Introduction Context: In Portugal assisted death was approved in February 2020 by the Parliament, although the law is not yet in force. Objectives To find out what doctors think about those practices. Methods A link to a questionnaire was sent by email three times, at intervals of one week, to the doctors registered in the Northern Section of the Portuguese Medical Association, before the Parliamentary approval. Results The questionnaire was returned by 1148 physicians. A minority of doctors would practice a (...) form of assisted death under the present law or if it was legalized, but a higher percentage think that euthanasia should be legalized, and more would like to have that option if they themselves were in a terminal phase of a disease. Religion has a strong influence on the attitudes of doctors, so too does their contact with patients in a terminal phase, as doctors who deal with more patients with far advanced diseases are more likely to be unfavorable to assisted death. On the other hand, younger doctors are more in favor of these practices. Conclusion The small percentage of questionnaires sent back is a weakness in this study and casts doubts on the generalizability of the conclusions. However, this is, so far, the best approximation to the opinions of Portuguese doctors on assisted death. (shrink)

Contracts play an important role in business management where relationships among different parties are dictated by legal rules. Electronic contracts have emerged mostly due to technological advances and electronic trading between companies and customers. New challenges have then arisen to guarantee reliability among the stakeholders in electronic negotiations. In this scenario, automatic verification of electronic contracts appeared as an imperative support, specially the conflict detection task of multi-party contracts. The problem of checking contracts has been largely addressed in the literature, (...) but there are few, if any, methods and practical tools that can deal with multi-party contracts using a contract language with deontic and dynamic aspects as well as relativizations, over the same formalism. In this work we present an automatic checker for finding conflicts on multi-party contracts modeled by an extended contract language with deontic operators and relativizations. Moreover a well-known case study of sales contract is modeled and automatically verified by our tool. Recent research shows that a faulty or sub‐optimally operating metabolic network can often be rescued by the targeted removal of enzyme‐coding genes – the exact opposite of what traditional gene therapy would suggest. Predictions go as far as to assert that certain gene knockouts can restore the growth of otherwise nonviable gene‐deficient cells. Many questions follow from this discovery: What are the underlying mechanisms? How generalizable is this effect? What are the potential applications? Here, I approach these questions from the (...) perspective of compensatory perturbations on networks. Relations are drawn between such synthetic rescues and naturally occurring cascades of reaction inactivation, as well as their analogs in physical and other biological networks. I specially discuss how rescue interactions can lead to the rational design of antagonistic drug combinations that select against resistance and how they can illuminate medical research on cancer, antibiotics, and metabolic diseases. Essas noções nos devem levar a um dos pontos fundamentais do pensamento merleau-pontyano, em que a interrogaçáo ontológica parte essencialmente da fé perceptiva para chegar a uma ontologia da carne.

This article aims to analyze the problems of defining and classifying explicitly the concept of religion. We agree with the criteria of extensional accuracy, neutrality, phenomenology and non-circularity established by Mark Owen Webb (2009) as suitable for a good philosophical definition of religion. However, all attempts to establish an explicit definition that satisfies these criteria were unsuccessful. We propose a definition of religion less demanding, sustained by Morris Weitz (1956) for literature and applied mutatis mutandis to the concept of religion. (...) The aim of this paper is to support the concept of technoscience is not confused when its meaning is understood in certain ways. The use of this concept is found inside and outside the academic world. However, not all philosophers are satisfied it is applied in philosophy of science and technology. Mario Bunge argues that the concept is generating confusion regarding the classical distinction between pure science, applied and technology. According to the Argentine-Canadian philosopher, the only acceptable sense of the (...) term occurs when applied to the activity of individuals who are both scientists and technologists, as was the case of Galileo and Tesla. Countering this position, we think that the term can be used, at least not so confusing in the sense proposed by the philosopher Javier Echeverría. (shrink)

As relações entre ciência e religião são complexas. Um dos problemas que se apresentam dizem respeito a por que não constam, na ciência e na história moderna, referências e explicações que apelem a entidades como Deus, anjos e demônios. Duas respostas – entre outras – podem ser dadas ao problema. A primeira é que, dada a natureza da ciência, o sobrenatural está excluído a priori de seu meio. A segunda é que a ciência não contém explicações sobrenaturais, a posteriori, porque (...) tais explicações não se mostraram adequadas durante o desenvolvimento da ciência moderna. Contudo, se não há nenhum impedimento a priori para as explicações sobrenaturais na ciência, sustentaremos, seguindo os argumentos de Dawes e Schick, que a melhor resposta ao problema parece ser a solução a posteriori. Porém, discordamos que sustentar tal posição acarrete o cientismo. Contra o cientismo seguimos os argumentos de Feser. (shrink)

O ensaio se ocupa em mostrar como se manifestaram os ideais educacionais em relação às brincadeiras na modernidade, identificando Fröebel como o principal referente teórico nesse âmbito. Veremos em Fröebel como as ideias do brincar são importantes para a sociedade e para as escolas modernas, e como podem funcionar nos modos se subjetivação infantil. Fröebel enfatiza a necessidade de organizar o cotidiano de forma estruturada, partindo do cotidiano, que envolve todas as atividades das crianças na instituição, o que revela uma (...) preocupação com o tempo. O espaço e o tempo também são modos de controle do brincar. Quanto mais o espaço é definido, mais podemos vigiá-los, observar como brincam, como se manifestam e reagem. Do mesmo modo isso se dá em relação ao tempo, quanto mais estrita a programação, mais controle se tem sobre os corpos. Por fim, realizamos uma tentativa de pensar o brincar como forma de resistência a formas disciplinadoras, mostrando que, onde há poder (modos de conduzir o brincar como algo que tem finalidade pedagogizante) há resistência (o brincar como ato de fruição, sem utilidade), apontando acerca da despedagogização do ato de brincar. A gênese histórica da paróquia e seu desenvolvimento estrutural em relação à história da Igreja é a problemática central à qual este texto está subordinado. Por esta razão, o texto parte da etimologia do termo paróquia à compreensão de suas origens e matrizes dentro da concepção do cristianismo nascente e em suas raízes bíblicas, sem a pretensão de apresentar críticas e reformulações da estrutura paroquial. O respectivo trabalho toma como alicerce os decorrentes períodos e fatos históricos da Igreja para caracterizar (...) e contextualizar o desenvolvimento da paróquia que, desde os primórdios, está subordinada a estruturas de autoridades eclesiais. O seguinte texto vale-se de documentos importantes que contextualizam a visão, função e organização da paróquia como parte fundamentalmente integrante do corpo eclesial, bem como conceituam juridicamente esta comunidade de fé, célula da Igreja Particular. Após um apanhado geral da genealogia eclesiástica, com o desenvolvimento paroquial no seu interior, o presente trabalho atem-se a contextualizar a visão que a paróquia assumiu dentro da eclesiologia do XXI Concílio Ecumênico da Igreja Católica, o Concílio Vaticano II e do Código do Direito Canônico de 1983 em comparação com o Código Pio-beneditino. O estudo reflete sobre o conjunto de categorias que coloca a alteridade como princípio articulador e compreensivo do saber das diferenças em Emannuel Lévinas. Uma ética da alteridade é um desafio para uma sociedade que uniformiza os processos de ensino e desvaloriza o ser em uma relação de supremacia do eu frente ao alter. A esfera educacional é propícia ao desenvolvimento de uma ética da alteridade, pois tem por princípio o diálogo e o respeito ao outro, enquanto compromisso de abertura (...) a uma comunidade de racionalidades plurais. Na ótica educativa, o ambiente escolar é um lugar de encontro com o outro para a construção de novas aprendizagens interativas, tendo a possibilidade de promover a ética da alteridade, num espaço de diálogo e escuta sensível. A formação educativa amplia a visão de mundo e humaniza as relações, cujo enfoque é pensar as inter-relações, as experiências, as singularidades, as imperfeições e inacabamentos, esclarecendo posições dogmáticas e compartilhando o respeito e o reconhecimento humano. Contribui ainda para uma formação integral do educando para deixar o outro ser outro, para uma cultura mais respeitosa e sem preconceitos, formando cidadãos que reconhecem e tornam compreensíveis seus atos. É um processo coletivo de conhecimento para aprimorar o saber reflexivo, pois a aprendizagem acontece através de inter-relações entre os educandos, cada um com suas próprias diferenças. Concluímos que por meio de uma ética da alteridade de Lévinas, somos convidados a uma atualização formativa de abertura à pluralidade humana, tornando-se um desafio para o educador resistir aos modismos e visões centralizadoras, evitando que os sujeitos sejam vistos de maneira reduzida, homogeneizada e inexpressiva. The purpose of the following text is to analyze the development of the understanding of God in the theological-biblical imaginery, as well as the formulations that allow us to understand the development of Transcendent identity in history and in the construction of the talk and about God. Starting from a brief synopsis of the biblical Old Testament design of elements present in the theological imagination of the identity of the God of Israel, from liberating perception present in the image of (...) God Revelation from Jesus Christ phenomenon, passing briefly to the understanding of God as Trinity and culminating with the perception of identity of God within the current context of liberation, it points out the development of the identity of a God who – far from remain static, immobile, inert – assumes an itinerant identity alongside your people. Thus, the present paper analyses aspects of revelation and maps an identity of God from these elements, pointing to the construction of the identity design of a God who, by walking along the humanity, is not free to be assimilated and perceived in different forms in the course of this Revelation route. We approach in the essay the temporality of childhood, taking as horizon the language and experience. Walter Benjamin and Giorgio Agamben are the main thinkers who help us to address the fragile experience in contemporaneity, in the sense that the current ways of life are full of everyday practices that are not transformed into experience. To restore experience it is necessary to understand childhood as a condition of existence that accompanies all life; it is a subject who is exposed to (...) historicity and who makes history, discontinuous history and singular event. With this in mind, through Manuel de Barros' poetic power we rekindle the relationship between childhood temporalities, language and experience, because ins this relation present itself the intensity of a lived that is devoid of a successive and chronological time. The creative power of this language has in the becoming-child the artisan for the creation of another perspective in the search for the inaugural source of words: to advance to the beginning and reach the childing of words. From these constructed approaches, we understand that together, Walter Benjamin, Giorgio Agamben and Manuel de Barros invite us to resume our childhood, in the search for the first meaning of words, which we only find with the presence of childhood. Here, it is not about establishing an absolute truth about childhoods and their times, but of finding ways to think about how to constitute other relationships with and in time. (shrink)

As health policy-makers around the world seek to make progress towards universal health coverage, they must navigate between two important ethical imperatives: to set national spending priorities fairly and efficiently; and to safeguard the right to health. These imperatives can conflict, leading some to conclude that rights-based approaches present a disruptive influence on health policy, hindering states’ efforts to set priorities fairly and efficiently. Here, we challenge this perception. We argue first that these points of tension stem largely from inadequate (...) interpretations of the aims of priority setting as well as the right to health. We then discuss various ways in which the right to health complements traditional concerns of priority setting and vice versa. Finally, we set out a three-step process by which policy-makers may navigate the ethical and legal considerations at play. (shrink)

ABSTRACT:Business ethics research has long been interested in understanding the conditions under which ethical consumption is consistent versus context-dependent. Extant research suggests that many consumers fail to make consistent ethical consumption decisions and tend to engage in ethical decisions associated with ingroup identity cues. To fill this gap, four experiments examine how construal levels moderate the influence of ingroup versus outgroup identity cues in ethical consumption. The studies support the contention that when consumers use concrete construal to process information, they (...) will focus on ingroup cues and make ethical consumption decisions that are aligned with ingroup biases. However, when consumers use abstract construal, they will act more consistently with their inner goals rather than focusing on ingroup and outgroup cues. Social goodwill, which indicates desires to give back to society, is identified as mediating the effects. The findings have important implications for ethical consumption and social influence literature. (shrink)

Com base na crítica que Hume faz ao argumento do desígnio, especialmente nas partes 10 e 11 dos Diálogos sobre a Religião Natural, meu objetivo neste artigo é, a partir de uma análise da relação entre a existência do mal no mundo e a suposta existência de uma divindade possuidora dos atributos tradicionais do teísmo, defender a tese segundo a qual o tratamento que Hume dá ao problema do mal corresponde, digamos assim, à cartada final – o último e decisivo (...) recurso que Philo personagem que articula essa crítica) aciona para mostrar que o argumento do desígnio não fornece bases suficientemente sólidas e consistentes para dar suporte à crença na existência de um Deus maximamente poderoso, justo e benevolente; e que, portanto, a existência do mal no mundo tem uma força argumentativa tal que a improbabilidade da existência de Deus é maior do que com base nos argumentos apresentados nas partes 2 a 8 dos Diálogos. Isso significa que eu tomo aqui o problema do mal como o maior problema para o teísta experimental – cuja argumentação pretende provar a existência de Deus a partir da observação dos fenômenos do mundo. Estudo comparado sobre o tratamento dado à reprodução humana assistida no direito do Brasil, Estados Unidos, Portugal, Espanha e Itália.

Resumo: O pensamento de Nietzsche é recepcionado na Escandinávia, através do historiador dinamarquês Georg Brandes. O historiador é atraído pelo aspecto aristocrático, o qual se depreende da leitura que Nietzsche realiza sobre a cultura. A radicalidade, a originalidade e a minuciosidade psicológica, que se reconhece no espírito filosófico do pensador alemão, permeiam a leitura que Brandes faz do autor de Zaratustra. O próprio Nietzsche dá testemunho do quanto seu nome, graças a Brandes, passa a ser conhecido na Dinamarca, em suas (...) diversas cartas e outros escritos, atestando, inclusive, um correto entendimento de seu pensamento. Esta proposta tem o intuito de averiguar o papel que a memória, em seu sentido aristocrático, tem a contribuir na recepção nietzschiana, efetuada por Brandes. Em que medida a mnemotécnica pode apontar caminhos para uma cultura aristocrática, no contexto da Dinamarca de Brandes?: Nietzsche’s thought is received in Scandinavia through the Danish historian Georg Brandes. The historian is attracted by the aristocratic aspect that emerges from Nietzsche’s reading of culture. Radicality, originality and psychological detail, which can be seen in the philosophical spirit of the German thinker, permeate Brandes’ reading of the author of Zarathustra. Nietzsche himself testifies to how much his name, thanks to Brandes, comes to be known in Denmark in several of his letters and other writings, even attesting to a correct understanding of his thinking. Our proposal is intended to ascertain the role that memory, in its aristocratic sense, has to contribute to Brandes’ Nietzschean reception. O tema da sustentação das rádios comunitárias emergiu com força no Brasil, desde a I Conferência Nacional de Comunicação, em 2009. A legislação em vigor, relacionada com as iniciativas de comunicação comunitária, restringe o financiamento e compromete vários projetos ou leva outros tantos às alternativas do amadorismo ou da desobediência civil. Este artigo analisa o tema a partir da legislação existente, dos impasses percebidos, do debate formulado e das saídas encontradas, partindo da pesquisa bibliográfica e documental relacionada ao tema. Compreende (...) o setor da Comunicação Comunitária como integrante de um Sistema de Comunicação mais amplo, no qual são fundamentais a formulação de suas políticas e a compreensão do papel do Estado para fomentar e viabilizar suas práticas, diante da força dos meios comerciais no país, que continuamente deslegitimam e criminalizam sua existência. O presente trabalho tem como objetivo compreender as contribuições da perspectiva teórico-metodológica da pesquisa-ação colaborativo-crítica na formação acadêmica e profissional dos autores de dissertações de um grupo de pesquisa. Assim, toma a perspectiva teórica de Jürgen Habermas, baseada nos conceitos de discurso e atos de fala. Assim, o discurso assume a forma de argumentação, de acordo com que os participantes argumentam sobre uma pretensão de validade criticável colocada em diálogo. Fundamenta-se na pesquisa qualitativa do tipo estudo de caso, que busca (...) nos espaços discursivos individuais e coletivos articular com seus participantes, um lugar onde todos têm o direito de falar e colocar seus entendimentos de forma racional, apresentando suas ideias e construindo pela via do diálogo argumentos fortes para chegar a um entendimento mútuo. Procura-se captar por meio dos espaços discursivos, as perspectivas teórico-metodológicas da pesquisa-ação colaborativo-crítica presente nas dissertações, os “silenciamentos” presentes e intencionalidades que permeiam os objetivos das propostas de pesquisa. A partir dos espaços constituídos, foi possível perceber que os autores construíram suas pesquisas coletivamente, sendo os conceitos de colaboração, participação e escuta primordiais para dar continuidade aos movimentos desencadeados. Neste sentido, a utilização da pesquisa-ação como perspectiva teórico-metodológica contribuiu para fundamentar as relações ao longo dos processos de pesquisa. Sobretudo os sujeitos puderam vivenciar a pesquisa como um todo, não apenas metodologicamente, mas teoricamente pela via comunicativa. Sendo assim, por meio da comunicação há uma mudança social, sendo possível estabelecer reflexões profundas do mundo da vida intersubjetivamente partilhado pelos sujeitos. (shrink)

Free software introduces a challenge to the classical conception of individual rights. The model of software licensing given by the General Public License generates the question whether it constitutes an exercise or a wavering of copyright. It is argued in this paper that the later alternative is entrenched in the classical concept of freedom as autonomy, which, by its turn, is reflected in a classical conception of individual rights based on the model of propriety as a dominion over an exclusive (...) object (res). We provide grounds for a concept of non-exclusive individual rights, based on the notion of freedom as reciprocity, in order to obtain more solid legal foundations for the free licensing of software. The concept of freedom as reciprocity and the corresponding reconstruction of non-exclusive subjective rights achieved in this paper is an exercise in general theory of law and thus may be applied to other legal fields where the classical notion of freedom and the property of exclusivity do not fit properly. Our outline of regional history alludes to its conceptual foundations, defines the object of its analysis and also identifies the convergence of factors that shape this area of study, such as genealogy, multicentrism, comparison (...) and social synthesis. Once these different aspects have been described it will be easier to understand that the past is not only a dependent variable of time but also, to a great degree, of space. (shrink)

We argue that deliberative decision-making that is inclusive, transparent and accountable can contribute to more trustworthy and legitimate decisions on difficult ethical questions and political trade-offs during the pandemic and beyond.

This paper discusses the post-trial access to drugs for patients who participated in clinical trials in Brazil. The ethical guidance for clinical trials in Brazil is arguably one of the clearest in the world in attributing to research sponsors the responsibility for providing post-trial drugs to patients who participated in their experiments. The Federal Constitution recognizes health as a fundamental right to be fulfilled by the State. Based on the Brazilian constitution and on the National Health Council resolutions, courts have (...) been accepting patients' claims and ordering the State and the pharmaceutical companies to provide these patients with the tested treatment in the quantity and duration they need it. This generous interpretation of the duties of the pharmaceutical companies and the State makes the Brazilian model for post-trial access unique when compared to the experience of other countries and thus should be followed with attention by future research in order to assess its consequences for patients, research sponsors, and the public health system. Brazil is currently a relevant country for the pharmaceutical industry due to the dimensions of its actual and potential market. As a consequence, the number of pharmaceutical trials has been rising. It is the largest market for pharmaceutical companies in Latin America, the 8th biggest in the world and second only to China among the so-called BRICS’s emerging countries. The demand for pharmaceutical products (...) in the country has been increasing by double digits over the last few years, reaching 20% in 2008. Not surprisingly, we are also witnessing a steady increase in the number of applications by national and international pharmaceutical companies before ethical research authorities for authorization to perform clinical trials of drugs. Esse texto é um resultado parcial e provisório de uma pesquisa de Pós-doutorado em andamento na Scuola Normale Superiore de Pisa/Italia sobre a supervisão do filósofo Roberto Esposito. Observa-se que nessas primeiras décadas do século XXI o pensamento filosófico Italiano, por algumas das razões que tentaremos expor abaixo, tem sido objeto de um grande interesse mundial, tornando-se objeto de inúmeros seminários, livros e artigos. O texto tenta avaliar se existiria algo como uma “filosofia Italiana” para além da pertença nacional daqueles (...) que contribuíram para a sua construção. Pode-se falar em uma Italian Theory? This article explores the ways in which suspects attempt to make putative victims/complainants at least partially responsible for the incidents for which they are investigated, transforming themselves into the victim and the other into the perpetrator. Drawing upon conversation analysis, I examine audio-recorded police interviews for low-level crimes in England and in which suspects have constructed what I refer as counter-denunciations. I argue that suspects accomplish these counter-denunciations through discursive practices that involve, for example (a) contrasting the complainant’s actions with (...) their own innocent conduct; (b) historicizing the event being investigated; and (c) discrediting the complainant’s character—stigmatizing. These practices have in common the suspects’ reliance on the relational and contextual character of the categories ‘offender’ and ‘victim’. (shrink)

The investigation presents a hermeneutics of memory in Nietzsche’s mature texts in the light of contributions of Aristotle and Thomas Aquinas. At the First Dissertation of Towards the Genealogy of Morals, Nietzsche introduces the influence that memory exerts on the capacity for reflection and action. The mnemotechnical procedure that the German philosopher analyzes is Thomas Aquinas’ commentary on Aristotle’s reminiscence. Aquinas identifies the ordering of what is wanted, the investment of the spirit, frequent meditation and the taking of the chain (...) of pending issues as fundamental points for the activity of memory. And, at these points, Nietzsche identifies morality as a key component in the memorization process. It will analyze some approximations and distances between the Nietzschean and Thomist theses and to what extent morality operates in the sense of detecting memory activity. (shrink)

O objetivo de nosso artigo é compreender as noções de fé perceptiva , filosofia e ciência em Le visible et l’invisible (1964). Essas noções nos devem levar a um dos pontos fundamentais do pensamento merleau-pontyano, em que a interrogaçáo ontológica parte essencialmente da fé perceptiva para chegar a uma ontologia da carne.

O artigo tem como objetivo descrever a crítica de Maurice Merleau-Ponty (1908- 1961) sobre a Filosofia da negatividade, especialmente em sua obra O visível e o invisível (1964) publicada após sua morte. Essa crítica é endereçada principalmente ao filósofo Jean- Paul Sartre (1905-1980).

A saúde e a educação são campos que se esbarram no fazer cotidiano dos profissionais que atuam com seres humanos. A relação destes dois campos deve ser de equilíbrio e harmonia tanto no campo do trabalho de professores, como no trabalho de profissionais médicos, psicólogos, enfermeiros, enfim. O campo da pesquisa raramente consegue agregar com harmonia esta necessidade de interseccionalidade em saúde e educação. Diante desta realidade, o livro “Cenários da saúde da população negra no Brasil – diálogos e pesquisas” (...) possui esta qualidade e agrega pesquisa em saúde e reflexões para profissionais que atuam nas escolas, no SUS, no SUAS, nas associações e instituições comunitárias. O livro apresenta os sujeitos negros em suas vidas cotidianas com o olhar da pesquisa acadêmica que serve as necessidades do Brasil negro e indígena. (shrink)

O tema principal deste trabalho é a análise de contradições da política brasileira contemporânea à luz da Teoria Crítica.

O presente artigo busca articular reflexões a partir da teoria da interseccionalidade. Nesse campo, a questão da liberdade é um ponto importante e é antípoda do racismo. A forma pela qual as mulheres negras afirmam a liberdade, individual ou coletivamente, produz resultados políticos e sociais. Neste artigo buscamos analisar a percepção da liberdade no cotidiano. Foram entrevistadas mulheres negras de diferentes níveis de escolaridade, em idade reprodutiva, residentes do sudoeste baiano. A liberdade se apresenta como uma possibilidade que advém de (...) conquistas econômicas e sociais. É, nesse sentido, resultante de lutas coletivas e sociais. O racismo é, então, uma barreira importante a ser considerada a partir da teoria da interseccionalidade. A estruturação de sentidos e significados construídos nas narrativas do cotidiano pode auxiliar na compreensão das condições sociais e de vida das mulheres negras e orientar hipóteses de pesquisa e de ação política. Diversas referências que envolvem os temas do germanismo e da aristocracia encontram em Nietzsche e em Brandes um campo bastante fértil. Ambos os autores, comprometidos com a discussão voltada à crítica da cultura ocidental, têm o intuito de fomentar a elevação da cultura, o que alavanca o tema da aristocracia. A dinâmica das forças, que caracteriza o pensamento nietzschiano, manifesta, na aristocracia, a vontade de superação de um povo dotado de espírito. Na recepção que Brandes faz deste tema da aristocracia (...) de Nietzsche, este adquire rasgos de um radicalismo. Por essa razão, o intuito, nesta investigação é o de, num primeiro momento, examinar em que medida a aristocracia, elevada a radicalidade, implica numa leitura que envolva, para além da dinâmica de autossuperação, a de um germanismo, radicado na exaltação da raça. Num segundo momento, o intuito é o de avaliar em que medida as implicações da recepção de Brandes do radicalismo aristocrático, traduzido em moldes de germanismo, enfatizaram a leitura que os nazistas realizaram do pensamento nietzschiano.
