El presente artículo se propone mostrar la versatilidad de la concepción hegeliana sobre la “positividad” del derecho y, a través de ella, su pretensión de lograr una mediación filosófica entre las concepciones éticas y políticas enfrentadas en la modernidad. Es muy revelador que Hegel haya empleado dicha expresión en un doble sentido: no sólo para cuestionar la pura normatividad de las teorías modernas de la libertad racional, sino igualmente para criticar las formas anquilosadas de realización institucional de las formas de (...) vida ética en la historia. Analizaremos esta doble vertiente de la concepción de la positividad en Hegel, en primer lugar, tomando como referencia su polémica con la Escuela histórica del derecho y, en segundo lugar, evocando su cuestionamiento de las teorías modernas del derecho natural. Creemos que hay allí una lección perdurable acerca de la necesidad de buscar formas de mediación entre normatividad y realismo en la filosofía política. (shrink)

El interés del debate es poner al descubierto los límites inmanentes de la civilización liberal como fuente de ideas para la filosofía moral. El derrumbe del socialismo pareció darle la razón al liberalismo, no obstante la crítica continuó, desde su propio terreno, por parte de los comunitaristas. Éstos le critican sus efectos de desintegración social y de encubrimiento ideológico para la cruda realidad que le toca vivir al individuo en la sociedad de mercado. Tres son los puntos criticados: el individualismo, (...) el formalismo moral, y la indiferencia ante el arraigo comunitario de la vida humana. Sin embargo el liberalismo tiene un punto fuerte: hace más viable la búsqueda de formas de relación humana transnacionales e interculturales, donde el reconocimiento recíproco resulta más equitativo, pues salva al estado democrático de derecho sin sacrificar el pluralismo cultural. Lucan's account of Caesar crossing the Rubicon is dense with metapoetic allusion. Although the river has been specified as a small stream at Caesar's arrival, it becomes swollen, tumidus, as soon as Caesar ‘breaks the delay of war’ and ‘carries his standards in haste over the [now] swollen river’. This has been pinpointed both as a metapoetic signpost of Lucan's engagement with the anti-Callimachean swollen river of grandiose epic at the outbreak of Civil War, and as a programmatic statement that (...) the whole Bellum Ciuile will set up a series of contrasts between Caesar's urgency in crossing boundaries and Lucan's narrative obstructions to or compliances with Caesar's progress. In fact, as Jamie Masters notes, ‘in spite of the “undoing of delay,” the perfect “tulit” and the adverb “propere,” Caesar has not crossed the river yet; or if he has, he must do it again’, precisely at 1.213–22. Within this densely self-reflexive passage, Lucan inserts a palindromic acrostic which signals both the doubling of Caesar's action and Lucan's poetic representation of Caesar taming the forces of nature. Siguiendo un revelador juicio de Hegel acerca de la ambivalencia de la moral moderna, podría decirse que el consenso buscado en los debates de la ética contemporánea oscilaentre la utopía y la nostalgia, entre la invención y la tradición. La idea de una concertación armoniosa de los intereses de todos, que pueda servir de norma moral vinculante, suele buscarse en la proyección de una comunidad ideal o en la recuperación de un paraíso perdido. Es, con toda la ambigüedad de la (...) expresión, una búsqueda de la felicidad perdida. Pero una búsqueda oscilante como ésta parece enfrentarse inevitablemente a paradojas argumentativas. como lo atestiguan los debates aporéticos de la moral en las últimas décadas, y como trata de mostrarse también en este ensayo. El artículo propone una serie de consideraciones hermenéuticas sobre los filósofos y sus textos, se concentra luego en los problemas que encuentra Hegel en la filosofía de su tiempo: la crisis de la ilustración, de la moral kantiana y el interés por la Grecia antigua. Finalmente expone la concepción de Hegel de su Fenomenología del Espíritu como introducción a la filosofía, entendida por él como Ciencia.

Hemos aprendido, en todo caso, por si alguno no lo hubiese sabido ya de antemano, que en Iquitos se puede vivir y trabajar con calor, sí, pero con seriedad, con modestia, con mucha entrega y con un espíritu de colaboración nacional. Con el respaldo pleno de la Universidad Nacional de la Amazonía Peruana y de su Rector. Gracias a ello, el VI Congreso Nacional de Filosofía ha sido un éxito en todo el sentido de la palabra, éxito que la Pontificia (...) El presente trabajo propone una interpretación de la lectura hegeliana del concepto moderno de voluntad. La idea central es que Hegel reformula la noción moderna de voluntad tratando de hacer surgir en ella la estructurade la acción propia de la ética aristotélica. Es la lógica de la acción la que permite poner de manifiesto los límites de la voluntad. El trabajo consta de dos partes. En la primera, se analiza el sentido y el contexto en que Hegel utiliza sistemáticamente la (...) noción de voluntad. The typical kind of color realism is reductive: the color properties are identified with properties specified in other terms (as ways of altering light, for instance). If no reductive analysis is available — if the colors are primitive sui generis properties — this is often taken to be a convincing argument for eliminativism. That is, realist primitivism is usually thought to be untenable. The realist preference for reductive theories of color over the last few decades is particularly striking in light (...) of the generally anti-reductionist mood of recent philosophy of mind. The parallels between the mind—body problem and the case of color are substantial enough that the difference in trajectory is surprising. While dualism and non-reductive physicalism are staples, realist primitivism is by and large a recent addition to the color literature. And it remains a minority position, although one that is perhaps gaining support. In this paper, we investigate whether it should be accepted, and conclude it should not be. (shrink)

Recent Work on Intrinsic Value brings together for the first time many of the most important and influential writings on the topic of intrinsic value to have appeared in the last half-century. During this period, inquiry into the nature of intrinsic value has intensified to such an extent that at the moment it is one of the hottest topics in the field of theoretical ethics. The contributions to this volume have been selected in such a way that all of the (...) fundamental questions concerning the nature of intrinsic value are treated in depth and from a variety of viewpoints. These questions include how to understand the concept of intrinsic value, what sorts of things can have intrinsic value, and how to compute intrinsic value. The result is a comprehensive, balanced, and detailed picture of current thinking about intrinsic value, one that provides an indispensable backdrop against which future writings on the topic may be assessed. A central tenet of contemporary moral psychology is that people typically reject active forms of utilitarian sacrifice. Yet, evidence for secularization and declining empathic concern in recent decades suggests the possibility of systematic change in this attitude. In the present study, we employ hypothetical dilemmas to investigate whether judgments of utilitarian sacrifice are becoming more permissive over time. In a cross-sectional design, age negatively predicted utilitarian moral judgment (Study 1). To examine whether this pattern reflected processes of maturation, we asked (...) a panel to re-evaluate several moral dilemmas after an eight-year interval but observed no overall change (Study 2). In contrast, a more recent age-matched sample revealed greater endorsement of utilitarian sacrifice in a time-lag design (Study 3). Taken together, these results suggest that today’s younger cohorts increasingly endorse a utilitarian resolution of sacrificial moral dilemmas. (shrink)

BLWith new text and full apparatus criticus The Eudemian Ethics was one of two ethical treatises which Aristotle wrote on the subject of ethica or `matters to do with character'. Although the two works cover much the same ground, the Nicomachean Ethics is better known; the poor manuscript tradition of the Eudemian Ethics has made correct translation and interpretation of the text extremely difficult. The subject of the work is the choice of a certain means of conduct, made by a (...) `man of practical wisdom', between two extremes of behaviour: asceticism and yielding to uncontrolled impulses. Aristotle also stresses the notion of moral intention and the importance of virtue of character. This new Oxford Classical Text of the Eudemian Ethics is the result of many years of work. After Sir David Ross's death, his original text was substantially reworked and revised by his friend and colleague R. R. Walzer, who was aided in the revision by his former pupil Mrs Jean Mingay, who continued his work after his death in 1974. Mrs Mingay was fortunate in being able to make use of previously unpublished contributions from D. J. Allan after his death in the late seventies, and more recently has been helped in her work by the suggestions of Professor D. A. Russell, David Robinson, and Christopher Rowe. (shrink)
