Legal theorists have proposed several theories to justify statutes of limitations in the criminal law, but none of these normative theories is generally accepted. This chapter investigates the related descriptive question as to whether ordinary people have the intuition that legal punishment becomes less appropriate as time passes from the date of the offense and, if they do, what factors play a role in these intuitions. Five studies demonstrate that there is an intuitive statute of limitations on both legal punishment (...) and moral criticism, and that these intuitions arise, in part, from judgments about changes in psychological connectedness over time. This handbook article reviews the situationist movements in psychology and philosophy, before turning to possible implications for issues about free will and moral responsibility. Particular attention is paid to possible threats to reasons-responsiveness and to agency.

The problem of free will as it is know in Western philosophical traditions is hardly known in China. Considering how central the problem is in the West, this is a remarkable fact. We try to explain this, and we offer insights into discussions within Chinese traditions that we think are related, not historically but regarding the issues discussed. Thus we introduce four central Chinese concepts, namely: (1) xīn 心 (heart, heart-mind), (2) xìng 性 (human nature, characteristic tendencies, inborn capacity), (3) (...) mìng 命 (lifespan, fate, command, allotment, endowment), and (4) zìrán 自然 (self-so, so of itself, nature, spontaneity), and we indicate how these concepts and their discussions can be related to discussions on free will. This article reevaluates Hermann Ebbinghaus’s famous criticisms of Wilhelm Dilthey’s 1894 essay “Ideas for a Descriptive and Analytic Psychology,” to determine how Dilthey’s diverse approaches toward philosophy and the human sciences are related to experimental psychology and to hypothetico-deductive science. It turns out that Ebbinghaus falsely accuses Dilthey of rejecting experimental psychology overall, while, in fact, Dilthey rejects only a specific misuse of experimental psychology: as a way to provide a foundation for the humanities. At the same time, Dilthey recognizes (...) several ways in which philosophy and the human sciences might benefit from experimental psychology. Although it clearly rules out experimental psychology, Dilthey’s descriptive psychology involves a hypothetico-deductive standpoint that intermediates, with some success, between modern social science and nineteenth-century hermeneutics. Several philosophers have recently claimed to have discovered a new and rather significant problem with virtue ethics. According to them, virtue ethics generates certain expectations about the behavior of human beings which are subject to empirical testing. But when the relevant experimental work is done in social psychology, the results fall remarkably short of meeting those expectations. So, these philosophers think, despite its recent success, virtue ethics has far less to offer to contemporary ethical theory than might have been initially (...) thought. I argue that there are plausible ways in which virtue ethicists can resist arguments based on empirical work in social psychology. In the first three sections of the paper, I reconstruct the line of reasoning being used against virtue ethics by looking at the recent work of Gilbert Harman and John Doris. The situationist movement in psychology and, more recently, in philosophy has been associated with a number of striking claims, including that most people do not have the moral virtues and vices, that any ethical theory which is wedded to such character traits is empirically inadequate, and that much of our behavior is causally influenced, to significant degrees, by psychological influences about which we are often unaware. Philosophers have argued about the nature and the very existence of free will for centuries. Today, many scientists and scientifically minded commentators are skeptical that it exists, especially when it is understood to require the ability to choose between alternative possibilities. If the laws of physics govern everything that happens, they argue, then how can our choices be free? Believers in free will must be misled by habit, sentiment, or religious doctrine. Why Free Will Is Real defies scientific orthodoxy and (...) presents a bold new defense of free will in the same naturalistic terms that are usually deployed against it. -/- Unlike those who defend free will by giving up the idea that it requires alternative possibilities to choose from, Christian List retains this idea as central, resisting the tendency to defend free will by watering it down. He concedes that free will and its prerequisites—intentional agency, alternative possibilities, and causal control over our actions—cannot be found among the fundamental physical features of the natural world. But, he argues, that’s not where we should be looking. Free will is a “higher-level” phenomenon found at the level of psychology. This paper addresses the seemingly insurmountable challenges the problem of personal identity raises for the prospect of radical human enhancement and synthetic consciousness. It argues that conceptions of personal identity rooted in psychological continuity akin to those proposed by Parfit and the Buddha may not provide the sort of grounding that many transhumanists chasing the dream of life extension think that they do if they rest upon ontologies that assume an incompatibility between identity and change. It also suggests that process (...) ontologies that take change to be primary, such as those that align with contemporary systems biology, offer a better way out of the personal identity dilemma. But the solution in this case, which regards biological organisms as processes rather than things, may constrain the possibility of biologically inspired superintelligent aliens (BISAs), which Schneider (following Bostrom 2014) posits as possibly the most common form of (extraterrestrial) superintelligence in the universe. This essay considers whether Buddhist Reductionism, a philosophical project grounded on the idea that persons reduce to a set of bodily, sensory, perceptual, dispositional, and conscious elements, (...) provides support for Parfit’s psychological criterion for personal identity. Spaces in the brain can refer either to psychological spaces, which are derived from similarity judgments, or to neurocognitive spaces, which are based on the activities of neural structures. We want to show how psychological spaces naturally emerge from the underlying neural spaces by dimension reductions that preserve similarity structures and the relevant categorizations. Some neuronal representational formats that may generate the psychological spaces are presented, compared and discussed in relation to the mathematical principles of monotonicity, continuity and convexity. Organizational deviance represents a costly behavior to many organizations. While some precursors to deviance have been identified, we hope to add to our predictive capabilities. Utilizing social cognitive theory and psychological contract theory as explanatory concepts, we explore the role of moral disengagement and turnover intentions, testing our hypotheses using two samples: a sample of 44 nurses from a hospital system in the Southwestern United States (Study 1), and a sample of 52 working adults collected from an online survey system (...) (Study 2). Results strongly supported our hypotheses in both samples, indicating that the self-regulatory deactivation inherent in moral disengagement led to increased organizational deviance; effects that were much more pronounced when turnover intentions were high. Our findings support the increased role of cognition in determining behavior when environmental pressures stemming from the psychological contract have been altered, leading to a number of theoretical and practical implications, particularly in industries with high turnover rates. I first summarize the central issues in the debate about the empirical adequacy of virtue ethics, and then examine the role that social psychologists claim positive and negative mood have in influencing compassionate helping behavior. I argue that this psychological research is compatible with the claim that many people might instantiate certain character traits after all which allow them to help others in a wide variety of circumstances. Modern computer-based applications often require the user to interact with avatars. Depending on the task at hand, spatial dissociation between the orientations of the user and the avatars might arise. As a consequence, the user has to adopt the avatar's perspective and identify herself/himself with the avatar, possibly changing the user's self-representation in the process. The present study aims to identify the conditions that benefit this change of perspective with objective performance measures and subjective self-estimations by integrating the idea of (...) avatar-ownership into the cognitive phenomenon of spatial compatibility. Two different instructions were used to manipulate a user's perceived ownership of an avatar used in otherwise identical situations. Users with the high-ownership instruction reported higher levels of perceived ownership of the avatar and showed larger spatial compatibility effects from the avatar's point of view in comparison to the low ownership instruction. This supports the hypothesis that perceived ownership benefits perspective taking. (shrink)

The central virtue at issue in recent philosophical discussions of the empirical adequacy of virtue ethics has been the virtue of compassion. Opponents of virtue ethics such as Gilbert Harman and John Doris argue that experimental results from social psychology concerning helping behavior are best explained not by appealing to so-called ‘global’ character traits like compassion, but rather by appealing to external situational forces or, at best, to highly individualized ‘local’ character traits. In response, a number of philosophers have argued (...) that virtue ethics can accommodate the empirical results in question. My own view is that neither side of this debate is looking in the right direction. For there is an impressive array of evidence from the social psychology literature which suggests that many people do possess one or more robust global character traits pertaining to helping others in need. But at the same time, such traits are noticeably different from a traditional virtue like compassion. (shrink)

In the context of climate change and its accompanying impact on stress and mental health, we argue that positive psychology may benefit from an integration of spirituality to better support people’s wellbeing. Starting with an overview of climate change’s impact on wellbeing and health, we explore the paradoxical and complex relationship between humans and nature. Following which, we will briefly define spirituality and present an evocative metaphor of the wave to portray the evolution of the field of PP. In our (...) conclusive remarks, we argue that the field of PP has gradually become more open to integrate spirituality, as it evolves towards greater complexity. In addition to meaning, some spiritual perspectives potentially relevant to positive psychology facilitate an ecocentric view which allow for a better understanding of the paradoxical human-nature relationship, as we struggle to deal with the complex issues related to climate change. We like to think of ourselves, our friends, and our families as decent people. We may not be saints, but we are still honest, relatively kind, and mostly trustworthy. Miller argues here that we are badly mistaken in thinking this. Hundreds of recent studies in psychology tell a different story: that we all have serious character flaws that prevent us from being as good as we think we are - and that we do not even recognize that these flaws exist. (...) But neither are most of us cruel or dishonest. Instead, Miller argues, we are a mixed bag. On the one hand, most of us in a group of bystanders will do nothing as someone cries out for help in an emergency. Yet it is also true that there will be many times when we will selflessly come to the aid of a complete stranger - and resist the urge to lie, cheat, or steal even if we could get away with it. Much depends on cues in our social environment. Miller uses this recent psychological literature to explain what the notion of "character" really means today, and how we can use this new understanding to develop a character better in sync with the kind of people we want to be. This paper argues that influential Mahāyāna ethicists, such as Śāntideva, who allow for moral rules to be proscribed under the expediency of a compassionate aim, seriously compromise the very notion of moral responsibility. The central thesis is that moral responsibility is intelligible only in relation to conceptions of freedom and human dignity that reflect a participation in, and sharing of, interpersonal relationships. The central thesis of the paper is that revisionary strategies, which seek to explain agency in event-causal terms, set (...) the stage for moral epiphenomenalism. On the view I defend here, an effective compatibilist solution to the problem of reconciling freedom of the will and determinism depends on expanding, rather than eliminating, the complex register of factors that underpin the experiential aspects of our moral life. Modern psychology, it is widely held, was born as a “science of mental life” based almost exclusively on the method of introspection. The most salient example is E.B. Titchener’s influential system of psychology known as “introspectionism.” Early in the twentieth century, this approach fell into disfavor—and, in turn, introspection as such also came to be seen as a dead end in psychology. As this paper argues, Titchener’s psychology was based on the key notions of elementism, reductionism and sensationism. His philosophical (...) commitment to these suppositions was deep and the general aim was to deliver a comprehensive scientific account of human mental life in accordance with that pre-experimental, theoretical agenda. The scientific goal of introspectionism was thus not to describe mental phenomena as they naturally and plainly form part of the subject’s experience. Here, Titchener’s approach contrasts rather starkly with contemporary introspective approaches, such as Descriptive Experience Sampling, that aim to bracket assumptions and theory. In sum, this paper calls into question the assumption that introspectionism in psychology should be regarded as an archetypal instantiation in the history of science, of a psychological system built on a fundamental commitment to introspection. Perhaps no other classical philosophical tradition, East or West, offers a more complex and counter-intuitive account of mind and mental phenomena than Buddhism. While Buddhists share with other Indian philosophers the view that the domain of the mental encompasses a set of interrelated faculties and processes, they do not associate mental phenomena with the activity of a substantial, independent, and enduring self or agent. Rather, Buddhist theories of mind center on the doctrine of no-self (Pāli anatta, Skt.[1] anātma), which postulates (...) that human beings are reducible to the physical and psychological constituents and processes which comprise them. Filipino's love for the elderly is undeniable. However, despite the respect they have for the elderly, an increasing amount of elderly abandonment is rising in the Philippines. The drastic increase in statistics of abandonment will still grow over the years because aging is inevitable. The primary goal of this study is to dig deeper into the experiences, challenges, and coping mechanisms of abandoned senior citizens inside of a home for the aged to spread awareness about this certain topic. By the (...) use of Interpretative Phenomenological Analysis, the study come up with the following findings: (1) The abandoned senior citizens chose to be inside the facility because they don't want to be a burden in their original homes. (2) Faith and religious works affect their psychological well-being. (3) Physical appearance does not affect their self-esteem. (4) Social support boosts their psychological well-being as well. (5) One of the biggest reasons why abandoned senior citizens left their homes is being neglected to cause them to leave and stay in home for the aged (6) Lastly, people inside the facilities accepted the fact that death is drawing closer to them but they don't want to die yet. This paper argues in favour of lingualism, i. e., the position according to which thought depends on language. The notion of thought at issue is the one we apply when we understand ourselves as full-blown thinking beings. The argument takes advantage of an idea put forward by Donald Davidson. A modified version of this idea is developed into a comprehensive line of thought, which consists of five steps. The argument from truth claims that the possession of the capacity of thought (...) requires possession of a grasp of the contrast between objective truth and falsehood. The subsequent four part arguments show that we can only conceive of a subject as phylogenetically acquiring a grasp of this contrast, if we conceive of her as acquiring a natural language. The conclusion of this argument implies that attributions of thought to non-linguistic being in contemporary ethology and developmental psychology must be carefully interpreted. They must not be understood as attributions of states we attribute to ourselves when we understand ourselves as thinking beings in the full-blown sense. Instead, the former notions of thought must be understood as technical notions, which are analogues to our ordinary notion of thought. (shrink)

For some time now, the topics of introspection, inner experience and so-called first-person approaches to the mental, have been the subject of attention in philosophy, psychology and consciousness studies. Indeed, some philosophers think that a central task of the latter field is to systematically relate and integrate data about subjective experience and data about behavior and brain processes.

An argument that makes use of a generalization activates the prototype for the category used in the generalization. We conducted two experiments that investigated how the activation of the prototype affects the persuasiveness of the argument. The results of the experiments suggest that the features of the prototype overshadow and partly overwrite the actual facts of the case. The case is, to some extent, judged as if it had the features of the prototype instead of the features it actually has. (...) This prototype effect increases the persuasiveness of the argument in situations where the audience finds the judgment more warranted for the prototype than for the actual case, but decreases persuasiveness in situations where the audience finds the judgment less warranted for the prototype than for the actual case. 100 years ago, the editors of the Journal of Educational Psychology conducted one of the most famous studies of experts’ conceptions of human intelligence. This was reason enough to prompt the question where we stand today with making sense of “intelligence”. In this paper, we argue that we should overcome our anthropocentrism and appreciate the wonders of intelligence in nonhuman and nonbiological animals instead. For that reason, we study two cases of octopus intelligence and intelligence in machine learning systems to (...) embrace the notion of intelligence as a non-unitary faculty with pluralistic forms. Reinforcement learning systems usually assume that a value function is defined over all states that can immediately give the value of a particular state or action. These values are used by a selection mechanism to decide which action to take. In contrast, when humans and animals make decisions, they collect evidence for different alternatives over time and take action only when sufficient evidence has been accumulated. We have previously developed a model of memory processing that includes semantic, episodic and working (...) memory in a comprehensive architecture. Here, we describe how this memory mechanism can support decision making when the alternatives cannot be evaluated based on immediate sensory information alone. Instead we first imagine, and then evaluate a possible future that will result from choosing one of the alternatives. Here we present an extended model that can be used as a model for decision making that depends on accumulating evidence over time, whether that information comes from the sequential attention to different sensory properties or from internal simulation of the consequences of making a particular choice. We show how the new model explains both simple immediate choices, choices that depend on multiple sensory factors and complicated selections between alternatives that require forward looking simulations based on episodic and semantic memory structures. In this framework, vicarious trial and error is explained as an internal simulation that accumulates evidence for a particular choice. We argue that a system like this forms the “missing link” between more traditional ideas of semantic and episodic memory, and the associative nature of reinforcement learning. (shrink)

This paper examines four central issues prompted by Thompson's recent critique of the Buddhist modernism phenomenon: (i) the suitability of evolutionary psychology as a framework of analysis for Buddhist moral psychological ideas; (ii) the issue of what counts as the core and main trajectory of the Buddhist intellectual tradition; (iii) the scope of naturalism in the relation between science and metaphysics, and (iv) whether a Madhyamaka-inspired anti-foundationalism stance can serve as an effective platform for debating the issue of progress in (...) science. The main argument of this paper is that while the mind sciences may corroborate some aspects of the Buddhist model of mind, they also call into question some core Buddhist ideas. Hence, if Buddhism is to enter into a fruitful dialogue with the mind sciences, it must be shown to complement the empirical claims to knowledge for which scientific naturalism so far provides the most viable basis. In a number of recent papers, I have begun to develop a new theory of character which is conceptually distinct both from traditional Aristotelian accounts as well as from the positive view of local traits outlined by John Doris. On my view, many human beings do have robust traits of character which play an important explanatory and predictive role, but which are triggered by certain situational variables which preclude them from counting as genuine Aristotelian virtues. Like others in this discussion, (...) I have focused on helping behavior in particular, and have gone on to argue that much of the social psychology literature is compatible with this new approach. And it is suggested that this dimensional time can (...) be analyzed on two different levels: on a microstructural level that is part of the subject–object relationship (cognitive–intentional time), and on a macrostructural level that is part of the subject–subject relationship (intersubjective time). In a close reading of Martin Wyllie's paper "Lived Time and Psychopathology" (2005) some implications and consequences of these suggestions are discussed. Conceptual Problems: Personal and Intersubjective Time One of Martin Wyllie's main theses is that to accurately describe suffering one may have to use a conceptual framework of a bipartite structure that includes the embodied temporal subject on the one hand and the temporal world on the other. It is this what the author calls a "dialectical relationship" between the time of the individual person called "personal time" and the time of the world called "world time" or "intersubjective time" (Wyllie 2005, 173).But then Martin Wyllie also deals with another model, another conceptual framework that follows a different logic and that—in contrast to the dualistic model—is usually associated with dialectics: the tripartite structure of past, future, and present. "Now in lived time", Wyllie claims, "is a unity of the past, present, and future, and is more than simply a succession because the immediate 'no-more', 'present', and 'yet-to-come' are ordinarily never sharply separated" (Wyllie 2005, 174).I want first to discuss the conceptual problems that come along with Martin Wyllie's use of these models. It seems to me that the author is dealing with the complexity of the relationship between these models by means of a double strategy: to conceptualize world time as intersubjective time (a), and to focus the analysis on the external, dualistic model of personal and intersubjective time (b).(a) "World time" may be differentiated at least into three categories: physical and cosmological time; natural and biological time; and social or sociocultural time. But the question is: how are these (quasi-) objective time matrices realized (and perhaps even "constituted") by the individual subject? To answer this question it is, also in my view, a good strategy for a psychopathology of time to concentrate on intersubjective [End Page 199] time, for, as Martin Wyllie states, there is indeed no doubt that "the embodied human subject is always already in an intersubjective world" (Wyllie 2005, 177).But what I think might be a severe problem with this focal point of the analysis is the tendency to identify the world exclusively with an intersubjective world. That the embodied human subject is always already in an intersubjective world does not mean that the subject's whole world is nothing more than an intersubjective world. Those temporal processes that are, for instance, necessary to "read"—in an intersubjective world—Martin Wyllie's text and to "write" a comment on it (as I do now) are part of at least a double temporal structure.First, reading and writing are formal processes of an integration of cognitive and intentional activities that are the transcendental basis of any intelligible discussion of semantic questions, namely, to recognize signs, retentionally and protentionally, as integral parts of higher temporal units to enable the subject to understand what is read or written. Without such retentional and protentional acts, as they were generally described by Husserl, any text would be a mere accumulation of signs without any formal or logical order.But, second, reading and writing are also informal processes of an integration of those intersubjective activities that result in an intelligible discussion of semantic questions.
