When adopted in 1991, the French Loi Evin was pioneering as one of the first in the world to regulate alcohol marketing as extensively. This short contribution assesses whether it remains fit for purpose over 30 years later. To this effect, it assesses its main provisions, considers the legislative amendments that have ensued as well as the extensive interpretation French courts have given of its scope, before concluding that the prospects for its revisions are limited in the near future.

Pourquoi a-t-on raison de se révolter contre l'homme-machine et le monde mécanique qu'entraînent les mutations technologiques incontrôlées? Et si, contre les robots, la fragilité faisait l'humanité? Un traité philosophique, un manuel de combat. Dans cet essai de philosophie contemporaine, Pascal Marin rassemble un large faisceau d'arguments contre ceux qui entendent faire de l'homme une machine. De chapitre en chapitre, il dénonce le fantasme du transhumanisme californien, qui s'exporte aujourd'hui à travers des médias en mal de sujets. Mais selon Marin, cette (...) crise du sens de l'humain est peut-être une chance pour la pensée : elle contraint à mieux prendre la mesure de la vie qui demeure énigmatique à la science. Cette enquête d'anthropologie radicale progresse donc par des chemins insolites jusqu'à atteindre à l'ironie d'un constat paradoxal : ce pouvoir technicien fascinant, qui semble sans limite, aurait pour cause le rapport intime que l'homme entretient depuis toujours avec le raté, la panne, le bug, bref tout ce qui peut mettre justement une machine en défaut. In this article, a chapter from a more general study, the butterfly is considered as an arresting `index', highlighting the evolution of children's culture and the relationships between science and literature. Comparing Furetière's knowledge of this insect, as set out in his Dictionnaire universel (1690), to its literary representations in Charles Perrault's or Fénelon's tales, helps to assess the context in which children's literature came to be written within the higher circles of the Versailles Court society. It also explains some (...) aspects of the `Querelle des Anciens et des Modernes'. Flying the flag for modernism, the butterfly stands in rhetorical opposition to the industrious bee or `zephyr' of the pastoral and idyll, as a sign of liberated childhood. An epilogue shows that butterflies in contemporary writings for children offer a postmodern illustration of the baroque trend that was initiated in children's literature at the end of the 17th century, and impart a special flavour to some of the most popular tales and picture-books. Poussin, à Rome, dit du Caravage qu'il était venu au monde pour détruire la peinture et cependant il est dit aussi qu'il possédait l'art de peindre tout entier. Ce livre cherche non point à résoudre une contradiction mais plutôt à développer une inconsistance du système représentatif dans le procès de peindre de Poussin au Caravage et vice versa. Il y sera donc question de mimésis et de fantaisie, d'histoire et d'action, de perspective et de ténèbres, de mort et de décapitation...

L'actuel regain d'intérêt pour la philosophie témoigne de l'attente la plus légitime qui soit, eu égard aux prétentions traditionnelles et à l'aura de cette discipline, mais également la plus difficile à satisfaire : qu'elle mène celui qui épouse ses chemins à une véritable réappropriation de sa propre existence, à une recréation personnelle. Impossible ici de se satisfaire d'un horizon de consolations aimables et de recettes de prospérité, non plus que de vertiges théorisants ou d'érudition monomaniaque. Face à un monde qui (...) semble avoir d'avance consumé nos élans et consommé nos révoltes, les postures et commodités ne sont plus de mise. Un retour d'authenticité s'impose à l'engagement philosophique lui-même. En fait, la mise à l'épreuve de soi est passage obligé, dès lors que de mort de Dieu en chute des idoles de remplacement, nul ne peut plus prétendre faire surgir la valeur irréductible de l'humain d'ailleurs que de l'homme... D'où la pertinence et l'attrait de l'exploration, ici proposée, des voies traditionnelles et ressorts nouveaux d'une maïeutique propre à faire naître l'homme à lui-même, à travers la mise à nu et le retrait de tous les masques que nous imposent la vie en société et le respect de ses codes. Poussant au déracinement du moi comme à une étape nécessaire au dévoilement de notre vérité, les auteurs de cet essai s'inscrivent dans la lointaine filiation de ces philosophes de l'Antiquité (Stoïciens, Cyniques) qui vivaient leur philosophie comme un travail sur soi, voire une ascèse, et dans le prolongement de tout ce pan de la pensée contemporaine qui, avec Foucault notamment, s'est employé à armer la philosophie d'un pouvoir maximal de transformation croisée de celui qui s'y adonne et du social qui l'environne. Résumé Comment une histoire matérielle de l’abstraction peut-elle servir l’histoire intellectuelle ou bien l’histoire des sciences, cela à l’encontre de l’histoire des idées et des généalogies rétrospectives? L’objet est ici l’œuvre de connaissance telle qu’elle est ancrée dans son cadre historique. Cette histoire intellectuelle déborde les coupes disciplinaires. L’article en offre plusieurs exemples qui partent de la recherche de différenciations explicables entre des pratiques intellectuelles d’abstraction. Une séquence s’ouvre alors avec l’émergence d’une conception, puis la formation de théories et finalement (...) la consolidation d’un corpus de choses tenues pour évidentes. The practice of taking hand-written notes in lectures has been rediscovered recently because of several studies on its learning efficacy in the mainstream media. Students are enjoined to ditch their laptops and return to pen and paper. Such arguments presuppose that notes are taken in order to be revisited after the lecture. Learning is seen to happen only after the event. We argue instead that student’s note-taking is an educational practice worthy in itself as a way to relate to the (...) live event of the lecture. We adopt a phenomenological approach inspired by Vilém Flusser’s phenomenology of gestures, which assumes that a gesture like note-taking is always an event of thinking with media in which a certain freedom is expressed. But Flusser’s description of note-taking focusses on the individual note-taker. What about students’ note-taking in a lecture hall as a collective gesture? Nietzsche considered note-taking ‘mechanical,’ as if students were automatons who mindlessly transcribed a verbal flow, while Benjamin considered it an inaesthetic gesture: at best, boring; at worst, ‘painful to watch.’ In contrast, we argue that the educational potentiality of note-taking—or better, note-making—can be grasped only if we account for its mediaticity (as writing that displaces the voice), together with but distinct from its political potentiality as a collective mediality (as a ‘means without end’). Note-taking enables us to see how collective thinking emerges in the lecture, a kind of thinking that belongs neither to the lecturer nor the student, but emerges in the relation of attention established between the lecturer, students and their object of thought. The classification of ageing as a disease is fundamental to developing new pharmacological strategies that can target said phenomenon. The European Medicines Agency does not do this and maintains a questionable perspective based on the traditional naturalistic argument and the value-free ideal. An alternative is proposed which, inspired by consequentialism, is committed to considering ageing as a disease in European regulatory contexts as long as the ethical consequences are desirable. Within a realistic framework, I show that making this decision would (...) have moderate positive effects such as increased knowledge about antiageing pharmacology or potential greater chances of completing vital projects. Furthermore, we will see that the main arguments used by critics to show that the negative effects outweigh the positive ones are not sound. Therefore, I conclude that it would be beneficial for the European Medicines Agency to change its position on ageing. (shrink)

Dada la necesidad de formalizar un espacio de reflexión y discusión sobre los problemas y autores correspondientes al período de la antigüedad grecorromana, desde la Universidad Tecnológica de Pereira ingeniaron y materializaron el desarrollo de un foro académico. Con miras a la difusión y acrecentamiento de los estudios sobre el pensamiento grecolatino, se piensa para la región cafetera colombiana un avance importante en cuanto a la propuesta de proyectos y de actividades de talante dialógico a ejemplo de los países latinoamericanos (...) y europeos en que esos estudios poseen mayor alcance. De aquí que, para efectos del fortalecimiento de lo clásico en la academia colombiana, se convoca bianualmente al nominado Foro Internacional de Filosofía Antigua en la ciudad de Pereira. (shrink)

Theoretical ethology allows computational neuroscience to understand brains from the perspective of their owners.

The current literature shows great interest in the issue of gender diversity on boards of directors. Some studies have hypothesized a direct relationship between diversity and the value of the firm, but not many examine the intermediate mechanisms that may exert an influence on such relationships. We employ two stages of GMM estimation methodology to exhibit evidences of the relationship between gender diversity and compensation of top managers in the Spanish context. Results show that gender diversity positively affects the effectiveness (...) of boards—in terms of composition, structure, size and functioning—influencing a proper design of top managers compensation linked to company performance. Evidences suggest that legislative actions aimed at increasing the presence of women on boards of directors are justified not only for ethical reasons, but also for reasons of economic efficiency. In this article, we suggest that the study of social interactions and the development of a “sense of agency” in joint action can help determine the content of relevant explanations to be implemented in artificial systems to make them “explainable.” The introduction of automated systems, and more broadly of Artificial Intelligence, into many domains has profoundly changed the nature of human activity, as well as the subjective experience that agents have of their own actions and their consequences – an experience (...) that is commonly referred to as sense of agency. We propose to examine the empirical evidence supporting this impact of automation on individuals’ sense of agency, and hence on measures as diverse as operator performance, system explicability and acceptability. Because of some of its key characteristics, AI occupies a special status in the artificial systems landscape. We suggest that this status prompts us to reconsider human–AI interactions in the light of human–human relations. We approach the study of joint actions in human social interactions to deduce what key features are necessary for the development of a reliable sense of agency in a social context and suggest that such framework can help define what constitutes a good explanation. Finally, we propose possible directions to improve human–AI interactions and, in particular, to restore the sense of agency of human operators, improve their confidence in the decisions made by artificial agents, and increase the acceptability of such agents. El texto plantea la importancia del oikos griego en tanto referente simbólico que puede permitir, en condiciones de adversidad, la construcción de una estética de la existencia que se constituya en una opción para seguir viviendo cuando las condiciones son desfavorables para la existencia de la vida y para la vivencia del hogar, es decir, en escenarios de conflicto como los que actualmente viven muchas personas en condición de refugiados, de inmigrantes, de asilados; así también quienes están secuestrados y aquellos (...) que viven el desplazamiento forzado y ambiental. Tomaremos como referente de la adversidad lo sucedido en el campo de concentración de Auschwitz para relacionar aquellos hechos de crueldad con muchas de las situaciones que acontecen hoy en el panorama global. Background Non-invasive prenatal testing (NIPT), which can screen for aneuploidies such as trisomy 21, is being implemented in several public healthcare systems across Europe. Comprehensive communication and information have been highlighted in the literature as important elements in supporting women’s reproductive decision-making and addressing relevant ethical concerns such as routinisation. Countries such as England and France are adopting broadly similar implementation models, offering NIPT for pregnancies with high aneuploidy probability. However, we do not have a deeper understanding of how professionals’ (...) counselling values and practices may differ between these contexts. Methods In this paper, we explore how professionals in England and France support patient decision-making in the provision of NIPT and critically compare professional practices and values. We draw on data from semi-structured interviews with healthcare professionals. Results Both English and French professionals emphasised values relating to patient choice and consent. However, understandings and application of these values into the practice of NIPT provision differed. English interviewees placed a stronger emphasis on interpreting and describing the process of counselling patients and clinical care through a “principle” lens. Their focus was on non-directiveness, standardisation, and the healthcare professional as “decision-facilitator” for patients. French interviewees described their approach through a “procedural” lens. Their focus was on formal consent, information, and the healthcare professional as “information-giver”. Both English and French professionals indicated that insufficient resources were a key barrier in effectively translating their values into practice. Conclusion Our findings illustrate that supporting patient choice in the provision of NIPT may be held as an important value in common on a surface level, but can be understood and translated into practice in different ways. Our findings can guide further research and beneficially inform practice and policy around NIPT provision. (shrink)

On July 2021, the UK High Court of Justice heard the Case CO/2066/2020 on the application of Heidi Crowter who lives with Down’s syndrome, and Máire Lea-Wilson whose son Aidan has Down’s syndrome. Crowter and Lea-Wilson, with the support of the disability rights campaign, ‘Don’t Screen Us Out’, have been taking legal action against the Secretary of State for Health and Social Care (the UK Government) for a review of the 1967 Abortion Act: the removal of section 1(1)(d) making termination (...) of pregnancy lawful for ‘severe’ fetal indications detected after 24 weeks' gestation. On 23 September 2021, the High Court dismissed the claim. This action came at a time when non-invasive prenatal testing (NIPT) was introduced into the NHS England Fetal Anomaly Screening Programme for the trisomies 21, 13 and 18. The implementation of NIPT has been heavily criticised, in particular by ‘Don’t Screen Us Out’ campaigners, for increasing fetal selection and discrimination of people living with disabilities. The case of Crowter and Lea-Wilson echoes debates in other European countries such as in France and Germany, where the introduction of NIPT in the public healthcare system has provoked equally vehement public reactions and discussions. The comparison between these three countries allows contextualising the public discourses around NIPT and the ground for termination of pregnancy in relation to different socio-cultural and political contexts. We examine how each country, and particularly England, deals with the conflict between the principles of promoting the rights of people living with disabilities and preserving women’s reproductive autonomy. Despite the triumphant rhetoric of mechanistic materialism, current biology has no shortage of unsolved fundamental problems. In 1981, seeking a way forward, Rupert Sheldrake proposed the hypothesis of “formative causation” as a unifying organizing principle of life. Expanding the concept of morphogenetic fields, Sheldrake posited a spatio‐temporal connection termed “morphic resonance” whereby the more often a self‐organizing process takes place, the easier it will be for it to take place in the future. After initial acclaim, his project was quickly met (...) with dogmatic skepticism, dismissed as scientific heresy, and ultimately ignored. Forty years later, the experimental implications of his ideas remain largely untested. Visionary or not, Sheldrake's case illustrates the conceptual resistance of the scientific enterprise to revise its own deepest theoretical commitments. Beyond career‐building selection pressures, young researchers need to be presented with the major questions in their field and encouraged to entertain radically alternative points of view. Este artículo plantea que ciertas situaciones en las que nos vemos obligados a prestar atención a los riesgos que tomamos al confiar, como la amenaza de violencia o la ruptura de la confianza, motivan una forma particular de confianza en la cual nos interesa tomar consciencia de las creencias, valoraciones e intenciones prácticas implicadas al confiar. Tras describir fenomenológicamente, desde una perspectiva husserliana, la estructura de esta forma de confianza, denominada confianza reflexiva o racional, se expone por qué su análisis (...) filosófico puede contruibuir a aclarar problemáticas epistemológicas y éticas que se desprenden del carácter social de nuestra existencia. En la parte final del artículo se sugiere que el concepto de confianza reflexiva o racional puede servir para entender problemáticas relacionadas con la posverdad y para discernir algunas formas básicas de dominación y de complicidad con la dominación. This article discusses C. E. Alchourrdn and E. Bulygin's ideas regarding the distinction between strong permission and weak permission. The author takes for granted that the distinction between the two terms should be placed at the level of the assertive metalanguage about norms. But the symbolizations and the definitions of strong and weak permissions offered by Alchourrdn and Bulygin, as well as their thesis concerning the relations between the two concepts are challenged.

El presente artículo hace un recorrido histórico de los procesos lógicos para lograr una formalización rigurosa del lenguaje. Desde sus inicios en Grecia hasta las propuestas contemporáneas de la lógica simbólica o matemática. Se realiza una ubicación general de los avances en las diferentes épocas para luego explicar el proceso de formalización lógico del lenguaje cotidiano a partir de la lógica clásica; luego de ello se postulan algunas limitaciones de la formalización clásica y se procede a explicar el proceso moderno (...) de formalización; en un tercer momento, se hace referencia a la importancia del manejo formal del lenguaje en el análisis del discurso y la validación de teorías cientí cas, valorando el lenguaje formal de la lógica y de la matemática como sistemas para la construcción de la ciencia. La formalización del lenguaje apoya con veracidad los manejos de la argumentación cientí ca y que luego se puede traducir en aplicaciones tecnológicas. El objetivo del artículo es analizar los procesos de formalización del lenguaje a través de un análisis histórico de la lógica, para la determinación de los elementos lógicos que aportan a la formalización del lenguaje y a la construcción de argumentos cientí cos válidos; y, se alcanzará por medio del planteamiento de las preguntas: ¿Qué aportes losó cos constituyen los postulados más relevantes para la evolución del análisis lógico? ¿Cuáles son las limitaciones que presenta la lógica clásica o aristotélica ante la lógica simbólica estructurada por Frege? ¿Cuáles son los aportes a partir de la formalización lógica del lenguaje para el análisis del discurso y la estructuración de la ciencia? Cet article dresse un état des lieux de l’utilisation de la sémantique distributionnelle en morphologie. L’approche distributionnelle, qui repose sur une représentation vectorielle du sens des mots, s’intègre dans l’évolution empirique que connaît la morphologie depuis quelques années, en contribuant par une analyse quantitative et basée sur les corpus du sens des mots morphologiquement construits. Nous présentons brièvement cette approche, puis nous donnons un aperçu de la diversité de ses utilisations pour la morphologie dérivationnelle, tant théorique que méthodologique.
