L'A. si sofferma sulle questioni teologiche, che in parte derivano da un prologo al Commento alle Sentenze, sulla questione relativa al problema della relazione , (...) sulla questione relativa al tempo . Quanto al ms. di Tortosa, l'A. esamina quattro questioni non attribuite, dimostrandone la paternità wyltoniana. Rispetto all'ultima delle questioni, sulla conoscenza scientifica di Dio, l'A. si sofferma sul prologo alle Sentenze di Prospero da Reggio Emilia dove la questione di Wylton è utilizzata per riferire l'opinione di Enrico di Harclay . The degree of realism that Duns Scotus understood his formal distinction to have implied is a matter of dispute going back to the fourteenth century. Both modern and medieval commentators alike have seen Scotus's later, Parisian treament of the formal distinction as less realist in the sense that it would deny any extra-mentally separate formalities or realities. This less realist reading depends in large part on a question known to scholars only in the highly corrupt edition of Luke Wadding, where (...) it is printed as the first of the otherwise spurious Quaestiones miscellaneae de formalitatibus. The present study examines this question in detail. Cited by Scotus's contemporaries as the Quaestio logica Scoti, we establish that it was a special disputation held by Scotus at Paris in response to criticisms of his use of the formal distinction in God, identify its known manuscripts, and provide an analysis based upon a corrected text, showing in particular the total unreliability of the Wadding edition. Our analysis shows that the Logica Scoti does not absolutely prohibit an assertion of formalities as correlates of the formal distinction, even in the divine Person, so long as their non-identity is properly qualified. That is, the positing of formalities does not of itself entail an unqualified or absolute distinction. (shrink)

L'importance de Duns Scot (1265?-1308) pour l'histoire de la métaphysique et de l'éthique n'est plus à démontrer. En demandant à Olivier Boulnois de recueillir ces études, Philosophie tente de se faire l'écho de la floraison récente de travaux consacrés à cet auteur, aussi bien à l'étranger qu'en France. L'article de Stephen Dumont souligne la place fondamentale de Scot dans l'histoire de la métaphysique. Mais au lieu de se centrer sur la tradition moderne de la métaphysique transcendantale (de Suarez à (...) Kant), il insiste sur le fait que Scot résout l'énigme de la Métaphysique d'Aristote en réduisant sa dimension théologique de celle-ci à sa dimension ontologique. La philosophie scotiste apparaît ainsi comme l'aboutissement d'une exploration systématique des possibilités d'interprétation ouvertes par le texte aristotélicien. L'étude d'Olivier Boulnois fait la transition entre la métaphysique et l'éthique. Elle s'interroge sur le fondement métaphysique de l'éthique scotiste et montre comment le primat d'une volonté libre, et, dans le monde fini, la contingence de la loi morale, s'accompagnent d'une objectivité du bien. La rigueur de la liberté n'est précisément pas l'arbitraire. Gérard Sondag, quant à lui, pose, à partir d'un point très précis d'exégèse aristotélicienne - pour quelle raison le citoyen courageux expose-t-il sa vie quand la Cité est en danger? - la question du fondement éthique du sacrifice de soi. En rejetant, dans sa réponse, toute éthique de l'intérêt personnel, et en posant une objectivité de la norme éthique indépendante de notre propre avantage, Scot ouvre une voie qui conduit à la morale normative de Kant. Duns Scot apparaît ainsi à la fois comme le refondateur de la métaphysique comme discipline transcendantale et comme un penseur original de l'éthique. Unissant ces deux dimensions, il est l'auteur d'une véritable métaphysique de l'éthique. (shrink)

Secondo questa teoria fisica i due termini contrari di un processo di mutamento , costituendo due segni di diversa natura, possono essere pensati entrambi come veri nell'istante temporale del mutamento, senza generare contraddizione. Sono studiati i passi in cui Enrico sarebbe giunto ad analoghe conlusioni. Nel Quodlibet XV, q. 13, affrontando la questione dell'Immacolata Concezione, Enrico avrebbe in un primo momento sostentuto la tesi (...) secondo la quale grazia e peccato, in quanto signa distinti, avrebbero potuto coesistere nell'istante temporale della concezione. Nei Quodlibeta X e XI Enrico fa un uso più deciso di tali argomentazioni, nel tentativo di conciliare due proposizioni apparentemente contraddittorie riguardanti alcune condizioni del rapporto tra intelletto e volontà nella scelta morale. By all accounts one of the most influential philosophical contributions of Duns Scotus is his distinction between intuitive cognition, in which a thing is known as present and existing, and abstractive cognition, which abstracts from actual presence and existence. Recent scholarship has focused almost exclusively on the role given intuitive cognition in the justification of contingent propositions and on the debates over certitude which arose from the critiques of Scotus's distinction by Peter Aureoli and William of Ockham.

Of singular importance to the medieval theory of transcendentals was the position of John Duns Scotus that there could be a concept of being univocally common, not only to substance and accidents, but even to God and creatures. Scotus''s doctrine of univocal transcendental concepts violated the accepted view that, owing to its generality, no transcendental notion could be univocal. The major difficulty facing Scotus''s doctrine of univocity was to explain how a real, as opposed to a purely logical, concept could (...) be abstracted from what agreed in nothing real, in this case, God and creatures. The present article examines Scotus''s solution to this difficulty and its interpretation in four of his noted fourteenth-century followers. It is shown that the balance Scotus''s solution achieved between the competing demands of the real diversity between God and creatures, on the one side, and the conceptual unity of transcendental being, on the other, is taken in opposed directions by his interpreters. Either the real diversity of God and creatures is given priority, so that the concept of being becomes a purely logical notion, or the real unity of the concept of being is stressed, so that some sort of real community is posited between God and creatures. On Being and Cognition: Ordinatio 1.3 is a translation by John van den Bercken of John Duns Scotus's large and influential treatise on mind and knowledge contained in book 1, distinction 3, of his Ordinatio. This is the first English rendering of Scotus's important distinction that is both complete and made from the definitive Latin text. Scotus's Ordinatio is the revised and greatly expanded version of his Oxford lectures on Sentences of Peter Lombard. The Sentences of Lombard was itself a (...) twelfth-century summa, later adopted as the required systematic text for theology in the medieval university. Duns Scotus's famous proposition was first attacked in a short polemical treatise attributed to Thomas of Sutton. By the time of Ockham, the proposition was known as the propositio famosa, so called by Walter Chatton, Ockham's colleague at Oxford and London, who defended it against Ockham's lengthy critique. At Paris, during the same period, it was called the propositio vulgata and was used approvingly by Francis of Meyronnes, Peter of Navarre and Durandus St. Pourçain. This “famous proposition” was so controverted (...) because on it depended the acceptance, with Duns Scotus, or the rejection, with Ockham, of theology as a strict, propter quid science. As its detractors and defenders must have realized, it also struck at the heart of the divergent philosophical outlooks of Duns Scotus and Ockham. For all of this, Duns Scotus's famous proposition and its history have all but escaped notice. (shrink)

A growing interest in and concern about the adequacy and fairness of modern peer-review practices in publication and funding are apparent across a wide range of scientific disciplines. Although questions about reliability, accountability, reviewer bias, and competence have been raised, there has been very little direct research on these variables.The present investigation was an attempt to study the peer-review process directly, in the natural setting of actual journal referee evaluations of submitted manuscripts. As test materials we selected 12 already published (...) research articles by investigators from prestigious and highly productive American psychology departments, one article from each of 12 highly regarded and widely read American psychology journals with high rejection rates (80%) and nonblind refereeing practices.With fictitious names and institutions substituted for the original ones (e.g., Tri-Valley Center for Human Potential), the altered manuscripts were formally resubmitted to the journals that had originally refereed and published them 18 to 32 months earlier. Of the sample of 38 editors and reviewers, only three (8%) detected the resubmissions. This result allowed nine of the 12 articles to continue through the review process to receive an actual evaluation: eight of the nine were rejected. Sixteen of the 18 referees (89%) recommended against publication and the editors concurred. The grounds for rejection were in many cases described as “serious methodological flaws.” A number of possible interpretations of these data are reviewed and evaluated. (shrink)

It is considered in some quarters that hypothesis‐driven methods are the only valuable, reliable or significant means of scientific advance. Data‐driven or ‘inductive’ advances in scientific knowledge are then seen as marginal, irrelevant, insecure or wrong‐headed, while the development of technology—which is not of itself ‘hypothesis‐led’ (beyond the recognition that such tools might be of value)—must be seen as equally irrelevant to the hypothetico‐deductive scientific agenda. We argue here that data‐ and technology‐driven programmes are not alternatives to hypothesis‐led studies in (...) scientific knowledge discovery but are complementary and iterative partners with them. Many fields are data‐rich but hypothesis‐poor. Here, computational methods of data analysis, which may be automated, provide the means of generating novel hypotheses, especially in the post‐genomic era. A collection of seminal essays, many appearing in English for the first time, which provides an excellent overview of the critical theory developed by the Frankfurt School.

Working within weak subsystems of second-order arithmetic Z2 we consider two versions of the Baire Category theorem which are not equivalent over the base system RCA0. We show that one version (B.C.T.I) is provable in RCA0 while the second version (B.C.T.II) requires a stronger system. We introduce two new subsystems of Z2, which we call RCA+ 0 and WKL+ 0, and show that RCA+ 0 suffices to prove B.C.T.II. Some model theory of WKL+ 0 and its importance in view of (...) Hilbert's program is discussed, as well as applications of our results to functional analysis. (shrink)

Continuing the investigations of X. Yu and others, we study the role of set existence axioms in classical Lebesgue measure theory. We show that pairwise disjoint countable additivity for open sets of reals is provable in RCA0. We show that several well-known measure-theoretic propositions including the Vitali Covering Theorem are equivalent to WWKL over RCA0.

The effectiveness of information retrieval technology in electronic discovery (E-discovery) has become the subject of judicial rulings and practitioner controversy. The scale and nature of E-discovery tasks, however, has pushed traditional information retrieval evaluation approaches to their limits. This paper reviews the legal and operational context of E-discovery and the approaches to evaluating search technology that have evolved in the research community. It then describes a multi-year effort carried out as part of the Text Retrieval Conference to develop evaluation methods (...) for responsive review tasks in E-discovery. This work has led to new approaches to measuring effectiveness in both batch and interactive frameworks, large data sets, and some surprising results for the recall and precision of Boolean and statistical information retrieval methods. The paper concludes by offering some thoughts about future research in both the legal and technical communities toward the goal of reliable, effective use of information retrieval in E-discovery. Accidents involving large trucks result in significant economic and social costs. As technological solutions have improved, behavioral factors contributing to accidents have risen in importance. The purpose of this research is to investigate how norms, consequences, and personal attitudes influence safety-related ethical judgments and behavioral intentions. The Hunt–Vitell’s theory of ethical decision-making is adapted to test how these factors influence truck drivers’ decisions containing ethical content. Professional truck drivers evaluated decisions presented in two scenarios that included the situation, the decision, (...) and the results. The research found that drivers rely heavily on evaluations of safety norms when forming ethical judgments and behavioral intentions. Further, drivers’ attitudes toward compliance and the effectiveness of safety regulations also influenced decision-making to an extent. Overall, evidence of a refutation of the assumption that a tradeoff exists between operational productivity and safety was discovered. Drivers in this study intended to behave in a certain manner irrespective of time or money pressures. The perceived ethical component of the decision outweighed regulatory and economic consequences under a range of parameters. (shrink)

The rise of neurotechnologies, especially in combination with artificial intelligence (AI)-based methods for brain data analytics, has given rise to concerns around the protection of mental privacy, mental integrity and cognitive liberty – often framed as “neurorights” in ethical, legal, and policy discussions. Several states are now looking at including neurorights into their constitutional legal frameworks, and international institutions and organizations, such as UNESCO and the Council of Europe, are taking an active interest in developing international policy and governance guidelines (...) on this issue. However, in many discussions of neurorights the philosophical assumptions, ethical frames of reference and legal interpretation are either not made explicit or conflict with each other. The aim of this multidisciplinary work is to provide conceptual, ethical, and legal foundations that allow for facilitating a common minimalist conceptual understanding of mental privacy, mental integrity, and cognitive liberty to facilitate scholarly, legal, and policy discussions.
