Criminal Liability for Negligent Accountancy.Justinas Sigitas Pečkaitis - 2013 - Jurisprudencija: Mokslo darbu žurnalas 20 (1):343-357.
This article presents the conception of negligent account management, analyses the rules of the criminal act that govern criminal liability for negligent account management, by focussing on the form of guilt and the problem of its content. The plenary session’s conclusion that the two offences – failure to administer bookkeeping and failure to protect the bookkeeping documents – can be committed both intentionally and negligently is disputed in this article. The adoption of the new Criminal Code in 2000, setting the (...)

Criminal Legislation against Illegal Income and Corruption: Between Good Intentions and Legitimacy.Oleg Fedosiuk - 2012 - Jurisprudencija: Mokslo darbu žurnalas 19 (3):1215-1233.
Recently (2010–2011) new criminal legislation to combat illegal income and corruption was passed and publicly discussed in Lithuania. Within the list of the new legal measures, special attention should be paid to criminalisation of illicit enrichment, establishment of a model of extended property confiscation, reinforcement of responsibility for corruption-related offenses, a provision that not only property but also personal benefits may constitute a bribe. It can be seen from the explanatory letters attached to the draft laws and the political debate (...)

  7. Action Recognition as Virtus Dormitiva.Vilius Dranseika - 2010 - Problemos 77:122-128.

Is it Easy to Remain Solely an Interpretator for a Court?Egidijus Baranauskas - 2009 - Jurisprudencija: Mokslo darbu žurnalas 116 (2):201-210.
The boundary between interpretation and creation of law is sometimes so subtle and intangible that the court judgments may give rise to discussions about judges having taken the role of lawmakers. This article reveals the concept of ‘precedent’ in the Lithuanian legal system as the influence of the common law has increased on the continental law and ideas of stare decisis have been transferred to the Lithuanian legal system. The start for this was a famous judgment of 28 March 2006 (...)

Recognition of Jurisdiction of the Court of Justice of the European Union in International Courts.Inga Daukšienė - 2012 - Jurisprudencija: Mokslo darbu žurnalas 19 (2):459-475.
From the point of the EU law, the CJEU has the exclusive competence to interpret the EU legal norms and decide upon validity of the legal acts adopted by the EU institutions because it is the most effective method to ensure the unilateral interpretation of the EU law and to prevent its fragmentation. Thus, it can be presumed that all disputes between the Member States regarding the EU law must be solved by the CJEU. The paper aims at finding the (...)

The study focuses on the phenomenon of crime-causing (criminogenic) law. It includes a review of related studies on such laws and their criminal side-effects, the change in the legislator’s liability for effects of enacted laws, and the effects of the legislator’s afflatus on the potential criminogenic effects of law. Of special concern are cases where the legislator is aware of the potential criminogenic side-effects of a new law but carelessly neglects them. The study evaluates the tool for detection of probable (...)

„Interpretative Play“ by Courts and their Doctrinal Assumptions.Giedrė Lastauskienė - 2012 - Jurisprudencija: Mokslo darbu žurnalas 19 (4):1343-1359.
A practising lawyer is not always aware of the fact that case decisions are more determined by legal doctrine – attitudes of authoritative lawyers and scientific legal discussion of other forms – than by changes in positive law. Regulations of specific case decisions are directly reliant on the ideas and statements of legal discussions – as one of the factors influencing the decisions of the courts. During the twenty years of independence, the form, content and argumentation of the Lithuanian court (...)

Interpretation Game or How to Make Law Without Parliament.Valentinas Mikelėnas - 2009 - Jurisprudencija: Mokslo darbu žurnalas 116 (2):79-92.
The contemporary State power is concentrated in the hands of the legislative, executive and judicial powers, which is traditionally referred to as the principle of the division of State power. The separation of State power and the attribution of the function of the interpretation and application of statutory law to courts were like “letting the genie out of the bottle”. Having started with a mechanical application of the statutory law, the courts, armed with various doctrines on interpretation of law, have (...)

Justice and Equity Within Civil Process.Rūta Petkuvienė - 2013 - Jurisprudencija: Mokslo darbu žurnalas 20 (3):1061-1080.
The article provides an analysis on how much the standard court proceedings can be regarded as the research, which is performed by investigating by what manner and measures the justice in a procedural sense is implemented. It is generally acknowledged that the court, as a subject, solving a legal dispute, implements justice only in the case, when it ensures the impartiality towards all persons. The appropriate legal proceedings form a constituent part of the constitutional right to apply in the court. (...)

The Influence of Constitutional Courts and Highest Administrative Courts Findings Upon the Interpretation of Tax Institutes.Michal Radvan - 2009 - Jurisprudencija: Mokslo darbu žurnalas 116 (2):187-200.
The aim of this article is to determine how can new interpretations of old institutes change the status of the taxpayers and tax administrators and to suggest what can the Ministry of Finance do to solve the problem – it can try setting a uniform interpretation of tax institutes. It deals with two findings of the Constitutional Court of the Czech Republic concerning two institutes described in Tax Administration Act: time-limits for tax assessment and tax inspection; and one finding of (...)

Lessons of the First EU Court of Justice Judgments in Asylum Cases.Lyra Jakulevičienė - 2012 - Jurisprudencija: Mokslo darbu žurnalas 19 (2):477-505.
Starting from 2009, national courts of the EU Member States for the first time gained a “real” right to request the EU Court of Justice for preliminary rulings in asylum matters. First judgments of this Court demonstrate equivocal tendencies: some are blaming the Court for incompetence in asylum matters, others believe that the adoption of authoritative decisions at the European level will assist in developing consistent practice of applying asylum law in the European Union, something that failed at international level (...)

Globalisation of Law: the Effect of Globalisation on the Domestic Interpretation of Law.Paresh Kathrani - 2009 - Jurisprudencija: Mokslo darbu žurnalas 116 (2):115-129.
The law consists of both internal and external rules, but in both cases they regulate the behaviour of the subjects towards each other. This can be viewed from a phenomenological perspective in the sense that people have a drive to make sense of their world, and the rules that are developed essentially enable them to relate to the world in this way. If anything interferes with this drive, then it causes peoples’ existential upset. That is why the state both enforces (...)

The Implementation of Rulings of the Constitutional Court in Legislation (article in Lithuanian).Vytautas Sinkevičius - 2011 - Jurisprudencija: Mokslo darbu žurnalas 18 (2):497-516.
There are some problems in the implementation of rulings of the Constitutional Court. The legislator should make more efforts for implementing the concept of the provisions of the Constitution provided in the reasoning parts of rulings of the Constitutional Court. The Statute of the Seimas should be supplemented with provisions obligating structural sub-units of the Seimas to carry out permanent and systemic analysis of reasoning parts of rulings of the Constitutional Court. It would allow timely to prepare proposals how to (...)

The Pitfall of Interpreting Rome II Regulation in Compliance with Brussels I Regulation.Jiří Valdhans - 2009 - Jurisprudencija: Mokslo darbu žurnalas 116 (2):229-244.
This article addresses several aspects of interaction between procedural and conflict rule regulation in private international law both of which are subject to unification process under the European Community law. They are interdependent of each other, and use the same or similar terms on many occasions. Problems with interpretation arise in application of these legal regulations. The European Court of Justice addresses them more or less successfully. As demonstrated in this article, the interpretation of procedural rules of regulation may contribute (...)
