Abstract

Kant claims in “On a Supposed Right to Lie from Philanthropy” the thesis that "truthfulness in statements that cannot be avoided is the formal duty of man to everyone, however great the disadvantage that may arise there from for him or for any other” . I try to show that this is not a good thesis, regardless if it is interpreted as a thesis concerning the juridical duties, whether interpreted as a thesis on ethical duties. For this, I make a critical reconstruction of the arguments contained in Article 1797. I point out that my rejection of Kant‟s thesis intends to be inspired in the premises of Kantian moral philosophy. I believe that a defensible interpretation of Kant's legal philosophy and the meaning of the categorical imperative to conclude that lying to a murderer is both legally and ethically justifiable.Em sobre um Suposto Direito de Mentir por Amor à Humanidade, Kant defende a tese de que “a veracidade nas declarações que não se pode evitar é um dever formal do homem em relação a quem quer que seja, por maior que possa ser o prejuízo que daí decorre para ele ou para outrem” . Tentarei mostrar que essa tese não pode ser apoiada com bons argumentos, seja ela interpretada como uma tese relativa aos deveres de direito, seja ela interpretada como uma tese sobre deveres éticos. Para tanto, farei uma reconstrução crítica dos argumentos contidos no artigo de 1797. Saliento que a defesa da improcedência da tese de Kant esposada no artigo sobre o direito de mentir pretende ser uma defesa inspirada nas premissas da filosofia moral kantiana. Acredito que uma interpretação defensável da filosofia jurídica de Kant e do sentido do imperativo categórico permite concluir que mentir a um assassino que pergunta se um amigo nosso e por ele perseguido não se refugiou na nossa casa é tanto jurídica como eticamente justificável
