Legal Principles to Combat Gender-Based Violence during Armed Conflict in Eastern Ukraine

Abstract

The purpose of the article is a comprehensive analysis of socio-legal aspects of gender-based violence caused by the armed conflict in eastern Ukraine, development of theoretical and applied bases for using criminological means to combat such violence, preparation of scientifically based proposals for improving legislation, law enforcement and practice. Methodological basis of the article. Philosophical, general scientific and specifically sociological methods were used in the research. The work was based on the laws of unity and the struggle of opposites, the denial of negation, the transition from quantitative to qualitative changes. Empirical material was obtained using the methods of questionnaires, interviews, content analysis, observation, expert assessments. Scientific novelty. The article presents the results of a comprehensive criminal law and administrative law research in the field of combating gender-based violence during the armed conflict in eastern Ukraine. The author identifies typical features of gender-based violence, specific factors that cause criminal violence in the family; as well as a comparative analysis of the legislation of Ukraine, Russia, DPR, LPR in this area. The paper identifies ways to improve the activities of subjects of prevention of gender-based violence. Conclusions. Since the legislation of the self-proclaimed republics is declarative in nature and a priori not endowed with the properties of a normative legal act in terms of international standards, we propose legal and social changes that can be implemented in Ukraine to protect citizens living in uncontrolled territories from gender-based violence.
