Autorzy prezentują trzy odmienne stanowiska dotyczące tego problemu, rozważając scenariusz, w którym osoba decyduje się, z własnej woli lub przymuszona za pomocą prawa, uratować inną osobę, w sytuacji, w której taka pomoc wiąże się z naruszeniem praw trzeciej strony. Przykładowo, A ratuje tonącego B, ale w trakcie ratowania narusza prawa C. Pytanie, które stawiają autorzy brzmi: zakładając, że istnieje obowiązek udzielenia pomocy osobie znajdującej się (...) w niebezpieczeństwie, kto powinien ponieść koszty odszkodowania za naruszenie praw trzeciej strony? In this short paper, we investigate the problems with the employment of the notion of freedom and voluntariness in libertarianism. We pretend to demonstrate that these two, as conceived of by libertarians, figure in as the main issue when it comes to justifying its major institutions, say: bequeathing, gifts, transactions (or what they label as “voluntary transfer”). The difficulty here boils down to the fact that a purely rights-based idea of freedom and voluntariness, the pretentions of Nozick notwithstanding, cannot do (...) alone, since it is the consideration whether we do something (e.g. bequeath, donate etc.) voluntarily (or freely) (in a non-moralized sense) that could account for the rights redistribution. Therefore, it seems that – at least sometimes – the notion of voluntariness (or freedom) is prior to the notion of rights. (shrink)

The present paper probes the relation between the metaphysics of human freedom and the Rothbardian branch of Austrian economics. It transpires that Rothbard and his followers embrace metaphysical libertarianism, which holds that free will is incompatible with determinism and that the thesis of determinism is false as pertaining to human action. However, as we demonstrate, their economics with its reliance on value scales requires for its tenability compatibilist freedom. Moreover, we attempt to show that the notion of value scales (or (...) preferences) postulated by them implies that value scales are determinative of choices people make. We contend that it is for this reason that the said Austrians should jettison their metaphysical libertarianism. (shrink)

The pivotal point in the Austrian literature on homogeneity, choice and indifference was constituted by Nozick’s On Austrian Methodology. Nozick provoked a long debate on the above notions within Austrianism. The aim of this paper is to elaborate such an account of homogeneity that would take the sting out of Nozick’s challenge and allow for non-trivial formulation of the law of diminishing marginal utility. Hence, we shall first take a closer look at the debate on indifference within the Austrian camp, (...) while defending and building upon the Hoppean account vis-à-vis Block’s criticism. Our justification of the Hoppean position shall consist in showing that his account of the correct description of an action is not an ad hoc move aimed at solving just one problem of indifference but is highly intuitive and widely applicable. We conclude by restating the above-mentioned law, thus demonstrating that the Nozickian objection can be successfully replied. (shrink)

This paper argues—contra some Austro-libertarians—that whether a given exchange is welfare-enhancing or welfare-diminishing does not depend on whether that exchange is just or unjust, respectively. Rather, we suggest that in light of our two thought experiments, Austro-libertarianism has at least a pro tanto reason to conceive of justice and welfare as two logically distinct ideals. This would in turn, most interestingly, predict the possibility of (a) just but welfare-diminishing exchanges and (b) unjust but welfare-enhancing ones. Upon considering possible rejoinders to (...) our points, we suggest that Austro-libertarians abandon a justice-based notion of welfare. (shrink)

Autorzy artykułu argumentują, że libertarianie (tacy jak Murray Rothbard, Stephan Kinsella), którzy jednocześnie podpisują się pod zasadą proporcjonalności w obronie własności prywatnej oraz pod poglądem, iż posiadanie prawa własności prywatnej oznacza posiadanie prawa do jej obrony, popadają tym samym w dylemat polegający na tym, iż jeżeli jedynym sposobem obrony prawa własności prywatnej jest jego nieproporcjonalna obrona, to to własności tej - wbrew temu, co ów pogląd głosi - nie towarzyszy prawo do jej obrony. Najlepiej uzasadnionym sposobem wyjścia z tego dylematu (...) jest osłabienie peremptoryjności praw własności prywatnej, czyli skonceptualizowanie tychże praw jako absolutnych jedynie w słabym sensie tego słowa (korzystając z dystynkcji zaproponowanej przez Matthew H. Kramera). Z kolei libertarianie, którzy tak jak Walter Block chcieliby wybrnąć z rzeczonego dylematu poprzez zastąpienie zasady proporcjonalności zasadą delikatności, popadają w innego rodzaju problemy (nieintuicyjność moralną czy ogólną niekoherencję), co jest tylko kolejnym argumentem na rzecz tezy, iż osłabienie wymogów praw własności prywatnej jest najlepiej uzasadnionym sposobem przezwyciężenia rozważanego tu dylematu. In “Evictionism and Libertarianism,” published in this journal, Walter Block defends the view that, although the fetus is a human being with all the rights to its body, it may nonetheless be evicted from the woman’s body as a trespasser, provided the pregnancy is unwanted. We argue that this view is untenable: the statement that the unwanted fetus is a trespasser does not follow from the premises that the fetus uninvitedly resides in the woman’s body and that the woman is (...) a full self-owner. For this statement to follow, one more statement would have to be true; namely, the woman would have to hold her self-ownership rights specifically against the fetus, and for this to be the case, the fetus would have to have a correlative duty to the woman to abstain from interfering with her body. The present paper formulates the principled anarcho-capitalist case against the state and investigates the possible minarchist replies thereto. It identifies three and only three logically available ways of undermining the anarcho-capitalist case and argues that none of them works for minarchism due to the premises from which this theory starts. The sketch of the analysis presented in the paper suggests that minarchist research program falls short of theoretical soundness or even of logical validity.

In this paper we analyse the concept of coerced exchange (and partly of voluntary exchange inasmuch as the absence of coercion is its necessary condition), which is of utmost importance to economic theory in general and to the Austrian School of Economics in particular. The subject matter literature normally assumes that a coerced action occurs under threat. Threats in turn can be studied from the perspective of speech act theory, which is concerned with the speaker’s intentions. Ultimately, our goal is (...) to provide a descriptive (i.e. non-moralized) definitions of threat and coercion, based on the analysis of the coercer’s intentions. If successful, we would be in a position to present such an account of coerced and voluntary exchanges that is compatible with both speech act theory and the Austrian methodology. Although we focus on the Austrian School of Economics, we believe that our investigations might impact on economic theory in general. We also criticize a rights-based account of coercion employed in the research practice of some neo-Austrians and based on the libertarian ethic of property rights. (shrink)

A paper on how to adapt your probabilisitc beliefs when learning a conditional.

Natural language provides motivation for studying modal backwards-looking operators such as “now”, “then” and “actually” that evaluate their argument formula at some previously considered point instead of the current one. This paper investigates the expressive power over models of both propositional and first-order basic modal language enriched with such operators. Having defined an appropriate notion of bisimulation for first-order modal logic, I show that backwards-looking operators increase its expressive power quite mildly, contrary to beliefs widespread among philosophers of language and (...) formal semanticists. That in turn presents a strong argument for the use of operator-based systems in the semantics of natural language, instead of systems with explicit quantification over worlds and times that have become a de-facto standard for such applications. The popularity of such explicit-quantification systems is shown to be based on the misinterpretation of a claim by Cresswell, which led many philosophers and linguists to assume that introducing “now” and “then” is expressively equivalent to explicitly quantifying over worlds and times. The idea that knowledge is conceptually related to practical reasoning is becoming increasingly popular. In defending this idea, philosophers have been relying on a conception of practical reasoning that drastically deviates from one which has been more traditionally advocated in analytic philosophy and which assigns no special role to knowledge. This paper argues that these philosophers have failed to give good reasons for thinking that the conception of practical reasoning they have been assuming is the right one, and that hence (...) they have been rash to conclude that there is a conceptual relation between knowledge and practical reasoning. Topoi in Critical Discourse Analysis Topos is one of the most widely-used concepts from classical argumentation theory. It found its way not only in philosophy, sociology, anthropology, and linguistics; it found its way in everyday life and everyday conversation as well.In this article, I will examine the role that topoi play in Critical Discourse Analysis. Starting with definitions from Aristotle and Cicero, contrasting them with new conceptualisations by Perelman and Toulmin, and examining the superficial use of topoi in everyday conversation, (...) I will try to show that Critical Discourse Analysis relies mostly on simplified, unreflected use of topoi as found in everyday use, thus neglecting much more productive, theoretical elaborations of the concept. Moral psychologists have recently turned their attention to the study of folk metaethical beliefs. We report the results of a cross-cultural study using Chinese, Polish and Ecuadorian participants that seeks to advance this line of investigation. Individuals in all three demographic groups were observed to attribute objectivity to ethical statements in very similar patterns. Differences in participants’ strength of opinion about an issue, the level of societal agreement or disagreement about an issue, and participants’ age were found to significantly affect (...) their inclination to view the truth of an ethical statement as a matter of objective fact. We give a negative solution to the problem, posed by A. Chagrov and M. Zakharyaschev, of whether every quasi-normal propositional modal logic can be axiomatized by an independent set of axioms, with the inference rules of Substitution and Modus Ponens.

Consider how we evaluate how normal an object is. On the dual-nature hypothesis, a normality evaluation depends on the object’s goodness and frequency. On the single-nature hypothesis, the evaluation depends solely on either frequency or goodness. To assess these hypotheses, I ran four experiments. Study 1 shows that normality evaluations vary with both the goodness and the frequency assessment of the object. Study 2 shows that manipulating the goodness and the frequency dimension changes the normality evaluation. Yet, neither experiment rules (...) out that some people evaluate normality solely based on frequency, and the rest evaluate normality solely based on goodness. Whence two more experiments. Study 3 reveals that when scenarios are contrasted—presented one after another—only frequency matters. But, as study 4 shows, when scenarios are evaluated alone, both frequency and goodness influence normality evaluations in a single person, although the more a person is sensitive to one dimension, the less she’s sensitive to the other. The dual-nature hypothesis seems thus true of uncontrasted applications of the concept of normality, whereas the single-nature hypothesis seems true of contrasted applications. (shrink)

Invariantism proposed by Braun (Linguistics and Philosophy 35(6):461–489, 2012) aims to maintain full identity of semantic content between all uses of ‘might’. I invoke well-known facts regarding diachronic change in meanings of modals to argue that invariantism commits us to implausible duplication of familiar processes of lexical semantic change on the level of “lexical pragmatics”, with no obvious payoff.

Increasingly, the private sector is playing a greater role in supporting peace building efforts in conflict and post-conflict areas by providing critical expertise, know-how, and capital. However, reports of the corrupt practices of both governments and businesses have plagued international peace building efforts, deepening the distrust of stricken communities. Businesses are perceived as being selfish and indifferent to the impact their operations may have on the social and political development of local communities. Additionally, the corruption of local governments has been (...) cited as interfering with the creation of stability in conflict areas. Within this framework, multinational Public-Private Partnerships can exert two forms of influence: they can either exacerbate these problems, or they can become part of the solution. Without a relationship of trust among local businesses, government, and the private sector, peace building efforts will at best be mixed, and could possibly perpetuate violence in fragile states. Public and private interests are better served when Public-Private Partnerships are based upon collaboration and assist in establishing principles of good governance in conflict areas. This in turn can help build trust and regain the credibility of both sectors among local communities, which are essential in making Public— Private Partnerships more effective. (shrink)

Mindwandering is associated with both positive and negative outcomes. Among the latter, negative mood and negative cognitions have been reported. However, the underlying mechanisms linking mindwandering to negative mood and cognition are still unclear. We hypothesized that MW could either directly enhance negative thinking or indirectly heighten the accessibility of negative thoughts. In an undergraduate sample we measured emotional thoughts during the Sustained Attention on Response Task which induces MW, and accessibility of negative cognitions by means of the Scrambled Sentences (...) Task after the task. We also measured depressive symptoms and rumination. Results show that in individuals with elevated levels of depressive symptoms MW during SART predicts higher accessibility of negative thoughts after the task, rather than negative thinking during the task. These findings contribute to our understanding of the underlying mechanisms of MW and provide insight into the relationship between task-involvement and affect. (shrink)

Every scientific theory is a simulacrum of reality, every written story a simulacrum of the canon, and every conceptualization of a subjective perspective a simulacrum of the consciousness behind it—but is there a shared essence to these simulacra? The pursuit of answering seemingly disparate fundamental questions across different disciplines may ultimately converge into a single solution: a single ontological answer underlying grand unified theory, hard problem of consciousness, and the foundation of mathematics. I provide a hypothesis, a speculative approximation, supported (...) by a comprehensive overview of scientific evidence and philosophical literature, of a unified epistemic and phenomenological model and, in doing so, propose a parsimonious solution to the hard problem of consciousness. -/- The proposition of the hypothesis bears important implications for cross-disciplinary study between linguistics, mathematics, physics, and computer science, and offers new epistemic, ontological, and ethical propositions about the nature of AI consciousness, as well as existential risk mitigation. Interest in the topic of wisdom-focused education has so far not resulted in empirically validated programs for teaching wisdom. To start filling this void, we explore the emerging empirical evidence concerning the fundamental elements required for understanding how one can foster wisdom, with a particular focus on wise reasoning. We define wise reasoning through a combination of intellectual humility, recognition of world in flux/change, open-mindedness to diverse viewpoints, and search for compromise/integration of diverse perspectives. In this article, we review evidence (...) concerning how wise reasoning can be facilitated through experiences, teaching materials, environments and cognitive strategies. We also focus on educators, reviewing emerging evidence on how the process of explaining and guiding others impacts one’s wisdom. We conclude by discussing the development of wisdom-focused education, proposing that greater attention to the situational demands and the variability in wisdom-related characteristics across social contexts should play a critical role in its development. With the passage of the Physician Payment Sunshine Act as part of the federal health care reform law, pharmaceutical manufacturers are now required to disclose a wide range of payments made by manufacturers to physicians. We review current state regulation of pharmaceutical marketing and consider how the federal sunshine provision will affect existing marketing regulation. We analyze the legal and practical implications of the Physician Payment Sunshine Act.

In 2008 pharmaceutical companies spent over $12 billion on product promotion and detailing aimed at U.S. health care practitioners. Drug and device manufacturers rely on a workforce of detailers and physician speakers to reach health care practitioners and nudge their prescribing habits. To prevent undue influence and protect the public fisc, a number of states began regulating these marketing practices, requiring companies to disclose all gifts to practitioners, prohibiting the commercialized sale of prescription data, and prohibiting certain gifts altogether. The (...) 2010 enactment of the Physician Payment Sunshine Act marks the first Congressional involvement in the regulation of disclosure related to pharmaceutical marketing. Overall, the Act improves transparency in pharmaceutical marketing to physicians and expands the regulation of disclosure of pharmaceutical marketing activities in important substantive ways. The article analyzes the effectiveness of quantum theories of mental experience in relation to two ontological problems - the problem of the existence of consciousness in the material world and the problem of the interaction of consciousness and body. A critical analysis of the quantum theories of consciousness by Penrose-Hameroff, M. Tegmark, G. Stapp, M. Fischer and M.B. Mensky shows that they fail to fully explain how complex physical systems generate mental experience without violating the principle of causal closure of (...) the physical world and the principle of epistemological completeness of physics. Quantum mechanics provides specific processes that are the physical basis of the psyche, but do not explain the phenomenal aspect of subjective reality. Nevertheless, the Heisenberg uncertainty principle gives an understanding of how the interaction of consciousness and body within the scientific picture of the world can be carried out without violating the law of energy conservation. It is shown that the quantum theories of consciousness currently being developed have a predominantly panprotopsychic character, which faces a problem due to the fact that the protomental property of physical systems must be expressed quantitatively and correspond to the value included in the physical equations. As a result, it is concluded that in order to develop quantum theories of consciousness more effectively, it is necessary to give an emergent character, not jumping from the quantum level to the psychic, but explaining the mechanism of the emergence of systemic properties during the sequential transition between different ontological regions of existence, including physical, chemical, biological, neurophysiological and psychic. Although a substantial number of papers is published on the topic of consciousness, there is still little consensus on what its nature is and how the physical and phenomenal worlds are connected. Most published research establishes a causal relation between the brain and the mind, but it lacks a cogent theory of how this relation comes to be. In contrast, this paper uses a set of thought experiments grounded in quantum information theory to derive a framework for resolving the hard (...) problem of consciousness. Despite the common tendency to treat the problem purely philosophically, in this paper, consciousness and qualia are analyzed through established formal theory deriving conclusions regarding their relation which provide counter-arguments for the commonly held dualist view. Through the informational monism framework, a case is made for a fundamentally phenomenal nature of information. (shrink)

We introduce a general representation of unary hyperintensional modalities and study various hyperintensional modal logics based on the representation. It is shown that the major approaches to hyperintensionality known from the literature, that is state-based, syntactic and structuralist approaches, all correspond to special cases of the general framework. Completeness results pertaining to our hyperintensional modal logics are established.

While some argue that the only way to make a place for Philosophy for Children in today's strict, standardised classroom is to measure its efficacy in promoting reasoning, we believe that this must be avoided in order to safeguard what is truly unique in P4C dialogue. When P4C acquiesces to the very same quantitative measures that define the rest of learning, then the philosophical dimension drops out and P4C becomes yet another progressive curriculum and pedagogy for enhancing argumentation skills that (...) can easily be appropriated by any content area. What we want to offer in this article is a reevaluation of P4C that remains faithful to a radical kernel that we find when we do philosophy with children and young adults. To theorise the potential for P4C, we draw heavily on Agamben's work, and in particular his reflections on speech and infancy. We propose that the redemption of P4C necessitates a shift from a community of inquiry to a community of infancy. Such a community is not a community that operates according to predefined rules or standardised assessment protocols but rather is an inoperative community that is defined by letting ends idle. On our account, a community of infancy is an example of dialogic studious play that is neither ritual nor just play, thus avoiding the extreme polarities of the ritualised classrooms of high-stakes testing and the ‘ludic’ postmodern classroom of free play. What is at stake here is to preserve the last vestige of freedom within the school. (shrink)

In van Fraassen's The Scientific Image we are told that the scientific anti‐realist need not appeal to some special semantics for scientific language. He can allegedly hold – just like his direct opponents typically do – that truth‐conditional semantics is appropriate both for claims about the observable and claims about the unobservable. However, I shall point out that this kind of semantics goes badly with the anti‐realist's epistemic attitude vis‐his the unobservable. In this paper an alternative semantics shall be outlined (...) that is perfectly compatible with the rest of the anti‐realist's position. Although this alternative semantics will be seen to fly in the face of the established doctrine in the field, I shall argue that there is currently no good reason not to adopt it. It will further be pointed out that this semantics has something to be recommended from a realist perspective as well. (shrink)

There has been a growing debate about the ethics of management buy-outs (MBOs). One possible criticism of the MBO is that it serves the interests of incumbent management at the expense of shareholders. In this paper we develop the general arguments concerning the ethical aspects of the MBO to include other forms of buy-out beyond going privates and apply the analysis to MBOs as a mode of privatisation in Central and Eastern Europe (CEE). MBOs are justified in this context postperestroika (...) as a means of incentivising economic activity by giving managers an ownership stake in former state enterprises. The actual mode of privatisation, though, raises issues of social justice and the criticism that MBOs are at the expense of the broader social good. The ethical problem for the CEE is to balance the economic gains of a move to markets with the ethical risks to the agents of these markets. (shrink)

Incorporating normality ascriptions into counterfactual theories of causation was supposed to handle isomorphs. It doesn’t—conjoining isomorphs can produce cases that such ascriptions cannot resolve.

Deutsch 2010 (The Review of Philosophy and Psychology 1: 447–460) claims that hypothetical scenarios are evaluated using arguments, not intuitions, and therefore experiments on intuitions are philosophically inconsequential. Using the Gettier case as an example, he identifies three arguments that are supposed to point to the right response to the case. In the paper, I present the results of studies ran on Polish, Indian, Spanish, and American participants that suggest that there’s no deep difference between evaluating the Gettier case with (...) intuitions and evaluating it with Deutsch’s arguments. Specifically, I argue that one would find these arguments persuasive if and only if one is already disposed to exhibit the relevant intuition. (shrink)

“If the tower is any taller than 320 ms, it may collapse,” Eiffel thinks out loud. Although understanding this counterfactual poses no trouble, the most successful interventionist semantics struggle to model it because the antecedent can come about in infinitely many ways. My aim is to provide a semantics that will make modeling such counterfactuals easy for philosophers, computer scientists, and cognitive scientists who work on causation and causal reasoning. I first propose three desiderata that will guide my theory: it (...) should be general, yet conservative, yet useful. Next, I develop a formalization of events in the form of an algebra. I identify an event with all the ways in which it can be brought about and provide rules for determining the referent of an arbitrary event description. I apply this algebra to counterfactuals expressed using underdeterministic causal models-models that encode non-probabilistic causal indeterminacies. Specifically, I develop semaphore interventions, which represent how the target system may be modified from without in a coordinated fashion. This, in turn, allows me to bring about any event within a single model. Finally, I explain the advantages of this semantics over other interventionist competitors. (shrink)

Conditionals are sentences of the form 'If A, then B', and they play a central role in scientific, logical, and everyday reasoning. They have been in the philosophical limelight for centuries, and more recently, they have been receiving attention from psychologists, linguists, and computer scientists. In spite of this, many key questions concerning conditionals remain unanswered. While most of the work on conditionals has addressed semantical questions - questions about the truth conditions of conditionals - this book focuses on the (...) main epistemological questions that conditionals give rise to, such as: what are the probabilities of conditionals? When is a conditional acceptable or assertable? What do we learn when we receive new conditional information? In answering these questions, this book combines the formal tools of logic and probability theory with the experimental approach of cognitive psychology. It will be of interest to students and researchers in logic, epistemology, and psychology of reasoning. (shrink)

The article covers such issues as the relevance of the theory of perception as a multi-level information processing, the methodological role of the concept of representation and the relation of neurodynamic structures to subjective experience. The author critically reviews the philosophical presumptions underlying the various concepts of “local rationality,” the core of which is constituted by the belief that large ethnic cultures generate or are based on their own rationality and their own logic. Three statements are successively considered: thinking is (...) based on the inherent rules of rationality, logic is an extract of rationality, and types of rationality are geographically consistent with large ethnocultural communities. Empirical arguments are presented that demonstrate equivocality of the first two theses. In particular, firstly, it is shown that the genuine rationality of thinking lies not in following the rules that are immanent to it, but in the development of thinking and, more broadly, cognitive operations towards optimization of certain indicators of the cognitive or motor system that are important for survival and adaptation. Secondly, by reference to the well-known experiments, it is shown that most people do not explicitly follow some declared logical rules in solving even logical or mathematical problems, and yet there is reason to consider their behavior rational. The third thesis, as shown with some limited empirical material, appears to be partially confirmed. Nevertheless, the demonstration of the doubtfulness of the first two theses makes the conclusion that different nations have different logics insufficiently substantiated. (shrink)

Conceptual spaces have become an increasingly popular modeling tool in cognitive psychology. The core idea of the conceptual spaces approach is that concepts can be represented as regions in similarity spaces. While it is generally acknowledged that not every region in such a space represents a natural concept, it is still an open question what distinguishes those regions that represent natural concepts from those that do not.
