In this introduction I give an overview of Carole Hafner’s work and discuss the papers in this volume. The final section offers some more personal reminiscences of Carole and her contribution to the AI and Law community, from myself and other colleagues.

In this paper I recapitulate the ideas of Berman and Hafner (1993) regarding the role of teleology in legal argument. I show how these ideas can be used to address some issues arising from more recent work on legal argument, and how this relates to ideas associated with the New Rhetoric of Perelman. I illustrate the points with a discussion of the classic problem of which vehicles should be allowed in parks.

This study described the relationships between academic class and student moral sensitivity and reasoning and between curriculum design components for ethics education and student moral sensitivity and reasoning. The data were collected from freshman (n = 506) and senior students (n = 440) in eight baccalaureate nursing programs in South Korea by survey; the survey consisted of the Korean Moral Sensitivity Questionnaire and the Korean Defining Issues Test. The results showed that moral sensitivity scores in patient-oriented care and conflict were (...) higher in senior students than in freshman students. Furthermore, more hours of ethics content were associated with higher principled thinking scores of senior students. Nursing education in South Korea may have an impact on developing student moral sensitivity. Planned ethics content in nursing curricula is necessary to improve moral sensitivity and moral reasoning of students. (shrink)

This article discusses the concept of joint attention and the different skills underlying its development. Research in developmental psychology clearly states that the development of skills to understand, manipulate and coordinate attentional behavior plays a pivotal role for imitation, social cognition and the development of language. However, beside the fact that joint attention has recently received an increasing interest in the robotics community, existing models concentrate only on partial and isolated elements of these phenomena. In the line of Tomasello’s research, (...) we argue that joint attention is much more than simultaneous looking because it implies a shared intentional relation to the world. This requires skills for attention detection, attention manipulation, social coordination and, most importantly, intentional understanding. After defining joint attention and its challenges, the current state-of-the-art of robotic and computational models relevant for this issue is discussed in relation to a developmental timeline drawn from results in child studies. From this survey, we identify open issues and challenges that still need to be addressed to understand the development of the various aspects of joint attention and conclude with the potential contribution of robotic models. Nietzsche gilt als ein "Dichterphilosoph", dessen Werk sich der konventionellen Unterscheidung von Literatur und Philosophie entzieht. Das betrifft zum einen seine offensichtliche Vorliebe für literarische Schreibweisen und Textformen, die ein wesentlicher Grund dafür ist, dass Nietzsche sich so schwer auf eindeutige philosophische Positionen festlegen lässt. Damit hängt zum anderen zusammen, dass er, der akademisch ausgebildete Philologe, sich zeit seines Lebens intensiv mit der abendländischen Literatur von der Antike bis zu seiner Gegenwart beschäftigte. Und so wie sein eigenes Schreiben durch vielfältige (...) literarische Einflüsse geprägt wurde, übte er umgekehrt auch eine immense Wirkung auf die nachfolgende Literatur aus. Der Band erkundet in einer exemplarischen Reihe von Beiträgen Nietzsches Verhältnis zur Literatur sowie das Verhältnis der Literatur zu ihm und zeigt neue Wege der Forschung auf. (shrink)

Uncovering the world’s ethnic inequalities is hampered by a lack of ethnicity-annotated datasets. Name-ethnicity classifiers (NECs) can help, as they are able to infer people’s ethnicities from their names. However, since the latest generation of NECs rely on machine learning and artificial intelligence (AI), they may suffer from the same racist and sexist biases found in many AIs. Therefore, this paper offers an algorithmic fairness audit of three NECs. It finds that the UK-Census-trained EthnicityEstimator displays large accuracy biases with regards (...) to ethnicity, but relatively less among gender and age groups. In contrast, the Twitter-trained NamePrism and the Wikipedia-trained Ethnicolr are more balanced among ethnicity, but less among gender and age. We relate these biases to global power structures manifested in naming conventions and NECs’ input distribution of names. To improve on the uncovered biases, we program a novel NEC, N2E, using fairness-aware AI techniques. We make N2E freely available at www.name-to-ethnicity.com. (shrink)

In recent literature, panpsychism has been defended by appeal to two main arguments: first, an argument from philosophy of mind, according to which panpsychism is the only view which successfully integrates consciousness into the physical world (Strawson 2006; Chalmers 2013); second, an argument from categorical properties, according to which panpsychism offers the only positive account of the categorical or intrinsic nature of physical reality (Seager 2006; Adams 2007; Alter and Nagasawa 2012). Historically, however, panpsychism has also been defended by appeal (...) to a third argument based on considerations about the nature and observability of causation. This argument has not been much discussed in recent times. Here is a concise version from William James: "… the concrete perceptual flux, taken just as it comes, offers in our own activity-situations perfectly comprehensible instances of causal agency … If we took these experiences as the type of what actual causation is, we should have to ascribe to cases of causation outside of our life, to physical cases also, an inwardly experiential nature. In other words, we should have to espouse a so-called “pan-psychic” philosophy" (James 1911: 218). James here suggests that we have direct experience of causation in our own agency. He thereby directly contradicts David Hume, who famously denied that we have any experience of causation. James goes on to claim that if this experience is representative of causation in general, it follows that all causation is mental, and that panpsychism is true. This kind of argument for panpsychism can be called the argument from (experience of) causation. This chapter offers, first, a history of this argument and arguments closely related to it, and second, an analysis of the argument – is it valid, are its premises in any way defensible, and how does it relate to the other, more popular arguments for panpsychism from philosophy of mind and categorical properties? This paper is an update of the documents we have concerning the Acts of the Christian martyrs, focused on three main aspects: 1) the kind of acts we know of and their classification from the point of view of their historic value; 2) the versions or editions of the texts that are most accepted by scholars; 3) the relevance of the different parts that make up these documents in order to discern the original text from passages that were rewritten or (...) underwent later variations. In this way, the article offers an exhaustive list of the documents for use in researching Christian martyrs in the Roman period. (shrink)

This is the first comprehensive study of Nietzsche's earliest (and extraordinary) book, The Birth of Tragedy (1872). When he wrote it, Nietzsche was a Greek scholar, a friend and champion of Wagner, and a philosopher in the making. His book has been very influential and widely read, but has always posed great difficulties for readers because of the particular way Nietzsche brings his ancient and modern interests together. The proper appreciation of such a work requires access to ideas that cross (...) the boundaries of conventional specialisms. This is now provided by M. S. Silk and J. P. Stern in their joint study of Nietzsche's book. They examine in detail its content, style and form; its strange genesis and hybrid status; its biographical background and the controversy engendered by its publication; its value as an account of ancient Greek culture and as a theory of tragedy and music; its relation to other theories of tragedy; and its place in the history of German ideas and in Nietzsche's own philosophical career. This article seeks to explain the variable implementation of gender mainstreaming as a `policy frame' over time and across various international organisations (I.O.s). In the years since the U.N. Fourth World Women's Conference in Beijing (1995),mainstreaming has been endorsed and adopted by a wide range of international organisations, and we compare the adoption and implementation of mainstreaming in four specific I.O.s: the World Bank, the United Nations Development Programme, the Organisation for Security and Cooperation in Europe, and the European Union. The rhetorical acceptance of mainstreaming by various international organisations, however, obscures considerable variation in both the timing and the nature of the mainstreaming process within and among organisations. This variation, in turn, can be explained in terms of the categories of political opportunity, mobilising structures and strategic framing, which have been put forward by social movement theorists.
