We reflect, using a vignette, on conceptual tensions and the value judgements that lie behind difficult decisions about whether or not the older person with dementia should return home or move into long-term care following hospital admission. The paper seeks, first, to expose some of the difficulties arising from the assessment of residence capacity, particularly around the nature of evaluative judgements and conceptual tensions inherent in the legal approach to capacity. Secondly, we consider the assessment of best interests around place (...) of residence, which demonstrates significant conceptual tensions. In addition, ‘best interests’ raise issues around the perception of risk and the perceptions of the family and crucially involve the notions of autonomy and trust. Finally, we not only gesture at some practical considerations based on insights from values-based medicine, but also make the suggestion that we require tighter functional assessments of residence capacity coupled with broader judgements about best interests. Studies of Y chromosome evolution often emphasize gene loss, but this loss has been counterbalanced by addition of new genes. The DAZ genes, which are critical to human spermatogenesis, were acquired by the Y chromosome in the ancestor of Old World monkeys and apes. We and our colleagues recently sequenced the rhesus macaque Y chromosome, and comparison of this sequence to human and chimpanzee enables us to reconstruct much of the evolutionary history of DAZ. We report that DAZ arrived on (...) the Y chromosome about 38 million years ago via the transposition of at least 1.1 megabases of autosomal DNA. This transposition also brought five additional genes to the Y chromosome, but all five genes were subsequently lost through mutation or deletion. The collection brings together a selection of essays on spatiality, difference, cultural aesthetics, and identity in the expanded field of place-making and being.

Whipple disease is a rare, infectious, disease first described from a single case by Whipple in 1907. As well as characterising the clinical and pathological features of the condition, Whipple made two suggestions regarding its aetiology. These were either than the disease was caused by an infectious agent, or that it was of metabolic origin. As the disease is now thought to be caused by infection with the bacterium Tropheryma whipplei, historical reviews of the history of the disease typically mention (...) only the first of these suggestions. In this paper, we therefore revisit Whipple’s other theory. We argue that a diverse and often successful research programme was developed around this mechanism of disease causation which gave rise to many useful findings on the condition. In the later parts of this article, we then turn to discuss the surprising neglect of this period of Whipple disease research in the current literature, and conclude by offering a brief reconstruction of this early history suitable for use in a technical context. The Speculum Ecclesie, by which title it is commonly known, of St Edmund of Abingdon, archbishop of Canterbury, has come down in various versions in Latin, Anglo-Norman, and English. The present edition comprises the original Latin text, which has never before been printed, and for comparison, printed en face, the vulgate Latin text, which is a translation of one of the Anglo-Norman versions.Manuscript evidence suggests that the Speculum must almost certainly have been written before Edmund became archbishop in 1234, and (...) even before the 1220s. The chief authority for the treatise, apart from the scriptures, is High of St Victor, and the Speculum is, in fact, a skilful summa of Hugh's teaching on the life of meditation and contemplation which should be the ideal of the religious. Edmund has drawn together and systemized advice and instruction scattered in many places in Hugh's ascetical and theological writings. (shrink)

This essay reads a short narrative, “Savoir” by Hélène Cixous, to describe susceptibility as a problem organized around two lines of impingement: between subject and world and between consciousness and the wayward impulses of interior life. The young girl in Cixous’s text suffers a moment of disorientation and distress one misty morning and, against presumptions of inviolability and ideals of subjective consistency, this unhappy event comes to resonate with her disappointed trust in the generosity of the world, her anxious sense (...) of betrayal with respect to those who ought to protect her and her insecurity about her own role in this complex of associations. The frame of susceptibility thus opens up a space for Cixous’s reader and this essay to think the subject in her inconsistency and self-strangeness. (shrink)

I develop a broadly reliabilist theory of non-ideal epistemic rationality and argue that if it is correct we should reject the recently popular idea that the standards of non-ideal epistemic rationality are mere social conventions.

Mix & Stir', this book's aim is an endeavour to understand art as being a panhuman phenomenon of all times and cultures; to steer away from the persistent Eurocentric/Western-centric viewpoint towards a transcultural and transnational interconnected model of exchange and processes of interculturalization. Mix & Stir wants to expand this landscape by bringing to the fore new, recalcitrant, queer, idiosyncratic practices and discourses, theories and topics, methods and concerns that open up ways to approach art from a global perspective. Analogous (...) to a cookery book filled with recipes and instruction, Mix & Stir explores new outlooks on contemporary art from global perspectives. It intends to encourage studying art beyond national constraints, cultural dominances, and hierarchies: a voyage similar to that of culinary discovery. The book brings a variety of tastes and flavours to the table, and breaks new ground by allowing innovative, contrary, queer, idiosyncratic practices and discourses, theories and topics, methods, and concerns to access art in its global dimensions. Researchers, curators and artists with a special interest in this topical issue were invited to present, develop, outline, and contemplate compelling frames of reference, both theoretical and artistic, in order to arrive at a true 'world art studies'. Their contributions are structured in seven thematic fields: Undecidability and Spectatorship, Collectives, Circulations, Exhibitions, Artists at Work, Postcolonial Perspectives, and Deep Art History. The term “value of life” can refer to life’s intrinsic dignity: something nonincremental and time-unaffected in contrast to the fluctuating, incremental “value” of our lives, as they are longer or shorter and more or less flourishing. Human beings are equal in their basic moral importance: the moral indignities we condemn in the treatment of e.g. those with dementia reflect the ongoing human dignity that is being violated. Indignities licensed by the person in advance remain indignities, as when people might volunteer (...) their living, unconscious bodies for surrogacy or training in amputation techniques. Respect for someone’s dignity is significantly impacted by a failure to value that person’s very existence, whatever genuine respect and good will is shown by wanting the person’s life to go well. Valuing and respecting life is not, however, vitalism: there can be good and compelling reasons for eschewing some means of prolonging life. (shrink)

This book reconstructs Heidegger’s philosophy of time by reading his work with and against a series of key interlocutors that he nominates as being central to his own critical history of time. In doing so, it explains what makes time of such significance for Heidegger and argues that Heidegger can contribute to contemporary debates in the philosophy of time. Time is a central concern for Heidegger, yet his thinking on the subject is fragmented, making it difficult to grasp its depth, (...) complexity, and promise. Heidegger traces out a history that focuses on the conceptualisations of time put forward by Aristotle, Plotinus, Augustine, Kant, Hegel, Bergson, and Husserl—an “alternative history of time” that challenges how time has been defined and studied within both philosophy and the sciences. This chapter considers the ways in which whiteness as a skin color and ideology becomes a dominant level that sets the background against which all things, people and relations appear. Drawing on Merleau-Ponty's phenomenology, it takes up a series of films by Bruce Nauman and Marlon Riggs to consider ways in which this level is phenomenally challenged providing insights into the embodiment of racialization.

Since its publication in 1918, Oswald Spengler's The Decline of the West has been the object of academic controversy and opprobrium. In their efforts to dispose of it, scholars have resorted to a variety of tactics: bitter invective, icy scorn, urbane mockery, or simply pretending that the book is not there. Yet generations of readers have refused to be warned off, finding in Spengler a prophetic voice and a source of profound intellectual excitement. H. Stuart Hughes's Oswald Spengler offers (...) a judicious and objective reading of Spengler's works that admirably fills the gap between hypercritical invective and naive enthusiasm. This pioneering volume makes clear why Spengler's pessimistic reading of the fate of European civilization continues to resonate with contemporary anxieties. Despite the author's self-imposed intellectual and social isolation, Spengler's work was as Hughes demonstrates, a part of the enormous effort of intellectual reevaluation that has characterized the early twentieth century. Viewing Spengler in the broadest possible perspective, the author places his thought in its cultural relationship to that of such predecessors as Giambattista Vico, Friedrich Nietzsche, and Nikolai Danilevsky and contemporaries including Benedetto Croce, Henri Bergson, and Vilfredo Pareto. Helen Steward argues that determinism is incompatible with agency itself--not only the special human variety of agency, but also powers which can be accorded to animal agents. She offers a distinctive, non-dualistic version of libertarianism, rooted in a conception of what biological forms of organisation might make possible in the way of freedom.

Failure to prevent these harms when it is possible for parents to do so without substantial burdens or costs to themselves or others are what J call “wrongful handicaps”. Derek Parfit has developed a systematic difficulty for any such cases being wrongs — when the harm could be (...) prevented only by preventing the existence of the individual who would have a worthwhile life even with the handicap, then bringing him into existence with the handicap does not make him worse off and so does not wrong him. I argue that a non “person‐affecting” principle requiring the avoidance of suffering and limited opportunity correctly accounts for cases of wrongful handicaps without requiring that the individuals with the handicap have been made worse off and therefore wronged. It is an advantage, not a difficulty, of this account that it does not imply that the person with the handicap has been wronged or is a victim with a special moral complaint. (shrink)

Increasingly the body is a possession that does not belong to us. It is bought and sold, bartered and stolen, marketed wholesale or in parts. The professions - especially reproductive medicine, transplant surgery, and bioethics but also journalism and other cultural specialists - have been pliant partners in this accelerating commodification of live and dead human organisms. Under the guise of healing or research, they have contributed to a new 'ethic of parts' for which the divisible body is severed from (...) the self, torn from the social fabric, and thrust into commercial transactions -- as organs, secretions, reproductive capacities, and tissues -- responding to the dictates of an incipiently global marketplace. Breaking with established approaches which prioritize the body as 'text', the chapters in this book examine not only images of the body-turned-merchandise but actually existing organisms considered at once as material entities, semi-magical tokens, symbolic vectors and founts of lived experience. The topics covered range from the cultural disposal and media treatment of corpses, the biopolitics of cells, sperm banks and eugenics, to the international trafficking of kidneys, the development of 'transplant tourism', to the idioms of corporeal exploitation among prizefighters as a limiting case of fleshly commodity. This insightful and arresting volume combines perspectives from anthropology, law, medicine, and sociology to offer compelling analyses of the concrete ways in which the body is made into a commodity and how its marketization in turn remakes social relations and cultural meanings. David Miller offers us a sophisticated account of how we can reconcile global obligations and duties to co?nationals. In this article I focus on four weaknesses with his account such as the following two. First, there remains considerable unclarity about the strength of the positive duties we have to non?nationals and how these measure up relative to other positive duties, such as the ones Miller believes we have to co?nationals to implement civil, political, or social rights. Second, just how responsibilities (...) for enacting our global commitments will be assigned still needs further development. A unifying theme of my criticisms concerns Miller?s account of how we are to mediate responsibilities to fellow?nationals and the partiality we may defensibly show co?nationals. In the final section I sketch an alternative way of conceptualizing our duties to fellow?nationals and duties to non?nationals, which can give more systematic advice about the partiality we may defensibly show co?nationals. There is much to admire and agree with in Bernard Gert’s book, Morality: Its Nature and Justification. Few philosophers have even attempted to provide the systematic account of the content of morality, what Gert calls the moral system, together with its justification that this book contains. In the brief space available here, I want to focus on a central feature of his account of the moral system of common morality and challenge, first, whether it is in fact a feature of (...) common morality, and, second, whether he has succeeded in justifying that feature. Gert argues that the goal or purpose of morality is to lessen the amount of evil or harm suffered. The first five moral rules do this directly by prohibiting doing actions that cause harm and the second five moral rules do this indirectly by prohibiting actions that typically result in harm. It is a fundamental mistake of consequentialists, according to Gert, to hold that there are also moral requirements to prevent harm and to promote good. In Gert’s view there are two errors here—not distinguishing causing harm from not preventing it, and not distinguishing harm or evil from pleasure or good. Gert’s moral system departs from a much wider range of moral views than consequentialism, however, because he argues there is no moral requirement to prevent harm or to promote good, not just that not causing harm may have some degree of priority over them. To be sure, this latest version of Gert’s theory is importantly improved over the initial version in giving place to moral and utilitarian ideals—the moral ideals include preventing harms and the utilitarian ideals include promoting good—as well as the moral rules, but acting in accord with ideals is only morally encouraged, never morally obligatory, and acting to promote a utilitarian ideal can never justify breaking a moral rule. In 'Meeting Needs', Braybrooke argues that a new and improved version of utilitarianism can be constructed around making a priority of satisfying needs. In this paper I concentrate on Braybrooke's suggestion about the method for determining needs, and more generally, the method of settling issues concerning matters of need. (This emphasis is chosen since these problems are most devastating to his project as currently formulated.) I argue that Braybrooke's method is seriously flawed. Braybrooke believes that the process for settling issues (...) concerning needs guarantees consensus and fairness. I refute this claim by showing that a number of assumptions crucial to Braybrooke's method are unwarranted. In addition, I show that these and other structural defects in the method are such that Braybrooke's account is guilty of paternalism and "fraud", despite his attempts to avoid these charges. I also indicate why similar methods are unlikely to meet with success. -/- . (shrink)
