Balance crítico de la Filosofía Jurídica de H. L. A. Hart

Abstract

El artículo intenta mostrar la existencia de una profunda incoherencia interna en el pensamiento jurídico de Hart. Contiene un breve examen de algunos conceptos centrales de su teoría del Derecho, como los de punto de vista interno, regla de reconocimiento, textura abierta del Derecho, o discrecionalidad judicial. Todos ellos apuntan en una misma dirección, reclamando la apertura del sistema jurídico a otros elementos normativos, como la moral. Contradiciendo esta tendencia inherente a su teoría del Derecho, Hart niega siempre la existencia de cualquier conexión necesaria entre el Derecho y la moral. Esta es precisamente la tesis central del positivismo jurídico, movimiento que Hart defendió tenazmente, pero al que, por esa misma contradicción latente en su pensamiento, dejó profundamente debilitado.This paper tries to prove the existence of a profound internal incoherence within the Hart’s legal thought. It examines some of the central concepts in his theory of law, such as the internal point of view, the rule of recognition, the open texture of law, and the judicial discretion. All these concepts point at the same direction, claiming that the legal system is open to other normative orders, such as morality. Contradicting this inherent tendency in his theory of law, Hart always disclaims the existence of any necessary connection between law and morals. This is also the main thesis of legal positivism, a movement that Hart has tenaciously embraced, but, because of that latent contradiction in his thought, he has left it deeply weakened
