Entendo a partidarização judicial como agravamento do anti-igualitarismo jurídico que degrada o formalismo democrático. Atenho-me ao Brasil, sem generalizar: há pessoas dignas no judiciário. Falo na aplicação indevida da lei na esfera política para impedir mudanças na sociedade. Trato o tema em três níveis. Preliminarmente, discuto a desigualdade político-jurídica, depois os golpes de Estado, e por fim o manejo da legislação como arma política que mantém injustiças.

The present article presents brief notes on the "new thought" of the German philosopher Franz Rosenzweig, in the work The Star of Redemption, with the exposure of reason and its totalitarian and violent vocation, which, since Antiquity until Modernity, was based on the tireless search for knowledge of the All, in its essence, with the formulation of concepts, in a closed experience. In contrast, the philosopher from Kassel points out his proposal for a new philosophical system, with a vocabulary similar (...) to the one found in Jewish theology, even being confused with theological thought, which revealed an alternative analysis of experience (open, dynamic, relational and in time), the construction of a plural reason, admitting and respectingplurality. The confinement of the population into their homes as a result of COVID-19 has entailed a notable increase in the consumption of diverse media. This exploratory study aimed to examine how the increase in media consumption was related to subjective happiness and psychological well-being. For this purpose, a questionnaire was administered to a sample of Spanish adults to assess their consumption of different media before and during confinement. Moreover, participants were evaluated for hedonic, eudaimonic, social, and experienced happiness by using (...) the Pemberton Happiness Index. The results underlined the great increase in the consumption of TV for entertainment and social networking sites during confinement. Furthermore, it was found that higher consumption was negatively correlated with the level of happiness, so that, people who reported greater well-being, both subjective and psychological, spent less time watching TV and using SNS. In contrast, no association was found between the level of happiness and the consumption of news and radio. Therefore, it seems that far from cultivating greater happiness, those who engaged in heavy consumption of TV entertainment and SNS during confinement were less happy than those who did so more moderately and spent more time using other media or performing other activities. En este artículo llevamos a cabo una extensa revisión de la literatura científica en lo relativo a los vínculos entre materialismo y felicidad, desde un enfoque multidisciplinar que incluye la psicología, la comunicación, la economía y la ética. La línea dominante en la bibliografía insiste en vincular un mayor materialismo con una menor auto-percepción de felicidad y de bienestar, y con una mayor propensión a la depresión. En esta revisión atendemos a los aspectos que así lo evidencian, al rumbo actual (...) de las investigaciones y a los retos aún pendientes de clarificación por parte de la comunidad investigadora. A dilemma has stymied interpretations of the Stranger’s method of dividing kinds into subkinds in Plato’sSophistandStatesman. The dilemma assumes that the kinds are either extensions or intensions. Now kinds divide like extensions, not intensions. But extensions cannot explain the distinct identities of kinds that possess the very same members. We propose understanding a kind as like an animal body—the Stranger’s simile for division—possessing both an extension and an intension. We find textual support in the Stranger’s paradigmatic four steps for collecting (...) a subkind. (shrink)

This study focuses on a news framing analysis of Latin America and Latin Americans in the Spanish press. For this purpose 1,271 news articles with different Latin American countries or their citizens as main actors were examined. These news stories had been published by the main Spanish newspapers in 1999. The results reveal that attribution of responsibility, human interest, and conflict constitute the prevailing frames used by the Spanish press. Furthermore, significant differences in the considered variables in terms of main (...) country actor were observed. Venezuela and Colombia, in particular, are associated with armed conflicts, natural disasters, crimes, and accidents using human interest and conflict news frames. This leads to a necessary consideration of the consequences this type of news coverage on Latin America may generate, and whether it will reinforce stereotypes or prejudices in the Spanish audience against peoples from these countries, especially those with a high migratory influx to Spain. Steinman indicates that his ability to understand beauty is limited by his imagination. Beauty, as it has been traditionally defined, is an ultimate value, an ideal on same level as truth and goodness. Many of the ancient Greeks believed that symmetry represented order, and order was beautiful because it revealed a type of cosmic justice and truth that no person could deny. So, when Steinman's application of beauty comes into play, he is definitely emphasizing the order and justice that beauty (...) provides. The player of BioShock is introduced to a world quite familiar to ours, not necessarily in sense of Rapture, underwater cities, or vintage décor, but rather in the form of worldview. The vending machines are not coincidentally called Circus of Values. No Íon, a autoridade e a sabedoria de poetas e rapsodos são confrontadas por meios indiretos. O caráter oblíquo dessa estratégia impede o acesso direto ao conteúdo do diálogo e provoca inúmeros equívocos de leitura. Um fato contextual estimula mais ainda leituras equivocadas. A poesia tratada no Íon difere muito da forma como nós, modernos, a entendemos. Na Antiguidade grega, de base aural, a poesia era o modo privilegiado de conservação da tradição herdada, e permaneceu exercendo essa função capital até (...) mesmo quando a escrita passou a desempenhar papel relevante na forma de composição e transmissão cultural. Neste contexto, o rapsodo representa uma autoridade que cobre praticamente todos os campos do saber. Autoridade enciclopédica, contra a qual Platão travou uma guerra não sem ambiguidades. O presente artigo busca revelar a motivação profunda que anima o Íon: a contraposição entre dois modos de comunicação, o da poesia e o da filosofia. Defende, ainda, que Platão, ao atacar a performance poética, busca, além de rejeitá-la, substituí-la pelo élenkhos socrático como modo de comunicação ideal para instrução e guia da vida humana. Bajo el concepto común de gamificación existe un complejo mundo dentro del cual existen distintas opciones, cada una con su denominación, que para quien se adentra por primera vez en él pueden generar confusión. Cada una de ellas goza de características, funciones y elementos metodológicos propios. ¿Gamificación? ¿Juegos serios? ¿Aprendizaje Basado en Juegos? Ante esta amalgama de posibilidades, las siguientes líneas se presentan a modo de hoja de ruta que ayude a transitar por la senda del juego educativo, para lo (...) que, a su vez, se acompaña esta fundamentación teórica con un ejemplo didáctico de ABJ -editado como juego de mesa bajo la denominación “Catedral 1221”- concebido y diseñado con la finalidad de promover y facilitar el estudio de la Edad Media en la Educación Secundaria Obligatoria. Su aplicación con éxito en las aulas permite aportar orientaciones didácticas al respecto y extraer conclusiones relativas a la conveniencia y validez académica del juego en el marco de la enseñanza reglada. La enseñanza aprendizaje de la historia ha enfrentado muchos retos, en todos los niveles educativos, que van desde la educación primaria y sin generalizar se puede decir que se extiende hasta la educación universitaria. Ello implica que cada vez sea más necesario que los docentes conozcan los avances sobre la didáctica de la historia así como la disciplina escolar. Las estrategias que el docente trabaje con los estudiantes deben encaminarse al desarrollo del pensamiento histórico, al uso de fuentes y a (...) la investigación. La propuesta que aquí se presenta tiene el propósito de que los estudiantes de primaria trabajen con versiones diferentes sobre un hecho histórico al tiempo que ejerciten su comprensión lectora. Current legal theory is concerned with the presence of principles in law partly because they are at the core of Dworkin's criticisms of Hart's rule of recognition. Hart's theory is threatened by the possibility that the identification of some principles follows an extremely relaxed rule of recognition, or even no rule at all. Unfortunately, there is no conclusive test to ascertain what is the case in actual practice. On the other hand, the evaluative arguments which support Dworkin's proposal of principled (...) adjudication are forceful but not conclusive. Moreover, since ultimate controversy over values is plausible, judicial discretion may sometimes be inevitable. (shrink)

Resumo A conservação da biodiversidade tornou-se um compromisso inquestionável diante do seu papel inexorável para a manutenção da vida na Terra. Apesar do consensual compromisso em sustentá-la, as razões pelas quais fazê-lo ainda são alvo de discussões e controvérsias. Que valores devem reger sua proteção? Contudo, a conservação da biodiversidade está cada vez mais voltada para um lado objetivo-econômico, na qual a natureza é marginal aos interesses que parecem mais evidentes: a eficiência econômica. Esse artigo faz uma reflexão sobre os (...) esquemas de biodiversity offsets, instrumentos cujo objetivo é a compensação pelos danos à biodiversidade provocados pelas atividades de desenvolvimento; e sobre a mudança nos valores da conservação da biodiversidade que tais instrumentos tendem a provocar. Uma mudança discursiva, institucional, técnica e material que altera o sentido de se fazer conservação e a relação humana com o mundo natural. Essa ‘nova’ perspectiva da conservação revela dilemas éticos fundamentais, e vem se tornando uma estratégia cada vez mais difundida no âmbito das políticas ambientais para a conservação. (shrink)

This chapter focuses on one of the common fallacies in Western philosophy called the slippery slope. According to Patrick Hurley in A Concise Introduction to Logic, “the fallacy of slippery slope is a variety of the false cause fallacy. It occurs when the conclusion of an argument rests on an alleged chain reaction and there is not sufficient reason to think that the chain reaction will actually take place”. The key term in the chapter is “chain reaction”. If all of (...) the events in the chain reaction can be justified, then the slippery slope is not committed. But the nuances and intricate improbable connections between each event still make it difficult to support the ultimate conclusion, which is to get rid of cable. The chapter discusses two simple techniques in order to avoid committing the slippery slope fallacy. (shrink)

O presente trabalho visa expor, utilizando dupla perspectiva, as tecnociências e suas inovações como resultantes do modo de produção capitalista e no que isso implica. Num primeiro momento, será apresentada a perspectiva utilizada por Deuleuze e Guattari em Mil Platôs para denotar a importância do Estado como garantidor de um modo de produção e como agenciador, via ordem jurídica, das linhas de fuga que emergem da sociedade, inclusive no que toca às inovações trazidas pelo desenvolvimento e ampliação dos conhecimentos e (...) dos saberes. Na sequência, de forma complementar, serão abordados o capitalismo em si e alguns de seus fundamentos relevantes para a compreensão das consequências possíveis para as inovações tecnocientíficas, isso a partir de postulados da teoria materialista-histórica. Após, irá se procurar demonstrar a realização de um estatuto ético-jurídico brasileiro como agenciamento das modificações e inovações que dizem com uso de células tronco para pesquisas. (shrink)

A common approach for measuring the effectiveness of an education system or a school is the estimation of the impact that school interventions have on students’ academic performance. However, the latest trends aim to extend the focus beyond students’ acquisition of knowledge and skills, and to consider aspects such as well-being in the academic context. For this reason, the 2015 edition of the international assessment system PISA incorporated a new tool aimed at evaluating the socio-affective variables related to the well-being (...) of students. It is based on a definition focused on the five dimensions proposed in PISA theoretical framework: cognitive, psychological, social, physical and material. The main purpose of this study is to identify the well-being components that significantly affect student academic performance and to estimate the magnitude of school effects on the well-being of students in OECD countries, the school effect being understood as the ability of schools to increase subjective student well-being. To achieve this goal, we analyzed the responses of 234,000 students from thirty-five OECD countries to PISA 2015 questionnaires. Specifically, we considered non-cognitive variables in the questionnaires and student performance in science. The results indicated that the cognitive well-being dimension, composed of enjoyment of science, self-efficacy and instrumental motivation, as well as the test anxiety all had a consistent relationship with student performance across countries. In addition, the school effect, estimated through a two-level hierarchical linear model, in terms of student well-being was systematically low. While the school effect accounted for approximately 25% of the variance in the results for the cognitive dimension, only 5-9% of variance in well-being indicators was attributable to it. This suggests that the influence of school on student welfare is weak, and the effect is similar across countries. The present study contributes to the general discussion currently underway about the definition of well-being and the connection between well-being and achievement. The results highlighted two complementary concerns: there is a clear need to promote socio-emotional education in schools, and it is important to develop a rigorous framework for well-being assessment. The following article aims to draw a dialogue between the conception of Ethos present in the poet Patativa of the Assaré and the thought of the philosopher Manfredo Araújo de Oliveira. From the particularity to the universality, both thinkers theorize social ethos as an intrinsic characteristic of the subject. Patativa is a representative of the poetry of the Northeastern pantheon, while Manfredo Oliveira stands out for the power of synthesis and analysis of the main problems in the History of Philosophy. (...) Both thinkers show us how it is possible to philosophize in Portuguese or how it is possible to extract from the historical specificity the dilemmas of human complexity. This article, therefore, makes a reflection that starts from the popular literature to the Northeastern philosophical thought, presented as a guiding thread to ethics. (shrink)

In The Birthright Lottery, Ayelet Shachar subjects the institution of birthright citizenship to close scrutiny by applying to citizenship the historical and philosophical critique of hereditary ownership built up over four centuries of liberal and democratic theory, and proposing compelling alternatives drawn from the theory of private law to the usual modes of conveyance of membership. Nonetheless, there are some difficulties with this critique. First, the analogy between entailed property and birthright citizenship is not as illustrative as Shachar intends it (...) to be; second, the mechanism of the birthright privilege levy is insufficient for addressing structural impediments to growth; and third, the principle of ius nexi, while an important corrective to currently dominant principles of nationality, will likely have effects both unnecessary and insufficient to correct the injustices that Shachar identifies. In the end, the most significant improvements in the lives of the neediest persons on the planet are more likely advanced through conventional arguments for the lowering of barriers to the circulation of goods, labor, and capital. This shift in attention from opening borders to extending citizenship risks being a distraction from more effective means of addressing the injustices associated with global inequality.Dans son livre The Birthright Lottery, Ayelet Shachar soumet l’institution de la citoyenneté par droit de naissance à un examen rigoureux, en appliquant à la citoyenneté la critique philosophique et historique de la propriété héritée construite pendant quatre siècles de théorie démocratique libérale, et en proposant aux modes habituels d’attribution de la citoyenneté une alternative séduisante tirée de la théorie du droit privé. Ce déplacement de l’attention de l’ouverture des frontières à l’extension de la citoyenneté risque de nous distraire des moyens plus efficaces de nous attaquer aux injustices associées à l’inégalité globale. English translates ‘genos’ as kind and ‘eidos’ as form, which differ in meaning as much as ‘herd’ and ‘brand’ do. But there are hard passages where ‘genos’ and ‘eidos’ have appeared to be synonyms, usually given the new meaning class. We show that, although ‘genos’ and ‘eidos’ are never synonyms and continue to mean kind and form, the word ‘eidos’ can be used figuratively, as a metonym, for a genos.
