formalization cannot capture the freedom of choice component. I will argue that in order to derive the right interaction between possibility modals and FC items, we need to add an exclusiveness condition to the standard wide scope paraphrases. The same proposal that guarantees freedom of choice will automatically account for the distribution restrictions of FC items. The formal implementation of this proposal is cast in the Hamblin semantics proposed in Kratzer and Shimoyama (Indeterminate phrases: The view from Japanese, 2002). (shrink)

A predominant assumption in studies of deliberative democracy is that stakeholder engagements will lead to rational consensus and to a common discourse on corporate social and environmental responsibilities. Challenging this assumption, we show that conflict is ineradicable and important and that affects constitute the dynamics of change of the discourses of responsibilities. On the basis of an analysis of social media engagements in the context of the grand challenge of plastic pollution, we argue that civil society actors use mobilization strategies (...) with their peers and inclusive-dissensus strategies with corporations to convert them to a new discourse. These strategies use moral affects to blame and shame corporations and solidarity affects to create feelings of identification with the group and to avoid disengagement and polarization. Our research contributes to the literature on deliberative democracy and stakeholder engagement in social media in the collective constructions of discourses on grand challenges. (shrink)

The present paper tries to answer the question _Is religious education compatible with the purposes of liberal education?_ This work argues that it is possible, and desirable, that democratic states built on liberal ideals include religious education in all schools since increasing the number of options among which the future citizen may choose the conception of the good with which he or she wishes to live is a condition for autonomy as one of its educational purposes. However, the proposal is (...) not based on religious confessional education, which by itself does not satisfy the liberal educational goals, but is redefined from the common noahide principles compatible both religious confessions and non-religious views of morality and citizenship. Las personas expuestas a acontecimientos traumáticos tales como desastres naturales, desastres provocados por otros seres humanos, secuestro, tortura, atraco, violación, accidentes, etc., incrementan el riesgo de desarrollar distintos trastornos psicológicos como el trastorno por estrés agudo, el trastorno por estrés postraumático (TEPT), el trastorno de pánico, la depresión, la ansiedad generalizada y el abuso de sustancias.

Algunos autores hablan del "giro religioso" del filósofo alemán Jürgen Habermas. El concepto de sociedad postsecular desarrollado por este autor en la etapa más reciente de su pensamiento ha exigido una revalorización de la religión como generadora de motivación y solidaridad sin la cual la sociedad occidental ve amenazada su existencia. Pero, ¿revalúa Habermas adecuadamente la religión hasta el punto de que podamos hablar de tal "giro"? -/- Esta tesis aborda los aspectos desarrollados en ese sentido por las obras más (...) recientes de Habermas: El pensamiento postmetafísico y También una historia de la filosofía, principalmente. Pero esta evaluación no se hace desde el lugar común de Habermas y los estudios comparativos de la religión: el cristianismo y el islam, sino desde la tradición noájida que precede y sustenta a estas tradiciones religiosas, lo cual permite a los ciudadanos religiosos y laicos comprender mejor la argumentación religiosa en la esfera pública, al tiempo que puede revelar las limitaciones de la comprensión laica (como la de Habermas) de los argumentos religiosos. This practical-theological study aims to develop a contextual theology in the areas of business and government that will aid a successful intervention by the church in diminishing the corrupt practices prevalent in South Africa. It seeks to prove that corruption is a major factor in causing the delays experienced in the implementation of service delivery, and that this is causing much anger and increasing disillusionment with the present system of democratic government. At the moment the church has a window of (...) opportunity for this intervention to take place, since many of those responsible for supporting, organising and implementing service delivery, both in government and industry, worship regularly, as committed members, in local Christian congregations. A modified application of the Asset-Based Community Development (ABCD) approach using focus groups is suggested as both a tool for intervention and for further research. (shrink)

Se examina una cuestión fundamental y poco estudiada de la teología política: la relación entre la defensa de la inmortalidad del alma y el mantenimiento del orden público. Se realiza un recorrido histórico por autores como Pietro Pomponazzi y Tomás Moro, que aceptan motivos políticos para defenderla, y David Hume, quien considera que no existe ningún motivo político para mantener dicha relación. Por último, se analizan los argumentos esgrimidos para mostrar que su eficacia está condicionada por la situación histórica.

The paper tries to analyze two notions, namely 'proterosis' ('Proterose') and 'proteraethesis' ('Proterasthese'), as used in these lectures to describe certain psychical phenomena, and to suggest a symbolic notation as a means of representing the results of this analysis. These results (and the notation) will be put to use in an interpretation of an uncharacteristically difficult passage of these lectures concerning the methodology of bringing someone to 'notice' something.

El presente artículo se centra en destacar el modo en que Schelling aparece en la obra de Deleuze como un eslabón que permite vincular la reacción anticartesiana de Spinoza y Leibniz (reivindicadora de la dimensión apetitiva de la naturaleza) con la propia actitud antihegeliana de Deleuze. El giro voluntarista que Schelling imprime a la filosofía es igualmente prolongado por Deleuze y Guattari cuando establecen la esquizofrenia como inconsciente ontológico libidinar por el que circulan libremente las intensidades deseantes. Across languages, we find indefinites that overtly mark a speaker’s lack of knowledge: they signal that the speaker is unable to give any further information about who or what satisfies her existential claim (Becker, 1999; Haspelmath, 1997). From now on, we will refer to the marking of the speaker’s lack of knowledge as an epistemic effect and to the indefinites that induce epistemic effects as epistemic indefinites.

El cálculo proposicional se basa proposiciones que son tautologías, antilogías y de tipo contingente, construidas con las operaciones de disyunción, conjunción, y negación, así como con el llamado condicional material para trasladar los enunciados condicionales. Con todo ello se obtiene una estructura de álgebra de Boole, que permite equiparar el cálculo proposicional al cálculo algebraico booleano. En parte, la simplificación conceptual que se obtiene resulta de ser el orden parcial del álgebra equivalente a la afirmación del condicional material. Además, con (...) tal metodología cabe ver qué partes del cálculo proposicional clásico pueden trasladarse, aun con limitaciones, a estructuras más débiles y, a la vez, más generales, como son los ortoretículos no booleanos o las álgebras de De Morgan.El cálculo proposicional trata con la deducción. Por ello, el artículo lo desarrolla a partir de un operador de consecuencias en el sentido de Tarski. Ampliado el modelo deductivo, es fácil ver otras consecuencias que las usualmente consideradas en los textos elementales; en particular, se analizan cuatro esquemas de razonamiento deductivo típicos y, entre ellos, se presta especial atención a los usuales Modus Ponens y Modus Tollens. En el caso de las estructuras algebraicas de conjuntos ‘borrosos’, ninguna es de álgebra de Boole ni siquiera de orto-retículo y sólo cabe trabajar, en algunos casos, con álgebras de De Morgan-Kleene. Por lo tanto el cálculo proposicional ‘fuzzy’ debe construirse de acuerdo con la estructura algebraica que corresponda en cada caso y una vez elegida como representación del condicional una función que verifique el Modus Ponens. The goal of this study was to introduce a model explaining how managers' attitudes, subjective norms, attributions, and the individualism-collectivism cultural dimension affect the way managers' deal with employee bribery in organizations. Twenty-six internal and external attributions related to bribery were identified through a series of structured interviews with 65 subject matter experts. These attributions, together with the other variables in the model, were evaluated by 354 Ecuadorian managers. Hierarchical regression analyses indicated that attitudes and external attributions significantly predicted managers' (...) intentions to discipline employees who accepted a bribe. In addition, external attributions mediated the relationship between individualism-collectivism and intent to discipline corrupt employees. Implications for the management of bribery in Latin American organizations are discussed. (shrink)

The intuitive distinction between natural and unnatural properties (e.g., green vs. grue) informs our theorizing not only in fundamental physics, but also in non-fundamental domains. This paper develops a reductive account of this broad notion of naturalness that covers non-fundamental properties: for a property to be natural, I propose, is for it to figure in a law of nature. After motivating the account, I defend it from a potential circularity charge. I argue that a suitably broad notion of lawhood can (...) be defined independently of naturalness, if we help ourselves to the notion of a fundamental physical property. I end by showing how the notions of naturalness and lawhood that my account delivers help illuminate a number of other important philosophical notions, like causation, reference/meaning, and rational induction. A partir da leitura comparada de trechos dos Cuadernos Spinozade Karl Marx e de Espinosa: filosofia prática,de Gilles Deleuze, o trabalho busca encontrar nestes autores elementos do pensamento espinosano, principalmente do Tratado Teológico-Políticoe excertos da Ética. Tais conexões parecem mais visíveis nos conceitos de materialismo e na relação homem-natureza. Se, conforme Marx, o concreto é a síntese de múltiplas determinações, o que relaciona-se com a ideia deleuziana da determinação da diferença como diferença de si e da História como contingência, como (...) isso se articularia com um conceito caro a Espinosa como o de que as transformações na realidade referem-se a determinações internas da própria realidade material, abdicando-se de um imperativo moral externo como eixo destas mudanças, ou seja, a causalidade imanente e não-transcendente dos processos? Para que estes conceitos tenham pontos de contato, de que forma o materialismo, a natureza e a liberdade devem ser entendidos? (shrink)

Este texto busca traçar algumas relações iniciais entre a ascensão das sociedades de controle, conforme notado por Deleuze, e as mudanças nas relações econômicas e políticas nas sociedades mundiais na contemporaneidade, com especial atenção ao processo ocorrido no Brasil.

Should clinicians ask women to donate or even sell their eggs for stem cell research? Enucleated ova are crucial in somatic cell nuclear transfer technologies, but risky for women’s health. Until comparatively recently, very few commentators debated the ethical issues in egg donation and sale, concentrating on the embryo’s status. The unmasking of Hwang Woo Suk, who used over 2,200 ova in his fraudulent research, has finally brought the question of ova donation and sale into prominence. In this article we (...) offer an international comparison of recent responses to this crucial question and suggest that the levels of risk are too imprecise to enable women to give meaningful informed consent for egg extraction. What we do know of the risks also indicates that they are too high and that potential donors or sellers are not being fully informed of their extent, raising disturbing ethical issues concerning commodification, deception, coercion, and exploitation. The paper introduces the communication view on Corporate Social Responsibility (CSR), which regards CSR as communicatively constructed in dynamic interaction processes in today’s networked societies. Building on the idea that communication constitutes organizations we discuss the potentially indeterminate, disintegrative, and conflictual character of CSR. We hereby challenge established mainstream views on CSR such as the instrumental view, which regards CSR as an organizational instrument to reach organizational aims such as improved reputation and financial performance, and the political-normative view on CSR, (...) which highlights the societal conditions and role of corporations in creating norms. We argue that both the established views, by not sufficiently acknowledging communication dynamics in networked societies, remain biased in three ways: control-biased, consistency-biased, and consensus-biased. We discuss implications of these biases and propose a future research agenda for the communication view on CSR. (shrink)

In recent years, character traits in general and virtue-related concepts in particular have been of considerable interest to philosophers, psychological researchers, and practitioners in the business ethics field. Three approaches to character traits can be used to incorporate ethics into organizations: virtues, character strengths, and competencies. The aim of this article is to clarify the concept of character traits, or virtues, and provide a unified operational version of it for incorporation into management. To this end, we first discuss the analogy (...) among virtues, character strengths, and competencies.
