This article argues that the passage to world society proliferates a structural transformation of constitutionalism. It is argued that its postdemocratic character is mainly rooted in a process where substantial policy objectives are constitutionalized on a higher-ranking level. While the first part of the article elaborates this diagnosis by combining systems-theoretical and post-marxist insights, the second part turns to a critique of contemporary theories about transnational constitutionalism. It reveals the shortcomings of cosmopolitan, societal and popular-sovereignty approaches in overcoming these postdemocratic (...) structures. Finally, it is argued that – in the light of such a new constitutionalism – the notion of constituent power must be replaced by the figure of a destituent power which attempts to free the constitution as a form from the selective policy objectives. Are we essentially human animals or persons? The aim of this paper is to find a middle way between animalism and constitutionalism and to develop a concept of a person's life which avoids their problems. I will argue for the following thesis: As humans we are persons, but we are persons not in the sense of certain abilities which distinguish our biological kind, but by an intersubjective form of our life. Therefore, I will strictly distinguish between the biological species form (...) of human beings and the life form of humans as persons. This allows me to develop an account of the personal life form which unifies metaphysics and value without succumbing to the naturalistic fallacy. (shrink)

In Alessandro Pinzanis Arbeit wird das Denken der Philosophen Machiavelli, Hobbes, Rousseau und Kant als Basis genommen, um die Reflexion über die Beziehung von Individuum und Staat neu zu beleben. Nachgewiesen wird, dass die Positionen dieser Philosophen zugleich vier Denktraditionen entsprechen, die eine vierfache Wurzel moderner Demokratien bilden: Republikanismus, Liberalismus, radikale Demokratie und Konstitutionalismus. Sowohl der Bezug auf klassische Denker wie auch die Entgegensetzung der benannten Traditionen modernen politischen Denkens sind allerdings problematisch. Der Autor zeigt, dass gerade die Benutzung vergangener (...) Autoren und schemenhaft definierter Denktraditionen viele der Schwierigkeiten verursacht, die beim Versuch entstehen, die aktuellen Probleme unserer Demokratien zu begreifen, geschweige denn, zu lösen. Nach der sowohl ideengeschichtlichen als auch systematischen Auseinandersetzung mit den Konzeptionen der Klassiker politischer Philosophie wird im Buch die aktuelle Debatte über die Notwendigkeit politischer Tugenden bzw. der Annahme einer bestimmten politischen Haltung seitens der Bürger gegenwärtiger Demokratien vorgestellt. Under the influence of a narrowly understood scientific legal positivism, jurisprudence has neglected interdisciplinary research for a long time. However, today there are strong practical and scholarly reasons for an interdisciplinary analysis of law triggered, e.g., by bioethics, life sciences, economics and ecology. And yet the very subject matter of law shimmering between normativity and descriptivity seems to resist all attempts to be taken in by common enterprises across disciplines: How then is the necessary interdisciplinary research in jurisprudence possible without (...) abandoning its core, legal dogmatics? This question was discussed at a special working group during the IVR-World Congress in Cracow. The papers have been polished and updated for publication. The volume falls into two parts: One is directed at the basic conceptual and institutional questions of interdisciplinary research in jurisprudence; the other one concentrates on one fruitful and highly important field of interdisciplinary research, constitutionalism. The volume brings together a truly international and in itself interdisciplinary group of experts in the field, from Finland to Brazil and from Spain to Greece. (shrink)
