This article will present how Systemics and Cybernetics might prove useful for law in advancing a Systemic-Cybernetic Theory of Law (TSCD). With TSCD it will be possible for legal scholars to solve several jurisprudential problems and also elaborate a new and more comprehensive approach to law than the ones currently available. In order to achieve this goal, it will be argued how systemic-cybernetic methodology and epistemology have come into play in the law, and which kind of features are included in (...) the theory, and also it will be added where new answers are offered.The authors hope TSCD to be considered as a paradigm helpful for facing the challenges and crisis that in their practical operation and philosophical and scientific research are being put forward by different systems of law (national, international, transnational, etcetera).Resumen:En el presente texto se presentará al lector cómo la sistémica y la cibernética sirven al derecho para estructurar así una Teoría Sistémico-Cibernética del Derecho (TSCD). Mediante ésta se podrá dar respuesta a diversos interrogantes iusfilosóficos, obteniendo una visión del derecho más completa de las que hasta ahora se nos ha ofrecido. Para lograr tal cometido, se expondrá la manera cómo la metodología y la epistemología sistémica y cibernética irrumpen en el mundo jurídico, para luego enumerar algunas características de una posible TSCD y los problemas a los que esta visión del derecho ofrece algo nuevo.La TSCD constituirá —así lo esperamos— el paradigma que la complejidad de los temas y sistemas del derecho (nacionales, internacionales, trasnacionales, etcétera) requiere para hacer frente a la crisis de su funcionamiento práctico y de su investigación científica y filosófica. En este ensayo se sostienen tres puntos. El primero es que el tema de las drogas merece una reflexión más allá de lo que nos dicen la sociedad telemática y los empresarios morales. En este sentido, se recuerda que en todas las culturas han existido drogas, que en ciertas culturas algunas drogas son prohibidas y que sobre dichas drogas y sus consumidores recae una doble estigmatización: adicción y (auto)destrucción. El segundo punto es nuestra propuesta concreta para reducir la violencia criminal (...) en Latinoamérica, que consiste en (i) despenalizar el consumo y el tráfico (por lo menos el menor) de drogas; (ii) eliminar la prohibición legal del consumo y el tráfico (por lo menos el menor) de drogas, salvo casos donde el consumo o el tráfico puedan afectar derechos legítimos de terceros; y (iii) suprimir la doble estigmatización que recae sobre el consumo en general y sobre los adictos en especial, lo que supone una sociedad civil más reflexiva sobre las drogas, principalmente sobre lo que hay detrás de la famosa lucha contra las drogas, etcétera. El tercer punto gira en torno a cómo las propuestas de eliminar la prohibición deben enfrentarse al discurso hegemónico de los empresarios morales, para lo cual se pone como ejemplo lo que sucedió en Colombia con la Sentencia C-221 de 1994, mediante la cual la Corte Constitucional dio un paso importante en el camino hacia la despenalización del consumo de drogas; esta Sentencia originó reacciones aireadas de los empresarios morales al punto de reformar la Constitución para mantener vivo el régimen de la prohibición. Este escrito plantea la complejidad sistémica del concepto crisis moral aplicada en la sociedad contemporánea, especialmente en el caso latinoamericano, lo que exige un estudio interdisciplinario para abordar el asunto. Ahora bien, se alude a una complejidad sistémica de la crisis moral por cuatro aspectos. En primer lugar, porque la moral, al ser un sistema normativo basado en el deseo de una sociedad mejor, nunca se sentirá satisfecha de la sociedad en la que se enmarca, lo que provoca un permanente (...) malestar. En segundo lugar, porque una crisis moral indica que no hay un acoplamiento entre la realidad de lo que se tiene con lo que se quiere, por lo que el acoplamiento deseado supone interrelacionar diversas variables sistémicas para que pueda suceder realmente un desarrollo moral (para lo cual se seguirá, con algunas correcciones, el modelo de desarrollo moral de Kohlberg), variables que son más complejas de lo que el sistema político cree o quiere hacer creer. En tercer lugar, porque afirmar la existencia de una crisis moral y, por tanto, la necesidad de acciones tendientes a resolverla, no implica que haya consenso sobre cuál es la moral que debe aceptarse ni sobre el camino a seguir para lograr dicho fin, para empezar porque es relativamente común que los agentes acusados de ser los causantes de la actual “crisis moral de la sociedad y del derecho” en las sociedades contemporáneas suelen ser los agentes que denuncian, como free riders, la misma crisis. Y, en cuarto lugar, porque un cambio sistémico que posibilite un salto en el desarrollo moral debe ser significativamente fuerte, y las medidas que suelen enunciarse para afrontarlo, además de no ser claras, suelen ser insuficientes o ingenuas (tales como pedir la creación o el fortalecimiento de una asignatura de ética en los planes de estudio de los futuros ciudadanos en general y abogados en especial). Finalmente, se propondrá partir de este diagnóstico sistémico e interdisciplinario para potencializar las respuestas que puedan darse para enfrentar la crisis; de lo contrario, lo rechazado permanecerá. El presente escrito tiene por objetivo demostrar cómo el estado actual del capitalismo neoliberal, entendido como una fuerza productora de la subjetividad basada en el rendimiento [síntesis de la disciplina (Foucault) y el control (Deleuze y Guattari) que se cataliza con la digitalidad (Han, Berardi, Fisher, entre otros)], se centra en ejercer una colonización frente al tiempo como concepto estructural de la existencia humana para poder desplegar un sistema de dispositivos psicopolíticos que le permitan su reproducción sistémica. Para conseguir este (...) objetivo la investigación cuenta con tres momentos: el primero expone el paso del domino espacial del capitalismo fordista al neoliberalismo actual de carácter temporal desde una disincronía del tiempo. El segundo explica la desfactificación del mundo como la pérdida del vínculo humano con la realidad, lo que perturba directamente el estado de ánimo de los sujetos desde un peso cargado de nihilismo. Finalmente, se expone la psicopolítica como un concepto que parte tanto de la disincronía como de la desfactificación para posicionar un dominio sugestivo de la psique humana. (shrink)

Este ensayo argumenta que el análisis conceptual inmodesto es epistémicamente inviable para seres como nosotros, porque no tenemos forma de justificar afirmaciones inmodestas acerca de la naturaleza de algo. Como argumento más adelante, las afirmaciones inmodestas no pueden ser justificadas por medios a priori o a posteriori. Si como suponen nuestras prácticas epistemológicas evaluativas tradicionales, no hay otras formas de justificar una creencia, entonces no podemos justificar afirmaciones inmodestas sobre la naturaleza de algo. El análisis conceptual inmodesto es epistemológicamente inviable, (...) entonces, porque nosotros no tenemos una forma confiable de identificar y justificar afirmaciones inmodestas sobre la naturaleza de algo. El ensayo finaliza con una evaluación de las teorías jurídicas de Scott Shapiro y Mark Greenberg desde el punto de vista de una aproximación desde el análisis modesto, por ejemplo, lo que implican nuestras prácticas conceptuales sobre la naturaleza del derecho. La tercera establece que las concepciones sobre la justicia, tanto las del escocés como las del (...) ginebrino, poseen contextos y sentidos distintos pero que, en realidad, son posturas que tienen algunas similitudes en lo que respecta al fundamento de la propiedad. The purpose of this paper is to expose the function of the culture and thought of the Far East, expressed in Japanese Zen Buddhism and Chinese Chan (as well as, in general, in Chinese philosophy and culture), within the thought of Byung-Chul Han. This dimension of the Korean's work has not been sufficiently deepened in the analyses that are made of him. This error leads to mistakes such as stating that there is no emancipation proposal in Han or that his (...) work is limited to a pessimistic description of the world. Thus, the investigation that follows the bibliographic-documental research method is divided into three moments; the first exposes the foundations of the philosophy of Zen-chan Buddhism developed by Han; the second delineates the ontology of Hanian falsification and; the third, analyzes the theses on the East within Han's theoretical project. La intención del trabajo es eminentemente pedagógica, considerando que es necesario contar con textos introductorios que le permitan al neófito adentrarse con mayor seguridad en la complejidad del pensamiento de Bentham y Austin. The aim of this study was to analyze the association between physical activity and eating habits during the COVID-19 pandemic among Brazilian adults. A sample of 1,929 participants answered an online survey, however 1,874 were included in the analysis. The impact of the COVID-19 pandemic on eating habits was assessed inquiring about participants' intake of fruits, vegetables, fried foods, and sweets during the pandemic. Physical activity was assessed by asking participants about their weekly frequency, intensity and number of minutes/hours engaging (...) in structured physical activities per week. Participants were then stratified into categories based on moderate-to-vigorous intensity and into active or inactive. Increased sweets consumption was the most commonly reported change to eating habits, followed by an increase in the consumption of vegetables, fruits, and fried foods. Physical activity practice was related to lower consumption of fried foods and sweets. A cluster analysis revealed subjects with higher the level of physical activity was more likely to follow a healthy diet. Thus, physical activity was positively associated with healthier eating habits. Health authorities must recommend regular physical as a strategy to improve overall health during the COVID-19 pandemic. Future studies should address the physical activity interventions to improve health status during a pandemic. (shrink)

This article describes and analyzes the design and functioning of the Statistical Ethics System (SETE) in Colombia’s National Statistical Office. It presents the methodology and general process of planning and implementation of the System, supported by a conceptual analysis of the requirements for an ethical functioning of official statistics. The general objective of the article is to make a practical contribution to the understanding of conceptual and practical features that ought to be considered in the implementation of an ethical system (...) in the operation of the public sector, particularly in the area of the production of official statistics. The text is divided into five parts. In the first part, we make a general introduction to the ethical value of official statistics. In the second and third parts, we make a presentation and analysis of the principles and risks that were selected as the basic ethical framework for the production of official statistics at the National Administrative Department of Statistics (DANE). Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

This reconsideration of Hume’s classic essay “Of Miracles” via the lens of American pragmatist ways of thinking about history and power shifts our attention from Hume’s epistemic concerns about the legitimacy of witnesses and testimony to his distaste for sacred history, his critical stance regarding the social force of revelation, and his disdain for religious authority. To view Hume’s essay both as an articulation of a critical philosophy of history and as an exercise in moral dynamism (social power or, authority, (...) is a result of epistemic transactions), is to intervene in both Hume studies and Contemporary Pragmatism. In this article, the key features of the Space-Time Expansion Theory are summarized and discussed, with three postulates incorporating different insights into the behavior of space-time expansion, gravity, space-time curvature, and time itself. Abstract: The objective of this work is to describe the current situation and the projections of forensic voice comparison in Chile, in the light of international standards that focus on the production of reliable evidence that can be used in the courts of justice. To do this, first, the scientific foundations that characterize this branch of forensic sciences are disclosed and, then, on that basis, the situation in Chile and its projections are analyzed and discussed, both in practice and in the forensic research. In various parts of the world—of which Mexico is one example— archaeology has been not only an academic discipline but has followed other motivations and goals, some valid and others more disputable: formation of a nationality, a need to know ancient roots, importance of a distinct art for understanding past societies or simply the promotion of tourism by attracting people to visit recently-excavated monuments or those that are already famous. In this paper, I intend to present the case of Mexico.

Drawing on recent findings, this study examines whether valence concordant electromyography (EMG) responses can be explained as an unconditional effect of mere stimulus processing or as somatosensory simulation driven by task-dependent processing strategies. While facial EMG over the Corrugator supercilii and the Zygomaticus major was measured, each participant performed two tasks with pictures of album covers. One task was an affective evaluation task and the other was to attribute the album covers to one of five decades. The Embodied Emotion Account (...) predicts that valence concordant EMG is more likely to occur if the task necessitates a somatosensory simulation of the evaluative meaning of stimuli. Results support this prediction with regard to Corrugator supercilii in that valence concordant EMG activity was only present in the affective evaluation task but not in the non-evaluative task. Results for the Zygomaticus major were ambiguous. Our findings are in line with the view that EMG activity is an embodied part of the evaluation process and not a mere physical outcome. (shrink)

This paper explores space-time with the Minkowski equation, trying to integrate using the three manuscripts presented to the Open Journal of Philosophy (OJPP) a “new theory of gravity” by introducing the concept of space-time flow. Gravity is a push rather than a pull, an idea presented in the first manuscript. Gravity is the inertia, the shape (frame) of space-time produced by dark energy. The space-time surrounding you provides the force that pushes you upwards, but it doesn’t increase the diameter of (...) the Earth. The sensation of gravity is actually caused by the accelerated flow of space-time against you, which acts as a mirror. The Earth’s expansion is apparent; creates the illusion, but Earth does not expand; rather, the space-time flow emanating from the Earth generates gravity. Einstein’s theory of relativity explains that gravity results from the curvature of space-time caused by the presence of mass and the background dark energy. “Dark energy, introduced from all directions,” which exists throughout the universe in space-time, is responsible for the universe’s accelerated expansion. One way to expand space-time is through the concept of cosmic inflation, which suggests that the universe lives a continuous widening of space-time. Free fall and relativity theory support this claim. Dark energy pushes (pressure) space-time inside the atoms, and the space-time, as in a nozzle, produces an accelerated flow which is gravity. Dark energy floods the whole space and produces positive pressure. It is a non-local/ non-analytical energy, an omnipresent that pervades everything. Dark energy is a space-time property; it was first discovered in 1998. The pressure makes space-time emerge from every point of the Universe and push it expansively. Quantum physics suggests that all the energy in the Universe can form a single universal emergent system, which produces time in the present before us in 4D space-time. This is dark energy. The expansion of space-time is universal and occurs everywhere. When this expansion occurs within atoms, it produces a space-time flux, which is gravity. The general expansion produces it and counteracts it. Pushing space-time outside of Earth (Earth does not expand, just looks like it does) is this space-time flux that makes Earth coordinates move upward, to make it feel like falling into Earth. The apparent matter expansion is its complement mirror. Here, we present Gravity as accelerated space-time flow going out from massive objects. (shrink)

The phenomenal properties of conscious mental states happen to be exclusively accessible from the first-person perspective. Consequently, some philosophers consider their existence to be incompatible with materialist metaphysics. In this paper I criticise one particular argument that is based on the idea that for something to be real it must (at least in principle) be accessible from an intersubjective perspective. I argue that the exclusively subjective access to phenomenal contents can be explained by the very particular nature of the epistemological (...) relation holding between a subject and his own mental states. Accordingly, this subjectivity does not compel us to deny the possibility that phenomenal contents are ontologically objective properties. First, I present the general form of the argument that I will discuss. Second, I show that this argument makes use of a criterion of reality that is not applicable to the case of subjective experience. Third, I discuss a plausible objection and give an argument for rejecting observation models of self-knowledge of phenomenal contents. These models fall prey to the homunculus illusion. (shrink)

An omnipresent, non-local/non-analytical energy that pervades everything enters the Universe through all infinitesimal points. Without determining its origin, our approach is to explain our gravity theory based on Einstein’s relativity theory and the behavior of space-time flow. This influx occurs continuously throughout all of space-time, making the universe expand. Our theory presents two kinds of expansion: (PUE) space-time primary universal expansion and the (VME) virtual matter expansion that occurs with the interaction of space-time with the matter. The internal space-time in (...) atoms produces a virtual slight broadening of the matter’s atoms. From our frame of reference, we can only distinguish the perturbation that occurs to the (PUE) primary universal expansion if it encounters matter. This perturbation finally is restored by a Gaussian distribution at the spherical environment. We call it the (STD) Space-time accelerated displacement. It is the inertial-gravity field. Thus, matter expands by the superposition of atoms (molecules). The accelerated expansion increases proportionally to the number of atoms that radially constitute matter. The effect is manifested immensely increased in the surface of the stellar objects. Then the surface of the massive stellar objects pushes and displaces the object’s external surrounding space-time. The acceleration of the (STD) space-time displacement decreases with the radius squared from the center of mass as it is distributed concentrically. The acceleration we feel at the Earth’s surface is permanently fixed, because when space expands, time also proportionally expands. The associated speed (ds/dt) is immersed in the accelerated expansion of space-time; the time base is the same as the acceleration of the PUE (space-time primary universal expansion) (d2s/dt2). Otherwise, in a short time, this acceleration and its associated velocity would reach the speed of light. Our theory introduces a different concept: “repulsion instead of attraction”. The expansion of space-time produces gravity instead of counteracting it. Finally, we explain using this gravity theory: Earth’s oceans, creating tidal bulges on opposite sides of the planet. (shrink)
