This essay examines the use of fictions in the reasoning of the House of Lords and United Kingdom Supreme Court in the context of two recent lines of authority on English tort law. First, the essay explores the relevance of counter-factual scenarios to liability in the tort of false imprisonment, in the light of the Supreme Court decisions in Lumba and Kambadzi. The second series of decisions is on causation in negligence claims arising from asbestos exposure. These cases have revealed (...) fundamental, ongoing judicial disagreement about the nature and extent of the exceptions made to general principles. The cases are also shown to lend force to Del Mar’s argument about the diachronicity of legal fictions. Overall, it is argued that such fictions play an important role in common law reasoning. Nurses have moral obligations incurred by membership in the profession to participate knowingly in health policy advocacy. Many barriers have historically hindered nurses from realizing their potential to advance health policy. The contemporary political context sets additional challenges to policy work due to polarization and conflict. Nursing education can help nurses recognize their role in advancing health through political advocacy in a manner that is consistent with disciplinary knowledge and ethical responsibilities. In this paper, the authors describe an exemplar of (...) Elizabeth Barrett's “Power as Knowing Participation in Change” theory as a disciplinary lens within a doctoral nursing health policy course. Barrett (radically) emphasizes “power as freedom” instead of “power as control.” This approach is congruent with nursing disciplinary values and enhances awareness of personal freedom and building collaborative relationships in the policy process. The theory was used in concert with other traditional policy content and frameworks from nursing and other disciplines. We discuss the role of nursing ethics viewed as professional responsibility for policy action, an overview of Barrett's theory, and the design of the course. Four student reflections on how the course influenced their thinking about policy advocacy are included. While not specific to policymaking, Barrett's theory provides a disciplinary grounding to increase students' awareness of freedom and choices in political advocacy participation. Our experience suggests that Barrett's work can be fruitful for enhancing nurses' awareness of choices to participate in change across settings. (shrink)

This paper offers a brief reply to William Morgan’s critique of my review of Andrei Marmor’s Social Conventions . Morgan’s principal critique is that I am wrong to think that the constitutive rules of games do not determine their aims and values. In particular, with regards to chess, Morgan argues that the rules of chess determine that the aim of playing chess is to win the game. I defend my position that one can play the game of chess without (...) the aim of winning - e.g. one can aim to play beautifully, and not, as Morgan suggests, only to win beautifully. More broadly, I argue for an account of games that is sensitive to the gap between playing and the game’s constitutive rules. Ultimately, the argument points to the descriptive priority for the social sciences of the concept of ‘play’ over the concept of games understood as ‘rule-governed domains’. (shrink)

This is an examination of an avian-shaped feature that rests below a network of cellular structures found on a mound within the Argyre Basin of Mars. The area examined is located near 48.0° south and 55.1° west. A set of four supportive images provided by the Mars Global Surveyor and Mars Reconnaissance Orbiter spacecraft show the feature is persistent over a period of more than 20 years. The images reveal defining aspects of this avian feature, including a head, beak, body, (...) eye, legs, feet, toes, wing, and feathers. When taken together, these components induce the visual impression of an avian-shaped formation that exhibits a unique set of proportional features. The claim of artificial construction is offered and the geoscientist author will examine natural mechanisms that could contribute to the creation of this feature and the testimony of three veterinarians will provide a critical analysis of the avian features. A terrestrial comparison of aesthetic and iconographic motifs is investigated. The request for further study and additional images of these structural components are also encouraged. (shrink)

In a recent article in this journal, Del Mar offered two main criticisms of Marmor’s account of social conventions. The first took issue with Marmor’s claim that the constitutive rules of games and kindred social practices determine in an objective way their central aims and values; the second charged Marmor with scanting the historical context in which conventions do their important normative work in shaping the goals of games. I argue that Del Mar’s criticism of Marmor’s account of the normative (...) centrality and force of constitutive rules in games and the like fails, but that his criticism faulting Marmor for giving short shrift to the normative work conventions do in these social practices is on the mark. So while I reject Del Mar’s claim that a closer look at the social and historical contexts in which the conventions of games and the like carry out their normative tasks undermines Marmor’s account of constitutive rules, I think his argument that conventions play a far more important, even if supplementary, role in shaping our understanding of and participation in these social practices than Marmor allows is persuasive. This article seeks to adumbrate something of an ascending complement to Blondel's descending Christology. For Blondel, the Word as Incarnate is not only the Redeemer but is also he in whom creation is constituted. Christ's synthesizing perception of creation mediates between the world and the creating Absolute and establishes things as real. Blondel's 'Panchristism' suggests that in his passive perception Christ is the keystone that solidifies and integrates even the most ignoble components of creation. In the current economy this passive (...) perception embraces the world as marred by sin. The way in which sin assumed by Christ in suffering and passivity is transformed in redemption is left underdeveloped, however. One aspect of a Christology that ascends from the sufferings of Christ is highlighted in reference to Blondel's own devotion to the Sacred Heart. This devotion illuminates an integration of sin and suffering into glory that is compatible with Blondel's thought. (shrink)

Some lower primates sort themselves, with alpha males beating their chests, feeding first, and claiming privileged mating rights. We humans would like to think we are above (...) such vulgar displays, yet a quick glance at Neptune or at our own town reveals that we may be more subtle, but only a little. Where we fit in, what our status is, matters. It matters to the way others treat us, but, maybe more importantly, it matters to the way we think of ourselves. The last decade has witnessed a particularly intensive debate over methodological issues in legal theory. The publication of Julie Dickson's Evaluation and Legal Theory (2001) was significant, as were collective returns to H.L.A. Hart's 'Postscript' to The Concept of Law. While influential articles have been written in disparate journals, no single collection of the most important papers exists. This volume - the first in a three volume series - aims not only to fill that gap but also propose a systematic (...) agenda for future work. This is a description of an avian-shaped feature that rests below a network of cellular structures found on a mound within the Argyre Basin of Mars in Mars Global Surveyor image M14-02185, acquired on April 30, 2000, and released to the public on April 4, 2001. The area examined is located near 48.0° South, 55.1° West. The formation is approximately 2,400 meters long from the tip of its beak to the tip of its farthest tail feather. There is a minimum (...) of six different variations in appearance of the surface material over this small area. Utilizing the public targeting request form provided on the Mars Global Surveyor (MGS) website, co-author Miller secured a second image of the area that was obtained on July 3, 2006, showing this feature under different conditions S20-00165. The new image was then released to the public on August 11, 2006. A third image of the formation identified as MGS S13-01480 was acquired on December 15, 2005, and although officially processed on June 20, 2006, it was not made available to the public until August 22, 2009, on NASA’s Planetary Data System (PDS) website. All three of the MGS images reveal defining aspects of this avian feature, including a head, beak, body, eye, leg, foot, toes, wing, and feathers. When taken together, these components induce the visual impression of an avian-shaped formation that exhibits a unique set of proportional features. Adjoining this formation is a composite of complex cellular features that form a compartmentalized infrastructure. The three authors who are veterinarians provide a critical analysis of the avian features, and the geologist and geoscientist authors examine natural mechanisms that could contribute to the formation of this feature. An extensive search of comparable regions within and beyond the area of the Argyre Basin was conducted. A list of these sites is provided, and terrestrial comparisons are also offered. (shrink)

There is a growing resurgence in the study of psychedelic medicines for the treatment of mental health and substance use disorders. However, certain early investigations are marred by questionable research methods, abuses against research participants, and covert Central Intelligence Agency financial involvement. The purpose of this study was to understand how and to what extent people of colour and other vulnerable populations, specifically, individuals who were incarcerated or incapacitated due to mental health issues, were exploited during the first wave of (...) psychedelic research in the USA. To do so, we reviewed available empirical publications according to current ethical standards. Variables of interest included race and ethnicity of participants, population vulnerability, drug administration conditions, informed consent and undue influence. Our findings draw attention to the history of research abuses against people of colour in Western psychedelic research. In light of these findings, we urge a call-to-action to current psychedelic researchers to prioritise culturally inclusive and socially responsible research methods in current and future studies. For at least 50 years science fiction’s dangerousness has sprung largely from its leaps into the transgressive. But something has now changed; the biggest problem today for anyone trying to create dangerous science fiction is that in the developed countries we now live largely in a libertarian, post-transgressive culture. There is, however, at least one target for science fiction that grows increasingly dangerous; the border between scarcity and post-scarcity. This danger is perhaps best realized in the great Mars trilogy by (...) Kim Stanley Robinson, which not only imagines a bridge from our current scarcity-based culture to a post-scarcity culture, but also shows people building this very bridge up from the foundations of our life today. Perhaps more dangerously, he then follows Marcuse and Mumford in envisioning not only an end to the economic problem of poverty but also to the social, anthropological and psychical forces of scarcity, showing step-by-step the dramatic changes in psychology, values and lives that post-scarcity would bring. And so, like certain tales by Plato and Tolstoy, it is a ‘threshing tale’, a tale that forces us into an imaginative confrontation with our current values, intending to winnow the false from the true. This epic sets out to alter the way we see ourselves and our social sphere, hoping – like William Blake – that altering the eye alters all; perhaps nothing but such a plausible, non-utopian and social vision of life in post-scarcity can be truly dangerous to the way we now think, love, work and war.
