One less obvious impact of legal bilingualism in a postcolonial jurisdiction like Hong Kong is an increasing trend of unrepresented litigants. Since their lack of legal knowledge often places them at a disadvantage and poses numerous problems in court, the government has established the resource centre for unrepresented litigants to offer them information about legal procedure. This paper evaluates the usefulness of the Chinese official reference materials at the centre in equipping laymen for civil litigation. As a first point of (...) contact between unrepresented litigants and the law, these leaflets have a direct impact on the users’ understanding of litigation procedures and their courtroom performance. This paper argues that the leaflets suffer from two major problems: incomprehensibility of language and lack of structure. Problems involved in include inconsistency in terminology, problematic translation, and language complexity arising from the use of odd collocation, unusual words, difficult legal terminology and confusing parts of speech; whereas in , information is found to be scattered and disorganised. To improve readability, the paper suggests using plain language, and providing checklists of documents, and a legal glossary. Cross-jurisdiction practices will be examined to show how unrepresented litigants’ access to justice may be facilitated. (shrink)

In my paper I will discuss both the processes of interlingual and intralingual translation of laws. The objective is to establish how the intralingual and the interlingual translation process influence or even shape a particular language of the law affecting thus the laws and the communication in a given legal system. In order to achieve this, I will initially research into the historical process that produced a series of intralingual translations of major laws in Greece and both interlingual and intralingual (...) translations of laws in Cyprus, investigate the main principles used in interlingual and intralingual translation, examine how the languages of the law in Greece and Cyprus were affected by these translations, and show how intralingual and interlingual translation influenced the law both in Greece and Cyprus. ABSTRACTAs a result of intensive mobility and migration over the last twenty-five years, multiculturalism and multilingualism have become a reality in European prisons. This “superdiversity” poses a serious challenge to the various stakeholders who need efficient and reliable communication. Yet this topic has been underresearched. According to statistics for the year 2014 issued by the Council of Europe, Belgium has a high rate of foreign inmates. Against this background, the aim of this exploratory research is to describe how the Flemish (...) penitentiary system tackles this linguistic challenge. The present paper reports a study of conversational acts in dialogical interaction. Conversation in which the use of a vulgar term [à la bieb żobbi] in the Maltese language was used was recorded and analysed for the present purpose. The term is demonstrated to serve social psychological functions. We documented three modes governing its use in conversation, that is, (a) as a personality descriptor, (b) as a strategy for shutting down an alternative view, and (c) as a strategy for shifting (...) dialogue to more neutral and less threatening grounds for the subject. We further document a number of modalities that govern justifications for using the vulgar term in conversation. We argue that the use of vulgarity can serve to achieve semantic barriers in dialogue and that these apply to internal conversations as much as they do to dialogical engagement with another. We further argue that semantic barriers can be overcome in ways that shift conversation to less threatening grounds. (shrink)

Contemporary realities of global population movement increasingly bring to the fore the challenge of quality and equitable health provision across language barriers. While this linguistic challenge is not unique to immigration contexts and is likewise shared by health systems responding to the needs of aboriginal peoples and other historical linguistic minorities, the expanding multilingual landscape of receiving societies renders this challenge even more critical, owing to limited or even non‐existing familiarity of modern and often monolingual health systems with (...) the particular needs of new linguistic minorities. The centrality of language to health beliefs, attitudes, practices, cultural scripts, and conceptual frameworks emphasizes its pivotal role in the healthcare process, and consequently in the adverse effects of treatment that is language‐insensitive and unaware. Such an attitude on the part of medical authorities risks considerable epistemic injustice in the form of a (mis)judgement of patients’ intelligence, credibility, and rationality based on the language that they speak and the manner in which they speak it, consequently impacting the quality and equity of care provided. This danger, I argue, may be effectively countered by fostering among the participants in the healthcare process a sense of epistemic humility through greater metalinguistic awareness. Outlining a range of operative steps that can be used to facilitate this. I argue that the reality of language barriers in the healthcare process, while not entirely eliminable, may nevertheless be successfully addressed, in order to mitigate the challenge of quality and equitable healthcare provision in multilingual societies. When people speak about “communication barriers”, what they usually think about are such things as the limitations set by human nature itself, or the constraints that are inherent in the tools we use for communicating. As an example of the first, consider the limited range of the naked human voice; for the second, we may think of the limitations imposed by such primitive communicative devices as the bonfire, the heliograph, or an old-fashioned megaphone.Our contribution draws attention to the fact that, (...) despite enormous advances on the technological side of human communication (such as demonstrated by the existence and use of computers as communication devices), there still are some barriers to be removed as far as the human side is concerned. We call these barriers the “stumble-blocks of the mind”. Their existence is demonstrated by the study of two case stories, which show that understanding the communicative implications of computerizing information is more important than increased emphasis on ever fancier and more expensive hardware products.The next question has to do with the reasons for these “stumbling blocks” to occur. Current communicative and linguistic theoretical findings are used in an effort to explain and solve the communicative dilemmas that are encountered in the organization of our communication, among others in the area of human-computer interface. In particular, the notion of “privacy” in speech acting is suggested as an overlooked aspect, and the notion of “information transfer” is replaced by that of “creating mental activity”.Finally, some conclusions are drawn, and a number of practical applications are offered. Does language limit the moral thoughts we can have? To answer that, I distinguish between two kinds of limits: Boundaries or barriers fence things out. Identification and erection of linguistic barriers, defines, diagnoses, or places restrictions on what language can in principle grasp or be, and often involves abstraction from actual linguistic behavior. This is typically preformed by remarks I call ‘theses’; Contours or outlines give real-life portrayals. Drawing the contours of a linguistic activity involves a certain (...) attention to reality: to detail and particularity, and we typically draw contours by using remarks I call ‘helpers’. I examine the possibility that confusion can be diagnosed in Sabina Lovibond's attempt to apply the idea that moral language has necessary boundaries, and explain the alternative of drawing linguistic contours. I then examine Richard Rorty's position according to which the fact that we can shape our language indicates that the boundaries of language do not encompass all possible sense, and compare Rorty's discussion with Sarah Bachelard's discussion of euthanasia. My claim here is that trying to improve on the language we have might be part of drawing its contours, rather than redefining its boundaries. The discussion reveals a difference between two kinds of contour drawing, and thus between two kinds of helpers: ones that help to draw the contours of the actuality of linguistic activities, and ones that help to draw the contours of their potentiality. Finally, I argue that the value of drawing contours instead of barriers is that the former better reveal the fact that we care about our ways of making sense. (shrink)

This article reviews empirical evidence and ethical norms in cross-linguistic nursing. Empirical evidence highlights that linguistic barriers between nurses and patients can perpetuate discrimination and compromise nursing care. There are significant organizational and relational challenges involved in ensuring adequate use of interpreters by nurses. Some evidence suggests that linguistic barriers are particularly problematic for nurses when compared with physicians. A comparative analysis of nursing ethical norms for cross-linguistic nursing was conducted using the codes of ethics of (...) the American Nurses Association, the Canadian Nurses Association, and the International Council of Nurses. Five principal ethical norms for cross-linguistic nursing were identified: (1) respect for the patient as a unique person; (2) respect for the patient’s right to self-determination; (3) respect for patient privacy and confidentiality; (4) responsibility for one’s own competence, judgment, and action; and (5) responsibility to promote action better to meet the needs of patients, families, and groups. The article explores the comprehensibility of court forms by providing a quantitative overview and a qualitative analysis of such syntactic characteristics as length and structure of sentences and noun phrases. The analysis is viewed in the broader context of genre characteristics of court forms, their role within legal proceedings, and their function for eliciting narratives from court users. The findings show that while the elicitation strategies are not always coherently aligned with the guidance sections, the guidance itself condenses legal and (...) procedural information into overly complex and verbose syntactic constructions. Comprehensibility barriers are thus created through breaks in information flow, ambiguous syntactic constructions, missing information and misalignment between questions and guidance. Such comprehension challenges have a negative impact on the potential of court users to effectively engage with legal proceedings. (shrink)

An important part of the explanatory role of concepts is that they enable us to combine a wide variety of objects, properties and relations in thought, with contents spanning diverse domains. I discuss an argument that appears to show that paradigmatic non-linguistic representational formats are unsuited to play this role, and thus conceptual representation could not occur in these formats. I show that this argument fails, because it overlooks the possibility of individual concepts being shared between a number of (...) special purpose representational systems. Demonstrating this requires defending the possibility of cross-format redeployment of concepts. (shrink)

I explore the idea of language reaching its limits by distinguishing two kinds of limits language may have: The first are “Boundaries” which lie on the edges of language, and distinguish what makes sense from what does not. These, I claim, are suitable in making theoretical generalizations. The second are “Contours,” which lie within language, and allow for contrasting and comparing meanings and shades of meanings that we capture in language. These are more suitable for characterizations of particulars, and for (...) literary use. I claim that failure to draw this distinction is responsible for confusions in Sabina Lovibond’s and Richard Rorty’s views of moral thought and language. (shrink)

Although the number of women in middle management has grown quite rapidly in the last two decades, the number of female CEOs in large corporations remains extremely low. This article examines many explanations for why women have not risen to the top, including lack of line experience, inadequate career opportunities, gender differences in linguistic styles and socialization, gender-based stereotypes, the old boy network at the top, and tokenism. Alternative explanations are also presented and analyzed, such as differences between female (...) leadership styles and the type of leadership style expected at the top of organizations, feminist explanations for the underrepresentation of women in top management positions, and the possibility that the most talented women in business often avoid corporate life in favor of entrepreneurial careers. Good communication between healthcare providers and patients is vital to effective healthcare. In order to understand patients’ complaints, make accurate diagnoses, obtain informed consent and explain treatment regimens, clinicians must communicate well with their patients. This can be challenging when treating patients from unfamiliar cultural backgrounds, such as the Deaf. Not only are they a linguistic and cultural minority, they are also members of the world’s largest and oft-forgotten minority group: the disability community. Under Article 25 of the United (...) Nations Convention on the Rights of Persons with Disabilities, persons with disabilities have rights to the same range, quality and standard of free or affordable healthcare and programmes as provided to other people. Yet communication barriers and healthcare providers’ lack of familiarity with Deaf culture can impair the quality and accessibility of healthcare for the Deaf. This essay analyses the scope of this issue in Singapore: a state party to the CRPD which has a vibrant Deaf community, and yet no legislative or constitutional guarantees of the rights of persons with disabilities. In addition to exploring the communication barriers faced by Deaf patients in Singapore, this essay highlights ways in which healthcare providers and the state can support community-based initiatives to overcome these barriers. This article discusses which barriers hamper access to, and participation in, cultural life for members of vulnerable groups, in particular persons belonging to old and new minorities and persons with disabilities in the context of digitization. It then examines what role public authorities can play in addressing and dismantling these barriers. The article adopts a bottom-up approach, in that it is based on a qualitative study, which gives voice to vulnerable groups. The qualitative research involved interviews with different organisations representing, (...) or working with, vulnerable groups in 12 European Union Member States (Belgium, Croatia, Denmark, Estonia, Finland, France, Germany, Hungary, Ireland, Italy, Malta and Spain). In that regard, the article approaches vulnerability from a distinct conceptual standpoint, identifying vulnerability as a condition caused by structural barriers. On the whole, the article shows that, while digitization of cultural content, goods and services, offers increased opportunities for culture to be democratised and for its consumption by wider and more varied audiences to be enhanced, it also engenders structural barriers and creates additional challenges. Furthermore, while digitisation has ensured more diverse representation in cultural content, vulnerable groups still face stereotypical and negative portrayals within mainstream cultural content. The thematic analysis of the qualitative interviews also captures different dimensions of access to digital cultural and supports the identification of effective policy measures to bridge the ‘digital divide’ and assist in the fulfilment of cultural rights of vulnerable groups. Deep learning techniques have revolutionised artificial systems’ performance on myriad tasks, from playing Go to medical diagnosis. Recent developments have extended such successes to natural language processing, an area once deemed beyond such systems’ reach. Despite their different goals, these successes have suggested that such systems may be pertinent to theoretical linguistics. The competence/performance distinction presents a fundamental barrier to such inferences. While DL systems are trained on linguistic performance, linguistic theories are aimed at competence. Such a (...) barrier has traditionally been sidestepped by assuming a fairly close correspondence: performance as competence plus noise. I argue this assumption is unmotivated. Competence and performance can differ arbitrarily. Thus, we should not expect DL models to illuminate linguistic theory. (shrink)

In the global economy, linguistic diversity influences economic and political development as well as public policies in positive and negative ways. It leads to financial costs, communication barriers, divisions in national unity, and, in some extreme cases, conflicts and war--but it also produces benefits related to group and individual identity. What are the specific advantages and disadvantages of linguistic diversity and how does it influence social and economic progress? This book examines linguistic diversity as a global social (...) phenomenon and considers what degree of linguistic variety might result in the greatest economic good.Victor Ginsburgh and Shlomo Weber look at linguistic proximity between groups and between languages. They describe and use simple economic, linguistic, and statistical tools to measure diversity's impact on growth, development, trade, the quality of institutions, translation issues, voting patterns in multinational competitions, and the likelihood and intensity of civil conflicts. They address the choosing of core languages in a multilingual community, such as the European Union, and argue that although too many official languages might harm cohesiveness, efficiency, and communication, reducing their number brings about alienation and disenfranchisement of groups.Demonstrating that the value and drawbacks of linguistic diversity are universal, How Many Languages Do We Need? suggests ways for designing appropriate linguistic policies for today's multilingual world. This article focuses on a study of historical emigration from the 1960s onwards, showing the importance of intercultural interaction. Due to the poverty, hunger and precarious living conditions that existed in Madeira Island, many young people saw emigration to South Africa as a means of escaping a difficult life. Arduous jobs due to their limited qualifications, as well as legal constraints and an inability to understand the language, were just some of the barriers encountered by these emigrants. By interviewing 15 (...) persons from different generations of emigrants (first and second-generation), it was possible to gather information about the reality Madeirans have faced in South Africa. The graphematic transcription of semistructured interviews plays a very important role in the effective recording of these data, guaranteeing their comparability, analysis and discussion. The compilation of the empirical corpus, with the informed consent obtained from the interviewees, respecting their privacy and guaranteeing their anonymity allows us to perform a sociocultural and linguistic study. The study took into account intercultural personal reports of informants coming from different locations of the Island, age groups, genders, and schooling. Even though the impact of the South African culture, language and society was noticeable, the presence of the Portuguese language, music, religion, tradition, and Madeiran food were very strong, due to the fact that the Portuguese community was united. Parsing according to the principles of modern linguistic theory is only now becoming a computationally interesting task. We contribute to these developments by illustrating how the account of movement introduced by Chomsky inBarriers can be incorporated into a Static Discontinuity Grammar (SDG). We are concerned with A''-movement as reflected inwh movement of arguments and adjuncts. The resulting SDG can be processed by an SDG parser to recover the thematic information and constitutency structure associated with a natural language sentence.

This paper calls for a paradigm shift in studying academic dependency, towards the paradigm of brokered dependency. Using Chinese academia as an example, I demonstrate how the neocolonial condition of academic dependency is always mediated through blockage-brokerage mechanisms. The two most salient blockage-brokerage mechanisms of dependency in the Chinese context are linguistic barrier and authoritarian malepistemization, and the effects of the latter consist of three layers: institutional, informational and incorporational. On top of their domestic impacts, those mechanisms jointly (...) exacerbate spectacularized postcoloniality in anglophone-hegemonic global academic publishing. The paradigm of brokered dependency not only represents a more nuanced approach to the study of academic dependency, but also underscores the fact that the dismantling of the neocolonial condition cannot be conceived and pursued in isolation from comprehending and confronting the authoritarian condition, especially when the latter pertains under the disguise of anticolonialism. In vitro fertilisation (IVF) daily practice reveals that couples are willing to take greater risks than doctors if there is a higher chance of pregnancy. Arising from this is a frequently addressed issue regarding the embryo transfer strategy: single or double embryo transfer? The dilemma is faced by patients, as well as physicians, who are caught between the possibility of no pregnancies at all and facing the prospect of iatrogenic twin gestation. How could the couple's preferences concerning how many children (...) they would like be taken into account in determining the number of embryos transferred? How should the physician exercise his medical responsibility towards his patients and the unborn child? An effective approach could be to enhance a couple’s autonomy by advocating a medical beneficence that incorporates patients’ values. This can be achieved through a case-by-case approach in a deliberative process of decision-making which includes real patient-centred communication. (shrink)

A linguistic barrier between healthcare professional and patient is a challenging experience for both parties. In many cases, the absence of formally trained medical interpreters necessitates that an informal interpreter, drawn from the immediate environment, be used to facilitate communication. While the presence of an interpreter in a medical interview raises many questions about the effectiveness of the communication between healthcare professional and patient, it also gives rise to new speculations revolving on patient rights, medical ethics and patient (...) privacy. In this article we examine the concept of communication competency in medical interviews, as well as translation theory, and link these theories to Western medical ethics in order to identify potential areas in which informal interpretation could impact on the patient. In his mature writings, Kuhn describes the process of specialisation as driven by a form of incommensurability, defined as a conceptual/linguistic barrier which promotes and guarantees the insularity of specialties. In this paper, we reject the idea that the incommensurability among scientific specialties is a linguistic barrier. We argue that the problem with Kuhn’s characterisation of the incommensurability among specialties is that he presupposes a rather abstract theory of semantic incommensurability, which he then tries to apply (...) to his description of the process of specialisation. By contrast, this paper follows a different strategy: after criticising Kuhn’s view, it takes a further look at how new scientific specialties emerge. As a result, a different way of understanding incommensurability among specialties will be proposed. (shrink)

As there are more and more bilingual couples who ran vlogs to share their bilingual and intercultural lives on the internet, this paper seeks to delineate the sources of motivation for these couples to disclose their privacy through vlogging. Based on the sample of selected vlogs, a qualitative analysis has been conducted to obtain the sociolinguistic picture of the bilingual couples’ motivations to attract wider audiences via the internet. The analysis of vlogs, informed by a multimodal theoretical framework, focused on (...) the audiovisual and textual content of vlogs with regard to the subjective representations of films and texts resulting from these couples’ individual stories. The conducted study spotlights vlogging activities of bilingual couples who feel the need to share their intercultural and bilingual experiences on the internet. Our data suggest that bilingual couples vlog to express their hybrid identities by sharing how they cope with challenges and overcome linguistic barriers, as well as find ways to enjoy cross-cultural understanding. The paper explores the linguistic and cultural diversity from a new perspective of private vlogs created and maintained by bilingual couples. It unfolds an account of the less studied online context in which partners of different ethnic backgrounds make their private lives public, and illustrates how bilingual couples generate ideas to filming and sharing online.
