Abstract

Resumo A justiça intergeracional envolve dois tipos de problemas filosóficos: o de indagar se existirá sequer uma justiça entre gerações; e o de identificar o seu conteúdo. Este ensaio aborda o primeiro problema, focando-se na área da Filosofia Política. Divide-se em três partes. Na primeira, serão elencadas as teorias mais recentes da justiça intergeracional no âmbito político, a partir de diferentes perspectivas. Na segunda, serão apresentados alguns dos principais argumentos cépticos à pergunta acerca da existência de justiça intergeracional. Por fim, será dada uma tentativa de resposta através de dois argumentos: o “argumento da temporalidade” e o “argumento da juridicidade modal” . It aims to offer a theoretical defence of the existence of certain constraints and responsibilities that present generations have towards the future. It is divided into three parts. The first contains a brief presentation of the several conceptions in favour of intergenerational justice. The second presents some of the main arguments developed by the sceptical stand on this subject matter. The final part offers two arguments in favour of an empirical conception of intergenerational justice. I will call them ‘the argument from temporality’ and ‘the argument from modal legality’. Together, they make a case for the existence of political and legal constraints on the actions of present people that might affect the lives of future people negatively.
