What does the Chilean Constitution say about euthanasia? When we read the Chilean Constitution we cannot find the word “euthanasia” in the text, and there is no such thing as a right to die, therefore the answer should apparently be that the Constitution does not say anything about euthanasia and, in short, euthanasia is not allowed. However, on a second reading we can find out some statements from which we can infer another answer. My aim (...) is to show that there is room for the acceptance of euthanasia in the Chilean Constitution, and in other similar Constitutions and international regulations in which freedom of conscience is granted. This article analyses the constitutional crisis that was triggered in Chile by the events of 18 October 2019. The purpose is to explain the link between the constitution and social unrest and to explore whether a constituent process, such as the one designed in Chile, has the potential to address the unrest that produced it. El propósito de este artículo es analizar las estrategias de descortesía verbal en una muestra de discurso parlamentario chileno. Para tal propósito se estudiaron las secuencias de discurso que manifestaban dichas estrategias en un corpus de 28 sesiones de la honorable Cámara de Diputados de Chile realizadas entre 2005 y 2007, en las que se discutieron diferentes asuntos polémicos de interés público. Para el análisis de la descortesía en el discurso político aquí realizado se consultaron los trabajos de Chilton y (...) Schäffner (1999), Blas Arroyo (2001 y 2003) y Bolívar (2005), entre otros. Una vez analizados los textos de las transcripciones de las sesiones de la muestra se identificaron las siguientes estrategias de descortesía: atacar la imagen pública del oponente y resguardar la propia imagen pública. Asimismo, la primera de dichas estrategias se subclasificó en las siguientes tácticas: desacreditaciones, ridiculizaciones y amedrentamientos. The purpose of this article is to analyze impoliteness strategies in a sample of Chilean parliamentary discourse. To that effect, this study puts forward an analysis of the discourse sequences manifesting these strategies in a corpus constituted by 28 sessions held between 2005 and 2007 by the honorable Chamber of Representatives of Chile, in which different and controversial issues of public interest were discussed. For the analysis of impoliteness in political discourse carried out in this study, the works of Chilton y Schäffner (1999), Blas Arroyo’s (2001 and 2003) and Bolívar’s (2005) were consulted, among others. Once the transcriptions of the sessions under analysis were processed, the following impoliteness strategies expressing the representatives’ political goals were identified: attacking the opponent’s public image and protecting the own public image. As scholars envision a new regulatory or statutory neurorights schema it is important to imagine unintended consequences if reforms are implemented before their implications are fully understood. This paper critically evaluates provisions proposed for a new Chilean Constitution and evaluates this movement against efforts to improve the diagnosis of, and treatment for, individuals with disorders of consciousness within the broader context of disability law, international human rights, and a capabilities approach to health justice as advanced by Amartya Sen (...) and Martha Nussbaum. Framed in this way, any neurorights regime would need to satisfy several criteria. First it would be obliged to balance both positive and negative rights in the furtherance of human capabilities. Second, it would need to be future oriented and informed about the science it sought to regulate and not fall prey to science fiction fantasies that remain ungrounded in reality. Third, it would need to be specific and avoid generalizations that would lead to conceptual confusion and litigation that could delay scientific progress. Finally, it would need to harmonize novel neurorights with long-established norms in international disability and human rights law. A failure to meet these criteria will destine any novel neurorights regime to the periphery. At this juncture Chile’s nascent constitutional venture into neurorights fails to satisfy these criteria. While there yet may be a role for a more capacious and bivalent articulation of neurorights that account for capabilities and precedent, the current Chilean neurorights reforms are vague and premature. As such they should undergo additional scholarly scrutiny and should not be adopted by other jurisdictions. (shrink)

The mobilization cycle that began in October 2019 represented a crucial moment in the Chilean democratic trajectory. What began as a protest for the rise of 30 Chilean pesos in the Santiago Metro, quickly took on national demand as the horizon exceeded that specific bid, and became a systemic and structural criticism of the democratic institutions and the constitutional, economic, social and cultural structure inherited from the dictatorship. This social awakening in October not only implied transformations associated to (...) material life. Also the conceptual and theoretical tools that were used to understand social phenomena from spaces of intellectual exercise, such as universities were modified. One of these categories is precisely space and territory, which from the nineties with supported and growing socio-environmental movements, was installed in the repertoire of popular demands. A dimension that was also strongly glimpsed in the October protests: the defence of territories as spaces for life. Based on this, a two-dimensional journey is proposed, first a theoretical conceptual debate and on the other hand a historical approach dealing with the emergence of the concept in recent Chilean history, with the interest of understanding a socio-territorial and historical dimension of what happened in October 2019. This paper explores the political awakening of the Chilean people that began in October 2019. It puts forward an alternative reading of the people’s claim for a new constitution. The first section briefly describes the October outcry and provides some context with regards to the nature of the social movement at its root. The two following sections examine two periods in Chilean recent history, the Pinochet regime and the period that has come after its overturn, focusing on (...) two elements: the neoliberal model set up by the dictatorship and the Constitution of 1980, which was designed to block the people’s political agency for the purpose of protecting the model. The final section works with these two elements in order to provide an alternative scheme by which to examine Chile’s awakening, the central question being: what does the claim for a new constitution mean? And critical for these purposes: what constitution is being overturned? Pinochet’s political project distorted constitutional ideas in such a way that only by clarifying the conceptual horizon is it possible to visualize how the concept of constitution and its relationship with the idea of a constituent power of the people can be of help to understand Chile’s constitutional awakening. We will examine the revolts, begun in October of 2019, and currently developing in Chile under three conjoined parts. First, we will not try to theoretically ‘tame’ the revolutionary creature, but rather to plug immanently into the energy of the ‘potentia’ of the revolutionary event. To this extent, we will highlight the shortcomings of a theoretical enterprise that intends to explain it in traditional terms or that thrives for a variant of simple ‘reformism’. Second, and consequently, we will describe how (...) the concept of the constitution is the perfect product of coloniality. Hence, the concept of the ‘constitutional trap’ is not something unique to the Chilean experiment, but that the constitutional idea itself is the main pipeline of coloniality and the most sophisticated product in the contention of democracy. Third, and to encompass and give a particular direction to the previous topics, we will deploy the ‘theory of encryption of power’ and the concept of the ‘hidden people’ to explicate the Chilean phenomenon under a new light, where no past is irrevocable, and no future is necessary. In this paper we will analyze critically the traditional interpretation of the principle of subsidiarity in the Chilean Constitution of 1980 and its influence on the configuration of our economic constitution. To this end, firstly we will study the traditional interpretation of the subsidiarity, trying to demonstrate its faults, and its relationship with neoliberalism. After, we will evaluate the influence of this position on the constitutional jurisprudence of recent years. One of the key tenets of James Buchanan’s political thought was the centrality of the status quo, embodied in Buchanan’s frequently heard axiom that “we start from where we are.” There is practical political value in “starting from where we are,” because we are in fact there, and not someplace else. Buchanan’s normative concern is that starting from where “we are” means that changes are more likely to be voluntary, and therefore Pareto-improving. The history of this notion of the status (...) quo in contractarian thought is developed briefly, and then a particular example, the Chilean Constitution and its problematic implementation, is discussed. Many philosophers have been appointed to top-level political positions during Chile's modern history. What makes Chilean philosophers unique in the context of Latin America and beyond, is that they have developed a sophisticated rationale for both their participation and withdrawal from politics. All along, philosophers have grappled with fundamental problems such as the role of religion and politics in society. They have also played a fundamental role in defining the nature and aims of higher education. The philosophers' production constitutes (...) a substantial, albeit largely unknown, portion of the intellectual history of Chile and Latin America. This book describes in detail the evolution of philosophical work in Chile, and pays close attention to the relationship between philosophical activity and contemporary social and political events. Various Chilean philosophical sources are discussed for the first time in the literature on Chilean ideas. The work of such intellectuals as Andres Bello, Valentin Letelier, Enrique Molina, Jorge Millas, Juan Rivano, Juan de Dios Vial Larrain, and many others is examined in relation to the principal political and educational issues of their time. The book also develops a distinction between the two main currents of Chilean philosophy, namely, a "professionalist" current that seeks the independence of the field from social and political involvements, and a "critical" current that seeks to relate philosophical activity to national realities. The present paper argues that the Venezuelan-Chilean philosopher Andrés Bello constitutes an important but heretofore neglected prefiguration of Richard Rorty. I argue for this thesis by articulating first an Inter-American philosophical narrative (based on previous work by Alex Stehn and Carlos Sanchez) that enables me to highlight certain common characteristics in philosophical projects that flourished across the Americas. Having done this, I show that Rorty’s anti-representationalism and anti-foundationalism are prefigured in Bello’s most important philosophical treatise, Filosofía del Entendimiento, to (...) the extent that Bello recognizes the problems posed by the ocular metaphors that are systematically used by Early modern philosophers such as Descartes or Locke, and suggests their elimination and replacement by other metaphors. Finally, I conclude that, if my arguments are correct, the intellectual geography of neo-pragmatism needs to be expanded beyond traditional geographies such as Europe and the US. (shrink)

Ella tiene una relevante producción poética, casi desconocida, que puede y debería considerarse como parte de la tradición de la vanguardia histórica chilena. Este trabajo pretende evidenciar cómo en Ola nocturna, su tercer poemario publicado en 1945, la autora utiliza personajes y referencias de la mitología griega para dar forma a su imaginario. Su universo figurativo está constituido por poderosas evocaciones de un espacio marítimo (...) en el que se confunde Eros y Tanatos. Personajes como Eolo, Hipocampos, Sirenas, Neptuno, Eco, Venus, forman parte de su galería mitológica-poética. Mediante estas figuras la poeta construye un mundo sorprendente y fascinante en donde el erotismo es tanto creación como destrucción.: Chela Reyes is a chilean writer born in Santiago, the same year as Pablo Neruda. She has a relevant poetic production, almost unknown, that can and should be considered as part of the tradition of the Chilean historical avant-garde. This work aims to show how, in Ola nocturna, her third book of poems published in 1945, the author uses characters and references from Greek mythology to shape her imaginary. Resumen: Las imágenes de tipos populares se erigieron como repertorios angulares en la conformación de los imaginarios de nación en América Latina, de ahí la importancia de su estudio para comprender la cultura visual decimonónica de territorios como Chile y Perú. Estas representaciones se desarrollaron fundamentalmente a partir de medios manuales, y en ellas se debaten cuestiones de gusto, asociadas a una estética de lo pintoresco, y se evidencian las tensiones y convergencias de varias funciones y demandas de la imagen (...) modélica. Sin embargo, durante la segunda parte del siglo XIX, esta tradición se enfrentará al advenimiento del medio fotográfico. Las repercusiones y transformaciones que esto implicó serán discutidas en el presente artículo, considerando el componente documental e informativo que la fotografía habría potenciado en un repertorio constituido particularmente, aunque no exclusivamente, en una estética de lo pintoresco. De esta manera, el ensayo propone una lectura historiográfica que analiza la constitución de esta tradición mediante casos particulares referidos al contexto chileno y peruano, para luego pensar su reformulación tras la incursión del aparato fotográfico.: Images of popular types and customs were set up as fundamental repertoires in the structure of nation imaginaries in Latin America, hence the importance of its study in order to understand nineteenth-century visual culture in territories such as Chile and Peru. These representations were mainly developed from manual media, in which are discussed matters of taste, associated to an aesthetic of the picturesque; this shows the tensions and convergences of various functions and demands of the model image. However, during the second half of the nineteenth century, this tradition will confront the emergence of the photographic medium. The repercussions and transformations which this implied will be discuss in the present article, considering both the documentary and the informative component that photography would have boost into a repertoire which was mostly constituted, though not exclusively, by an aesthetic of the picturesque. In this way, this paper proposes a historiographic reading that analyses the setting-up of this tradition through particular cases refer to the Chilean and Peruvian context, to think afterwards its reformulation following the incursion of the technical device. El presente texto se interroga sobre los efectos performativos del himno de Chile en cuanto éste designa al país en la forma de una "copia feliz del Edén". A partir de ahí, se pregunta ¿cómo podría una copia afirmarse en la originalidad de una soberanía? Para solucionar la distancia entre copia y original y, por tanto, dar lugar al funcionamiento de la soberanía, el himno designa a esa copia como "feliz". El término "feliz" se constituye, así, en el operador que (...) vendría tanto a apuntalar a la constitución de una soberanía como a revelar el límite de su imposibilidad. "Feliz" permite disminuir la distancia entre copia y original, pero a la vez, la conserva irremediablemente. Por eso, decir que el país es la copia "feliz" es lo mismo que decir "infeliz" toda vez que ambos términos no hacen más que corroborar la diferencia ontológica entre copia y original. Se argumenta que el término "feliz" constituye un dispositivo teológico político, toda vez que replica la función angélica destinada a la administración de la creación divina. En estos términos se pregunta: ¿no será el proyecto de la República de Chile un proyecto esencialmente administrativo? A esta luz, el texto plantea la contraposición entre himno con el poema: el himno -se plantea- constituye el operador angélico que hace posible la articulación de una soberanía. El poema, en cambio, constituiría el resto irreductible que le resiste. This essay asks on the performative efects of the chilean hymn, because it names the country as a "happy copy of Eden". Since this problem, the essay asks: how could the copy may posits as the originality of the sovereignity? To solve the distance between the copy and the original and make posible the sovereignity´s operation, the hymn names the copy as "happy". The word "happy" supports the constitution of the sovereignity and reveals the limit of its own imposibility. "Happy" reduce the distance between the copy and the original but, at the same time, absolutely preserve it. That´s why, say that the country is the "happy" copy is the same than to say that is a "unhappy" one, because both words shows the ontological difference between the copy and the original. This essay argues that the word "happy" is a political theological device because repeats the angelical task of manage the divine creation. In theses terms we ask: ¿Is the chilean republican proyect an administrative one? In this light, the essay posits an aporia between the hymn and poem: the hymn constitutes the angelical operator that makes sovereignity posible, the poem constitutes a singular rest that resist it. Food systems transformations require coherent policies and improved understandings of the drivers and institutional dynamics that shape (un)sustainable food systems outcomes. In this paper, we introduce the Chilean National Organic Agriculture Law as a case of a policy process seeking to institutionalize a recognized pathway towards more sustainable food systems. Drawing from institutional theory we make visible multiple, and at times competing, logics (i.e., values, assumptions and practices) of different actors implicated in organic agriculture in Chile. More specifically, our (...) findings identify five main institutional transformative logics underpinning the interests and actions of organic actors. However, we find that the Law was not motivated by these logics and did not advance them. Rather, the Law was designed to support a market niche targeted to elite consumers and to reinforce agricultural exports. As a result, the Law constrains rather than enables the practice of organic agriculture and access to organic food by consumers, especially at the domestic level. We note that attention to institutional logics in the analysis of food systems, and specifically food system transformation, is relevant to more comprehensive assessments of the transformational potential of food systems policies. We conclude that there is a need to further consider and make visible the way in which different drivers (i.e., laws) are constituted through and by diverse, and often competing, institutional logics. Merleau-Ponty, Varela, Nagarjuna. Une triangulation possibleDans cet article, on voudrait mettre en évidence une triangulation possible entre Maurice Merleau-Ponty, le biologiste chilien Francisco Varela et le philosophebouddhiste de l’Antiquité Nagarjuna. L’objectif de cette perspective réside dans l’urgence d’une étude de la dynamique du réel, et même de la sensibilité en général.Dans The Embodied Mind, le « projet neuro-phénoménologique » et « l’urgence énactive » de Varela se joignent à la pratique bouddhiste Mahayana de Nagarjuna, à laquelle le biologiste consacre une (...) grande partie de son oeuvre. Ce rapprochement révèle l’intérêt de Varela pour l’ontologie bouddhiste, non substantielle et permanente, ce qui, non seulement le conduit jusqu’aux ultimes conséquences de la chair merleaupontienne, mais accroît aussi sa compréhension de la signification de cette chair.Dans les années précédant le développement de son ontologie, Merleau-Ponty se consacre à l’anthologie intitulée Les philosophes célèbres et décide d’y inclure un chapitre sur la philosophie orientale. A Possible TriangulationIn this article, we would like to bring to light a possible triangulation between Maurice Merleau-Ponty, the Chilean biologist, Francisco Varela, and the ancientBuddhist philosopher, Nagarjuna. The purpose of doing this lies in the urgency of a study of the dynamic of the real and even of the sensible in general.In The Embodied Mind, Varela’s “neuro-phenomenological project” and the “enactive urgency” are joined to the Nagarjuna’s Mahayana Buddhist practice, to which the biologist devotes a large part of this work. This intersection reveals Varela’s interest in Buddhist ontology, an ontology that is non-substantialist and permanent. Une triangulation possibleDans cet article, on voudrait mettre en évidence une triangulation possible entre Maurice Merleau-Ponty, le biologiste chilien Francisco Varela et le philosophebouddhiste de l’Antiquité Nagarjuna. L’objectif de cette perspective réside dans l’urgence d’une étude de la dynamique du réel, et même de la sensibilité en général.Dans The Embodied Mind, le « projet neuro-phénoménologique » et « l’urgence énactive » de Varela se joignent à la pratique bouddhiste Mahayana de Nagarjuna, à laquelle le biologiste consacre une (...) grande partie de son oeuvre. Corporate power in the constitutional educational debate in Chile Abstract: Economic elites have historically intervened in the Chilean education system, and in recent times they have consolidated their position in the framework of extreme privatization promoted by the neoliberal reform. In Chile, the constitutional principle of freedom of education has made it possible to organize an educational market, which ultimately reproduces the power of the elite over the system itself. The present work proposes a critical exploration of the epistemological foundations of modern contractualism, showing how its exclusion criteria operate through language games and the configuration of constitutional order. This critical exercise may improve the understanding of the conditions of possibility for a new social pact sense, in a political context marked by the Chilean popular revolt of 2019. Two consequential effects from above: the resignification of constitutional contents and the beginning of a constituent process.

This study shows how three Chilean media construct in their discourse the social actor ‘secondary students’, in a multimodal way. It focuses on the representation of Televisión Nacional de Chile (also known as TVN), El Dínamo and El Ciudadano of this social group which is often suppressed suppressed from the media sphere. It is a qualitative study with a social semiotic approach, following the guidelines of Visual Grammar and the typology of representation of social actors by van Leeuwen (2003). (...) The corpus comprised 15 multimodal texts of 2018 compiled from internet sites, which constitute a semiotic chain of a news event about education. The results suggest that TVN creates the meaning of an ‘aggressor student’, El Dínamo as a ‘student to be reformed’; whereas El Ciudadano, represents him as a social actor who is an ‘active participant’. In October 2019, the so-called ‘social outbreak’ took place in Chile, a major socio-political conflict that led to an unprecedented constitutional change in the country. Under this context, the feminist movement takes on a prominent role, not only because of the massiveness of its demonstrations but also because of its influence on the achievement of gender parity in the constitutional process.The experiences of the protests were captured in the countless graffiti that have propagated in urban spaces since the social outbreak (...) and which, even today, abound in certain areas. The aim of this study is to analyse the conceptual metaphors expressed in graffiti related to the Chilean protest. The methodology includes three instances of analysis: the identification of linguistic metaphors; their semantic-discursive grouping; and the conceptual analysis of the established groups, in which the ‘Basic Scene’ component is considered. As a result, the conceptual metaphor PROTEST IS WAR is proposed, which conceptualises Chileans as warriors fighting against an enemy, represented by the political institutionality, the economic model and the patriarchal system. It is concluded that the established metaphor sets out a cognitive dichotomy that highlights the opposition between the participants in the Chilean social conflict and the demonstrators’ discomfort with the current system, emphasising its commitment and unity with the reasons to protest. While Chile's partial decriminalization of abortion in 2017 was a long overdue recognition of women's sexual and reproductive rights, nearly four years later the caseload remains well below expectations. This pattern is the product of standing barriers in access to abortion‐related health services, especially at the primary care point of entry. This study seeks to identify and describe these barriers. The findings presented here were obtained through a qualitative, exploratory study based on 19 semi‐structured interviews with relevant actors identified through (...) non‐random sampling and snowballing techniques. Coding was inductive and complemented by semantic content analysis. The authors find that the key barriers in primary care to accessing legal abortion are unfamiliarity with the law, insufficient practitioner training, intersectoral discrimination, and the stigma surrounding abortion. They conclude that the government needs to exercise its constitutional mandate as guarantor of public health and act promptly to safeguard and guarantee the abortion rights of Chilean women. The studies show a positive and direct relationship between basic psychological needs satisfaction and intrinsic motivation of the students. However, there is a lack of studies that analyze the psychological processes that affect these relationships. For this reason, the purpose of this study was to investigate the mediating role of academic integration on the relationship between basic psychological needs satisfaction and intrinsic motivation of Chilean university students. The participants were a total of 580 students from a university in northern (...) Chile, 359 women and 221 men. The mediation analysis was performed by structural equations modeling, using the maximum likelihood method and the bootstrapping procedure with 10,000 iterations. The results indicated that academic integration partially mediated the relationship between basic psychological needs satisfaction and intrinsic motivation of the students. Therefore, the basic psychological needs satisfaction had an indirect effect on the intrinsic motivation of the students through academic integration. It is concluded that the academic integration constitutes a psychological process that promotes the development of intrinsic motivation for learning. The practical implications are discussed along with the limitations of the study and recommendations for future research. (shrink)

This paper proposes a methodological approach to the study of discourses in the hybrid media system (Chadwick, 2013). The hybrid media system is defined as a new type of system in which traditional and emerging media are assembled, changed and flow gradually to create new forms. One form of hybridization is the relationship between social networks and television, in which both media model and build each other. Various studies (Gruber, 2017; Vaccari et al., 2016) have demonstrated the importance of the (...) study of hybrid media system to explore the construction of meanings in new media contexts, especially in political contexts. This study is part of a qualitative paradigm that incorporates the principles of critical discourse analysis for the analysis of semiotic resources used in 30,000 tweets with hashtags of five Chilean political television programs broadcast during 2016, which promote online public debate and participation. Based on the analysis of online texts and television programs, it was established that the argumentative strategies and resources used constituted an expansion of the televised political debate and a space for interaction of social network users with traditional media. The decision to directly involve these users in television programs has implications for the understanding of the symbolic limits of the policy. The inclusion of new actors has the potential to model the quality of debate and argumentation in the digitally mediated public sphere. (shrink)

Three Chilean Thinkers, a companion piece to Three Argentine Thinkers, attempts to examine some of the outstanding characters of Chile's intellectual development by way of analyzing the contribution of three of her distinguished representatives. Each thinker or philosopher, whichever the case may be, is symbolic of a definite sociopolitical movement which left its unmistakable imprint upon the cultural scene. Moreover, each thinker, no doubt, was strongly influenced by European philosophical trends, but should in now way be considered a mere (...) imitator. It would be more accurate to say that they adapted these currents to their particular situation, utilizing the various component elements in order to explain or reform the Spanish American scene. Since each of the three represents a separate epoch, it was thought best to present them in chronological fashion in order to insure a measure of historical continuity. Thus, the first author treated is Francisco Bilbao, representative par excellence of the Romantic period. He is followed by Valentín Letelier, who can be said to have been one of the foremost exponents of what may well be considered as a reaction to Romanticism, namely, the Positivist era. Finally, Positivism, in turn, also produced a reaction in the form of the various idealistic tendencies which blossomed forth at the turn of the century--reaction to the dominant position exercised by evolutionism and scientism--represented in Chile by Enrique Molina. Resumen El artículo tiene como objetivo revisar y analizar los pasajes referentes al territorio chileno en los poemas épicos que cantaron la Guerra de Arauco en el siglo XVI. Aun cuando su argumento central consistió en los acontecimientos bélicos, algunos pasajes dieron cabida a la descripción del espacio como un paisaje épico. Así como se demostrará, su representación no solo se configuró atendiendo a las condiciones fisonómicas del territorio, sino también a los recursos literarios propios de la epopeya que caracterizaron (...) al sur de Chile como un escenario desafiante y peligroso, espacio histórico y a la vez literario, representativo de la condición heroica e indomable del Reino de Chile.The aim of this article is to review and to analyze the passages relating to the Chilean territory in the epic poems that reported Arauco's War in the 16th century. Even if their central argument consisted of the warlike events, some passages gave content to the description of the space as an epic landscape. As it will be demonstrated, the representation of the territory not only was formed attending to the physical conditions of the land, but also to the literary resources of the epic that characterized to the south of Chile as a challenging and dangerous scene, historical and simultaneously literary space, representative of the heroic and indomitable condition of the Kingdom of Chile. Resumen: El artículo busca observar el hecho religioso mapuche, a partir de la reflexión de Rudolf Otto respecto de lo numinoso y lo santo. Para ello se utiliza su metodología de análisis fenomenológico aplicada a los conceptos de mysterium, tremendum y fascinans o las dimensiones del temor, incorporadas en la cultura mapuche. Se concluye que el análisis de estos diversos momentos de la experiencia santo-numinoso en la vida religiosa del mapuche, permite constatar el dinamismo existente en la idea religiosa del (...) mapuche, lo que a su vez representa adecuadamente la relación entre el hombre religioso y lo santo.: This article seeks to observe the Mapuche religious fact, starting from Rudolf Otto’s reflection on the numinous and the holy. For this, it uses its methodology of phenomenological analysis applied to the concepts of mysterium, tremendum and fascinans or the dimensions of fear, incorporated in the Mapuche culture. It is concluded that the analysis of these different moments of the saint-numinous experience in the religious life of the mapuche, allows to verify the dynamism existing in the religious idea of ​​the mapuche, which in turn represents adequately the relationship between religious man and the Holy. Theorists of public reason such as John Rawls often idealize constitutional courts as exemplars of public reason. This paper raises questions about the seduction and limits of analogies between theorists’ account of public reason and actual constitutional jurisprudence. Examining the work product of the United States Supreme Court, the paper argues that while it does engage in reason-giving to support its decisions—as the public reason strategy suggests— those reasons are (largely) legalistic and specifically juristic reasons—not the theorists’ idealized moral-political reasons (...) on matters of fundamental principle. But if constitutional courts do not engage on matters of fundamental principle, then a public reason strategy for assuaging democratic worries about judicial review would no longer be open: prominent liberal and deliberative democratic theorists could no longer point to the alleged superiority of constitutional courts to speak in the name of, and for, the people’s shared political principles. The paper extends beyond the U.S. case study by pointing to three institutional factors explaining the disanalogy between what some constitutional courts do and what public reason theories require them to do. It concludes with considerations about whether the public reason strategy might be more successfully applied to international courts. (shrink)

On constitutive panpsychism, changes in macro-level consciousness amount to changes in either the way that micro-conscious entities ‘bond’ or the way that micro-conscious qualities ‘blend’. I pose the ‘Selection Problem’ for constitutive panpsychism—the problem of explaining how high-level functional states of (...) the brain ‘select’ micro-conscious qualities for bonding or blending. Westin provides a documentary portrait of historically important constitutional law case, 'Youngstown Sheet & Tube Co. v. Sawyer, ' from its rise in a bargaining dispute in the steel industry during 1952 to the aftermath of its decision by the United States Supreme Court. Westin has added to his classic book additional materials and personal commentaries collected since the work was first published. The new information (...) covers what went on within the Truman administration, what went on within the Supreme Court when analyzing and resolving issues that come before it. Westin includes selections from transcripts, briefs and other official proceedings, adds notes describing each phase of the constitutional process, and a section of commentary and questions relating this case to others.
