Abstract
In this paper we will analyze critically the traditional interpretation of the principle of subsidiarity in the Chilean Constitution of 1980 and its influence on the configuration of our economic constitution. To this end, firstly we will study the traditional interpretation of the subsidiarity, trying to demonstrate its faults, and its relationship with neoliberalism. After, we will evaluate the influence of this position on the constitutional jurisprudence of recent years. And finally, considering the crisis of legitimacy of our political system, we believe that the Welfare state could be a solution to the constitutional problem.
