Abstract

在我国宪法学界,围绕宪法实施的论争,自一开始就绝不单纯地是宪法实施的问题,而是真实的国体和政体问题,也即主权问题,尽管论争者未必明确意识到这一点。本书的主体部分,由关于宪法概念和宪法实施的五篇长文构成。在参与这些论争的过程中,本书尝试性地提出了“人民的宪法”这一概念,以区别于“法官的宪法”.
