At this historical moment, few terms are as charged and powerful as the omnipresent term environment. It has become a strategic tool for politics and theories alike, crossed the borders of the disciplines of biology and ecology, and left the manifold field of environmentalism. This article explores the first steps on this path of expansion, in which the term becomes an argumentative resource and achieves a plausibility that transforms it into a universal tool. It is not self-evident to describe ubiquitous (...) media, cinematic spaces, or augmented realities as environments. To understand how the term gained this plausibility, it is necessary to distinguish it from two other terms: the French milieu and the German Umwelt. When these three terms substitute one another and are used as translations, they lose their historical specificity and depth, and three different theoretical and philosophical traditions merge into indifference. Consequently, a conceptual history of the term environment and its relation to milieu and Umwelt—as well as terms such as medium, atmosphere, ambiance, and climate—can help us to understand the potentials and dangers of the term’s plausibility. In this sense, the article argues for a new perspective on epistemologies of surrounding that relate that which surrounds to that which is surrounded. (shrink)

There are legitimate worries about gaps between scientific evidence of brain states and function (for example, as evidenced by fMRI data) and legal criteria for determining criminal culpability. In this paper I argue that behavioral evidence of capacity, motive and intent appears easier for judges and juries to use for purposes of determining criminal liability because such evidence triggers the application of commonsense psychological (CSP) concepts that guide and structure criminal responsibility. In contrast, scientific evidence of (...) neurological processes and function – such as evidence that the defendant has a large brain tumor – will not generally lead a judge or jury to directly infer anything that is relevant to the legal determination of criminal culpability . (Vincent 2008) In these cases, an expert witness will be required to indicate to the fact-finder what this evidence means with regard to mental capacity; and then another inference will have to be made from this possible lack of capacity to the legal criteria for guilt, cast in CSP terms.<br><br>To reliably link evidence of brain function and structure and assessment of criminal responsibility, we need to re-conceptualize the mental capacities necessary for responsibility, particularly those that are recognized as missing or compromised by the doctrines of “legal capacity” (Hart 1968) and “diminished capacity.” I argue that formulating these capacities as executive functions within the brain can provide this link. I further claim that it would be extremely useful to consider evidence of executive function as related to the diminished capacity doctrine at sentencing. This is because it is primarily at this stage in criminal proceedings where the use of the diminished capacity doctrine is most prevalent, as evidenced by the recent Supreme Court cases of Atkins v. Virginia (536 U.S. 304 (2002)) and Roper v. Simmons (543 U.S. 551 (2005)).<br>. (shrink)

It reviews all known evidence for Ficino’s work on the _Elements of Physics_ and _Elements of Theology_, examines new references and fragments of these texts in Ficino’s manuscripts, especially in his personal manuscript of Plotinus’ _Enneads_, and studies how they fit within the Florentine’s philosophical oeuvre. The present case studies (...) of manuscript evidence demonstrate how Proclus accompanied Ficino from his early ‘scholastic background’ through to his mastery of the Platonic tradition late in his career, especially, as is shown, in his study of Pseudo-Dionysius and Plotinus. First-in-human clinical trials represent a critical juncture in the translation of laboratory discoveries. However, because they involve the greatest degree of uncertainty at any point in the drug development process, their initiation is beset by a series of nettlesome ethical questions [1]: has clinical promise been sufficiently demonstrated in animals? Should trial access be restricted to patients with refractory disease? Should trials be viewed as therapeutic? Have researchers adequately minimized risks? The resolution of such ethical questions inevitably turns on (...) claims about future events like harms, therapeutic response, and clinical translation. Recurrent failures in clinical translation, like Eli Lilly's Alzheimer candidate semagacestat, highlight the severe limitations of current methods of prediction. In this case, patients in the active arm of the placebo-controlled trial had earlier onset of dementia and elevated rates of skin cancer [2]. Various authoritative accounts of human research ethics state that decision-making about risk and benefit should be careful, systematic, and non-arbitrary [3]–[5]. Yet, these sources provide little guidance about what kinds of evidence stakeholders should use to ensure their estimates of such events ground responsible ethical decisions. In this article, we suggest that investigators, oversight bodies, and sponsors often base their predictions on a flawed and inappropriately narrow preclinical evidence base. (shrink)

Available evidence highlights the importance of emotion regulation in psychological well-being. However, translation of the beneficial effects of ER from laboratory to real-life remains scarce. Here, we present proof-of-principle evidence from a novel cognitive-emotional training intervention targeting the development of ER skills aimed at increasing resilience against emotional distress. This pilot intervention involved training military veterans over 5–8 weeks in applying two effective ER strategies [Focused Attention and Cognitive Reappraisal ] to scenarios presenting emotional conflicts. Training was (...) preceded and followed by neuropsychological, personality, and clinical assessments, and resting-state functional MRI data were also collected from a subsample of the participants. Results show enhanced executive function and psychological well-being following training, reflected in increased working memory, post-traumatic growth, and general self-efficacy. Brain imaging results showed evidence of diminished bottom-up influences from emotional and perceptual brain regions, along with evidence of normalized functional connectivity in the large-scale functional networks following training. The latter was reflected in increased connectivity among cognitive and emotion control regions and across regions of self-referential and control networks. Overall, our results provide proof-of-concept evidence that resilience and well-being can be learned through ER training, and that training-related improvements manifested in both behavioral change and neuroplasticity can translate into real-life benefits. Evidence-based medicine’s (EBM) quantitative methodologies reflect medical science’s long-standing mistrust of the imprecision and subjectivity of ordinary descriptive language. However, EBM’s attempts to replace subjectivity with precise empirical methods are problematic when clinicians must negotiate between scientific medicine and patients’ experience. This problem is evident in the case of bibliotherapy (patient reading as treatment modality), a practice widespread despite its reliance on anecdotal evidence. While EBM purports to replace such flawed practice with reliable evidence-based methods, this essay (...) argues that its aversion to subjective language prevents EBM from effectively evaluating bibliotherapy or making it amenable to clinical and research governance. This essay addresses the legal meanings of the phrase hefa quanyi, an important Chinese legal phrase that is frequently found in many Chinese laws and legal documents, and whose interpretation is claimed by various scholars to affect the alienability of people’s rights. It first challenges the existing translations of the phrase into Italian and English. It secondly delves into its history and etymology, studying the legal meanings that the phrase has had in the various texts of the Constitution of China. (...) It is suggested that hefa quanyi is not the semantic and legal equivalent of Western ‘rights and interests’, but rather that the phrase retains its etymological meaning of ‘power and negatively-connoted profit’. It is further argued that the adjective hefa in the phrase is used to impose constraints on the rights and interests that the Chinese people are entitled to. (shrink)

Previous studies that explored the impact of task-related variables on translation performance focused on task complexity but reported inconsistent findings. This study shows that, to understand the effect of task complexity on translation process and its end product, performance in translation tasks of various complexity levels needs to be compared in a specific setting, in which more factors are considered besides task complexity—especially students’ translating self-efficacy belief. Data obtained from screen recording, subjective rating, semi-structured interview, and quality (...) evaluation were triangulated to measure how task complexity influenced the translation performance of Chinese students with high and low TSEB. We found that the complex task led to significantly longer task duration, greater self-reported cognitive effort, lower accuracy, and poorer fluency than the simple one among students, irrespective of their TSEB level. Besides, the high-TSEB group outperformed the low-TSEB group in translation accuracy and fluency in both tasks. However, the interaction effect of task complexity and TSEB was not significant, due possibly to weak problem awareness among students. Our study has implications for effectively designing task complexity, getting the benefits of TSEB, and improving research on translation performance. (shrink)

Thoroughgoing relativists typically dismiss the realist conviction that competing theories describe just one definite and mind-independent world-structure on the grounds that such theories fail to be relatively translatable even though they are equally correct. This line of argument allegedly brings relativism into direct conflict with the metaphysics of realism. I argue that this relativist line of reasoning is shaky by deriving a theorem about relativistic inquiry in formal epistemology—more specifically, in the approach Kevin Kelly has dubbed “logic of reliable inquiry”. According to the theorem, two scientists, who share some background knowledge but follow different appropriately reliable methods, will converge to relatively formally translatable competing theories, even if meaning, truth, logic and evidence are allowed to vary in time depending on each scientist’s conjectures, actions, or conceptual choices. Some final remarks on the relevance of the theorem to the incommensurability thesis that has vexed twentieth century philosophy of science are adduced. (shrink)

Evidence-based medicine has been rapidly and widely adopted because it claims to provide a method for determining the safety and efficacy of medical therapies and public health interventions more generally. However, as others have noted, EBM may be riven through with cultural bias, both in the generation of evidence and in its translation. We suggest that technological and scientific advances in medicine accentuate and entrench these cultural biases, to the extent that they may invalidate the evidence (...) we have about disease and its treatment. Evidence-Based Medicine (EBM) developed from the work of clinical epidemiologists at McMaster University and Oxford University in the 1970s and 1980s and self-consciously presented itself as a "new paradigm" called "evidence-based medicine" in the early 1990s. The techniques of the randomized controlled trial, systematic review and meta-analysis have produced an extensive and powerful body of research. They have also generated a critical literature that raises general concerns about its methods. This paper is a systematic review of the critical (...) literature. It finds the description of EBM as a Kuhnian paradigm helpful and worth taking further. Three kinds of criticism are evaluated in detail: criticisms of procedural aspects of EBM (especially from Cartwright, Worrall and Howick), data showing the greater than expected fallibility of EBM (Ioaanidis and others), and concerns that EBM is incomplete as a philosophy of science (Ashcroft and others). The paper recommends a more instrumental or pragmatic approach to EBM, in which any ranking of evidence is done by reference to the actual, rather than the theoretically expected, reliability of results. Emphasis on EBM has eclipsed other necessary research methods in medicine. With the recent emphasis on translational medicine, we are seeing a restoration of the recognition that clinical research requires an engagement with basic theory (e.g. physiological, genetic, biochemical) and a range of empirical techniques such as bedside observation, laboratory and animal studies. Enargeia became a technical term –to which Cicero coined the neologism evidentia for its translation– in the Hellenistic Epistemology, so it seems, beginning from Epicurus. In his analysis of the perceptive evidence he developed a relevant reformulation of the nature of perceiving and the Aristotelian typology of sensibilia which bases the truth of perception on the autonomy and opacity of each one of the senses in relation to the rest of the senses and other faculties such as memory (...) or reason. Sextus Empiricus objected to this type of approach that every perceptive act entails synthesis, in which memory or reason get involved, and requires the affection, which comes between perception and object, and makes the perceptive evidence another case of inference through signs. Elite athletes, coaches and high-performance staff are exposed to a range of stressors that have been shown to increase their susceptibility to experiencing mental ill-health. Despite this, athletes may be less inclined than the general population to seek support for their mental health due to stigma, perceptions of limited psychological safety within sport to disclose mental health difficulties and/or fears of help-seeking signifying weakness in the context of high performance sport. Guidance on the best ways to promote mental health within (...) sporting environments is increasing, though current frameworks and position statements require greater focus on a whole of system approach, in which the needs of athlete, coaches and high-performance staff are considered within the context of the broader ecological system in which they operate and perform. This paper synthesizes existing research, reviewed for translatability by mental health professionals working in elite sport, to provide an evidence-informed framework with real world utility to promote mentally healthy environments for all stakeholders in elite sporting organizations, from athletes through to administrators. Recommendations are provided to positively impact the mental wellbeing of athletes and support staff, which may in turn influence athletic performance. This framework is intended to provide sporting organizations with evidence-informed or best practice principles on which they can develop or progress their policies to support mental health promotion and prevent the onset of mental health difficulties. It is intended that the framework can be adapted or tailored by elite sporting organizations based upon their unique cultural, contextual and resourcing circumstances. (shrink)

The emergent Coronavirus Disease 2019 caused by the Severe Acute Respiratory Syndrome Coronavirus 2 could produce a maternal immune activation via the inflammatory response during gestation that may impair fetal neurodevelopment and lead to postnatal and adulthood mental illness and behavioral dysfunctions. However, so far, limited evidence exists regarding long-term physiological, immunological, and neurodevelopmental modifications produced by the SARS-CoV-2 in the human maternal-fetal binomial and, particularly, in the offspring. Relevant findings derived from epidemiological and preclinical models show that a (...) MIA is indeed linked to an increased risk of neurodevelopmental disorders in the offspring. We hypothesize that a gestational infection triggered by SARS-CoV-2 increases the risks leading to neurodevelopmental disorders of the newborn, which can affect childhood and the long-term quality of life. In particular, disruption of either the maternal or the fetal cholinergic anti-inflammatory pathway could cause or exacerbate the severity of COVID-19 in the maternal-fetal binomial. From a translational perspective, in this paper, we discuss the possible manifestation of a MIA by SARS-CoV-2 and the subsequent neurodevelopmental disorders considering the role of the fetal-maternal cytokine cross-talk and the CAP. Specifically, we highlight the urgent need of preclinical studies as well as multicenter and international databanks of maternal-fetal psychophysiological data obtained pre-, during, and post-infection by SARS-CoV-2 from pregnant women and their offspring. Among the more peculiar literary papyri uncovered in the past century are numerous bilingual texts of Virgil and Cicero, with the Latin original and a Greek translation arranged in distinctive narrow columns. These materials, variously classified as texts with translations or as glossaries, were evidently used by Greek-speaking students when they first started to read Latin literature. Four chapters survive of a supposed translation of the Suvar?a-prabh?sottama-s?tra by Param?rtha. Versions of these chapters are also found in a later Chinese version of the s?tra by Yijing. In earlier work, I have argued that these chapters were most likely composed in China, basing my argument upon extensive verbatim correspondences between these chapters and a number of earlier Chinese texts. However, a significant obstacle still stands in the way of this thesis. A Tibetan version of the s?tra also (...) includes the same chapters, and Tibetan tradition holds that this version is a translation from Sanskrit. Here, I examine evidence that suggests that these portions of Tib II might in fact be translations from Chinese, despite the reports of Tibetan bibliographers. First published in English in1966, _The True and The Evident_ is a translation of Franz Brentano’s posthumous _Wahrheit und Evidenz_, edited by Oscsar Kraus. The book includes Brentano’s influential lecture "On the Concept of Truth", read before the Vienna Philosophical Society, a variety of essays, drawn from the immense wealth of Brentano’s unpublished material, and letters written by him to Marty, Kraus Hillebrand, and Husserl. Brentano rejects the familiar versions of the "correspondence theory of truth" and proposes to define (...) the true in terms of the evident. The expression of physical motion (the spider crawls across the net) and metaphorical motion (the fear crawls across her heart) shows strong inter-typological differences between language types (German, an S-language vs. Spanish, a V-language) and more subtle intra-typological differences within a language type (German vs. Polish, both S-languages). However, we know relatively less about the extension of these patterns to translated texts. In this study, we focused on physical and metaphorical motion descriptions in written texts in original language and their (...) translations to a language that belongs to the same or a different typological group, to determine whether motion expression in translated texts shows the same patterns of inter-typological and intra-typological variability as it does in original texts. We investigated this question by extracting 450 physical motion (150/language) and 450 metaphorical motion (150/language) descriptions from novels originally written in German, Polish, or Spanish and their translations to typologically different (i.e. inter-typological; German to Spanish, Spanish to German) or typologically similar (i.e. intra-typological; German to Polish, Polish to German) languages. Our results provided evidence for similar patterns of strong inter-typological and more subtle intra-typological variability in translations akin to those observed in original texts – with translated texts largely following the patterns of the target language in their expression of physical and metaphorical motion. Our results also highlighted specificity of event expression in a language as an important factor in the attainment of target language patterns in translated texts. (shrink)

The past fifty years have witnessed the flourishing of scholarship in virtually every area of ancient Greek philosophy, but the sophists have for the most part been neglected. This is certainly true of Prodicus of Ceos: of the four most well-known sophists--Protagoras, Gorgias, Prodicus, and Antiphon--he has received the least attention. Robert Mayhew provides a reassessment of his life and thought, and especially his views on language, religion, and ethics. This volume consists of ninety texts with facing translations--far more than (...) have appeared in any previous edition--and provides the first commentary on the extant evidence for Prodicus' life and thought. In this text, which employs the analytic-comparative method, we read the Poetics of Aristotle in a new way to take an example of translation as an artistic creation. We can present the result of the essay as a metaphor called “the art of translation”, and then we refer to four evidences which can support our metaphor: reading the text as seeing the world, understanding the meaning as perceiving the main action, representing the text as recreating an image, and (...) word making as the art of poetic. If we want to explain the useful dimension of our research, it can be said: every translation has a moral dimension which depends on its imitation of the author’s line and reader’s culture, and also has an artistic dimension that attends to the beauty of text and new vision of culture. According to Moderation theory of Aristotle, an ideal intercultural translation sees the right of author and reader by the equal criterion. Then it shows a production that is combined with “representation”, a term which can embrace the beauty and ethic in the art of translation. Mimesis in art and translation As Aristotle has said about art and poetry, they are based on Mimesis or imitation. It means that he believes art is Mimesis. But his theory about this issue is totally different to Plato’s thought. He thinks that Mimesis is not imitation of Ideas as Plato thought. Mimesis in his thought is imitation from the existence, aspect or form of things in this world. So he emphasizes that Mimesis is imitation of something or maybe happenings outside of man. After collecting all of Aristotle’s thoughts, especially about poetry, it seems clear that the imitation or Mimesis is a representation of the subject of imitation in which sometimes the subject of imitation has been represented better than its fact, like tragedy, and sometimes worse, like Comedy. It seems that we can see translation as imitation, understanding the latter as in Aristotle’s conception of art mentioned above. Indeed, a translator at the beginning of is translation process looks at the text deeply and tries to understand it as well as possible. After that, he thinks about the value of translations. In this step, if the text has repeatability in other languages and cultures, the translator starts the imitation from an original text to create another text. It seems that this process is like what an artist does to create artworks. 2. resemblances between art and translation On the basis of Aristotle’s Poetics, we want to explain some resemblances between art and translation to describe our conception of translation as an art. We think those resemblances can convince us to see translation as an art. The first resemblance between creation of artworks and translation is at the first step of them. The first resemblance between the artistic creation and translation is in their first step. Viewing the environment and finding something for imitation is the first step of artistic creation, which is like confronting and reading a text for translation. It is clear that viewing the environment deeply and reading a text carefully are necessary for artistic creation and translation because a surface of them cannot be suitable and helpful for Mimesis or imitation. The second step of artistic creation and translation is the accurate understanding of the subject of imitation. In Fact, deep and accurate understanding is necessary for exact imitation. Without comprehensive understanding, imitation of things is not possible. Both artist and translator in the process of imitation should take this step. In the other words, it seems that by deep and exact understanding they can find the direction of similarity between subject of imitation and artwork or translated text. Rewriting text in a new language like representing an image is the third step of imitation that is visible in the process of artistic creation and translation. In this step, combining their understanding and viewing the environment, translator and artist try to create the subject of imitation in a new style and a new form. The last step of imitation in artistic creation and translation is that of choosing colors in art and words and other literary elegances in translation, and using them. In this step, paying attention to details of their work, artist and translator try to create a new thing that is similar to the subject of imitation, although it is a new thing and there may be some differences between them. As was stated, the understanding of the subject of imitation by artist and translator is a very important step, in which, however, their thought of the subject of imitation is not totally the same as it, and so, during creating the new thing their understanding and thought can affect the form and the style of the new thing. 3. conclusion In conclusion, it seems that, because of the similarity between art and translation based on Aristotle’s conception of art, we can move from ethical and aesthetic functions of art, and artist’s moral duty in creating art, to the same aspects in translation and translator. In other words, based on Aristotle conception, while translator makes a faithful imitation and a creative presentation of the source, after the ethical decision to translate and promote the original text, he should pay attention to linguistic and cultural details of his translation. In this regard, while observing his audience in the target language, he also refreshes his insights and attitudes because this two-sided view, the center of gravity of moderation, will take into account the aspects of beauty and ethics in the cultural interactions of societies. The objective of the study was to translate and validate the COVID Stress Scales into Spanish in Peru. Around 1,424 people, selected through a non-probabilistic sampling, participated in the study. Factor analysis confirmed an initial six-dimensional factorial structure of the CSS-36. Reliability by internal consistency was good for the dimensions of fear of danger, socioeconomic consequences, xenophobia, fear of contamination, traumatic stress, and compulsive control. In addition, the factorial structure of scale has been shown be strictly invariant for both males (...) and females. The Spanish version of the CSS-36 has evidence of validity, reliability, and invariance to measure COVID-19 stress in a Peruvian sample. (shrink)

Can music be considered a language of the emotions? The most common view today is that this is nothing but a Romantic cliché. Mainstream philosophy seems to view the claim that 'Music is the language of the emotions' as a slogan that was once vaguely defended by Rousseau, Goethe, or Kant, but that cannot be understood literally when one takes into consideration last century’s theories of language, such as Chomsky's on syntax or Tarski's on semantics (Scruton 1997: ch. 7, see (...) also Davies 2003: ch. 8, and Kania 2012). In this chapter, I will show why this common view is unwarranted, and thus go against nowadays philosophical mainstream by defending what I call the musicalanguage hypothesis. In Section 1, I will introduce the musicalanguage hypothesis and present, based on empirical evidence, some of the many similarities between language and music and explain why we should take them seriously. I will introduce a framework that aims to explain the communicative power of music using what we already know about linguistic communication (1.1). I will then outline several working hypotheses about musical grammar, musical meaning, and affective meaning (1.2), and thus defend that music is indeed very close to literally be a language of the emotions. In Section 2, I will detail some of the methodology, expectations, and preliminary results of a cross-cultural study on musical grammar that I am presently conducting between South India (Chennai) and Switzerland (Geneva and Lausanne)4. This empirical study focuses on two musical idioms and their grammatical features: Western classical music of the Common Period (ca. 1600-1900) and South Indian classical music (also know as Carnatic music). In this issue of the Hastings Center Report, Jonathan Kimmelman and Alex London argue that in assessing the success of clinical translation, it is narrow‐minded to focus only on how many new drugs get licensed and how quickly they achieve licensure. Kimmelman and London show that clinical translation should be judged on its ability to generate as comprehensive an intervention ensemble as possible for the tested interventions. I would like to extend Kimmelman and London's position in two ways. (...) First, I would argue that in the current environment, failures should be seen not just as acceptable, but probably as the most useful outcomes that translational research efforts can offer. Second, an intervention ensemble probably cannot be generated with information only about the drug or drugs produced by a single company. For most conditions and diseases, there are already a large number of other interventions whose use is supported or contradicted by various levels of evidence. (shrink)

In response to those who treat gender as an endlessly mutable fiction, performance, or facade Serano says:Sure, I can perform gender: I can curtsy, or throw like a girl, or bat my (...) eyelashes. But performance doesn’t explain why certain behaviors and ways of being come to me more naturally than others. It offers no insight into the countless restless nights I spent as a pre-teen wrestling with the inexplicable feeling that I should be female. It doesn’t capture the very real physical and emotional changes that I experienced when I hormonally transitioned from testosterone to estrogen. (Serano 2010, 85–86)My first reaction to this understanding of performativity was to get defensive, immediately thinking of all the ways in which it reflects a poor reading of Judith Butler and is an incorrect use of the concept. Yet, to make that argument would mean arriving late to the party. Many theorists, notably Jay Prosser and Viviane Namaste, have made similar arguments about performativity to which Butler and many others have responded. I am not interested in joining this debate by defending or critiquing performativity; instead, I want to take seriously Serano’s criticism of the way performativity functions as a “mantra” for [End Page 84] “queerer-than-thou hipsters” (Serano 2010, 87). The fact is, concepts that help people make sense of their experience are often taken up piecemeal. They gain traction, get printed on posters, discussed in safe-spaces, taught in intro classes, and yelled at parents. They take on a life of their own and are queered again and again. It may not be anyone’s fault that performativity has come to signify a kind of insincerity, detachment from the body, linguistic constructionism, or a play of surfaces, but for many people this is exactly what it means. What follows is inspired by the questions at the heart of Serano’s poem: “Can’t we find new ways of speaking? Shouldn’t we be championing new slogans that empower all of us, whether trans or non-trans, queer or straight, female and/or male and/ or none of the above?” (Serano 2010, 87). I depart slightly from Serano insofar as I am not interested in replacing performativity as a concept. Instead, I am interested in locating other concepts that could be useful in understanding and communicating our multiple experiences of gender.Serano’s concern is not only the depth and conviction with which she experiences gender, but also the communicability of this conviction. We are social beings. We seek out the company of other people, animals, and objects. In order to flourish we need to feel understood by our surroundings. We are creatures that need to be connected, and connection requires translating our subjective experiences into a communicable, socially understandable register. How does this translation occur? How do we make ourselves understandable? What external forces regulate or influence this translation? And, crucially, how can we construct philosophical concepts that do justice to our need to feel that our interior selves are understood? What concept could we cast out into the world that might answer Serano’s call for new ways of speaking? What follows is an attempt to think through this question by looking at the relationship between the medicalization of trans people, Michel Foucault’s writings on parrhesia, and coming out.The first half of this essay examines the ways in which the medical apparatus that manages transitioning attempts to control transsexual coming-out narratives, an example of what Foucault calls biopower. I argue that the medicalization of transitioning has created a legible transsexual identity structured on the distance between our interiority and the world external to the self. The trans person’s claims about their interior sense of self are the only evidence needed to access medical technologies such as hormone therapy or surgery. We suggest that in the particular context of medical education, ethics can be considered in a similar way to other kinds of knowledge that are categorised and shaped by academics in the context of wider society. Moreover, the study of medical ethics education is translational in a manner loosely analogous to the study of medical education as adjunct to translational medicine. Some have suggested there is merit in the idea that much as translational research attempts to connect the laboratory scientist's (...) work to its implications for patient care, translational ethics focuses on bringing ethics scholarship into the sphere of personal and public action. We distinguish the term ‘translational ethics’ (the study of ethics being translated between academy, classroom and clinic) from other prominent definitions in the bioethics literature. To do this, we build off a notion of knowledge translation that focuses on the nonlinear movement of information that comes to professionals through multiple competing sources. We suggest that this knowledge, and particularly knowledge about ethics, becomes embodied by the individual. It is through a reflective practice that internally embedded ethics knowledge might be modified, and this work might be best carried out with a moral community that maintains a sense of practical wisdom. Applying this translational approach to the study of medical ethics education can be both academically relevant and practically useful. This view of translation can help bridge the evident, multidirectional relationships between research, education and performance. It might also create further opportunities to develop medical ethics education theory. (shrink)

The application of evidence-based medicine helps clinicians avoid unnecessary procedures and decreases unnecessary harm for future patients while sparing economic burdens. Randomised controlled trials most accurately produce best research evidence. In arthroscopic surgery, however, many procedures have been extensively used without supportive evidence verified with RCTs. In this paper, we introduce two procedures, where over 30 years of procedure usage has continued prior to garnering evidence for the inefficacy of the procedures. The situations are attributed to (...) the fact that clinical trials in arthroscopic surgeries are challenging given the use of placebo controls. A placebo-control RCT can accurately answer research questions about efficacy and safety of surgical procedures; however, the majority of arthroscopic surgeries in practice have not been rigorously tested against placebo surgeries. This is because preparing surgical placebo controls, known as sham surgeries, are ethically controversial. Also considering that high-quality study results often do not change clinical practice due to insufficient knowledge translation, the benefits of such trials may be uncertain to society at large. Additionally, there are a lack of clear guidelines for conducting arthroscopic placebo surgeries in RCTs. We hope that this article helps drive discussion about appropriate use of placebo surgeries in RCTs to produce the best quality evidence in arthroscopic surgery. (shrink)

BackgroundThe public and healthcare workers have a high expectation of animal research which they perceive as necessary to predict the safety and efficacy of drugs before testing in clinical trials. However, the expectation is not always realised and there is evidence that the research often fails to stand up to scientific scrutiny and its 'predictive value' is either weak or absent.DiscussionProblems with the use of animals as models of humans arise from a variety of biases and systemic failures including: (...) 1) bias and poor practice in research methodology and data analysis ; 2) lack of transparency in scientific assessment and regulation of the research; 3) long-term denial of weaknesses in cross-species translation; 4) profit-driven motives overriding patient interests; 5) lack of accountability of expenditure on animal research; 6) reductionist-materialism in science which tends to dictate scientific inquiry and control the direction of funding in biomedical research.SummaryBias in animal research needs to be addressed before medical research and healthcare decision-making can be more evidence-based. Research funding may be misdirected on studying 'disease mechanisms' in animals that cannot be replicated outside tightly controlled laboratory conditions, and without sufficient critical evaluation animal research may divert attention away from avenues of research that hold promise for human health. The potential for harm to patients and trial volunteers from reliance on biased animal data1 requires measures to improve its conduct, regulation and analysis. This article draws attention to a few of the many forms of bias in animal research that have come to light in the last decade and offers a strategy incorporating ten recommendations stated at the end of each section on bias. The proposals need development through open debate and subsequent rigorous implementation so that reviewers may determine the value of animal research to human health. Understanding learners’ translating self-efficacy belief helps predict their ability to cope and translation performance during their career. Despite this connection, the assessment of self-efficacy during learning has been largely overlooked in translation research. The purpose of this study was to develop and validate an instrument to examine belief in self-efficacy in a sample of Chinese translation learners. Scale items were collected and refined based on an expert-panel consensus opinion. Exploratory factor analysis and confirmatory factor analysis across two (...) independent samples revealed and validated a three-dimensional structure: efficacy in internal competence, efficacy in psycho-physical competence, and efficacy in external competence. These findings provide supporting evidence for scale applications in educating translators. (shrink)

Jnanasri argues: whatever does not reveal reliably presence or absence of something does not have that thing as the content. For example, perception of a cow does not reveal presence or absence of a horse and does not also have a horse as the content. The point is that perception does not provide reliable evidence for external objects for perception does not reveal reliably their presence or absence and does not have them as the content. Udayana claims that the (...) general premise is false. Something may be perceived and be the content even if it is not revealed where it is present or absent (as is the case in the Nyaya view in misperception). Further, it has been argued that a substance and its features are different and that a substance may be the content of perception or be perceived even if some or most of its features are not perceived. Since these positions are argued for and not refuted, Jnanasri has made gratuitous assumptions. (shrink)

In 1993, an astonishing discovery was made at a tomb in Guodian in Hubei province (east central China). Written on strips of bamboo that have miraculously survived intact since 300 B.C., the "Guodian Laozi," is by far the earliest version of the _Tao Te Ching_ ever unearthed. Students of ancient Chinese civilization proclaimed the text a decisive breakthrough in the understanding of this famous text: it provides the most conclusive evidence to date that the text was the work of (...) multiple authors and editors over hundreds of years, rather than the achievement of a single individual writing during the time of Confucius. Robert Henricks now presents the first English translation of the "bamboo slip Laozi." Differing substantially from other versions we have of the text, the Guodian Laozi provides us with clues on how and when the text came into being. As Henricks's translation shows, many chapters are missing in this form of the text, and some chapters remain incomplete. All of this seems to suggest that the _Tao Te Ching_ was not yet "complete" when these slips were copied. In his translation, Henricks focuses attention on lines in each of the chapters that vary from readings in other editions. In addition, he shows how the sequence of chapters in this form of the text is totally unrelated to the sequence readers commonly see in the "standard" form of the text, i.e., in other translations. Here are just a few of the noteworthy features of this new _Tao Te Ching:_ • A lucid introduction to the Guodian Laozi, offering background on the archaeological interpretation of the discovery • Line-by-line comparisons of the Guodian Laozi against the Mawangdui and Wang Bi editions • Extensive notes on each chapter describing the unique elements of the Guodian Laozi in comparison with other versions • Transcriptions for each chapter, noting both the ancient and modern form of the characters in the chapter • An appendix featuring the official biography of Laozi written by Sima Qian, the Grand Historian of China, as well as Henricks's commentary and notes on this biography This groundbreaking work will lead to a reassessment of the history and significance of this well-known and critical work as well as a reevaluation of the role it played in the development of Taoism in early China. The main aim of this paper is to present the results of a job satisfaction survey conducted on a group of Polish sworn translators. The first part of this paper discusses the state of the art of sociology of translation as well as providing a definition of job satisfaction. Then, the author of the paper moves on to the presentation of the research procedure: the methodology, the limitations of the study, the results and a discussion about the findings. This (...) study presents evidence suggesting that Polish sworn translators experience a high level of job satisfaction. Nevertheless, due to research limitations, further studies on this topic are recommended before the issue of job satisfaction among sworn translators is more clearly understood. (shrink)

In place of the traditional epistemological view of knowledge as justified true belief we argue that artificial intelligence and law needs an evidence-based epistemology according to which scientific knowledge is based on critical analysis of evidence using argumentation. This new epistemology of scientific evidence (ESE) models scientific knowledge as achieved through a process of marshaling evidence in a scientific inquiry that results in a convergence of scientific theories and research results. We show how a dialogue interface (...) of argument from expert opinion, along with its set of critical questions, provides the argumentation component of the ESE. It enables internal scientific knowledge to be translated over into a wider arena in which individual nonexpert citizens and groups can make use of it. The external component shows how evidence is presented and used in a legal procedural setting that includes fact-finding, weighing the credibility of expert witnesses, and critical questioning of arguments. The paper critically reviews the standards of admissibility of scientific evidence using the ESE. (shrink)
