This paper explores the conduct of performance appraisals of nurses in a New Zealand hospital, and how fairness is perceived in such appraisals. In the health sector, performance appraisals of medical staff play a key role in implementing clinical governance, which, in turn, is critical to containing health care costs and ensuring quality patient care. Effective appraisals depend on employees perceiving their own appraisals to be fair both in terms of procedure and interaction with their respective appraiser. We examine qualitative (...) data from interviews and focus groups, involving 22 nurses in a single department, to determine whether perceived injustices impact on the effective implementation of the appraisal system. Our results suggest that particular issues had been causing some sense of injustice, and most of these were procedural. Potential solutions focus on greater formalisation of the performance appraisal process, and more training for appraisers and appraisees. (shrink)

The inventional focus, however, of much modern rhetorical theory has tended to relegate figuration either, on the one hand, to the domains of literary criticism or linguistics (the heirs of ancient grammar) or, on the other hand, to an ancillary position. The concomitant marginalization of the study of figures has had a significant effect upon contemporary scholarship in historical rhetoric. Many of the seminal scholarly works on the history of rhetoric have denigrated or minimized the importance of figural rhetoric. As Brian Vickers (1990, 294-95) has mentioned, George Kennedy and numerous other historians of rhetoric (e.g., Clarke 1996, 34) tend to condemn the teaching of figural rhetoric as dreary, tedious, and otiose. Often, the very periods themselves in which the study of the figures was pursued most vigorously and extensively are omitted from or condemned by modern scholarly discussion. As Marjorie Curry Woods has pointed out (1995, 73-78), biases against the medieval period, especially as found in Charles Sears Baldwin (1928) and Kennedy (1963, 1980) have in many ways defined the contours of our discipline, especially our attitudes toward the study of figures and tropes. Late antiquity and the Middle Ages, the periods of "decline" so deplored by Baldwin, Vickers, Kennedy, and others, were those in which figural rhetoric flourished, and both the sheer [End Page 116] volume of extant figural treatises and the continuity of figural rhetoric from the Hellenistic period through such contemporary semipopular books as Arthur Quinn's Figures of Speech: 60 Ways to Turn a Phrase (1982) and William Espy's The Garden of Eloquence: A Rhetorical Bestiary (1983) demand attention from the historical scholar. Along with the trivialization of figures in contemporary rhetoric has come a drastic oversimplification of the semiotics of figural terminology, which, in turn, contributes to the trivialization of many recent accounts of figures. To recover a more complex understanding of the semiotics of figural terms, we must start with a historical understanding of figuration, because rhetorical terms are encased in numerous historical strata that determine our understandings of them. 1 As Richard Rorty (1984, 49-75) argues concerning the historiography of philosophy, rational and historical reconstruction are mutually interdependent. A brief history of figural rhetoric From antiquity through the present, lists of figures have either occupied substantial sections of general treatises on rhetoric or grammar or have been the subject of specifically figural handbooks. Use of what we might term highly figured speech appears to predate the development of theoretical models for analysis of figures by many centuries. The Homeric epics, which were to provide the standard examples of rhetorical figures for many subsequent centuries, use patterns of speech later to be named and classified as rhetorical figures, but neither figural terminology nor self-conscious reflection upon figures qua figures appears in the epics. Similarly, although Gorgias was renowned for his use of the "Gorgianic" figures that later took his name, there is no evidence that he attempted systematic catologuing or development of specialized terminology for the figures. The testimonia describing his use of poetic words and figures (DK82a1, DK82a2, DK82a4, DK82a32--translated in Sprague 1972) do not attribute to him any invention of technical terminology.The question of invention of specific terminology for rhetorical figures is part of a more general historical question of the development of rhetoric as a self-conscious field. In "Mathematical Truth", Paul Benacerraf articulated an epistemological problem for mathematical realism. His formulation of the problem relied on a causal theory of knowledge which is now widely rejected. But it is generally agreed that Benacerraf was onto a genuine problem for mathematical realism nevertheless. Hartry Field describes it as the problem of explaining the reliability of our mathematical beliefs, realistically construed. In this paper, I argue that the Benacerraf Problem cannot be made out. There simply is no intelligible problem (...) that satisfies all of the constraints which have been placed on the Benacerraf Problem. The point generalizes to all arguments with the structure of the Benacerraf Problem aimed at realism about a domain meeting certain conditions. Such arguments include so-called "Evolutionary Debunking Arguments" aimed at moral realism. I conclude with some suggestions about the relationship between the Benacerraf Problem and the Gettier Problem. (shrink)

Many recent decisions in tort law attempt to combine two conceptually incommensurable features: a traditional 'but for' test of factual causation, and the scientific or medical evidence that is required to explain how some injury occurred. Even when applied to macroscopic objects, the 'but for' test fails to identify causes, because it merely rephrases in the language of possible worlds what may be inferred from what is inductively known about the actual world. Since scientific theories explain the occurrence of events (...) without reference to causes, this test of causation is not only ineffectual but also inapplicable to scientific or medical evidence. Tort law, therefore, should abandon the 'but for' test; when scientific or medical evidence is required in a tort case, the courts should rely on the explanatory strategies that function within the theories from which they borrow such evidence. In the Transcendental Aesthetic (TA), Kant is typically held to make negative assertations about “things in themselves,” namely that they are not spatial or temporal. These negative assertions stand behind the “neglected alternative” problem for Kant’s transcendental idealism. According to this problem, Kant may be entitled to assert that spatio-temporality is a subjective element of our cognition, but he cannot rule out that it may also be a feature of the objective world. In this paper, I show in a new (...) way how Kant’s view (focusing on his conclusions about space) is not subject to this objection, by showing that he does not make the denial about mind-independent reality that he is typically held to make. The argument develops consequences of a new reading of Kant’s expression “an sich selbst” (‘in itself’; ‘in themselves’). I argue that “an sich selbst” or “per se” has a special, judgment-level role, so that this expression does not form new noun-terms adjectivally. It follows that the conceptual unit of Kant’s “Conclusions” in the TA is simply “things” (Dinge), since “things in themselves” is not a nominal expression; Kant adopts the Wolffian ontological use of “thing” as the basic kind-term for any existent. The arguments that things per se are not in space are arguments that space cannot be a necessary property or relations of things as a kind. I show that this does not involve the positive claim about mind-independent reality that inspires the neglected alternative objection. (shrink)

John Dupr argues that 'scientific imperialism' can result in 'misguided' science being considered acceptable. 'Misguided' is an explicitly normative term and the use of the pejorative 'imperialistic' is implicitly normative. However, Dupr has not justified the normative dimension of his critique. We identify two ways in which it might be justified. It might be justified if colonisation prevents a discipline from progressing in ways that it might otherwise progress. It might also be justified if colonisation prevents the expression of important (...) values in the colonised discipline. This second concern seems most pressing in the human sciences. (shrink)

Pateman challenges the way contemporary society functions by questioning the standard interpretation of an idea that is deeply embedded in American and British political thought: that our rights and freedoms derive from the social contract explicated by Locke, Hobbes, and Rousseau and interpreted in the United States by the Founding Fathers. The author shows how we are told only half the story of the original contract that establishes modern patriarchy. The sexual contract is ignored and thus men's patriarchal right over (...) women is also glossed over. No attention is paid to the problems that arise when women are excluded from the original contract but incorporated into the new contractual order. One of the main targets of the book is those who try to turn contractarian theory to progressive use, and a major thesis of the book is that this is not possible. Thus those feminists who have looked to a more "proper" contract- one between genuinely equal partners, or one entered into without any coercion- are misleading themselves. In the author's words, "In contract theory universal freedom is always a hypothesis, a story, a political fiction. Contract always generates political right in the forms of domination and subordination." Thus the book is also aimed at mainstream political theorists, and socialist and other critics of contract theory. The author offers a sweeping challenge to conventional understandings- of both left and right- of actual contracts in everyday life: the marriage contract, the employment contract, the prostitution contract, and the new surrogate mother contract. By bringing a feminist perspective to bear on the contradictions and paradoxes surrounding women and contract, and the relation between the sexes, she is able to shed new light on fundamental political problems of freedom and subordination. Did Freud present a scientific hypothesis about the unconscious, as he always maintained and as many of his disciples keep repeating? This question has long prompted debates concerning the legitimacy and usefulness of psychoanalysis, and it is of utmost importance to Lacanian analysts, whose main project has been to stress Freud's scientific grounding. Here Jacques Bouveresse, a noted authority on Ludwig Wittgenstein, contributes to the debate by turning to this Austrian-born philosopher and contemporary of Freud for a candid assessment of (...) the early issues surrounding psychoanalysis. Wittgenstein, who himself had delivered a devastating critique of traditional philosophy, sympathetically pondered Freud's claim to have produced a scientific theory in proposing a new model of the human psyche. What Wittgenstein recognized--and what Bouveresse so eloquently stresses for today's reader--is that psychoanalysis does not aim to produce a change limited to the intellect but rather seeks to provoke an authentic change of human attitudes. The beauty behind the theory of the unconscious for Wittgenstein is that it breaks away from scientific, causal explanations to offer new forms of thinking and speaking, or rather, a new mythology. Offering a critical view of all the texts in which Wittgenstein mentions Freud, Bouveresse immerses us in the intellectual climate of Vienna in the early part of the twentieth century. Although we come to see why Wittgenstein did not view psychoanalysis as a science proper, we are nonetheless made to feel the philosopher's sense of wonder and respect for the cultural task Freud took on as he found new ways meaningfully to discuss human concerns. Intertwined in this story of Wittgenstein's grappling with the theory of the unconscious is the story of how he came to question the authority of science and of philosophy itself. While aiming primarily at the clarification of Wittgenstein's opinion of Freud, Bouveresse's book can be read as a challenge to the French psychoanalytic school of Lacan and as a provocative commentary on cultural authority. Recent years have witnessed an escalation in corporate social reporting (CSR) by UK companies (Gray, Kouhy and Lavers 1995). Whilst some elements of CSR reporting are required by law, much of it represents voluntary reporting. By investigating the non‐mandatory reporting of two aspects of social responsibility, corporate community involvement (CCI) and environmental impact, this paper seeks to explore why companies choose to make such disclosures. It specifically asks whether companies are primarily motivated by the strategic need to manage their reputation (...) and legitimacy rather than by the recognition of their ethical accountability, which is the stated purpose of reports produced by cutting edge companies (Clarke 1998). The subject of personal identity is one of the most central and most contested and exciting in philosophy. Ever since Locke, psychological and bodily criteria have vied with one another in conflicting accounts of personal identity. Carol Rovane argues that, as things stand, the debate is unresolvable since both sides hold coherent positions that our common sense, she maintains, is conflicted; so any resolution to the debate is bound to be revisionary. She boldly offers such a revisionary theory of (...) personal identity by first inquiring into the nature of persons. Rovane begins with a premise about the distinctive ethical nature of persons to which all substantive ethical doctrines, ranging from Kantian to egoist, can subscribe. From this starting point, she derives two startling metaphysical possibilities: there could be group persons composed of many human beings and muliple persons within a single human being. Her conclusions supports Locke's distinction between persons and human beings, but on altogether new grounds. These grounds lie in her radically normative analysis of the condition of personal identity, as the condition in which a certain normative commitment arises, namely, the commitment to achieve overall rational unity within a rational point of view. It is by virtue of this normative commitment that individual agents can engage one another specifically as persons, and possess the distinctive ethical status of persons. The Ethics of Need: Agency, Dignity, and Obligation argues for the philosophical importance of the notion of need and for an ethical framework through which we can determine which needs have moral significance. In the volume, Sarah Clark Miller synthesizes insights from Kantian and feminist care ethics to establish that our mutual and inevitable interdependence gives rise to a duty to care for the needs of others. Further, she argues that we are obligated not merely to meet others’ needs but (...) to do so in a manner that expresses "dignifying care," a concept that captures how human interactions can grant or deny equal moral standing and inclusion in a moral community. She illuminates these theoretical developments by examining two cases where urgent needs require a caring and dignifying response: the needs of the elderly and the needs of global strangers. In behavioral ethics today, there is debate as to which theory of moral development is the best for understanding ethical decision making, thereby facilitating ethical behavior. This debate between behavioral ethicists has been profoundly influenced by the field of moral psychology. Unfortunately, in the course of this marriage between moral psychology and business ethics and subsequent internal debate, a simple but critical understanding of human being in the field of management has been obscured; i.e., that morality is not a secondary (...) phenomenon arising out of something else. Therefore, in this paper, we will argue that there is a need in behavioral ethics to shift our understanding away from the influence of contemporary moral psychology and back to management theorist Ghoshal’s :75–91, 2005) view of what it means to be human in which the moral is fundamental. To assist in this labor, we will build on the philosophical work of Emmanuel Levinas who sees ethics, regardless of the setting, as a metaphysical concern. What this means is that Levinas sees the essential moral character of human life and the reality of human agency as ontologically fundamental, or constitutive of human nature itself. In other words, the ethical is the “first cause” in regard to understanding the nature and action of the individual, including within organizations. Thus, morality in any sphere of human endeavor, including in business, is not merely epiphenomenal to some more fundamental reality. (shrink)

There is no broadly accepted definition of ‘life.’ Suggested definitions face problems, often in the form of robust counter-examples. Here we use insights from philosophical investigations into language to argue that defining ‘life’ currently poses a dilemma analogous to that faced by those hoping to define ‘water’ before the existence of molecular theory. In the absence of an analogous theory of the nature of living systems, interminable controversy over the definition of life is inescapable.

Carol Zaleski's book is the first objective, comprehensive survey of the mass of evidence surrounding near-death experiences: the extraordinary visions and ecstatic feelings reported by people who have survived a close brush with death. Comparing recent near-death narratives with those of a much earlier period she finds both profound similarities and striking contrasts.

In this essay, I connect the sexual victimization of women, children, and pet animals with the violence manifest in a patriarchal culture. After discussing these connections, I demonstrate the importance of taking seriously these connections because of their implications for conceptual analysis, epistemology, and political, environmental, and applied philosophy. My goal is to broaden our understanding of issues relevant to creating peace and to provide some suggestions about what must be included in any adequate feminist peace politics.

How to formulate the doctrine of relativism -- Evaluating the doctrine of relativism.

Many scientists believe that there is a uniform, interdisciplinary method for the prac- tice of good science. The paradigmatic examples, however, are drawn from classical ex- perimental science. Insofar as historical hypotheses cannot be tested in controlled labo- ratory settings, historical research is sometimes said to be inferior to experimental research. Using examples from diverse historical disciplines, this paper demonstrates that such claims are misguided. First, the reputed superiority of experimental research is based upon accounts of scientific methodology (Baconian inductivism (...) or falsificationism) that are deeply flawed, both logically and as accounts of the actual practices of scientists. Second, although there are fundamental differences in methodology between experimental scien- tists and historical scientists, they are keyed to a pervasive feature of nature, a time asymmetry of causation. As a consequence, the claim that historical science is methodo- logically inferior to experimental science cannot be sustained. (shrink)

Extant theoretical work on the political resource curse implies that dependence on resource revenues should decrease autocracies’ likelihood of democratizing but not necessarily affect democracies’ chances of survival. Yet most previous empirical studies estimate models that are ill-suited to address this claim. We improve upon earlier studies, estimating a dynamic logit model that interacts a continuous measure of resource dependence with an indicator of regime type using data from 166 countries, covering the period from 1816-2006. We find that an increase (...) in resource dependence at time t - 1 increases the likelihood of autocratic persistence at t, but has no appreciable effect on democratic survival. We go beyond existing empirical studies to show that increases in resource dependence have persistent and substantial cumulative effects on autocracies' likelihood of becoming democratic over the long-term, showing that the total effect of resource dependence on regime type is much larger than the short-term (one period) effect indicates.
