Broadly speaking, two views of modernity are prevalent in contemporary debates. According to the first view, i.e. “modernization theory,” there is one single form of modernity, which is tantamount to liberal, capitalist modernity. The West has already and fully achieved modernity; non-Western societies have lagged behind and must simply catch up with the West. In contrast, according to the second view, “post-colonial theory,” there is no such thing as modernity. What the West erroneously calls “modernity” is nothing but a highly (...) parochial way of thought, and of economic and political organization, that developed by accident first in the West and then by the exercise of military violence or economic power was subsequently “universalized.” In this chapter, I argue that Hegel, read properly, provides a third conception of modernity, one which, contrary to the modernization theory, respects differences between societies, and yet, contrary to post-colonial theory, does not engage in dividing the human species into fundamentally different or incommensurate groups. I argue that Hegel’s theory of modernity must be sought at the conjunction of the Science of Logic (specifically the logic of the Concept) and the Philosophy of Right. I then elaborate on Hegel’s theory of modernity, thus construed. (shrink)

For a long time, the sections of the Philosophy of Right dedicated to the relations among states have been neglected by contemporary International Relations theories. However, especially since the end of the Cold War, this discipline has finally reconsidered Hegel’s theory, in particular by stressing two aspects: the thesis of an ”end of history” implied in it; and, more generally, the primacy of the state in international politics. This paper suggests a different interpretation. It argues that, in order (...) to really understand Hegel’s theory of international relations, it is necessary to consider how it is related to the momentous changes that occurred in the wake of the French Revolution and to previous philosophical developments in the Age of Enlightenment. Indeed, the convergence of these two aspects in his own philosophy of history should suggest that, according to Hegel, by the early nineteenth century international politics had finally entered a new era in which states would still interact as the foremost actors, but would be bound nonetheless by an unprecedented awareness of their historical character. This article challenges Honneth's reading of Hegel's Philosophy of Right in The Pathologies of Individual Freedom: Hegel's Social Theory (2001/2010). Focusing on Hegel's method, I argue that this text hardly offers support for the theory of mutual recognition that Honneth purports to derive from it. After critically considering Honneth's interpretation of Hegel's account of the family and civil society, I argue that Hegel's text does not warrant Honneth's tacit identification of mutual recognition with symmetrical instances of mutual recognition, (...) let alone his subsequent projection of symmetrical forms of mutual recognition onto the various spheres of the Philosophy of Right as a whole. I conclude by indicating an alternative way in which Hegel's text might be used to understand contemporary society. (shrink)

This paper is an attempt to provide an adequate theoretical framework to understand the biological basis of human rights. We argue that the skepticism about human rights is increasing especially among the most rational, innovative and productive community of intellectuals belonging to the applied sciences. By using examples of embryonic stem cell research, a clash between applied scientists and legal scientists cum human rights activists has been highlighted. After an extensive literature review, this paper concludes that the advances in applied (...) sciences proven by empirical evidence should not be restricted by normative theories and philosophies of the social sciences. If we agree on these premises that Human Rights are biological, then biology can provide a framework of cooperation for social and applied scientists. (shrink)

During the last 20 years, philosophers from different quarters and with very different approaches have begun to theorize human rights in an outpouring of authored and edited books and journal articles. In addition, among policy makers and in the legal arena—the so called workings fields of human rights—there have been noteworthy investigations of human rights that tackle philosophical issues. In this book, Anat Biletzki brings a systematic approach to the multitudinous philosophical analyses of human rights, offering a cohesive overview and (...) analysis of this diverse but now very active field. She explores both the conceptual and historical treatments of human rights and the roots of its practice and examines its derivation from classical theories of rights all the way to existing uses. The book is "contemporary" in two senses: it investigates the most current human rights issues and it addresses emerging criticism of human rights, now arising in various sectors. A long introduction provides background information on the history of human rights, a synopsis of modern-day documents, and an articulation of basic questions. This is followed by a section on the philosophical groundings of human rights, proceeding from a philosophy of rights, to specific theories of human rights, to the questions of universalism vs. relativism. The third sections focuses on specific philosophical issues in human rights, including cultural relativity, economic rights, women’s rights, group, indigenous, and minority rights, security, and sovereignty and humanitarian intervention. Published in 1821, Outlines of the Philosophy of Right is considered the definitive articulation of the legal, moral, social, and political philosophy of G.W.F. Hegel. However, shortly before its publication, Hegel delivered a series of lectures on the subject matter of the work at the University of Berlin. These lectures are unlike any others Hegel gave on the philosophy of Right in that they do not supplement a published text but rather give a full and (...) independent presentation of his mature political thought. Yet, they are also unlike Hegel's formal treatise in that they form a smooth and flowing discourse, much like Hegel's lectures on the philosophy of history, philosophy of art, philosophy of religion, and history of philosophy. Substantively, these lectures contain more extensive discussions of poverty and the proletariat than are found in Hegel's published text--discussions that carry out the retreat from optimism about the present age intimated in the preface to Outlines but nowhere evident in the text itself. Translated with an introduction and notes by Alan Brudner, Hegel's 1819/20 lectures on the philosophy of Right present his complete thoughts on law and the state in a manner that is more accessible and engaging than any other Hegelian text on these subjects. This is the first English translation of the seminar Martin Heidegger gave during the Winter of 1934-35, which dealt with Hegel's Philosophy of Right. This remarkable text is the only one in which Heidegger interprets Hegel's masterpiece in the tradition of Continental political philosophy while offering a glimpse into Heidegger's own political thought following his engagement with Nazism.
