O decorrer século XIV, o conflito entre o papa e o imperador se esvaiu. Entrementes, os novos estados criavam corpo e os antigos problemas adquiriam nova roupagem. Esse foi o ambiente em que viveu Wyclif. Seu pensamento político possui uma matriz religiosa e sua intenção maior foi a de compreender a Igreja como comunidade de redimidos. Nessa condição ela só é conhecida por Deus e só no juízo final os homens saberão quem pertenceu à verdadeira Igreja. Baseado em Egídio Romano, (...) mas lendo-o em outra clave, justifica a propriedade e o poder através do estado de graça. Em suas críticas à Igreja foi um dos antecessores da Reforma. In the meanwhile, the new states took body and the ancient problems took on new clothes. That was the environment in which Wyclif lived. His political thought owns a religious source, and his major intention was to understand the Church as a community of the redeemed. In such a condition the Church is only known by God, and only in the final judgment men will know who belonged to the true Church. Based on Giles of Rom, but reading him from a different point of view, he justifies property and power through the state of grace. In Hobbes's Theory of the Will, Jurgen Overhoff reveals the religious, ethical, and political consequences of Thomas Hobbes's doctrine of volition. The author gracefully describes how Hobbes's thought was governed by assumptions based firmly in Galilean natural philosophy and orthodox Protestant theology. Denn die kritische Reflexion auf die vorgängig leitenden Interessen, die den Erkenntnisprozessen ihre Richtung geben, entzog der Kantischen Vorstellung den Boden, alle Erkenntnis beruhe allein auf der Selbstbestimmtheit des erkennenden Subjekts.

This article focuses on the question of whether the task of the security authorities to protect public safety can justify unlawful encroachments on fundamental rights committed by them. First, the concept of security is analysed and criticised. This is followed by an analysis of the normative compatibility of the concept of security with the legal system. In particular, the legal principles and the concepts of possibility, probability and risk as standards of assessment for the justification of encroachments on fundamental rights (...) by security authorities as well as predictive policing as measures for determining the concepts are discussed. It is shown that the task of the security authorities to protect public safety cannot justify unlawful encroachments on fundamental rights in any way. (shrink)

Soren Kierkegaard’s Lutheran existentialism represents a distinctively postmetaphysical philosophy of religion, focused in particular on a Christian vision of ethical authenticity. His philosophy continues to pose challenging questions for postmetaphysical philosophers in contemporary pluralistic settings. Focusing on specific works of Kierkegaard, this essay develops three such questions: (1) Can philosophy in a postmetaphysical vein still give advice for the pursuit of the good life, today’s diversity of life styles and values notwithstanding? (2) How can a postmetaphysical philosophy relate to the (...) ethical teachings and truth claims of religious doctrines? Methodenstreit in Economics. This essay offers an account of the Methodenstreit in economics between first Menger and Schmoller and later Max Weber and again Schmoller. It is argued that, for Schmoller, two issues were central; to use economics (widely conceived) as an instrument for economic policy and notably social policy: and to base the science empirically with all the modern methods available. In contrast, the Austrian position had a different view of economics as a science, seeing it more as a (...) system of ideas, which implies a radically different use of empirical evidence. (shrink)

Der Artikel behandelt die Problemstellung inwieweit der Klassik-Begriff als Periodenbegriff sinnvoll ist. Dabei wird herausgearbeitet, dass ein historisch-kritischer Zugang den Begriff als einen Wertungsbegriff aus einer jeweils gegebenen historischen Perspektive zu dechiffrieren vermag.

Arming uninhabited vehicles (UVs) is an increasing trend. Widespread deployment can bring dangers for arms-control agreements and international humanitarian law (IHL). Armed UVs can destabilise the situation between potential opponents. Smaller systems can be used for terrorism. Using a systematic definition existing international regulation of armed UVs in the fields of arms control, export control and transparency measures is reviewed; these partly include armed UVs, but leave large gaps. For preventive arms control a general prohibition of armed UVs would be (...) best. If that is unattainable, several measures should be taken. An explicit prohibition of autonomous attack, that is without a human decision, should be added to IHL. Concerning armed UVs remotely controlled by a human soldier, recommendations differ according to type or mission. New kinds of uninhabited nuclear-weapon carriers should be banned. Space weapons should be prohibited in general. UVs smaller than 0.2–0.5 m should be banned. Bigger remotely controlled armed UVs not equipped with weapons of mass destruction should be subject to numerical limitations in various categories. For these the Treaty on Conventional Armed Forces in Europe is an important precedent. (shrink)

In a case study Kuhn's morphology of scientific revolutions is put to the test in confronting it with the contemporary developments in physics. It is shown in detail, that Kuhn's scheme is not compatible with the situation in physics today.

In _The New Order and Last Orientation,_ Eric Voegelin explores two distinctly different yet equally important aspects of modernity. He begins by offering a vivid account of the political situation in seventeenth-century Europe after the decline of the church and the passing of the empire. Voegelin shows how the intellectual and political disorder of the period was met by such seemingly disparate responses as Grotius's theory of natural right, Hobbes's _Leviathan,_ the role of the Fronde in the formation of the (...) French national state, Spinoza's _Tractatus Theologico-Politicus,_ and Locke's _Second Treatise,_ the blueprint of a modern middle-class society. By putting these responses and the thought of Montesquieu, Hume, and others in the context of the birth pains of the national state and the emergence of a new self-understanding of man, Voegelin achieves a brilliant mixture of political history and profound philosophical analysis. Voegelin's verdict of modernity is pronounced most powerfully in the opening part of "Last Orientation," in the chapter entitled "Phenomenalism." His discussion of the intellectual confusion underlying the modern project of scientistic phenomenalism is the most original criticism leveled against modernity to date. It is at the same time the first step toward a recovery of reality through philosophy conceived as a science of substance in the spirit of Giordano Bruno. Voegelin's first example of such an effort at recovering reality is the chapter on Schelling, one of the spiritual realists who has not been affected by the prevailing rationalist or reductionist creeds that are part of the modern disorder. Schelling's indirect yet powerful influence on Schopenhauer, Nietzsche, and Freud more than justifies Voegelin's interest in his philosophy and character, even though Voegelin would later distance himself from some of Schelling's positions. The volume's concluding chapter, "Nietzsche and Pascal," applies the understanding gained from the study of Schelling to the thought of the most powerful critic of the age, Nietzsche. Nietzsche's self-avowed affinity with Pascal provides the key to an analysis of the strengths and weaknesses of his thought and reaffirms the connection that links the beginning of modernity with its most recent crises and the efforts to overcome them.
