It is argued that quantum mechanics must be interpreted according to the Copenhagen interpretation. Consequently the formalism must be used in a purely operational way. The relation between realism, hidden variables, and the Bell inequalities is discussed. The proof of impossibility of local hidden-variables theories (Bell's theorem) is criticized on the basis that the quantum mechanical states violating local realism are not physically realizable states.“Einstein had great difficulty in reaching a sharp formulation of Bohr's meaning. After analyzing the difficulties for a local realistic interpretation of quantum theory, it is argued that such an interpretation might be possible if some new postulates are added to the standard ones. We propose a stochastic interpretation of quantum theory, which involves the need of joint probability distributions for all relevant observables. The well known problems for the existence of joint distributions are solved by assuming that neither all Hermitian operators correspond to observables nor all density matrices represent physical states. It is argued that the long standing failure to show an uncontroversial, loophole-free, empirical violation of a Bell inequality should be interpreted as a support to local realism. After defining realism and locality, this as relativistic causality, the performed experimental tests of Bell’s inequalities are commented. It is pointed out that, without any essential modification of quantum mechanics, the theory might be compatible with local realism.

It is argued that a realistic interpretation of quantum mechanics is possible and useful. Current interpretations, from “Copenhagen” to “many worlds” are critically revisited. The difficulties for intuitive models of quantum physics are pointed out and possible solutions proposed. In particular the existence of discrete states, the quantum jumps, the alleged lack of objective properties, measurement theory, the probabilistic character of quantum physics, the wave–particle duality and the Bell inequalities are analyzed. The sketch of a realistic picture of the quantum (...) world is presented. It rests upon the assumption that quantum mechanics is a stochastic theory whose randomness derives from the existence of vacuum fields. They correspond to the vacuum fluctuations of quantum field theory, but taken as real rather than virtual. (shrink)

Arguments are provided for the reality of the quantum vacuum fields. A polarization correlation experiment with two maximally entangled photons created by spontaneous parametric down-conversion is studied in the Weyl–Wigner formalism, that reproduces the quantum predictions. An interpretation is proposed in terms of stochastic processes assuming that the quantum vacuum fields are real. This proves that local realism is compatible with a violation of Bell inequalities, thus rebutting the claim that it has been refuted by experiments. Quantum optics does not give a local explanation of the coincidence counts in spatially separated photodetectors. This is the case for a wide variety of phenomena, including the anticorrelated counting rates in the two channels of a beam splitter, the coincident counting rates of the two “photons” in an atomic cascade, and the “antibunching” observed in resonance fluorescence.We propose a local realist theory that explains all of these data in a consistent manner. The theory uses a completely classical description of (...) the electromagnetic field, but with boundary conditions of the far field that are equivalent to assuming a real fluctuating, zero-point field. It is related to stochastic electrodynamics similarly to the way classical optics is related to classical electromagnetic theory.The quantitative aspects of the theory are developed sufficiently to show that there is agreement with all experiments performed till now. We claim that physics has been constructed because three “philosophical” principles have been respected, namely, realism, locality, and consistency. These principles lead to an interpretation of quantum mechanics (QM) in terms of local hidden-variables theories (LHV). In order to prove that LHV have not been refuted, we analyze the empirical proofs of Bell's inequalities and we argue that none is loophole-free. Then we propose a restricted QM that does not contain measurement postulates and that does not claim that all state (...) vectors (self-adjoint operators) are states (observables). The contradiction of such restricted QM with Bell's inequality cannot be shown as a theorem, but only by the design of a loophole-free experiment. Finally, we argue that noise has been underestimated in quantum theory. It does not appear in QM, but it is essential in quantum field theory. We conjecture that noise will prevent the violation of Bell's inequality. (shrink)

This article analyzes the framing of the Revolutionary Armed Forces in Razón Pública, a Colombian digital magazine, from July 2008 to July 2018. The article’s methodology combines Natural Language Processing and close reading. Results indicate that the magazine’s language primarily framed FARC as a protagonist of the peace process, and, secondarily, as an actor of Colombia’s armed conflict and drug trafficking. Shortly after Juan Manuel Santos’ first inauguration as Colombian president, some authors forecasted that the conditions were ripe for (...) a peace process with FARC. During the official negotiation, FARC was framed as enigmatic, and rational protagonist of a challenging peace process. Overall, the frames detected in this analysis are an echo of the UNDP Colombian Report that called for analytic journalism that improves the public’s understanding of the country’s complex armed conflict and proposes negotiated and military solutions. The act of iudicare hostes (‘declare public enemy’) was a formal pronouncement of the Roman Senate, voted for the first time in 88 BCE following a proposal by L. Cornelius Sulla after his first march on Rome. Legal historians have generally interpreted it as an emergency measure intended to preserve legality in a situation of civil strife and viewed it as a consistently defined institutional framework throughout the final decades of the Republic. Through an analysis of Sulla’s performative political communication, (...) before, during and in the immediate aftermath of the march, this paper argues that the act of judging (iudicare) someone a public enemy (hostis publicus) was first deployed as a political action, void of legal effects. Later instances of iudicare suggest that this act underwent a process of institutionalization after 63 BCE. (shrink)

The topic of the present reflection is Christian religious belief. Specifically, we will use Husserlian tools in order to examine the positional nature of this particular type of belief. We will be less interested in the question concerning the success conditions of this experience and more in its noetic structure. According to our proposal, to believe by faith supposes (although it is not exhausted by) accepting the existence of mundane evidence speaking against this fundamental belief. The believer acknowledges the existence (...) of this contradicting en-doxical basis and nevertheless believes what she believes. We will refer to this simultaneous movement of accepting and cancelling as the concessive structure of the religious attitude. The para-doxical movement of experiencing conflicting evidence as being subjectively ineffective is a key component of this attitude. At least some inchoative conflict with the world is required in order for the religious belief to be religious. Lastly, we will try to show that, with a distinctive terminology, the idea that the Christian religious attitude involves a conflict between subjectivity and world is present not only in Kierkegaard but also in phenomenological figures like Scheler and even Husserl. In this paper I attempt to bring together (at least) two very different debates: one on justice, mercy and particularity, the other on the play of exclusionary reasons. My aim is to show how the discussion of the uneasy co-existence of justice and mercy pivots on the question of particularity. And, secondly, that the debate on exclusionary reasons can show us why law may fail to do justice in this context.

What are the Early Memoranda?1 When were they written? What are their sources? What is their purpose and their relation to Hume's works? These questions, usually addressed separately, are in fact tightly interwoven: they require an articulated response that embraces them all. Our response could be summarised as follows: far from being current reading notes, or even less the exhaustive diary of Hume's intellectual experience, the Early Memoranda are most likely second-tier texts, or—as James Harris recently conjectured—"notes taken from notes."2 (...) This article aims to present four case studies of the different responses to governmental measures to fight the COVID-19 pandemic by supreme and constitutional courts, especially in cases of jurisdictions that have been facing democratic erosion. The spread of the COVID-19 pandemic demanded immediate public policies and other political decisions from the branches of government. Executive authorities were the main actors in effecting constitutional public health norms. The expectation was that they will abide by the rule of law in fulfilling (...) their duties; that has not been the case under governments that promoted democratic erosion. The different contexts of the threats posed to the constitutional democracies led populist and illiberal leaders to opportunistically either try to—and then be contained by courts—or effectively consolidate the expansion of powers under the conditions of the pandemic. Concentrating on four jurisdictions (the USA, Hungary, El Salvador, and Brazil), the article demonstrates that courts can effectively work as bulwarks against waves of democratic erosion, especially in situations of stress, as it was the case in the global COVID-19 pandemic. This hypothesis is also proven by episodes in which courts did not sufficiently operate to curb illiberalism because they were already captured. The analyses enable classifying the court’s responses to the COVID-19 executive measures in a threefold pattern: deferential, restrictive, and of forced capitulation. (shrink)

Equidistante del moderno analisis formalista y de la tradicion clasica que reivindicaba la primacia del contenido, el tipo de trabajo patente en estas paginas reivindica el lugar central del texto filmico y sus texturas singulares en los nuevos estudios cinematograficos. «Greek Love is a modern invention», asserts the classical scholar. David Hume can claim the title of inventor. In his 1751 Dialogue on morals he used the phrase to account for the relationship between a university boy and a man of merit. How did Hume come to this expression? Pederasty was a traditional sceptical topic against a universal standard for morals. What did Hume think of this practice and its origin? When he accounts for pederasty and homosocial arrangements by negative (...) epithets, is Hume seriously condemning them or he is «only» and prudentially following the common use? The Article tries to give a first answer to these questions by examining Hume's writings and their sources, and the views of the modern authors. The Article delineates the eighteenth-century debate, without projecting on it our views, and maintains that, like some ancient philosophers according to Sextus Empricus, and possibly like Smith, Hume would have declared practice in itself «indifferent». Unlike Dickens’s novel, this is not a tale of light and darkness, order and chaos, good and evil… It is, though, a story worth to be told about two standpoints about games and sports, teaching and research, physical education simply put, that have pursued similar interests on parallel tracks for too long, despite their apparent closeness and expected shared cultural grounds. The objective of this conceptual analysis is to try and reconcile two perspectives, namely motor praxeology and teaching games for (...) understanding (TGfU), born in the last third of the XX century in France and England with the intention to rethink the foundations of physical education (PE) and sports teaching. Pierre Parlebas, from the French side of the English Channel, claimed in 1967 that sports make part of PE, that team sports must be considered from a specific, sociomotor point of view, and that motor conducts (i.e. the significative organization of motor behaviour), not sports techniques, are the corner-stone of PE and sports coaching. In the early 1980s, from the English side of La Manche, Almond, Thorpe, and Bunker made a plea for a shift in the way to teach games (sporting collective duels mostly), deeply concerned by the negative impact of the traditional technics-centred approach on motivation, competence and attained level of the least able in school situations. Our conclusion is that TGfU, or game-based approaches to sports coaching and teaching, can take great advantage of the motor-praxeological rationale for three reasons: firstly, because concepts like understanding, game sense and action principles are operatively, semiotically linked to the reality of the playing process; secondly, because the inner structures of the games that constrain players and guide their motor conducts, permit to integrate games in the general system of sporting games, no matter their level of institutionalisation; finally, because the intervention practice is better thought of and more systematically developed upon the operational concepts of internal logic and expected practical effects of game playing. This time, Paris could be the place to go to in search of solutions, not the city to run away from in hope of consolation. (shrink)
