The Dual State, first published in 1941, remains one of the most erudite books on the legal origins of democracy and dictatorship. It provided the first comprehensive analysis of the rise and nature of National Socialism, and was the only such analysis written from within Hitler's Germany. Fraenkel's concept of the dual state, being the normative state and the the prerogative state. It retains its vital relevance for the theory of democracy in the twenty-first century. The Dual State considerably influenced (...) scholars studying and working on questions of political justice in the period following World War II, particularly in the context of political and legal theory; in the domain of legal history; in the area of constitutional theory; in the context of comparative politics; and in what has become known as the field of comparative constitutional law. This republication of Fraenkel's classic work makes it once again widely available to scholars and students in the field. It includes both Fraenkel's 1974 introduction to the German second edition, never before published in English, and a new introduction by Dr Jens Meierhenrich, examining the world in which The Dual State was originally published, and the lasting legacy of this classic work. Complementary and alternative medicine has become an important section of healthcare. Its high level of acceptance among the general population represents a challenge to healthcare professionals of all disciplines and raises a host of ethical issues. This article is an attempt to explore some of the more obvious or practical ethical aspects of complementary and alternative medicine.

As long-term childhood cancer survivors are at risk for late effects, ongoing medical care is crucial to detect and treat physical illnesses as early as possible. However, previous research from around the world has shown that many adult survivors did not participate in long-term medical follow-up. This study aimed to provide insight into German survivors’ care situation, with a particular focus on barriers to follow-up care. We investigated a sample of adult CCS drawn from the German Childhood Cancer Registry’s oldest (...) cohort. Our analyses included data from a standardized medical examination, a self-report questionnaire, and in-depth interviews with a subsample. Half of the participants reported participating in some kind of medical follow-up. In a logistic regression analysis, attendance of medical follow-up care was associated with higher age. Reasons for non-attendance were assigned to four categories: lack of information about medical follow-up and/or its purpose, termination by the health care provider, structural barriers, and emotional-motivational aspects. The interviews contributed to a better understanding of how these reported barriers played out in the care of individual survivors. Further, they revealed that some survivors currently in medical follow-up had had periods without follow-up care in the past—which were also in many cases related to a lack of information, both on the part of health care providers and CCS themselves. The results indicated that a large proportion of long-term CCS do not receive the recommended follow-up care. Further, there is a great need for more information regarding the aims of long-term medical follow-up and available offers. This is an important prerequisite for CCS to make informed decisions. The author considers Pope John Paul II's 1998 encyclical, Fides et ratio, as bringing into view new horizons for Catholic philosophical theology by virtue of its endorsement of a constrained philosophical pluralism. Through a retrospective examination of the history of magisterial interventions as depicted in the encyclical, the author notes how a progressive openness to philosophical pluralism relates to the changed status of Thomism within magisterial teaching on the practice of Catholic philosophical theology. Fides et ratio describes an evolution in (...) magisterial emphasis from proscription to prescription, which corresponds to change in the status of Thomism from an absolute to an exemplary norm. Attention to this decisive shift in the normative status of Thomism, as implied within the encyclical itself, provides both new illumination on the Pope's general intentions and new clarity with regard to some contested interpretive issues. Finally, the author highlights several new challenges that are implied by this development in magisterial teaching. (shrink)

Oder sind moralische Überzeugungen eher das Produkt unserer Interessen und Neigungen, Ausdruck unserer Wünsche oder Mittel der Machtausübung, das bloße Ergebnis unserer Erziehung, unseres sozialen Umfelds oder gar eine List der Evolution? Ist es eine Illusion, wenn man glaubt, echte moralische Erkenntnisse gewinnen zu können? Kurzum: Kann die Moral Objektivität beanspruchen? Die (...) vorliegende Arbeit versucht, eine Antwort auf diese zentrale Frage der Metaethik zu geben. Dazu wird zunächst gezeigt, dass uns der Status der Moral ein Rätsel ist, weil wir dazu neigen, drei Thesen für wahr zu halten, die nicht zugleich wahr sein können. Die drei prinzipiell möglichen Strategien zur Auflösung dieses Trilemmas geraten jedoch in Schwierigkeiten, weil es bisher nicht gelungen ist, ein passendes Vergleichsobjekt für die Moral zu finden. Indem ich versuchte, von Seiten der Logik aus einen Zugang zu den Grundbegriffen der Mathematik zu gewinnen, erwies es sich vor allem als notwendig, die B e g r i f f s f u n k t i 0 n e'lhsimaher zu zergliedern und auf ihre Voraussetzungen zuruckzufuhren. Hier (...) aber machte sich alsbald eine eigentumliche Schwierigkeit geltend: die her kommliche logische Lehre vom Begriff zeigte sich in ihren bekannten Hauptzugen als unzureichend, die Probleme, zu denen die Prinzipienlehre der Mathematik hinfuhrt, auch nur vollstandig z u b e z e i c h n e n. Die exakte Wissenschaft war hier, wie sich mir immer deutlicher zu ergeben schien, zu Fragen gelangt, fur welche die Formensprache der tradi tionellen Logik kein genaues Correlat besitzt. INTRODUCTION XIII On a number of occasions Mach expressed the sentiment, especially in his correspondence, that America was the land of intellectual freedom and opportunity, the coming frontier for a new radical empiricism that would help to wash metaphysics out of philosophy. In 1901 he sponsored the German edition of Concepts and Theories of Modern Physics (1881) (...) 2 by J. B. Stallo, Cincinnati lawyer and philosopher. Mach warmly endorsed Stallo's book because his scientific aims so closely approximated his own, and because Stallo rejected the latent metaphysical elements and concealed ontological assumptions of the mechanical-atomistic inter­ pretation of the world. The second edition of Wiirmelehre was dedicated to Stallo in 1900. The fourth edition of Populiir-wissenschaftliche Vorlesungen (1910), containing seven new essays, was dedicated to Harvard Professor of physiology, philosophY, and psychology, William James. Mach had a strong intellectual affinity for James' pragmatism because, like himself, he recognized that James had come to radically empirical views from science. Both men took pure pre-conceptualized experience, from which the mental and physical predicates of experience are composed, to be neutral rather than real, unreal, objective or subjective. (shrink)

La spécialisation sans l'universalisme est aveugle mais l'universalisme sans la spécialisation est inconsistant. Pour avoir su concilier l'une avec l'autre, l'ouvrage de E. R. Curtius sur "La littérature européenne et le Moyen âge latin" demeure l'une des sources fondamentales de la réflexion littéraire contemporaine. Il le doit tout d'abord à la rigueur d'une méthode dont l'intransigeante précision ne le cède en rien à celle des sciences de la nature car pour Curtius "la philologie démontre à l'aide des textes, tout comme (...) la géométrie démontre à l'aide des figures." C'est dire que dans cette œuvre l'étude des faits littéraires n'est altérée par aucun présupposé doctrinal étranger à son objet. Il le doit surtout à, l'ampleur de la perspective adoptée qui, de Virgile à Dante et de Vico à Goethe, reconstitue magistralement l'unité de la tradition culturelle latine. (shrink)

Para ele, como para o introdutor, em vez de resumir-se essencialmente ao aprendizado da história da filosofia e à leitura dos grandes filósofos, o ensino dessa disciplina – algo (...) como uma “arte” – deveria incluir, desde o começo, o exercício da argumentação sobre temas e problemas e a redação de textos curtos nessa linha. The paper introduces a new type of rules into Natural Deduction, elimination rules by composition. Elimination rules by composition replace usual elimination rules in the style of disjunction elimination and give a more direct treatment of additive disjunction, multiplicative conjunction, existence quantifier and possibility modality. Elimination rules by composition have an enormous impact on proof-structures of deductions: they do not produce segments, deduction trees remain binary branching, there is no vacuous discharge, there is only few need of permutations. This new (...) type of rules fits especially to substructural issues, so it is shown for Lambek Calculus, i.e. intuitionistic non-commutative linear logic and to its extensions by structural rules like permutation, weakening and contraction. Natural deduction formulated with elimination rules by composition from a complexity perspective is superior to other calculi. (shrink)

The article investigates Cassirer's developing interest in the cultural sciences to display how his Philosophy of Symbolic Forms constitutes a philosophy of culture. The core concept in such a philosophy of culture is the symbolic formation that both possesses a structured-structuring dimension and appears as an historical process in which culture shows itself as a temporal creation. The philosophy of culture displays 'life in meaning', that is reality as it exhibits human reality manifested in and through the medium of linguistic, (...) artistic, religious, scientific "and so on" action and behaviour. This reality, therefore, is mediation between culture and nature through human spirit. Cassirer's philosophy of culture connects back to Kant's transcendental idealism by emphasizing that any concept of reality establishes itself through a modalization of reality, e.g. that reality constitutes itself in the mode of interpretation. This makes the basis for Cassirer's characteristic understanding of hermeneutics where cultural development is regarded as drama. (shrink)
