Resumen La globalización genera espacios multilingües de interacción donde existen conflictos en la interpretación de prácticas discursivas aceptables a nivel local, provocando una re-escalarización de lo local, nacional, regional y global. Este trabajo explora cómo en el fútbol internacional – en que interactúan jugadores, fanáticos y medios deportivos internacionales – se disputan estas prácticas discursivas y su significado. En un corpus de artículos periodísticos investigamos dos incidentes en los que enunciados en español fueron interpretados por hablantes de otras lenguas ­como (...) actos discriminatorios. Usando herramientas de análisis del discurso mostramos cómo se construyen comunidades axiológicas y posicionamientos ideológicos que legitiman marcos interpretativos regionales, relegando a un segundo plano la discusión sobre las prácticas discursivas discriminatorias a nivel local. Esta pugna por el derecho a la interpretación produce reflexiones metapragmáticas sobre la inestabilidad del significado a través de las diferentes escalas. Mostramos cómo lo que en una escala resulta inocuo, en otra es un índice de significados ideológicamente cargados que define a un individuo o grupo como racista u homofóbico. (shrink)

As consequence to the coronavirus outbreak, governments around the world imposed drastic mitigation measures such as nationwide lockdowns. These measures included the closures of schools, hence, putting parents into the position of juggling school and work from home. In the present study, we investigated the well-being of parents with school-aged children and its connection to mitigation measures with particular focus on parental roles “caregiver,” “worker,” and “assistant teacher” as stressors. In addition to direct effects, we expected indirect effects on well-being (...) through changes in household dynamics. Data were collected via an online survey (N= 1313, 85.5% female; 53.2% university degree) conducted during the first wave of school closures in Germany. We observed that during the early COVID-19 pandemic, parental well-being in general was quite positive. Comparing the positive and negative PANAS subscales, parents agreed significantly more with the positive than with the negative items,t(1299) = 28.55,p< 0.001. Parents also reported an increase in positive family activities during the lockdown,t(1272) = 43.96,p< 0.001. Although a significant increase in negative household dynamics, such as disputes, was also observed to a lower extent,t(1295) = 7.78,p< 0.001. Using structural equation modeling, we observed that “homeoffice” was not significantly related to parents’ well-being, but positively affected household dynamics. Taking on the role of “assistant teacher” was negatively related to household dynamics. Additionally, we found a significant direct effect on negative affect for “assistant teacher.” We conclude that parents of school-aged children have mostly been able to establish positive dynamics in their households during the lockdown given the extra time they got to spend with their children by working from home. However, our results identify the role of “assistant teacher” as a potential stressor for parents. Bridging the gap between teachers and parents seems warranted especially if (some) distance-learning continues, in order to avoid long-term consequences for the students. (shrink)

Any complete account of morality should be able to account for its characteristic normativity; we show that enactivism is able to do so while doing justice to the situated and interactive nature of morality. Moral normativity primarily arises in interpersonal interaction and is characterized by agents’ possibility of irrevocably changing each other’s autonomies, that is, the possibility of harming or expanding each other’s autonomy. We defend that moral normativity, as opposed to social and other forms of normativity, regulates and, in (...) some cases, constitutes this very possibility. Agents are thus morally responsible for caring about their own and others’ autonomies in interaction. In our conception, moral normativity is embodied, situated, and deeply affective, and is constituted in social practices and maintained in interaction. We identify at least two necessary conditions for moral normativity to arise as a social practice. The first is our embodied constitution as living beings who are precarious and therefore vulnerable and in need of interaction with others and with the environment. The second is our sociolinguistic nature, which allows us to exponentially expand our possibilities for action and normatively distinguish among them. We finish by drawing a distinction between moral character and the moral content of interactions, which allows us to universally recognize the ethical dimensions of all human interaction while doing justice to the situated character of morals. Haciendo visible la estrecha relación entre las modalizaciones de conciencia y la estructura noético-noemática de los actos intencionales, se demostrará la necesaria complementariedad de los métodos de las reducciones eidética y fenomenológica para el proyecto de Husserl de una crítica fenomenológica del conocimiento. En el presente trabajo analizaré la tensión que se propone en las novelas Mano de obra de Diamela Eltit y Los cuerpos del verano de Martín Felipe Castagnet, entre la aceleración y los límites de la corporalidad, resto humano que emerge en un mundo de deshumanización y que recuerda el vínculo del cuerpo con el animal y la finitud. En este sentido, el cansancio y la depresión son consideradas patologías del sistema que necesitan corrección, en tanto estados que la sociedad (...) no tolera y de los que se hace responsable al individuo ante el peligro de significar un atasco en el proceso de producción. El presente artículo defiende que las nociones de epojé y de modificación de neutralidad, a pesar de su aparente semejanza, deben mantenerse radicalmente diferenciadas. La razón de fondo es que ambas surgen en el seno de operaciones de la conciencia que son metodológica y jerárquicamente distintas. Para tal efecto, haré una descripción de sus funciones y estructura, de modo que se hagan visibles tanto sus respectivas esferas de aplicación como el alcance operativo de sus procedimientos.

This paper deals with one of the first attempts to measure simple reactions in humans. The Swiss astronomer Adolph Hirsch investigated personal differences in the speed of sensory transmission in order to achieve accuracy in astronomy. His controversial results, however, started an intense debate among both physiologists and astronomers who disagreed on the nature of these differences. Were they due to different eyes or brains, or to differences in skill and education? Furthermore, they debated how to eliminate them. Some, for (...) example, wanted to eliminate the observer, and prescribed the use of new technologies like the electro-chronograph or photography, while others believed in discipline and education. By debating the nature of these differences, astronomers and physiologists sketched both different conceptions of ‘man’ and different paths to objectivity. These diverse conceptions, moreover, were tied to current nineteenth-century debates, such as the benefits or disadvantages of railroads, telegraphy and the standardization of time and longitudes. By focusing on the debates surrounding the speed of sensory transmission, this paper reevaluates the history of astronomy, physiology and experimental psychology. El presente artículo se propone explorar la noción de mundo ficcional desde la filosofía de Edmund Husserl, destacando la potencialidad de la fenomenología para los campos de la estética y la teoría de la ficción. Para ello, partiré de la descripción de las estructuras sobre las que se erige la vivencia ficcional, que aquí será tratada como una vivencia de fantasía. Bajo este enfoque, el análisis muestra primero la correlación entre conciencia de fantasía y mundo de fantasía, pasando a continuación (...) a explicitar las estructuras de cada uno de los polos de experiencia. Para Husserl, esta correlación se sustenta lógicamente en la doctrina del idealismo trascendental y en su concepción del mundo de fantasía como mundo posible. (shrink)

Este artículo busca establecer en primer lugar una doble distinción: de un lado, entre fantasía y conciencia de imagen; y, por el otro, entre fantasía y conciencia estética, ambas a partir de los trabajos de Edmund Husserl. Las dos series de distinciones se encuentran ligadas una con otra por el especial estatuto fenomenológico que Husserl concede a la imagen, el cual debe ser también sometido a aclaración. El artículo propone tres conclusiones: que la así llamada “conciencia estética” no es resultado (...) de ninguna “epojé”; que la experiencia de la imagen entremezcla percepción y fantasía; y que esta conciencia estética exige como contrapolo a un sujeto que habita en la irrealidad del “como si”. While scientists and engineers are designing and constructing ever more sophisticated space technology, and computer producers are pursuing a seemingly never ending race to store ever more knowledge on micro chips, western type democracies still live on 200 year old social and political ideas. The apparent disparity between technological innovation and socio?political innovation opens the door for a critical analysis of post modern society. How valid is Adam Smith's social paradigm on the role of self?interest in view of the fact (...) that the social and ecological external effects of the free market economy are threatening the well being of future generations? Can we much longer afford a political system that leaves the social and ecological to inefficient and bureaucratic state authorities undermining democratic virtues like political transparency and individual responsibility? The answer is no. New social paradigms have to be introduced to cope with the ruptures of post modern societies. To avoid suffocation from an overburdened state or the dissolution of society as a coherent and living community and indeed preserve freedom, social and ecological responsibility have to materialise as voluntary individual acts. Social paradigm innovation, it is argued, leads to a complete new role of individuals and institutions in modern society, where self?interest is not identified with egotism, but becomes compatible with altruism. By underlining the individuals role in bringing about change, institutional reforms are not a precondition, but the consequence of social paradigm innovation. A cultural revolution allows for changes of action now and any minute. Corporate cultures, e.g., can straightforwardly assimilate new social paradigms, leading to new forms of organisation, service philosophy, production and cooperation. (shrink)

During the late nineteenth century, scientists around the world disagreed as to the types of instruments and methods that should be used for determining the most important constant of celestial mechanics: the solar parallax. Venus’s 1874 transit across the sun was seen as the best opportunity for ending decades of debate. However, a mysterious “black drop” that appeared between Venus and the sun and individual differences in observations of the phenomenon brought traditional methods into disrepute. To combat these difficulties, the (...) astronomer Jules Janssen devised a controversial new instrument, the “photographic revolver,” that photographed Venus at regular intervals. Another solution came from physicists, who rivaled the astronomers’ dominance in precision measurements by deducing the solar parallax from physical measurements of the speed of light. Yet other astronomers relied on drawings and well‐trained observers. The new space emerging from this debate was characterized by a decline in faith in photography and in geometry and by the growing realization of the importance of alternative elements needed for establishing scientific truths: power and authority, skill and discipline, standardization, mechanical reproducibility, and theatricality. By examining the “cinematographic turn” in science and its alternatives, this essay brings to light unexplored multidisciplinary connections that contribute to the histories of psychology, philosophy, physics, and film studies. Partiendo de una crítica a una línea de interpretación que, en su intento de aproximarse fenomenológicamente a una «conciencia estética», homologa la modificación de neutralidad con la epojé, el artículo busca exponer la función metodológica que cumplen la modalización de la creencia en el proyecto de Ideas I, así (...) como también resaltar la importancia creciente que la fantasía y la conciencia del ‘como si’ irán adquiriendo en el desarrollo posterior de la fenomenología de Husserl. El siguiente artículo se propone estudiar la poesía de Luis Hernández a partir de los problemas que surgen al intentar estudiar su obra reunida. Antes que ser valorada como una poesía “inacabada”, la deliberada asistematicidad de su poética debe ser entendida como el resultado de un calculado y consciente ejercicio artístico, cuyas fuentes filosóficas tradicionalmente han pugnado por una ontología del movimiento frente a una metafísica de la permanencia. Bajo esta perspectiva, la obra de Hernández se revela como un “plano (...) de inmanencia”, desde el cual acontece el sentido de su poesía en el quehacer de la escritura. (shrink)

This paper defines and analyzes the processes of “othering” as they manifest in the practice and praxis of nursing education. Othering is bound up in the establishment and reinforcement of norms, and shores up power inequities that negatively impact faculty, students, and patients. While previous analyses have addressed othering in nursing more broadly, this paper adds a consideration of the multiple processes of othering that operate within the context of nursing education spaces. Cases from recent nursing education literature are interpreted (...) through the frameworks of exclusionary, inclusionary, and structural othering, and provide specific illustrations of the concepts described. The paper concludes by arguing for an application of norm‐critical pedagogical practice to counteract, disrupt and dismantle othering processes within nursing education. (shrink)

In this paper I argue that expert’s opinions have a much wider impact on legal decision-making. In particular, they may generate a problem that I will call ‘the opacity of law’. A legal text, such as a statute or regulation, becomes opaque if a legal authority is not able to grasp its full (...) linguistic content but is nevertheless in a position to use it, thanks to an expert’ opinion, in legal decision-making. When this occurs, not only do experts contribute to fact-finding but also to determining the content of the law. In the paper I analyse the linguistic and cognitive sources of this phenomenon, its characteristics and troublesome consequences, and the different kinds of opacity that may affect legal decision-making. We remark that the A Contrario Argument is an ambiguous technique of justification of judicial decisions. We distinguish two uses and versions of it, strong and weak, taking as example the normative sentence “Underprivileged citizens are permitted to apply for State benefit”. According to the strong version, only underprivileged citizens are permitted to apply for State benefit, so stateless persons are not. According to the weak, the law does not regulate the position of underprivileged stateless persons in this respect. We (...) propose an inferential analysis of the two uses along the lines of the scorekeeping practice as described by Robert Brandom, and try to point out what are the ontological assumptions of the two. We conclude that the strong version is justified if and only if there is a relevant incompatibility between the regulated subject and the present case. (shrink)

ArgumentIn 1895 when the Lumière brothers unveiled their cinematographic camera, many scientists were elated. Scientists hoped that the machine would fulfill a desire that had driven research for nearly half a century: that of capturing the world in its own image. But their elation was surprisingly short-lived, and many researchers quickly distanced themselves from the new medium. The cinematographic camera was soon split into two machines, one for recording and one for projecting, enabling it to further escape from the laboratory. (...) The philosopher Henri Bergson joined scientists, such as Etienne-Jules Marey, who found problems with the new cinematographic order. Those who had worked to make the dream come true found that their efforts had been subverted. This essay focuses on the desire to build a cinematographic camera, with the purpose of elucidating how dreams and reality mix in the development of science and technology. It is about desired machines and their often unexpected results. The interplay between what “is” (the technical), what “ought” (the ethical), and what “could” be (the fantastical) drives scientific research. (shrink)

The aim of this article is to follow Honig's intention of thinking inoperativity as a form of refusal. It demonstrates that Agamben's inoperativity entails an intensification of use that can circumvent the pitfalls associated with the language of 'demands,' or the need to rescue the city as the space of the political par excellence, all while preserving its potential for instituting change. I claim that all destitution entails instituting practices and forms of experimentation that modify the subject, and that, with (...) the help of Agamben, subjects are nothing other than these modifications. The wager of this short intervention, therefore, is that a form of refusal that pays critical attention not only to the suspension but also to the intensification of use that this suspension inherently entails is attainable, all while acknowledging that the city is shaped by anti-blackness. Several legal arguments use the notion of ratio legis in order to sustain a normative conclusion, in particular the argument from analogy and some forms of teleological argumentation. However, determining the ratio is often a difficult and controversial task. In this paper we look firstly at the speech acts typically performed by legal practitioners in order to determine the ratio and, secondly, we take into account the argumentative commitments they undertake in so doing and the argumentative constraints put on them. In this paper we consider whether a pragmatics of semantic content can be a useful approach to legal interpretation. More broadly speaking, since a pragmatic conception of meaning is a component of inferential semantics, we consider whether an inferentialist approach to legal interpretation can be useful in dealing with some problems of this important aspect of law. In other words, we ask whether Legal Inferentialism is a suitable conception for legal interpretation. In Section 1 we briefly consider the semantics/pragmatics debate (...) in contemporary philosophy of language and in relation to legal interpretation. In Section 2 we discuss the relations between a pragmatics of semantic content and an inferentialist conception of content. In Section 3 we consider how Inferentialism can be applied to legal interpretation. Finally, in Section 4 we consider some possible advantages and drawbacks of Inferentialism applied to legal interpretation and adjudication. (shrink)

Many Western nations are emphasizing the importance of population health across health care delivery organizations and education systems. Despite significant momentum to integrate population health into nursing practice, a parallel effort to examine how these efforts impact practicing nurses' views of their professional role and work identity has not occurred. This secondary qualitative analysis, employing an abductive approach, explored processes public health nurses use in creating and maintaining their work identity through three organizing themes: narrative self‐identity, mandated identity, and identity (...) as struggle. The analysis was based on interview data collected from 30 US public health nurses residing in 17 states. ‘Being a real nurse’ describes public health nurses' efforts to balance a contradictory work identity where at times they are expected to focus on populations and at other times, on individuals. The identity work revealed through this study should be further explicated and specific strategies developed for stabilizing a work identity for public health nurses, as well as for any nurse charged with a population health role. Después de una larga tradición de pensamiento en donde los procesos de justificación moral se asociaron con el valor normativo de la razón, hoy en día asistimos a una nueva orientación que defiende la integración de aspectos cognitivos y emocionales dentro del análisis de la acción moral y los compromisos ciudadanos. En este contexto, Martha Nussbaum, con su teoría (...) cognitivo-evaluadora de las emociones, aporta una original reflexión ética centrada en lo que ha denominado el juicio eudaimonista ligado al florecimiento de la persona y la comprensión de una vida humana buena. Esta visión posibilita entender las emociones como advertidores de vulnerabilidad, sufrimiento y dignidad humana menoscabada, en momentos en que miles de hombres y mujeres se sumergen en lo infrahumano. In moral philosophy and psychology there is currently discussion of vital importance, this is the relationship between morality and emotions. After a long tradition of thought in which the processes of moral justification were associated with the normative value of reason, today we are witnessing a new orientation that defends the integration of cognitive and emotional aspects within the analysis of moral action and citizen commitments. In this context, Martha Nussbaum, with her cognitive appraisal theory of emotions, contributes an original ethical reflection focused on what has been called the eudaimonist judgment linked to the flowering of the person and understanding of a good human life. This vision makes it possible to understand the emotions as warners of vulnerability, suffering and human dignity undermined, at a time when thousands of men and women are immersed in the subhuman. The A Simili Argument draws the conclusion that a target case has a normative property Q since it shares a relevant property P with a source case. It can be seen as a complex inference constituted by three inferential steps: An abduction of the relevant property P , an induction of the class having that property, and a deduction of the target's having property Q . A major problem of this argument is the characterization of the property relevance. The standard (...) answer refers to the notion of ratio: It is the ratio that fixes what is relevant for what. But the determination of the ratio is often a difficult and controversial task. This issue is considered here from an inferentialist point of view, claiming that the ratio and relevance are determined by the normative statuses reciprocally attributed by the speakers in the context of legal argumentation. We recorded Event-Related Potentials to investigate differences in the use of gender information during the processing of reflexive pronouns. Pronouns either matched the gender provided by role nouns (such as “king” or “engineer”) or did not. We compared two types of gender information, definitional information, which is semantic in nature (a mother is female), or stereotypical (a nurse is likely to be female). When they followed definitional role-nouns, gender-mismatching pronouns elicited a P600 effect reflecting a failure in the agreement process. (...) When instead the gender violation occurred after stereotypical role-nouns the Event Related Potential response was biphasic, being positive in parietal electrodes and negative in anterior left electrodes. The use of a correlational approach showed that those participants with more “feminine” or “expressive” self sex-role descriptions showed a P600 response for stereotype violations, suggesting that they experienced the mismatch as an agreement violation; whereas less “expressive” participants showed an Nref effect, indicating more effort spent in linking the pronouns with the possible, although less likely, counter-stereotypical referent. El presente artículo se propone ofrecer al lector una visión panorámica de las principales adquisiciones críticas relativas a la formación juvenil de Dante Alighieri. A lo largo de siete siglos de estudios, las fuentes de las que bebió el futuro autor de la Comedia siguen siendo en buena medida conjeturales, lo cual no quita que los análisis de archivo más recientes y algunos proyectos de investigación en continuo desarrollo han permitido ampliar al respecto nuestros horizontes de conocimientos.

Abstract. The purpose of this paper is to address some of the main issues of contemporary jurisprudential methodology by considering the contribution of Jules Coleman to this subject. After a description of Coleman's methodological approach and a clarification of its philosophical background, the paper focuses on some related problems, such as the relation between linguistic meaning and conceptual content, the nature of legal concepts, the different aspects of the normativity of content, and the revisability of conceptual truths.
