Abstract

Niklas Luhmann developed his sociological theory and ethical reflections following his express rejection of the European philosophical tradition. For Luhmann morality is a special form of communication relating to the question of whether, and under what circumstances, human beings respect or disrespect each other. Accordingly, assumptions regarding an ethical theory should avoid including general principles of any sort. Thus only a casuistic ethical theory oriented closely toward specific problems is feasible. Yet it is doubtful that one can develop any ethical theory in the absence of some relation to a philosophical conception of reality. The concept of morality relates to an order that is understood to be normal, and casuistry in the absence of any principles which are to be applied in the concrete case is difficult to imagine as well. Luhmann entwickelt seine soziologische Theorie und auch seine ethische Reflexionen nach einer ausdrücklichen Ablehnung der europäischen philosophischen Tradition. Moral ist für ihn eine besondere Art von Kommunikation, die sich auf die Frage bezieht, ob und unter welchen Bedingungen Menschen einander achten bzw. mißachten. Wenn man eine Ethik annimmt, dann sollte sie auf jede Art von Prinzipien verzichten. Nur eine casuistische Ethik mit engem Bezug auf Spezialprobleme kann in Betracht kommen. Doch es ist fragwürdig, daß man eine Ethik ohne Bezug auf eine philosophische Auffassung der Wirklichkeit aufbauen kann. Der Problembegriff bezieht sich auf eine als normale verstandene Ordnung, und eine Casuistik ohne Prinzipien, die es im konkreten Fall anzuwenden gilt, ist auch schwer zu denken
