Conscience – a catholic anthropological vision In the catholic tradition conscience always played an important role as visible in the ‘clausula Petri’ (Ac 5,30-33) or in Paul’s belief in its wisdom (Rm 2,14-16). Conscience can break rules (‘epikeia’), but should not stand up against the church as such. Luther’s historical deed left behind a distrust in conscience in the Catholic Church; it took 400 years to restore Paul’s vision of the conscience as the highest authority – if it is formed (...) and reaches the state of maturity. By his conscience, man is called to be as God created him; he is called by others to develop and to respect their dignity. He is also called by the world to form it according to its higher possibilities which cannot be realized but by man. Conscience is God’s voice in the person where his promises can be heard. Though conscience is free, it is the place where responsibility is formed according to what someone can and should do. This is why the conscience will keep its unavoidable and undeniable role – even in a postmodern context. (shrink)

ABSTRACTThe Jewish-Catholic philosopher and Carmelite Edith Stein offers a rich notion of love, based on an original phenomenology, which resulted from an active engagement with her teachers Edmund Husserl and Max Scheler, and was later enriched and deepened by incorporating religious philosophical and theological ideas. In order to locate Stein’s original thinking, the essay will first introduce the two thinkers by whom she was most clearly influenced, and show how Stein contrasted the ‘nothing’, as it is presented in Husserl’s other (...) pupil Martin Heidegger’s existentialist analysis, with the fullness of being to which the human person aspires, and which is given through love. Her phenomenological thinking, based on the intersubjective approach to its object, ultimately leads Stein to a triple philosophical statement about love: Love is a principle of being, a principle of knowledge and a principle of relationship. The passage through theology verifies what has been said philosophically about its relationship to God, in whom love ultimately finds its completion. The three basic principles of love complement and correct each other, to the point not only of issuing in an analysis of the phenomenon ‘love’ but of also opening up an ethics of love. (shrink)

I will explore the paradoxical nature of epistemic access. By critiquing the traditional conception of mental states that are labelled as ’knowledge’, I demonstrate the susceptibility of these states to an infinite regress, thus, challenging their existence and validity. I scrutinise the assumption that an epistemic agent can have complete epistemic access to all facts about a given object while simultaneously being ignorant of certain truths that impact the very knowledge claims about the object. I further analyse the implications of (...) this paradox when attempting to fine-grain the parameters of epistemic access, which happens to reveal the vacuity of such definitions and the inevitability of the regress. In this article Cristoph Wulf examines the basic concepts of pedagogy and educational science in the German-speaking world, looking at education and socialization from the perspective of educational anthropology. He makes evident that the complex German concept of Bildung, in particular, can only be fully understood by means of a historical and philosophical analysis.

I defend J. L. Austin's direct realism against the colour delusion argument by employing epistemic logic to demonstrate that perceiving colours does not necessitate an intermediary such as sense-data, thus preserving the directness of perception.

El presente trabajo propone analizar la manera en que Agustín de Hipona recepciona el pensamiento de Tertuliano, autor cristiano latino, también africano, del que lo separan unos 200 años. Las principales menciones al cartaginés tienen lugar en la crítica agustiniana a la concepción de la corporeidad del alma defendida por Tertuliano. A fin de poder analizar los argumentos y los conceptos filosóficos utilizados por el hiponense en el desarrollo de su crítica presentamos, en primer lugar, una breve introducción a Tertuliano (...) (c. 160- c. 220), deteniéndonos en algunos pasajes cruciales de su obra titulada _De anima_ (208/210). En segundo lugar, nos dedicamos a presentar y analizar la discusión que lleva adelante Agustín respecto de la tesis de la corporeidad del alma humana en _De Genesi ad litteram _(finalizado hacia el 415)_,_ y en _De anima et eius origine, _escrita posteriormente, entre 419 y 420. This article discusses burnout prevalence and detection, including issues of complexity regarding diagnosis and assessment. An ethical lens is utilized to explore problems that may arise due to burnout, and the ethical responsibility of practicing self-care. Recommendations for graduate clinical training programs as well as practicing professionals are suggested, including strategies for monitoring self and others for warning signs of burnout (...) and implementing self-care. We introduce a new theorem in social choice theory built on a path integral approach which will show that, under some reasonable conditions, there is a unique way to aggregate individual preferences based on fuzzy sets into a social preference based on probabilities, and that this way is invariant under any permutation of alternatives. We then apply this theorem to the case of democratic decision making with data of the behaviour and voting preferences of voting agents and show that there (...) is a tradeoff between fairness and efficiency and that no voting system can achieve both simultaneously. In this contribution pain and the experssion of pain are looked at from the perspective of evolutionary biology, utilizing, among others, cross-cultural data from field work in Melanesia.No other being cares for sick and suffering conspecifics in the way humans do. Notwithstanding aggression and neglect, common in all cultures, human societies can be characterized as empathic, comforting, and promoting the health and well-being of their members. One important stimulus triggering this (...) caring response in others is the expression of pain. The nonverbal channel of communication, particularly certain universal — i.e., culture-independent facial expressions, gestures, and body postures, convey much of the message from the painstricken person to the group.These behaviors signal the person's physical and psychical pain, sadness, grief, and despair in ways very similar to the signs given by infants and small children: the body loses tonus and sinks or drops to the ground, the gestures are those of helplessness. Pain and grief may be so strong that control is lost not only over the body's posture but also over the mind's awareness. In such cases the afflicted person may carry out actions endangering himself or others. In general, these behavior patterns resemble those of infants in situations of distress and danger, and it is not surprising that the response of the members of the group is basically parental: taking care, assisting and consoling.Perceptive and behavioral patterns which developed in the course of avian and mammalian phylogeny to serve the well-being of the young have proven, as was shown by Eibl-Eibesfeldt, to be powerful building blocks for actions in other spheres of human interaction. Most decision-making research in economics focuses on individual decisions. Yet, we know, from psychological research in particular, that individual preferences can be sensitive to social pressures. In this paper, we study the impact of a group environment on individual preferences for risky and ambiguous prospects. In our experiment, each participant was invited to make a series of lottery-choice decisions in two different conditions. In the Alone condition, individuals made private choices, whereas in the Group condition, individuals belonged to a three-person (...) group and group members’ choices were aggregated according to either a majority or unanimity rule. This design allows us to study the impact of a group environment on individuals’ attitude towards both risky and ambiguous prospects, while controlling for the decision rule used in the group. Our experimental results show that when individuals are in the Group condition, they tend to be less risk averse and more ambiguity averse than when they are not part of a group. Our experiment also suggests that the decision rule matters as it shows that these two trends tend to be stronger when the group implements a unanimity rule. Specifically, we found that individuals who belong to a group implementing a unanimity rule are significantly less risk averse than individuals who belong to a group that relies on the majority rule. We obtained a similar—but non-significant—result under ambiguity. (shrink)

The assumption in current U.S. mainstream medicine is that birthing requires hospitalization. In fact, while the American College of Obstetricians and Gynecologists supports the right of every birthing person to make a medically informed decision about their delivery, they do not recommend home birth owing to data indicating greater neonatal morbidity and mortality. In this article, we examine the evidence surrounding home birth in the United States and its current limitations, as well as the ethical considerations around birth setting.

Kuhn claimed that several algorithms can be defended to select the best theory based on epistemic values such as simplicity, accuracy, and fruitfulness. In a recent paper, Okasha :83–115, 2011) argued that no theory choice algorithm exists which satisfies a set of intuitively compelling conditions that Arrow had proposed for a consistent aggregation of individual preference orderings. In this paper, we put forward a solution to avoid this impossibility result. Based on previous work by Gaertner and Xu, we suggest to (...) view the theory choice problem in a cardinal context and to use a general scoring function defined over a set of qualitative verdicts for every epistemic value. This aggregation method yields a complete and transitive ranking and the rule satisfies all Arrovian conditions appropriately reformulated within a cardinal setting. This article describes the current status of nursing ethics in the curriculum taught in schools of higher education for nurses in The Netherlands. This paper discusses the ethical implications of perverse incentives with regard to autonomous driving. We define perverse incentives as a feature of an action, technology, or social policy that invites behavior which negates the primary goal of the actors initiating the action, introducing a certain technology, or implementing a social policy. As a special form of means-end-irrationality, perverse incentives are to be avoided from a prudential standpoint, as they prove to be directly self-defeating: They are not just a form of (...) unintended side effect that must be balanced against the main goal or value to be realized by an action, technology, or policy. Instead, they directly cause the primary goals of the actors—i.e., the goals that they ultimately pursue with the action, technology, or policy—to be “worse achieved”. In this paper, we elaborate on this definition and distinguish three ideal-typical phases of adverse incentives, where only in the last one the threshold for a perverse incentive is crossed. In addition, we discuss different possible relevant actors and their goals in implementing autonomous vehicles. We conclude that even if some actors do not pursue traffic safety as their primary goal, as part of a responsibility network they incur the responsibility to act on the common primary goal of the network, which we argue to be traffic safety. The memory wave in the humanities has contributed to the impressive revival of cultural history, but the success of memory studies has not been accompanied by significant conceptual and methodological advances in the research of collective memory processes. Most studies on memory focus on the representation of specific events within particular chronological, geographical, and media settings without reflecting on the audiences of the representations in question. As a result, the wealth of new insights into past and present historical cultures cannot (...) be linked conclusively to specific social collectives and their historical consciousness. This methodological problem is even enhanced by the metaphorical use of psychological and neurological terminology, which misrepresents the social dynamics of collective memory as an effect and extension of individual, autobiographical memory. Some of these shortcomings can be addressed through the extensive contextualization of specific strategies of representation, which links facts of representation with facts of reception. As a result, the history of collective memory would be recast as a complex process of cultural production and consumption that acknowledges the persistence of cultural traditions as well as the ingenuity of memory makers and the subversive interests of memory consumers. The negotiations among these three different historical agents create the rules of engagement in the competitive arena of memory politics, and the reconstruction of these negotiations helps us distinguish among the abundance of failed collective memory initiatives on the one hand and the few cases of successful collective memory construction on the other. For this purpose, collective memory studies should adopt the methods of communication and media studies, especially with regard to media reception, and continue to use a wide range of interpretive tools from traditional historiography to poststructural approaches. From the perspective of collective memory studies, these two traditions are closely related and mutually beneficial, rather than mutually exclusive, ways of analyzing historical cultures. (shrink)

The fragility of the subject is a recurring issue in the work of Anne Enright, one of Ireland's most remarkable and innovative writers. It is this specific interest, together with her attempt to make women into subjects, that inevitably links her work to Bracha Lichtenberg-Ettinger's theory of the matrixial borderspace, a feminine sphere that coexists with the Lacanian symbolic order and that, even before our entrance into this linguistic system, informs our subjectivity. By turning to a point in time before (...) language—the encounter between “self” and “other” during pregnancy—both Enright and Ettinger test the boundaries of and the gaps within the linguistic system. It is the going before language that ultimately enables both to go beyond some of the most persistent dualisms present within the linguistic system and to create room for an alternative—a feminine—understanding of the ethical relationality between self and other. Wulf Gaertner provides a comprehensive account of an important and complex issue within social choice theory: how to establish a social welfare function while restricting the spectrum of individual preferences in a sensible way. Gaertner's starting point is K. J. Arrow's famous 'Impossibility Theorem', which showed that no welfare function could exist if an unrestricted domain of preferences is to be satisfied together with some other appealing conditions. A number of leading economists have tried to provide avenues out of (...) this 'impossibility' by restricting the variety of preferences: here, Gaertner provides a clear and detailed account, using standardized mathematical notation, of well over forty theorems associated with domain conditions. Kierkegaard geht es vielmehr darum, wie man die eigenständige, persönliche Sinnfindung des Gesprächspartners anregen kann, ohne dies durch die eigene Rede zu beeinflussen. Das Buch untersucht, welche sprachlichen und textuellen Maßnahmen diesem Programm geschuldet (...) sind. Mit Rekurs auf das Denken des theologisch weitgehend abstinenten Ludwig Wittgenstein wird deutlich, daß dieses Problem nicht nur religiöse Rede affiziert und daß das Ideal direkter Mitteilung fragwürdig ist. Une vie vécue est inséparable de ses formes, de ses modalités, de ses régimes, de ses gestes, de ses façons, de ses allures... qui sont déjà des idées. Le monde, tel que nous le partageons et lui donnons sens, ne se découpe pas seulement en individus, en classes ou en groupes, mais aussi en "styles", qui sont (...) autant de phrasés du vivre, animé de formes attirantes ou repoussantes, habitables ou inhabitables, c'est-à-dire de formes qualifiées : des formes qui comptent, investies de valeurs et de raisons d'y tenir, de s'y tenir, et aussi bien de les combattre. C'est sur ce plan des formes de la vie que se formulent aujourd'hui beaucoup de nos attentes, de nos revendications, et surtout de nos jugements. C'est toujours d'elles que l'on débat, et avec elles ce sont des idées complètes du vivre que l'on défend ou que l'on accuse. Une forme de vie ne s'éprouve que sous l'espèce de l'engagement, là où toute existence, personnelle ou collective, risque son idée. Vouloir défendre sa forme de vie, sans tapage, en la vivant, mais aussi savoir en douter et en exiger de tout autres, voilà à quoi l'histoire la plus contemporaine redonne de la gravité. Bien au-delà du champ de l'art, Marielle Macé propose la construction critique d'une véritable stylistique de l'existence. This paper distinguishes between two main questions regarding the notion of privacy: “What is privacy?” and “Why do/should we value privacy?”. In developing a social-ontological recognitional model of privacy, it gives an answer to the first question. According to the SORM, Privacy is a second order quality of roles within social practices. It is a function of who is or should be recognized as a “standard authority”. Enjoying standard authority means to have the right to interpret and contest role behavior (...) and role obligations within a specific practice, as well as evaluate the normative structure, the fundamental practice norms as well as the roles and their status. The SORM utilizes the concept of standard authority to explicate privacy with regard to two categories that capture the relevant phenomena of privacy: decisional and informational privacy. Within a practice, an actor is said to have decisional privacy if she as a BCR does not recognize bearers of accidental roles as standard authorities. Vice versa, an actor is said to enjoy informational privacy if all other BCRs recognize her as a standard authority. Additionally, the requirement of mutual recognition by the practice participants as standard authorities introduces a “weak normativity” into the theory, which can be used to identify deficient privacy arrangements within practices. This technique is also used more and more frequently to generate rainfall and avoid agricultural droughts. This type of 'sky colonization' or climate militarization is a profanation of language as much as of nature: to "sow the clouds" (or "grow meat")—even language tells us something is wrong…)It took a great amount of time and much denial before widespread bodily infection and industrial pollution's public health effects could be recognized. The McGurk illusion occurs when listeners hear an illusory percept, resulting from mismatched pairings of audiovisual speech stimuli. Hearing a third percept—distinct from both the auditory and visual input—has been used as evidence of AV fusion. We examined whether the McGurk illusion is instead driven by visual dominance, whereby the third percept, e.g., “da,” represents a default percept for visemes with an ambiguous place of articulation, like/ga/. Participants watched videos of a talker uttering various consonant vowels with and without audios (...) of/ba/. Individuals transcribed the CV they saw or heard. In the V-only condition, individuals predominantly saw “da”/“ta” when viewing CVs with indiscernible POAs. Likewise, in the AV condition, upon perceiving an illusion, they predominantly heard “da”/“ta” for CVs with indiscernible POAs. The illusion was stronger in individuals who exhibited weak/ba/auditory encoding. In Experiment2, we attempted to replicate these findings using stimuli recorded from a different talker. The V-only results were not replicated, but again individuals predominately heard “da”/“ta”/“tha” as an illusory percept for various AV combinations, and the illusion was stronger in individuals who exhibited weak/ba/auditory encoding. These results demonstrate that when visual CVs with indiscernible POAs are paired with a weakly encoded auditory/ba/, listeners default to hearing “da”/“ta”/“tha”—thus, tempering the AV fusion account, and favoring a default mechanism triggered when both AV stimuli are ambiguous. Prenatal ultrasound use is skyrocketing despite limited evidence of improved outcomes. One factor driving this trend is the widely recognized psychological appeal of real-time fetal imaging. Meanwhile, considering imperfect safety evidence, U.S. professional guidelines dictate that prenatal ultrasound—a screening test—should be governed by expected clinical benefits—an opportunity for intervention. However, when women’s healthcare professionals themselves are pregnant, their access to ultrasound technology permits informal, personal use that may deviate from standard-of-care, e.g., for reassurance. Highlighting a poignant case wherein a pregnant (...) obstetrician’s personal ultrasound use had unforeseen negative consequences, we explore this issue within context of professional ethics and informal medical care. We discuss how women’s health professionals’ self-care may influence and inform prenatal care at large. We advocate curtailing informal prenatal ultrasound use, but also potentially broadening accepted indications for or relaxing proscriptions against ultrasounds for patients. Further research and updated, evidence-based, ethically-sound guidelines are needed. (shrink)

Common hospital and surgical center responses to the Covid‐19 pandemic included curtailing “elective” procedures, which are typically determined based on implications for physical health and survival. However, in the focus solely on physical health and survival, procedures whose main benefits advance components of well‐being beyond health, including self‐determination, personal security, economic stability, equal respect, and creation of meaningful social relationships, have been disproportionately deprioritized. We describe how female reproduction‐related procedures, including abortion, surgical sterilization, reversible contraception devices and in vitro fertilization, (...) have been broadly categorized as “elective,” a designation that fails to capture the value of these procedures or their impact on women's overall well‐being. We argue that corresponding restrictions and delays of these procedures are problematically reflective of underlying structural views that marginalize women's rights and interests and therefore threaten to propagate gender injustice during the pandemic and beyond. Finally, we propose a framework for triaging reproduction‐related procedures during Covid‐19 that is more individualized, accounts for their significance for comprehensive well‐being, and can be used to inform resumption of operations as well as subsequent restriction phases. Background: Little is known about U.S. healthcare provider views and practices regarding evidence, counseling, and shared decision-making about in-hospital versus out-of-hospital birth settings. Methods: We conducted 19 in-depth, semistructured, qualitative interviews of eight obstetricians, eight midwives, and three pediatricians from across the United States. Interviews explored healthcare providers’ interpretation of the current evidence and their personal and professional experiences with childbirth within the existing medical, ethical, and legal context in the United States. Results: Themes emerged concerning risks and benefits, decision-making, (...) and patient-provider power dynamics. Collectively, the narratives illuminated fundamental ideological tensions between in- and out-of-hospital providers arising from divergent assignment of value to described risks and benefits. The majority of physicians focused on U.S.-specific data demonstrating increased neonatal morbidity and mortality associated with delayed access to hospital-based interventions, thereby justifying hospital birth as the standard of care. By contrast, midwives emphasized data demonstrating fewer interventions and superior maternal and neonatal outcomes in high-income European countries, where out-of-hospital birth is more common for low-risk birthing people. A key gap in counseling was revealed, as no interviewees offered anticipatory counseling regarding birth setting options. Providers directly and indirectly illustrated the propensity for asymmetric power relations between birth providers and pregnant people, especially in hospital settings. Conclusions: The narratives highlight the common goal of optimizing maternal and neonatal outcomes despite tensions arising from divergent prioritization of specific maternal and neonatal risks. Our findings suggest opportunities to foster collaboration and optimize outcomes via mutual respect and improved integration of care. (shrink)
