La criminalisation des violences sexuelles faites aux femmes est le résultat d’une longue évolution dans le monde romain : si la pénalisation des rapports sexuels illicites s’opère à partir du ier siècle av. notre ère à la suite de la promulgation de la loi Iulia de adulteriis, un édit de Constantin datant probablement de 326 réprime pour la première fois le raptus comme crime distinct. Le principal écueil que pose cette évolution législative est d’ordre sémantique, la notion de viol (...) n’étant pas juridiquement définie. Durant les premiers siècles de l’Empire, ce problème se reflète non seulement dans le discours du droit, mais aussi dans le méta-discours que les écoles de rhétorique tiennent. La présente étude met en relation les deux discours pour examiner des éléments-clés de la logique éducative à partir de laquelle les Romains analysaient les catégories relatives à ce que nous entendons aujourd’hui par “viol”. Elle permettra de constater que la société romaine du Haut Empire avait une forte conscience du phénomène dans ses aspects les plus problématiques, et peut-être même des réponses aux défis forgés par le droit à son égard. On May 4, 1380, Cecily Chaumpaigne brought a deed of release into the Chancery of Richard II and had it enrolled on the close rolls . In this deed Chaumpaigne released the poet Geoffrey Chaucer from “all manner of actions such as they relate to my rape or any other thing or cause” . The deed had been witnessed three days earlier by several prominent members of the court of Richard II.

An analysis of the boundary between “raptus”, “ecstasis” and “excessus mentis” allows us to draw a line that unites theology and speculative mysticism, with interesting results. The mystical state described with regard to the co-redemptrix Virgin in sermo VI de assumptione beatae Virginis Mariae constitutes a good starting point. I will analyze the fundamental characteristics of the peculiar charism of the Virgin Mary “in via”, which overcomes the knowledge of the prophets and makes it deiform, perfectly coinciding in knowledge (...) with the Son and by its own ontological and gnoseological “status” co-redemptive of humanity, a heavenly door between man and God. By working on Eco’s Confessions of a Young Novelist, we will try to investigate the phenomenology of reading together with immersivity and our emotional involvement with fiction.

Diego, is one of the many productive seventeenth-century Franciscan authors whose works are not habitually discussed within the world of Franciscan scholarship. According to the existing bibliographical guides, Sinistrari authored under his own name and (...) under various pseudonyms (such as Panfilo, Clodoveo Farvamondi, Nicolò Turris, Lazaro Socio, and Lazaro Agostino Cotta) about 34 works, more or less half of which reached the printing press during his lifetime. These works cover a wide range of genres and topics, including comedies, religious and secular dramas, astrological, astronomical and scientific works (including polemics against works of other scholars, medical and embryological papers), defenses of the religious orders, sermons and funerary orations, treatises of sacramental theology, some atypical hagiographical texts, and works of religious disciplinary law. This production was linked to his acknowledged expertise in a variety of disciplines, which apparently made him a celebrated lecturer in Pavia within the order and in public schools, teaching the liberal arts, geometry, military architecture and theology. Some of his works are connected with his activities as a preacher, advisor, and later censor for the Holy Office, practicing exorcist, consultant for the Franciscan Minister General, and personal theologian of Alessandro Montecatini (Archbishop of Avignon) and Federico Caccia (Cardinal and Archbishop of Milan).1Within the order itself, his most enduring legacy might have been his three volume Practica criminalis illustrata, a work that is both a commentary on penal law within the Franciscan order, and a more wide-ranging manual for dealing with penitential and religious-criminal issues, written [End Page 191] to supplant older handbooks of such kind. He was initially tasked to compile such materials at the Franciscan general chapter celebrated at Rome in 1688. The first two volumes of the Practica criminalis illustrata appeared in print in 1693. They were again published posthumously in 1702.2 In between he finished another volume of the Practica with a somewhat different focus, also known under the title De delictis et poenis tractatus absolutissimus, and which was proposed as a useful guidebook for judges, lawyers, and prelates in ecclesiastical courts, as well as for confessors, exorcists, and lay practitioners of law. This work was issued for the first time in 1700.3Although a wished-for early eighteenth-century re-issue of this multi-volume Practica criminalis illustrata was put on hold when it was placed on the index of forbidden books in March 1709 donec corrigatur for suspicion of laxist tendencies,4 all three volumes did appear again with some modifications in a 1753-1754 opera omnia edition. Early medieval Irish literature presents several types of voyages into the afterworld: echtrai (various adventures into Mag Mell), immrama (sea travels to the enchanted islands of the Ocean), fisi (ecstatic revelations of Christian eschatology), journeys into Saint Patrick’s Purgatory. In this paper, we seek to contrast the fisi and the descents into the cave of Saint Patrick. From a morphological point of view, both have a great deal of topoï in common, which describe the structure of the Christian other world: (...) the waste land of pains, the infernal pit, the ordeal bridge, the land of the blessed, the celestial Kingdom of God, etc. However, between the two genres appear some major differences, such as the order in which these places are visited. The main distinction lies in the fact that the fisi are mainly ecstatic voyages (i.e. psychanodias ), implying a “ raptus animae ”, while the voyages into Saint Patrick’s Purgatory are physical expeditions (i.e. somanodias ), during the actual life of the adventurers. Although many of the common themes of the two genres derive from the medieval Christian tradition (especially the apocryphal apocalypses and visiones ), we argue that the differences may be due to the input of local Irish Celtic heritage. Das Wirken Gabriel Biels, eines der bedeutendsten Theologen des Spatmittelalters, ist nicht nur durch scharfsinniges, vor allem an Ockham, aber auch an Scotus orientiertes theologisches Nachdenken gekennzeichnet. Es ist ebenso gepragt durch die Devotio moderna. Aus dieser Quelle speist sich sein unermuedlicher Einsatz fuer eine Kirchenreform wie auch seine tiefe Frommigkeit. Trotz Kenntnis der Bedeutung dieser Linie fuer Biels Frommigkeitspraxis blieb sein Verhaltnis zur Mystik bisher unerforscht. Das vorliegende Buch fuellt diese Luecke. Es sammelt aus Biels Hauptwerken, dem Collectorium und (...) der Auslegung des Meakanons, die mystischen Elemente (wie z.B. raptus, Einwohnung, unio, transformatio) und analysiert deren Rezeption. Dabei beruecksichtigt es auch das Vorfeld von Mystik in Gebet und Meditation. Einen anderen Schwerpunkt bildet Biels Stellung zum Phanomen religioser und mystischer Erfahrung. Einen qualifizierten Begriff religioser Erfahrung entwickelt Biel nicht. Er wertet sie durchaus positiv, doch gilt ihm als das Hochste im Christenleben die Liebe. Betrachtet man aber die Funktion der Mystik in Biels Werken, so ist seine Theologie im weiteren Sinne mystagogisch. In devoter Tradition stehend, will er zur Frommigkeit hinfuehren. Nicht zu hoch veranschlagt werden darf die Relevanz des Nominalismus fuer Biels Mystik-Rezeption. Mit Register. In the Prologue to the Commentary on St. John, Albert the Great uses the image of an eagle to describe the main feature of the Evangelist, that’s the contemplation. As an eagle John flew into the sky of Trinity going beyond creatural limitation and living a experience, that can be interpreted like a raptus. For better understanding the contemplation of John, some texts are very important: De resurrectione; Quaestio de visione dei in patria; Quaestio de raptu, in which the (...) german teacher explains in what sense the human intellect can know the divine infinity. About this problem it’s significant the distinction between “quid est” and “ut est” in God.
