Algunos de los argumentos que pretenden justificar el constitucionalismo desde la asunción del valor de la democracia atribuyen alguna relevancia normativa al sujeto o al procedimiento de elaboración de la constitución, considerando incompleta o incorrecta la mera apelación a una teoría de la justicia basada en derechos. Aunque los argumentos tienen orígenes heterogéneos es posible reconstruir algunos de los presupuestos que están en su base y que pueden reconducirse a los siguientes: la primacía de la democracia sobre los derechos, conforme (...) a la que éstos cobran su sentido pleno en el principio de soberanía popular; una estrategia dualista para la que no todas las decisiones políticas son cualitativamente iguales y que prima la política constitucional sobre la política legislativa ordinaria; una actitud de desconfianza hacia la representación ordinaria y la exigencia de un procedimiento diferente y más exigente para la creación y la reforma constitucional; y, por último, la neutralidad metaética y la irrelevancia de una teoría ontológicamente objetivista. A partir de estos presupuestos se han empleado principalmente dos tipos de instrumentos argumentativos para dar prioridad a la decisión constituyente y fundar en ella la supremacía de la constitución. Por una parte, se ha considerado que la analogía de las situaciones de debilidad de la voluntad individual con la democracia constitucional justifica la extensión del instrumento del precompromiso para dar cuenta de las restricciones constitucionales como vínculos autoimpuestos. Por otro lado, se ha planteado que un concepto jurídico de poder constituyente sirve para dar prevalencia a las decisiones “populares” adoptadas en una práctica deliberativa amplia frente a las decisiones parlamentarias. The numerous biographies on Ignatius of Loyola’s that emerged in recent years have rarely addressed the post mortem treatment received by the body of the Holy Jesuit. Even more, those that actually talked about this chapter of the Saint’s life did not take into account the descriptive and interpretive richness that provides the History of Medicine. Therefore, this paper aims to reconstruct the postmortem treatment received by the body of Ignatius of Loyola’s. In addition, we aim to suggest some ideas (...) about the health professionals who performed the autopsy and subsequent embalming of the corpse, the “signs of holiness” found in the body and the places where it was preserved. Resumen En este trabajo intentaré comparar dos momentos en la producción teórica de Nancy Fraser: sus análisis contemporáneos del capitalismo como orden institucional y su marco categorial previo, basado en dualismo de redistribución y reconocimiento. Destacaré tres grandes rupturas en su evolución intelectual: en el diagnóstico del presente, en la comprensión del capitalismo como tal y en la propuesta política.In this paper I will try to compare two periods in Nancy Fraser's theoretical evolution: her analysis of contemporary capitalism as an (...) institutional social order and her previous categorial framework, based on the dualims of redistribution and recognition. The ultimate source of explanation in biology is the principle of natural selection. Natural selection means differential reproduction of genes and gene combinations. It is a mechanistic process which accounts for the existence in living organisms of end-directed structures and processes. It is argued that teleological explanations in biology are not only acceptable but indeed indispensable. There are at least three categories of biological phenomena where teleological explanations are appropriate.

It is an intimate experience for us to think, to understand and to perceive things as being identical to themselves, and to suppose, consequently, that things are truly “what” they are. Something is always conceived as itself. The given is given full of itself in all its modifications. For instance, I can think or perceive partially some lips, I can see them almost in their whole or in some of their aspects, or just see them disappear. But it does not (...) seem to be possible to think or to perceive a given as almost itself, as an aspect or as part of itself. It is the aim of this work to study the assumptions and conditions for the original position of sameness in experience, just as it occurs in the synthesis of the datum singular and distinct. The polarization of single tone (einstimmig) intentional rays in an αvτó already contains the aporiae peculiar to the experience of the identical, whose revelation shall lead us, on the one hand, to one of the nuclei of the analysis of passive synthesis, and, on the other hand, to point up how critical revision of the numerical or extensional model of self-identity is for the unity of meaning. Then, it will be a question of pointing out the reasons why in a phenomenology of identity, the renunciation of the phenomenological legitimacy of the αvτó as a guarantee for the different positions of identity must be observed. The Aymara Pentecostalism is one of the most important religious movements in Chile. In the last decades it has been produced a considerable amount of sociological and anthropological research about this movement and this has resulted in the emergency of a particular field. However, these studies have not the thematized the relevance of the theoretical assumptions that underlie in their analysis. Due to this, our aim is to develop an epistemological analysis of the theoretical assumptions behind the studies about the (...) Aymara Pentecostalism in Chile, elucidating specifically how they have used the difference between structure and action when they aim to understand the features of this socio-religious movement. This will allow us to elucidate the types of epistemological conflation that take place in the explanations develop by these authors, assessing its theoretical contribution. El pentecostalismo aymara es uno de los movimientos religiosos más distintivos de Chile. En las últimas décadas se ha producido una considerable cantidad de estudios sociológicos y antropológicos sobre este movimiento, generándose un incipiente campo de estudios al respecto. Sin embargo, estos estudios no han tematizado la adecuación de los supuestos teóricos que subyacen a sus análisis. Por ello, nuestro objetivo es realizar un análisis epistemológico de los supuestos teóricos que subyacen a los estudios sobre pentecostalismo aymara en Chile, distinguiendo específicamente cómo han utilizado la distinción entre estructura y acción a la hora de comprender las características de este movimiento socioreligioso. The sociobiologists' argument is that human ethical norms are sociocultural correlates of behaviors fostered by biological evolution. I argue that such proposals are misguided and do not escape the naturalistic fallacy. The isomorphism between the behaviors promoted by natural selection and those sanctioned by moral norms exist only with respect to the consequences of the behaviors; the underlying causations are completely disparate. José Otero Espasandín (1900-1987) was an important science popularizer in Argentina during the 1940´s, who belonged to the Misiones Pedagógicas (Educational Missions) group in Spain. This paper presents his biography and his work as a science and technology popularizer. It focused on his features, value and significance for that period.

Introduction: The use of human samples in genomic research has increased ethical debate about informed consent (IC) requirements and the information that subjects should receive regarding the results of the research. However, there are no quantitative data regarding researchers’ attitudes about these issues. Methods: We present the results of a survey of 104 US and 100 Spanish researchers who had published genomic epidemiology studies in 61 journals during 2006. Results: Researchers preferred a broader IC than the IC they had actually (...) obtained in their published papers. US authors were more likely than their Spanish colleagues to support obtaining a broad IC, covering either any future research project or any projects related to a group of diseases (67.6% vs 43%; adjusted OR = 4.84, 95% CI, 2.32 to 10.12). A slight majority of researchers (55.8%) supported informing participants about individual genomic results only if the reliability and clinical validity of the information had been established. Men were more likely than women to believe that patients should be informed of research results even if these conditions were not met (adjusted OR = 2.89, 95% CI = 1.46 to 5.72). Conclusions: This study provides evidence of a wide range of views among scientists regarding some controversial ethical issues related to genomic research, suggesting the need for more study, debate and education. In the interim, journals might consider including the investigators’ policies regarding these ethical issues in the papers they publish in the field of genomic epidemiology. (shrink)

Medical stem cell research is currently the cause of much moral controversy. Those who would confer the same moral status to embryos as we do to humans consider that harvesting such embryonic cells entails sacrificing embryos. In this paper, the author analyses critically the arguments given for such a perspective. Finally, a theory of moral status is outlined that coherently and plausibly supports the use of embryonic stem cells in therapeutic research.

Sobre el libro: El presente libro recoge las ponencias presentadas en la reunión anual del Seminario Spinoza que tuvo lugar en la Facultad de Filosofía de la UNED los días 13 y 14 de marzo de 2009, así como la presentación del cuadro de Espinosa pintado por Sorolla procedente de la Donación Simarro y perteneciente al fondo artístico de la Universidad Complutense, que tuvo lugar en El Escorial en el verano de 2008. Los trabajos se articulan en cuatro apartados: la (...) política, la ciencia, la proyección de Espinosa en la Ilustración y la iconografía de Espinosa, y sitúan a Espinosa en su siglo, destacando su carácter anómalo en relación con el resto de autores de su entorno. Espinosa no se adaptó a la crisis, sino que se esforzó por comprenderla sin ceder en sus ideales, lo que permitió que las ilusiones renacentistas se desarrollaran en la ilustración, superando el hiato de la crisis barroca. Œuvre de maturité de François Suarez (1548-1617), Des lois et du Dieu législateur a été publié en latin en 1612. Parmi les dix livres que comprend cet ouvrage, nous avons choisi de présenter pour la première fois les deux premiers en langue française. À partir de l'héritage retravaillé de la philosophie politique antique et médiévale, Suarez élabore une théorie originale de la loi et de la communauté en renouvelant leur rapport à l'éthique et à la jurisprudence. Dans une période marquée (...) notamment par la controverse de Valladolid (1550) et la Contre-Réforme, l'auteur redéfinit le contenu et la finalité des concepts fondamentaux de la théorie politique (l'état de nature, le droit naturel, le droit subjectif, la loi naturelle, le pacte social, la souveraineté, l'État et le droit des gens) en les articulant à une compréhension historique de l'homme conçu comme être libre, raisonnable et fini. Suarez instaure ainsi les conditions d'un basculement du théologico-politique dans la modernité dont les effets se feront sentir, entre autres, chez Grotius et l'École du droit naturel. Les conséquences de ce mouvement seront perceptibles jusqu'au XVIIIe siècle avec Wolf. Des lois et du Dieu législateur permet précisément d'apprécier à sa juste mesure la place privilégiée qu'il convient de redonner à la théorie suarézienne de la loi dans l'histoire de la pensée politique. El presente trabajo se divide en dos partes. En la primera parte, se explican las nociones fenomenológicas de temporalidad e historicidad de Maurice Merleau-Ponty, para interpretar la novela sin ficción de Javier Cercas, El Impostor. El personaje de la novela, Enric Marco, crea una identidad falsa como salvavidas a una realidad que no es capaz de ver o en la que no es capaz de existir. Explicaremos como este problema podría ser identificado, como una negación de la existencia. En la (...) segunda parte, ampliamos el análisis existencial hacia una descripción de la sociedad: cuán cerca estamos de ser Enric Marco. Acompañaremos esta segunda parte con textos breves de Merleau-Ponty, publicados al finalizar la Segunda Guerra Mundial, cuyos argumentos permiten describir las respuestas sociales a la violencia, las mismas que son semejantes a las descripciones que hace Cercas de la sociedad española, esto es, la incapacidad social para reincorporarnos o rehacernos frente a un presente confuso. Nous présentons la notion d’« être au monde » de Merleau-Ponty, en prenant comme point de départ l’étude de l’auteur sur le rapport mère-enfant dans la première étape de l’enfance (de 0 à 3 mois). Dans cet article nous nous appuyons, spécifiquement, sur le cours tenu à la Sorbonne entre 1949 et 1952, influencé par les travaux de la psychologie de la Gestalt et de la psychanalyse, pour montrer comment, à partir de la relation et de l’unité mère-bébé, on peut (...) expliciter ce que Merleau-Ponty pense de l’intersubjectivité et l’idée qu’il se fait du corps comme projet orienté vers le monde. Nous voulons montrer comment Merleau-Ponty rapproche la philosophie de la réalité concrète et comment il analyse le développement de l’enfant en tant que processus d’individualisation.We explore Merleau-Ponty’s notion of “being-toward-the-world,” taking his study on the mother-child relation during the first stage of infancy (0-3 months) as our point of departure. In this article we consider, more specifically, the Sorbonne lectures of 1949-1952, which were influenced by works in Gestalt psychology and psychoanalysis, in order to show how, starting from the relation of the mother-baby unity, we can clarify what Merleau-Ponty thinks of intersubjectivity, and his idea of the body as project oriented toward the world. We wish to show how Merleau-Ponty brings philosophy closer to concrete reality and how he analyzes child development as a process of individualization. Presentiamo la nozione di “essere al mondo” in Merleau-Ponty prendendo come punto di partenza i suoi studi sul rapporto madre-bambino nella prima fase dell’infanzia (dagli 0 ai 3 mesi di età). In quest’articolo consideriamo, in particolar modo, il corso tenuto alla Sorbona tra il 1949 e il 1952, influenzato dai lavori di psicologia della Gestalt e dalla psicoanalisi, per mostrare come, a partire dalla relazione dell’unità madre-bambino, possiamo esplicitare ciò che Merleau-Ponty pensa dell’intersoggettività e l’idea che si è fatto del corpo come progetto orientato al mondo. As it is well known, in the forties of the past century, Curry proved that in any logic S closed under Modus Ponens, uniform substitution of propositional variables and the Contraction Law, the naïve Comprehension axiom trivializes S in the sense that all propositions are derivable in S plus CA. Not less known is the fact that, ever since Curry published his proof, theses and rules weaker than W have been shown to cause the same effect as W causes. Among (...) these, the Contraction rule or the Modus Ponens axiom, for example, are to be noted. But, moreover, as Brady has proved, even the Generalized Modus Ponens axiom or the Generalized Contraction rule give rise to “Curry’s Paradox” under the same circumstances as W does. In some previous work by us, “weak relevant model structures” are defined on “weak relevant matrices” by generalizing Brady’s model structure MCL built upon Meyer’s Crystal matrix CL. We have proved that wr-ms only verify logics with the “depth relevance condition”. The aim of this paper is to show how to falsify gMPa and gRW in certain wr-ms. In particular, it will be shown that gMPa is falisfied in any wr-ms and gRW in any wr-ms verifying Routley and Meyer’s basic positive logic B+. (shrink)

Increased concern for the environment has increased the number of investment opportunities in mutual funds specialized in promoting responsible environmental attitudes. This article examines the performance and risk sensitivities of US green mutual funds vis-à-vis their conventional peers. We also analyze and compare this performance relative to other socially responsible investing (SRI) mutual funds. In order to implement this analysis, we apply a CAPM-based methodology and find that in the 1987–2009 period, environ- mental funds had lower performance than conventional funds (...) with similar characteristics. However, if we focus on a more recent period (2001–2009), green funds achieved adjusted returns not significantly different from the rest of SRI and conventional mutual funds. (shrink)

Resumo No Manifesto surrealista, de 1924, Breton explicita o produto da atividade surrealista como uma “luz de imagem”, gerado pela aproximação involuntária de duas realidades distantes. Essa estrutura dupla da imagem surrealista tem um caráter disruptivo, que rompe com a nossa percepção da realidade cotidiana. Com isso, abre-se a possibilidade de um espaço para a crítica social e histórica, bem como para uma intervenção estético-política justamente em uma sociedade na qual as formas tradicionais de crítica parecem estar neutralizadas. Essa experiência (...) surrealista e esse espaço aberto por ela Walter Benjamin caracteriza respectivamente com a fórmula “iluminação profana” e “espaço de imagem”. Ambos apresentam uma grande semelhança com alguns pontos e consequências, em seus conceitos, tanto de “imagem do pensamento”, como de “imagem dialética”, sobretudo na medida em que esses conceitos também são formulados em meio à crise cultural da sociedade europeia, nos 1920, e buscam uma saída revolucionária para a mesma. Trata-se de investigar aqui, por meio de uma análise comparativa dessas concepções de imagem, até onde vai a influência e a relevância do surrealismo para o pensamento figurativo-dialético de Benjamin e para sua compreensão da história.In the Surrealistic manifest from 1924, Andre Breton explains the product of surrealistic action as a “light of image” resulting from an arbitrary approach of two distant realities. This double structure of surrealistic image has a disrupting character that breaks our common perception of reality. Thus can open a space for social and historical criticism as well as for an aesthetical-political intervention in a society where traditional forms of criticism seem to be neutralized. Walter Benjamin defines this surrealistic experience and its opened space respectively with the expressions “profane illumination” and “image space”. Both have similarities with Benjamin’s ideas of “thought image” and “dialectical image”, especially because they were elaborated amidst the cultural european crisis in the 1920ies looking to find a revolutionary way out of it. Through a comparative analysis of these notions of image, this paper proposes to investigate the influence and the relevance of surrealism for Benjamin’s dialectical-figural way of thinking and his comprehension of history. Cognition is context-sensitive, as the same sensory information is processed differently depending on its context (e.g., on its probabilistic association with goal-directed actions and their outcomes). Despite this, the concept of context in studies of higher-order cognitive processes, like cognitive control, is often simplified to nominal stimulus categories (like a target vs. distractor). Here we propose that quantifying contextual information to model cognitive demands is (1) fruitful as it can provide novel insight into the nature of cognitive control, (2) accessible (...) as simple probability models offer a tool for quantifying context and (3) analytically useful as a fine-grained quantification of context can be entered into more complex models as regressors that allow a direct way of appropriately exploring many of the defining tenants of cognitive control (e.g., rapidly changing trial-by-trial neural dynamics). Here, we briefly describe the logic of using context-sensitive measures of cognitive control and highlight recent studies from this approach using simple information theory metrics. (shrink)

The moral enhancement of human beings is a constant theme in the history of humanity. Today, faced with the threats of a new, globalised world, concern over this matter is more pressing. For this reason, the use of biotechnology to make human beings more moral has been considered. However, this approach is dangerous and very controversial. The purpose of this article is to argue that the use of another new technology, AI, would be preferable to achieve this goal. En este encuentro convergen monstruos reales y ficticios -aunque nos cueste diferenciarlos-, así como las neurosis del siglo XXI y las leyendas del siglo XIX, que aliviadas unas por el psicoanálisis y alimentadas otras, por los primeros experimentos de “ingeniería genética”, consiguen sembrarnos una interrogante sobre la (in)distinción de lo real en nuestro entorno. This article discusses some of the claims of the earlier and later versions of the Contemporary Theory of Metaphor (CTM) and addresses some of the criticism that has been leveled against it. It is argued that much of this criticism arises from common misconceptions as to the real claims made by the theory. However, CTM is still in need of further exploration and empirical support. In this connection, we identify some areas where research is still needed and supply our own (...) developments. We argue for a more complex classification of metaphor types, which takes into account various complementary taxonomic perspectives, including the nature of source and target and the genericity and complexity of the metaphoric operation. We also explore metaphor in relation to cognitive prominence and conceptual interaction issues. Finally, we deal with the problem of constraints on metaphor and make a proposal for three complementary kinds of constraint. (shrink)

Rescate y edición de cuatro artículos olvidados de María Zambrano publicados en el diario _Crítica_ de Buenos Aires en marzo de 1937. Los artículos se corresponden con los capítulos de la segunda parte de _Los intelectuales en el drama de__ España_, el libro que Zambrano escribió y publicó en Chile en la editorial Panorama en 1937. En este trabajo se da cuenta del estado de la cuestión relativo al periodo chileno de Zambrano, se procede al estudio de los artículos encontrados, (...) sobre todo en lo que tiene que ver con su correspondencia con los capítulos de la segunda parte del libro chileno y se dan las coordenadas de su circunstancia editorial. The "antecedents, continuity and projections" of Neoplatonism are revised, priming the individual and communitary intertextuality, as the medium of study most valid for a train of thought that gives priority to the doctrinal body rather than to the individual. In this way are seen the diverse neoplatonic systems (Greek, Byzantine, Gnostic...) although it is also noted that, when this doctrinal aspect is weakened, Neoplatonism may externally influence the doctrines and philosophical authors who are very different from its spirit (Christians, Jews, (...) Islamic, renaissentists, modern and contemporary). (shrink)
