Opening remarks delivered at "Incommensurability (and related matters)" conference, Hanover, June 1999.

The volume is a collection of essays devoted to the analysis of scientific change and stability. It explores the balance and tension that exist between commensurability and continuity on the one hand, and incommensurability and discontinuity on the other. Moreover, it discusses some central epistemological consequences regarding the nature of scientific progress, rationality and realism. In relation to these topics, it investigates a number of new avenues, and revisits some familiar issues, with a focus on the history and philosophy of (...) physics, and an emphasis on developments in cognitive sciences as well as on the claims of “new experimentalists”. The book constitutes fully revised versions of papers which were originally presented at the international colloquium held at the University of Nancy, France, in June 2004. (shrink)

The incident in May-June 2007 involving a U.S. citizen traveling internationally while infected with drug-resistant tuberculosis involved the U.S. federal government's application of its quarantine and isolation powers. The incident and the isolation order raised numerous important issues for public health governance, law, and ethics. This article explores many of these issues by examining how the exercise of quarantine powers provides a powerful lens through which to understand how societies respond to and attempt to govern threats posed by dangerous, (...) contagious pathogens. The article considers historical aspects of governmental power to quarantine and isolate individuals and groups; analyzes the current state of quarantine and isolation law in the United States in light of the recent incident with drug-resistant tuberculosis; and explores global aspects of public health governance and law highlighted by this incident. Dramatic events involving dangerous microbes often focus attention on isolation and quarantine as policy instruments. The incident in May-June 2007 involving Andrew Speaker and drug-resistant tuberculosis joins other communicable disease crises that have forced contemplation or actual application of quarantine powers. Implementation of quarantine powers, which encompasses authority for both isolation and quarantine actions, is important not only for the handling of a specific event but also because the use of such authority provides a window on broader issues of (...) public health and the legal rules, ethical principles, and governance systems that support it. Debates about quarantine powers reflect political and social attitudes about public health that often tell us more about this policy endeavor than acts of isolation and quarantine themselves. For those with advanced life-limiting illness, the optimization of quality of life and avoidance of nonbeneficial treatments at the end of life are key ethical concerns. This article evaluates the efficacy of an Interdisciplinary Ethics Panel (IEP) approach to decision making at the end of life for unbefriended nursing home residents who lack decisional capacity and have advanced life-limiting illness, through the use of a ninestep algorithm developed for this purpose. We reviewed the outcomes of three quality-of-care phased initiatives conducted (...) in our facility, a large public nursing home in New York City, between June 2016 and February 2020, which indicated that this IEP approach promoted advance-care planning, as palliative measures were endorsed to optimize quality of life for this vulnerable population at the end of life. We also examined another quality-of-care initiative when this IEP approach was applied to end-of-life decision making for nursing home residents who had a surrogate during the COVID-19 pandemic. This application appeared to be beneficial in adding more residents to our Palliative Care Program while it improved rates of advance-care planning. When all of the above findings are considered, we believe this novel IEP approach and algorithm have the potential to be applied elsewhere after appropriate assessment. (shrink)

Over the past twenty years, Wettstein has attempted to reconcile his faith with his philosophy, and he brings his personal investment in this mission to the essays collected here. Influenced by the work of George Santayana, Wittgenstein, and A.J. Heschel, Wettstein grapples with central issues in the philosophy of religion such as the relationship of religious (...) practice to religious belief, what is at stake in the debate between atheists and theists, and the place of doctrine in religion. His discussions draw from Jewish texts as well as Christianity, Islam, and classical philosophy. The challenge Wettstein undertakes throughout the volume is to maintain a philosophical naturalism while pursuing an encounter with God and traditional religion. This book brings the ideas of Kant's critical philosophy to bear on one of the leading political and legal questions of our age: under what circumstances, if any, is recourse to war legally and morally justifiable?

This book shows how the traditional concerns of political theory push it increasingly into the study of international relations. This is done, first, by demonstrating how many of the issues usually dealt with by political theory, such as democracy and justice, arise within an increasingly global context and, secondly, by considering how international issues, such as colonialism and war, are best illuminated by building on the work of political theorists. The book is a comparative analysis of all the major social science/political science grand theories. It focuses on developmentalism, dependency theory, the world systems approach, Marxism, institutionalism, rational choice, psychoanalysis, political sociology, sociobiology, environmentalism, neuro-politics, transitions to democracy, and non-Western systems of analysis. To facilitate comparison and analysis, a common framework and outline are employed throughout. An integrating introduction and conclusion help tie the book together.

The loss of the federally protected constitutional right to an abortion is a threat to the already tenuous autonomy of pregnant people, and may augur future challenges to their right to refuse unwanted obstetric interventions. Even before Roe’s demise, pregnancy led to constraints on autonomy evidenced by clinician-led legal incursions against patients who refused obstetric interventions. In Dobbs v. Jackson Women’s Health Organization, the Supreme Court found that the right to liberty espoused in the Constitution does not extend to a (...) pregnant person’s right to an abortion. With Roe’s demise, the right to request specific types of care has been vitiated. The same argument underpinning that holding may now become ballast for attacks on the traditionally more robust right, the right to refuse. Here we discuss how the elevation of fetal and embryonic rights may lead to a cascade of medical intrusions and deprivations of liberty against pregnant persons, and offer an argument opposing these improprieties. In challenging the prevailing paradigm for understanding how the human mind works, Patterns, Thinking, and Cognition is certain to stimulate fruitful debate.

Modes-of-being figure centrally in Heidegger's masterwork Being and Time. Testimony to this is Heidegger's characterisation of two of his most celebrated enquiries—the Existential analytic and the Zeug analysis—as investigations into the respective modes-of-being of the entities concerned. Yet despite the importance of this concept, commentators disagree widely about what a mode-of-being is. In this paper, I systematically outline and defend a novel and exegetically grounded interpretation of this concept. Strongly opposed to Kantian readings, such as those advocated by Taylor Carman (...) and Cristina Lafont, I interpret a mode-of-being as a universal that defines a district —that is, a natural class of entities that ought to be conceptualised in a special way. As such, every mode-of-being plays an important metaphysical and epistemic role: serving both to unify a natural class of a high degree of generality and as the interpretandum of an act yielding the basic-concepts pertaining to the entities therein. In explicating and arguing for this interpretation, I attribute a characteristically Aristotelian philosophical position to the early Heidegger, encompassing both metaphysical and epistemological realism and a conceptualist theory of universals. It has been widely known that in 1992, after some initial resistance, Yoder submitted to a disciplining process initiated by his home congregation for inappropriate advances to women and that he had been reconciled and reunited in worship shortly before his death.1 The new allegations, which have become broadly public only since 2013, are considerably more serious and include coercive—indeed, “violent”—advances toward a number of women over three decades, including many students and others in subordinate positions. Further, Yoder abused the power of his reputation by intimidating the president and other administrators of AMBS, compelling them to keep the matter quiet as he slipped away to a more prestigious appointment at Notre Dame in 1984.2 According to some witnesses, this inappropriate behavior continued at Notre Dame. [End Page 210]These revelations have complicated the process of writing even a simple review.3 Were Yoder an astrophysicist with groundbreaking discoveries regarding dark matter, we would be disappointed with his behavior, but we would not challenge on those grounds the veracity of his discovery. With Christian ethics, the issue is more complicated, especially for someone of Yoder’s stature whose persona suggested that he was committed to and embodied, however imperfectly, what he proclaimed. Reading these volumes a second time has brought several jarring moments. For example, in both volumes, Yoder defines in almost identical language the temptation of “egocentric altruism”:The real temptation of good people like us is not the crude, the crass, and the carnal as those traits are defined in Puritanism. The real refined temptation, with which Jesus himself was tried, was that of egocentric altruism, of being oneself the incarnation of a good and righteous cause for which others are to suffer, of stating our self-justification in the form of a duty to others.(Revolutionary Christianity, 83; Essential Writings, 144)Consider also the following statement on religious liberty, which is certainly prescient in view of the current conflicts being played out in the courts: “Religious liberty is not only a necessary limitation upon the power of the state; it also marks a voluntary renunciation by the church of any capacity to coerce” (Revolutionary Christianity, 11). At the very least, then, perhaps we should read Yoder’s misdeeds as a warning: even we may be tempted by the crude and the carnal as well as by egocentric altruism; when threatened, even we may resort to coercion.The fourteen lectures in Revolutionary Christianity, published here for the first time, are organized into three sections—“The Believers Church,” “Peace,” and “Church in a Revolutionary World”—roughly the order of presentation to predominantly Mennonite and Anabaptist groups in Montevideo and Buenos Aires in May–June 1966. Several factors related to fetal risk render it more or less acceptable in justifying constraints on the behavior of pregnant women. Risk is an unavoidable part of pregnancy and childbirth, one that women must balance against other vital personal and family interests. Two particular issues relate to the fairness of claims that pregnant women are never entitled to put their fetuses at risk: relative risks and relatives' risks. The former have been used—often spuriously—to advance arguments against activities, such as home (...) birth, that may incur risk; the latter implicate the nature of relationships in determining the acceptability of coercing or precluding activities. Motivated reasoning by clinicians and judges leads to inaccurate risk assessments, and judgments based on false claims to objectivity. Such judgments undermine the moral and legal standing of pregnant women and do not advance the interests of fetuses, pregnant women, families, or states. (shrink)

In this major reinterpretation, Howard Caygill argues that all of Benjamin's work is characterized by its focus on a concept of experience derived from Kant but applied by Benjamin to objects as diverse as urban experience, visual art, literature and philosophy. The book analyzes the development of Benjamin's concept of experience in his early writings showing that it emerges from an engagement with visual experience, and in particular the experience of colour.
