Simone Weil non ha grande considerazione del diritto e non v’è dubbio che questa considerazione sia contraccambiata dai giuristi. In effetti, la Weil ha una concezione troppo severa verso istituzioni che sono fondamentali per il funzionamento della democrazia –i partiti politici– ed ha una visione del diritto che è troppo schiacciata sulla forza per destare l’attenzione dei giuristi. Ciò nonostante, leggere la Weil da una prospettiva giuridica non è affatto privo di interesse: i suoi scritti hanno anticipato molte vicende del (...) costituzionalismo del secondo dopoguerra come, ad esempio, il tramonto della legge generale ed astratta e la crescita di importanza dei giudici; essi, inoltre, offrono degli utili spunti di riflessione –sia critici che costruttivi– su temi che oggi sono all’ordine del giorno in ambito filosofico-giuridico, come l’uso retorico dei diritti e l’attenzione agli obblighi di giustizia sociale. This essay describes the ambitious claim of modern constitutionalism and distinguishes it from mere juridification of public power. It shows the challenges of constitutionalism that follow from the loss of identity between state power and public power. The essay asserts that the necessity to regulate public power persists, regardless of whether it is exercised by state authorities or international organizations. However, it raises doubts that the fragmented public power on the international level can be regulated in a way that would (...) satisfy the demands of constitutionalism. What can be observed is an ongoing juridification which, however, lacks basic features of constitutionalism. How a full compensation could look like is an open question. The article argues that the end of the formal division of the world between a colonizing metropolis and a colonized periphery requires a different reading of the State’s history. The essay deals with the relation between the formation of British India and the development of Indian nationalist movement through the events related to the ‘tiger of Mysore’, Tipu Sultan, and the swadeshi movement as portrayed in Tagore’s The Home and the World. The essay shows how colonial constitutionalism developed through the (...) contemporary affirmation of the rule of law and the colonial difference. The postcolonial State emerged via concrete crossing of this difference, which today allows a different reading of the political discourses beyond the affirmation of the State as the barycenter of political organization at a global scale. This article deals with democratic constitutionalism in order to investigate the proper nature of constitutionalism, by wondering about its peculiarities and specific objects. Against this background, this essay aims at providing a paradigmatic definition of constitutional theory, for more specifically exploring its different undertones. For this reason, the first section of the article offers an analysis of the most relevant theoretical contributions within modern and contemporary constitutionalism. Thus, the first section explores Carl Schmitt’s, Hans Kelsen’s and Robert Dahl’s definition of (...) constitutional democracy. The second section then focuses with more attention on contemporary liberal-democratic constitutionalism, manly on one of the most debated issues: the dichotomy between legal and political models of constitutionalism, which goes hand in hand with a distinction between dualist and monistic accounts of democratic theory. The last section proposes an insight into the Italian constitutional system, by comparing it with the U.S. model, by especially focusing on the functioning and structure of the Constitutional Court compared to the U.S. Supreme Court. Il libro intende fornire una ricostruzione dettagliata del dibattito, oggi centrale all’interno della teoria politica e democratica, tra due modelli costituzionali speculari: da un lato il cosiddetto “modello Washington”, che ricalca il sistema istituzionale degli Stati Uniti, dall’altro il “modello Westminster”, che invece descrive l’ordinamento britannico. Il libro ricostruisce il panorama liberal-democratico, discutendo i temi chiave di alcuni tra i maggiori teorici del costituzionalismo contemporaneo, a cominciare da John Rawls, Bruce Ackerman e Richard Bellamy. Attraverso il confronto tra modello (...) dualista e modello monista della democrazia costituzionale, il libro mira a gettare uno sguardo sulle interpretazioni, ma soprattutto sulle prospettive del costituzionalismo democratico contemporaneo, che si trova oggi a fronteggiare le sfide e i pericoli derivanti dal populismo. Starting from the analysis of the relationship between law, territory and the so called “global space”, the essay examines and discusses the “spatial” crisis of the age of rights, in view of the urban specificity of the European space and of the persistence of the States as main political actors, entertaining functional or tense relations with the indirect powers of financial capitalism. In particular, the author puts into question the existence of a credible alternative to the political concrete universals. Against (...) the imposition of a postdemocratic and decostitutionalized character of the space, the author proposes an analysis that aims at recovering the political product of social and democratic constitutionalism, revitalizing its emancipatory character and present-day importance. For the author this operation is possible only by considering the risk of moving among remains, conceptual persistences and illusions. (shrink)

A partire dal commento ad una sentenza sul problema della discriminazione razziale in una scuola privata, Cover presenta una teoria del pluralismo normativo fondata sulla distinzione fra autorità e significato. A tale dicotomia è dovuta la “proliferazione” dei mondi normativi e delle interpretazioni costituzionali. L’autore descrive i processi di formazione dei significati giuridici – la cosiddetta “giusgenesi” – ed offre una teoria della giurisdizione adatta ad un universo giuridico connotato da un radicale pluralismo. Così facendo, Cover intende mettere in luce (...) il potenziale trasformativo del diritto e in particolare del costituzionalismo. (shrink)

The Author asks himself if the peculiar mode of application of the nexus doctrine/discipline represented by ideol- ogy constitutes the only possibility for reproducing and maintaining consensus in a political community. The constitutionalism’s curve shows the contrary: in the beginning constitutionalism developed as a common field between different ideologies, still it survived their crisis, and has opened a new mode of social and political collective behaviour, defined by the author as «political discourse». In order to overcome the risk of political (...) neutralization produced by the growing importance of technique in the contemporary governance processes, political discourse – considered in its function of language mediator and translator –, might work as an instrument able to link the broken threads of obligation. In order not to reproduce a straight and unilateral political discourse, a radical revision of the concept of measure would be necessary. Measure should be taken as an instrument for the allocation/distribution of differences and, therefore, as a useful element for the creation of consensus in a mass society. (shrink)
