L'ordre juridique qui se met en place, en France, aux derniers siècles du Moyen Âge a encore tout récemment été l'objet de riches débats : l'auto-développement des coutumes, l'autorité des droits savants et l'interventionnisme du roi de France ont notamment été au cœur de vives controverses historiographiques. La lecture des sources est à l'origine de querelles interprétatives, auxquelles s'ajoutent des difficultés méthodologiques que rencontrent les historiens du droit. Tandis que l'historien n'a accès qu'à une proportion infime du concret, celui-ci s'efforce (...) de combler ces lacunes, parfois même à l'aide d'une projection des catégories juridiques contemporaines. Cet anachronisme des concepts – parfois couplé à un anachronisme des faits – ne constitue-t-il pas l'un des vices rédhibitoires de la discipline? Cette méthode ne présente-t-elle pas, à l'inverse, une indéniable vertu heuristique et disciplinaire? Certains estiment alors que la théorie du droit est anhistorique, quand d'autres critiquent l'emploi par les historiens des concepts contemporains, comme la hiérarchie des normes, la souveraineté ou encore l'État. Outre de telles projections, c'est le sens donné à certains signifiants médiévaux ou modernes qui peut être relativisé, comme c'est le cas notamment pour les notions de droit positif, de droit commun ou encore de loi. Ces difficultés révèlent aussi à certains égards l'ambivalence de l'histoire du droit, écartelée entre science historique et dogmatique juridique. Ce livre propose alors une réflexion épistémologique sur l'un des grands enjeux de l'historiographie juridique contemporaine : peut-on penser l'ordre juridique médiéval et moderne à partir des catégories juridiques contemporaines? Le XVIIIe colloque international Cioran (2013) a été dédié au thème des "Transfigurations". Les actes du colloque témoignent des différentes approches (philosophique, historique, poétique, littéraire et linguistique) abordées par les chercheurs, universitaires, philosophes ou écrivains venus à Sibiu.

This research aim to investigate the effects of motor imagery, focused on the trajectory of the ball and the target area, and self-talk before the actual strike on the performance of the service in skilled tennis players. Thirty-three participants, competing in regional to national competitions, were randomly divided into three groups: Control, MI, and MI + self-talk. They performed a pre-test, 20 acquisition sessions, and a post-test similar to the pre-test, in match situations. The percentage of the first service, their (...) speed, and the efficiency scores, evaluated by experts, were use as dependent variables and indicators of performance. While there was no difference in service speed, this study showed an improvement in the first service percentage and efficiency in the participants of the MI and MI + self-talk groups. Additionally, analyses revealed greater efficiency when MI was combined with self-talk compared to other conditions. It, therefore, seems advantageous for skilled tennis players to use MI and motivational self-talk before performing the first service balls. (shrink)

In 2014, the worldwide context is that the population is increasingly both expanding and aging in industrial countries. In contrast, the personal health levels of individuals could decrease. Although retirement homes and health-care centers assume most of the demand, they will most probably overflow in the next few years. One of the current solutions is e-Health, which involves biomedical monitoring but also home automation functions to compensate for disabilities that tend to increase with age. In this context, several domains have (...) to be merged while respecting the entire ecosystem: the users, their needs and environment, but also all the various actors/experts involved in this process. The issue, however, is that enormous effort is required to combine the multiple expert domains because these can be antinomic. Hence, this paper proposes a collaborative workflow that brings together these different actors and generates the control/command application. Applying model-driven engineering, this workflow makes a clear distinction between people’s health requirements, the home automation functions, and the user interface points of view. Thus, it allows experts in each field to adapt their system in terms of the user’s needs, disability, and health state. (shrink)

L’étude de l’antonomase, qui est en fait un trope double puisqu’il existe des antonomases de nom propre et de nom commun, invite à plaider pour l’existence d’un système du nom propre fondé sur des positions et organisé à partir d’un prototype, les formes se situant à plus ou moins grande distance de celui-ci. Après avoir montré comment la catégorie du nom propre peut être structurée à partir d’un double mouvement de déconceptualisation et de conceptualisation, double mouvement dont les emplois du (...) nom propre portent la trace en discours, on montre que l’antonomase de nom commun, qui fige un lien référentiel, se situe à l’entrée du système du nom propre, quand l’antonomase de nom propre, qui construit une catégorie conceptuelle à partir d’une dénomination individuelle, renvoie à une position au-delà de laquelle disparaît la perception de la proprialité. Ces formes périphériques, qui illustrent un emploi figuré de la description définie et du nom propre, représentent des tropes complémentaires. On souligne in fine l’existence d’antonomases imbriquées, c’est-à-dire d’antonomases (de nom propre ou de nom commun) formées à partir d’une autre antonomase (de nom commun ou de nom propre). The academic journal publishing model is deeply unethical: today, a few major, for-profit conglomerates control more than 50 of all articles in the natural sciences and social sciences, driving subscription and open-access publishing fees above levels that can be sustainably maintained by publicly funded universities, libraries, and research institutions worldwide. About a third of the costs paid for publishing papers is profit for these dominant publishers' shareholders, and about half of them covers costs to keep the system running, including lobbying, (...) marketing fees, and paywalls. The paywalls in turn restrict access of scientific outputs, preventing them from being freely shared with the public and other researchers. Thus, money that the public is told goes into science is actually being funneled away from it, or used to limit access to it. Alternatives to this model exist and have increased in popularity in recent years, including diamond open-access journals and community-driven recommendation models. These are free of charge for authors and minimize costs for institutions and agencies, while making peer-reviewed scientific results publicly accessible. However, for-profit publishing agents have made change difficult, by co-opting open-access schemes and creating journal-driven incentives that prevent an effective collective transition away from profiteering. Here, we give a brief overview of the current state of the academic publishing system, including its most important systemic problems. We then describe alternative systems. We explain the reasons why the move toward them can be perceived as costly to individual researchers, and we demystify common roadblocks to change. Finally, in view of the above, we provide a set of guidelines and recommendations that academics at all levels can implement, in order to enable a more rapid and effective transition toward ethical publishing. Cancers rely on multiple, heterogeneous processes at different scales, pertaining to many biomedical fields. Therefore, understanding cancer is necessarily an interdisciplinary task that requires placing specialised experimental and clinical research into a broader conceptual, theoretical, and methodological framework. Without such a framework, oncology will collect piecemeal results, with scant dialogue between the different scientific communities studying cancer. We argue that one important way forward in service of a more successful dialogue is through greater integration of applied sciences (experimental and clinical) (...) with conceptual and theoretical approaches, informed by philosophical methods. By way of illustration, we explore six central themes: (i) the role of mutations in cancer; (ii) the clonal evolution of cancer cells; (iii) the relationship between cancer and multicellularity; (iv) the tumour microenvironment; (v) the immune system; and (vi) stem cells. In each case, we examine open questions in the scientific literature through a philosophical methodology and show the benefit of such a synergy for the scientific and medical understanding of cancer. Building a meaningful model of biological regulatory network is usually done by specifying the components and their interactions, by guessing the values of parameters, by comparing the predicted behaviors to the observed ones, and by modifying in a trial-error process both architecture and parameters in order to reach an optimal fitness. We propose here a different approach to construct and analyze biological models avoiding the trial-error part, where structure and dynamics are represented as formal constraints. We apply the method to (...) Hopfield-like networks, a formalism often used in both neural and regulatory networks modeling. The aim is to characterize automatically the set of all models consistent with all the available knowledge. The available knowledge is formalized into formal constraints. The latter are compiled into Boolean formula in conjunctive normal form and then submitted to a Boolean satisfiability solver. This approach allows to formulate a wide range of queries, expressed in a high level language, and possibly integrating formalized intuitions. In order to explore its potential, we use it to find cycles for 3-nodes networks and to determine the flower morphogenesis regulatory network of Arabidopsis thaliana. Applications of this technique are numerous and concern the building of models from data as well as the design of biological networks possessing specified behaviors. (shrink)

Various threshold Boolean networks, a formalism used to model different types of biological networks, can produce similar dynamics, i.e. share same behaviors. Among them, some are complex, others not. By computing both structural and behavioral complexities, we show that most TBNs are structurally complex, even those having simple behaviors. For this purpose, we developed a new method to compute the structural complexity of a TBN based on estimates of the sizes of equivalence classes of the threshold Boolean functions composing the (...) L’idée s’est imposée que le droit du travail pouvait assurer auprès des entreprises la promotion de modèles de gestion responsables. En donnant au modèle le caractère de la règle, le législateur a cherché à informer directement la pratique des acteurs économiques. La Gestion prévisionnelle de l’emploi et des compétences représente aujourd’hui la bonne pratique à imiter. À partir de cet exemple, l’article montre que la façon dont les acteurs jouent avec la règle de droit déçoit les perspectives d’appropriation du (...) modèle tracées par le législateur. Entre les usages qui s’attachent à un objet et son régime juridique, les rapports sont fragiles et la déconnection toujours possible. Comment savons-nous distinguer le bien du mal, reconnaître que telle action est bonne ou telle règle injuste ? Comme l'écrit Adam Smith, « selon certains, le principe de l'approbation est fondé sur un sentiment d'une nature originale, sur une faculté de perception particulière que l'esprit exerce au spectacle de certaines actions ou dispositions... lls lui donnent un nom particulier et l'appellent sens moral ». L'histoire moderne du sens moral, anglaise et surtout écossaise, commence par un dilemme. L'obligation suppose une (...) règle extérieure à la conscience qui est obligée. Comment juger, si nous ne disposons pas d'une règle de justice ? Mais les partisans du sens moral objectent : comment reconnaître et nous assurer que cette règle est bien juste, si nous n'avons pas d'abord la capacité de discerner ce qui est juste, indépendamment de l'obéissance à cette règle ? De deux choses l'une : soit nous sommes d'emblée et comme naturellement sensibles aux qualité morales, soit la moralité se réduit à la conformité à un univers de conventions. Cette notion est-elle autre chose qu'une chimère de moralistes ? Son étude permet de reconstituer une histoire de la philosophie morale et des polémiques qui l'animent au XVIIIe siècle - depuis Cudworth et Locke, en passant par Shaftesbury, Bayle, Hutcheson, Hume et Smith, jusqu'à Kant et Bentham. Il est assez commun de se représenter le bûcheron comme un être plutôt fruste, qualifié avant tout par sa force au service d’une tâche peu valorisée. Or cette représentation se révèle tronquée, car l’équation qui associe la force à l’outil ne peut se réaliser sans le contrôle du geste. Plus encore, l’écoute des témoignages recueillis auprès des forestiers nous apprend que ce travail réclame d’efficaces systèmes de précision. C’est là une qualification oubliée, pourtant reconnue à part entière dès l’Iliade, qui (...) nous en donne deux témoins privilégiés par l’anthropologie historique de la Grèce, la mètis, l’« intelligence rusée », prêtée au kybérnêtês, le pilote du navire, au conducteur de char et, en bonne première place, au bûcheron. La théorie du contrôle nous permet maintenant de dépasser le flou conceptuel de la notion historiquement pré-théorique de mètis, la ruse s’appliquant à des cas bien trop divers, pour lui préférer les développements les plus récents d’une science du contrôle de l’action, théorisée depuis Wiener, nourrissant aujourd’hui les projets les mieux financés de cyber-cerveaux informatiques, au service des neurosciences et de la médecine. Le travail forestier, qui réclame une coordination maîtrisée des gestes, y compris de leurs commandes vocales dans le chant de travail — qu’un seul ou plusieurs bûcherons en équipe soient mobilisés —, nous en fournit une parfaite illustration. The woodcutter is commonly represented as a fairly boorish person, reduced to brute force and low-level tasks. But this representation is partial because a simplistic inferential link between an axe and strength obliterates that nothing can happen without any modus operandi, i.e. a set of neural controls over gestures. Indeed, listening to woodcutter’s testimonies led us to elicit that this work needs efficient precision systems. This high level of qualification was acknowledged at least since Homer’s Iliad as evidenced by two favourite telltales from historical anthropology of Ancient Greece: mètis ascribed to kybérnêtês, the ship’s pilot as to the chariot-driver and in the first rank to the woodcutter. Control theory allows now to avoid the fuzziness of meaning of the pre-theoretical notion of mètis to focus on a domain steadily developed since Wiener, now part of costly cyber-brain projects in informatics, for neuroscience and medicine. Forest work, which requires skilled gesture coordination, with vocal commands in a worksong—for one or more woodcutters being engaged in the task—is such a telling case. (shrink)

Au cœur de cet espoir sont des vérités normatives irréductibles telles que l’affirmation que la souffrance est intrinsèquement mauvaise. Parfit se demande si Nietzsche menace son édifice et lui consacre un chapitre entier chapeautant la discussion du désaccord moral et de la convergence, et conclut que Nietzsche soit n’est pas en vrai désaccord, soit ne raisonne pas dans des conditions satisfaisantes. Je (...) mets ici à l’épreuve la prédiction de convergence de Parfit et montre que Nietzsche pose une menace encore plus sérieuse que ne le prétend Parfit. Dans son dernier cours au Collège de France, Michel Foucault nous parle d'un oubli, plus fondamental à ses yeux que le fameux "oubli de l'être", ou plus précisément d'une négligence ; une négligence dont la philosophie est responsable, ce qui est d'autant plus paradoxal qu'il concerne précisément la vie philosophique. "Je voudrais, en tout cas, suggérer simplement que s'il est vrai que la question de l'être a bien été ce que la philosophie occidentale a oublié et dont l'oubli a rendu (...) possible la métaphysique, peut-être aussi la question de la vie philosophique n'a-t-elle pas cessé d'être, je ne dirais pas oubliée, mais négligée ; elle n'a pas cessé d'apparaître comme en trop par rapport à la philosophie, à la pratique philosophique, à un discours de plus en plus indexé au modèle scientifique" Cette négligence a une histoire. Car le problème de la vie philosophique a été posé dans toute sa radicalité dans l'Antiquité ; il n'était pas complètement oublié à l'époque moderne, comme en témoigne l'oeuvre de Spinoza ; mais à partir du moment "où la philosophie est devenue un métier de professeur, c'est-à-dire au début du XIXème siècle", elle a évacué du champ des problèmes pertinents, des problèmes "sérieux", cela même qui pourtant lui avait donné son horizon et sa raison d'être : la possibilité de définir une vie philosophique, c'est-à-dire une vie juste, une vie bonne, une "vraie vie". The growth of the Semantic Web resulted in the emergence of various kinds of artificial agents navigating the web, sharing resources and communicating among each other in a more and more sophisticated fashion. No one denies the relevance of research concerning the establishment of architectures and models for representing and enabling interaction and communication among agents. In another domain, ontologies have been consecrated as an essential tool to structure information in order to facilitate shareability and re-usability of knowledge resources like (...) the ones found on the Web. It is therefore no surprise that the management of ontologies by interacting and communicating agents is a hot topic for the whole Semantic Web community. In addition, the ontological foundations of agent interaction still remain a very active research area. The present issue of Applied Ontology on Formal Ontologies for Communicating Agents follows a workshop organized in July/August 2006 in the scope of the 11th European Summer School in Logic, Language and Information. After the workshop we issued an open call for contributions that allowed us to select a focused range of works addressing the research topics raised in the original workshop call. L’actualité du kantisme en philosophie morale et politique est illustrée par l’importance en son sein des approches formelles, notamment l’éthique de la discussion et le libéralisme politique. Ces approches estiment que le formalisme pratique implique une réduction de la sphère de la rationalité pratique à la seule réflexion morale sur l’impartialité des normes, au détriment du questionnement éthique sur la vie bonne renvoyé à la particularité subjective. Dans le présent article, nous contestons la nécessité d’une telle implication et nous (...) voulons montrer la possibilité de penser une éthique formelle : un jugement éthique a priori peut être fondé sur la seule nécessité de donner sens à la forme de la finitude.The actuality of Kantism in moral and political philosophy is mirrored in the importance of formal approaches, i.e. deliberative ethics and political liberalism. These approaches underline that practical formalism implies a reduction of the sphere of practical rationality to a moral reflection on impartiality of norms. This reflection is carried out at the expense of the ethical questioning on the « good life », which is reduced to the subjective particularity. In the present article, I contest the necessity of such an implication. Also, I want to show the possibility to conceive a formal ethic, namely an a priori ethical judgement can be founded on the necessity alone to give sense to the form of finitude. (shrink)

PREFACEProf. Göran Sundholm of Leiden University inspired the group of Logic at Lille and Valparaíso to start a fundamental review of the dialogical conception of logic by linking it to constructive type logic. One of Sundholm's insights was that inference can be seen as involving an implicit interlocutor. This led to several investigations aimed at exploring the consequences of joining winning strategies to the proof-theoretical conception of meaning. The leading idea is, roughly, that while introduction rules lay down the conditions (...) under which a winning strategy for the Proponent may be built, the elimination rules lay down those elements of the Opponent's assertions that the Proponent has the right to use for building winning strategy. It is the pragmatic and ethical features of obligations and rights that naturally lead to the dialogical interpretation of natural deduction.During the Visiting Professorship of Prof. Sundholm at Lille in (2012) the group of Lille started delving into the ways of implementing Per Martin-Löf's Constructive Type Theory with the dialogical perspective. In particular, Aarne Ranta's (1988) paper, the first publication on the subject, was read and discussed during Sundholm’s seminar. The discussions strongly suggested that the game-theoretical conception of quantifiers as deploying interdependent moves provide a natural link between CTT and dialogical logic. This idea triggered several publications by the group of Lille in collaboration with Nicolas Clerbout and Juan Redmond at the University of Valparaíso, including the publication of the book (2015) by Clerbout / Rahman that provides a systematic development of this way of linking CTT and the dialogical conception of logic. However the Clerbout / Rahman book was written from the CTT perspective on dialogical logic, rather than the other way round. The present book should provide the perspective from the other side of the dialogue between the Dialogical Framework and Constructive Type Theory. The main idea of our present study is that Sundholm's (1997) notion of epistemic assumption is closely linked to the Copy-Cat Rule or Socratic Rule that distinguishes the dialogical framework from other game-theoretical approaches. One way to read the present book is as a further development of Sundholm’s extension of Austin's (1946, p. 171) remark on acts of assertion to inference. Indeed, Sundholm (2013, p. 17) gave the following forceful formulation: When I say therefore, I give others my authority for asserting the conclusion, given theirs for asserting the premisses.Per Martin-Löf, in recent lectures, have utilized the dialogical perspective on epistemic assumptions to get out of a certain circle that threatens the explanation of the notions of inference and demonstration. A demonstration may be explained as a chain of (immediate) inferences starting from no premisses. That an inference J1... Jn—————Jis valid means that the conclusion J can be made evident on the assumption that J1, …, Jn are known. The notion of epistemic assumption thus enters in the explanation of valid inference. We cannot, however, in this explanation understand 'known' in the sense of demonstrated, for then we are explaining the notion of inference in terms of demonstration, whereas demonstration has been explained in terms of inference. Martin-Löf suggests that we here understand 'known' in the sense of asserted, so that epistemic assumptions are judgements others have made, judgements for which others have taken the responsibility; that the inference is valid then means that, given that others have taken responsbility for the premisses, I can take responsibility for the conclusion:The circularity problem is this: if you define a demonstration to be a chain of immediate inferences, then you are defining demonstration in terms of inference. Now we are considering an immediate inference and we are trying to give a proper explanation of that; but, if that begins by saying: Assume that J1, …, Jn have been demonstrated – then you are clearly in trouble, because you are about to explain demonstration in terms of the notion of immediate inference, hence when you are giving an account of the notion of immediate inference, the notion of demonstration is not yet at your disposal. So, to say: Assume that J1, …, Jn have already been demonstrated, makes you accusable of trying to explain things in a circle. The solution to this circularity problem, it seems to me now, comes naturally out of this dialogical analysis. […]The solution is that the premisses here should not be assumed to be known in the qualified sense, that is, to be demonstrated, but we should simply assume that they have been asserted, which is to say that others have taken responsibility for them, and then the question for me is whether I can take responsibility for the conclusion. So, the assumption is merely that they have been asserted, not that they have been demonstrated. That seems to me to be the appropriate definition of epistemic assumption in Sundholm's sense. One of the main tenets of the present study is that the further move of relating the Socratic Rule rule with judgemental equality provides both a simpler and more direct way to implement the constructive type theoretical approach within the dialogical framework. Such a reconsideration of the Socratic Rule, roughly speaking, amounts to the following. 1.A move from P that brings-forward a play-object in order to defend an elementary proposition A can be challenged by O. 2.The answer to such a challenge, involves P bringing forward a definitional equality that expresses the fact that the play-object chosen by P copies the one O has chosen while positing A. For short, the equality expresses at the object-languaje level that the defence of P relies on the authority given to O to be able to produce the play-objects she brings forward. More generally, according to this view, a definitional equality established by P and brought forward while defending the proposition A, expresses the equality between a play-object (introduced by O) and the instruction for building a play-object deployed by O while affirming A. So it can be read as a computation rule that indicates how to compute O's instructions. Let us recall that from the strategic point of view, O's moves correspond to elimination rules of demonstrations. Thus, the dialogical rules that prescribe how to introduce a definitional equality – correspond – at the strategic level – to the definitional equality rules for CTT as applied to the selector-functions involved in the elimination rules. So, what we are doing here is extending the dialogical interpretation of Sundholm's epistemic assumption to the rules that set up the definitional equality of a type.The present work is structured in the following way:•In the Introduction we state the main tenets that guide our book•Chapter II contains a brief overview of Constructive Type Theory penned by Ansten Klev with exercises and their solutions. •Chapter III offers a novel presentation of the dialogical conception of logic. In fact, the first two sections of the chapter provide an overview of standard dialogical logic – including solved exercises, slightly adapted to the content of the present volume. Les emprunts les plus importants, lexicaux autour de la valeur travail et énonciatifs autour de l’exhibition du « je » et du « je veux », concernent statistiquement Nicolas Sarkozy.

This paper demonstrates the central role of the Socratic elenchus in the Sophist. In the first part, I defend the position that the Stranger describes the Socratic elenchus in the sixth division of the Sophist. In the second part, I show that the Socratic elenchus is actually used when the Stranger scrutinizes the accounts of being put forward by his predecessors. In the final part, I explain the function of the Socratic elenchus in the argument of the dialogue. By contrast (...) with standard scholarly interpretations, this way of reading the text provides all the puzzles about being (241c4–251a4) with a definite function in the dialogue. It also reveals that Plato’s methodology includes a plurality of method and is more continuous than what is often believed. (shrink)

Nicolas Weill propose une lecture stimulante de ces textes qui constituent une des découvertes philosophiques les plus importantes de ces dernières années. La publication des "Cahiers" redonne une actualité brûlante à la question qui divise épigones et détracteurs du penseur allemand : comment continuer à philosopher avec Heidegger sans tenir compte d'une éventuelle contamination de cette philosophie par l'idéologie nazie? Par une analyse sans concession des "Cahiers", en se concentrant sur les Réflexions (tenues par Heidegger de 1931 à 1941) (...) mais tout en cherchant à en dégager les éléments proprement philosophiques, cet ouvrage invite à une approche équilibrée, quitte à "penser avec Heidegger, contre Heidegger", comme le suggérait Jürgen Habermas dès le début des années 1950. Il montre notamment comment l'auteur d'Etre et temps, en inventant une nouvelle forme de philosopher, a poursuivi et prolongé dans ces carnets la critique de la modernité telle qu'elle a été formulée par la "révolution conservatrice" allemande et par Oswald Spengler, le théoricien du déclin de l'Occident. With aims to both increase organ supply and better reflect individual donation preferences, many nations worldwide have shifted from ‘opt‐in’ to ‘opt‐out’ systems for post‐mortem organ donation (PMOD). In such countries, while a prospective donor's willingness to donate their organs/tissues for PMOD was previously ascertained—at least partially—by their having recorded positive donation preferences on an official register prior to death, this willingness is now presumed or inferred—at least partially—from their not having recorded an objection to PMOD—on an official organ donation (...) register. Using evidence regarding the presence and prevalence of selective donation preferences, and via exploration of how appeals to donation preferences are used to both motivate and legitimate shifts to opt‐out frameworks, this paper draws attention to a set of previously unexplored problems for opt‐out organ donation arising in contexts where: (a) individuals demonstrate selective post‐mortem organ/tissue donation preferences, (b) legislation provides prospective donors with the opportunity to selectively permit/refuse the donation of certain organs/tissues in line with these preferences. While selective preferences pose few problems for opt‐in systems where a selective occasion is built into the process of signing the donor register, this is not the case for opt‐out systems. The loss of this selective occasion can cause significant problems where appeals to preferences motivate/legitimate shifts to opt‐out but evidence regarding variable preferences does not feed into determinations regarding organ/tissue exclusions. The nature of these problems depends on how the authorization aspect of ‘opt‐out’ systems is framed (e.g. as presumed consent, deemed consent or, given the role of familial consent in many jurisdictions as consent in name only). The unconscious-thought effect occurs when distraction improves complex decision making. Recent studies suggest that this effect is more likely to occur with low- than high-demanding distraction tasks. We discuss implications of these findings for Newell & Shanks' (N&S's) claim that evidence is lacking for the intervention of unconscious processes in complex decision making.

On a souvent résumé la présence importante des avocats dans la vie politique française sous la III e République à travers l’expression de « République des avocats. » De manière plus complexe, il s’agit de montrer comment les avocats sont au cœur, dans les premières décennies de la République, de la construction d’un champ politique marquée par la codification des règles électorales et une certaine démocratisation du personnel politique. Nicolas de Warren uses detailed analysis of texts by Husserl, some only recently published in German, to examine Husserl's treatment of time-consciousness and its significance for his conception of subjectivity. This article argues that many situations in social life can be analyzed by their requirement for the justification of action. It is in particular in situations of dispute that a need arises to explicate the grounds on which responsibility for errors is distributed and on which new agreement can be reached. Since a plurality of mutually incompatible modes of justification exists, disputes can be understood as disagreements either about whether the accepted rule of justification has not been violated or about (...) which mode of justification to apply at all. The article develops a grammar of such modes of justification, called orders of worth (grandeur), and argues that the human capacity for criticism becomes visible in the daily occurrence of disputes over criteria for justification. At the same time, it is underlined that not all social situations can be interpreted with the help of such a sense of justice, which resides on a notion of equivalence. Regimes of love, of violence or of familiarity are systematically distinct from regimes of justification. (shrink)

Nous montrons dans cet article comment les approches dynamiques en logique contemporaine ont retrouvé, quoique sous d ’ autres attendus, une configuration théorique qu ’ on peut attribuer à Aristote au moment de la rédaction des Topiques. Dans cette configuration, la logique et la rhétorique – ou au moins la dialectique – se complètent dans le cadre conceptuel homogène offert par la dialectique, entendue comme une certaine forme relativement codifiée de débat critique. L ’ idée principale est qu ’ aujourd (...) ’ hui, de même qu ’ alors, la dialectique est le cadre dans lequel il est possible de penser le rapport entre la logique et les formes générales de l ’ argumentation d ’ une part, et entre la logique et la théorie de la connaissance scientifique d ’ autre part. Eternal recurrence and the principle of economy in Nietzscheʼs thought. This paper explores the place that the principle of parsimony occupies in Nietzscheʼs thought. I argue that the principle of parsimony is one of the criteria that allow Nietzsche to organize the many different interpretations available to us into a hierarchy. The question is whether Nietzsche can justify the use of this principle without making it a petitio principii. Oddly enough, it seems that eternal recurrence has a role to play (...) in this context. The most important problem Nietzsche has to confront is the problem of circularity. Bringing together Nietzsche’s specific conception of truth with the problem of eternal recurrence allows us to recognize that circularity provides for access to a higher density of the real. (shrink)
