By investigating the ethics of The Tripartite Tractate, this study offers in-depth exploration of the text's ontology, epistemology, theory of will, and passions, as well as the anthropology and social setting of the text. Valentinians have often been associated with determinism, which has been presented as "Gnostic" and then not taken (...) seriously, or disregarded as an invention of ancient intra-Christian polemics. This paper proposes that managers add an attention to virtues and vices of human character as a full complement to moral reasoning according to a deontological focus on obligations to act and a teleological focus on consequences (a balanced tripartite approach). Even if the criticisms of virtue ethics cloud its use as a mononomic normative theory of justification, they do not refute the substantial benefits of applying a human character perspective – when done so in conjunction with also-imperfect (...) act-oriented perspectives. An interactive tripartite approach is superior for meeting the complex requirements of an applied ethic. To illustrate how deficiencies of a "strong" virtue ethics formulation can be overcome by a balanced tripartite approach, this paper compares normative leadership paradigms (each based on a combination of virtue, deontology, or consequentialist perspectives) and the dangers inherent in each. The preferred paradigm is servant leadership, grounded in a tripartite ethic. Effective application of such an ethics approach in contemporary organizations requires further empirical research to develop a greater understanding of the moral language actually used. Meeting this challenge will allow academics better to assist practicing managers lead moral development and moral reasoning efforts. (shrink)

Plutarch’s Parallel Lives was once considered a preeminent source of ethical and leadership instruction. But despite generations turning to the Lives for leadership education, we lack clarity concerning how the Lives cultivate leadership. In fact, Plutarch offers the key to this puzzle in a tripartite theory of leadership education evident throughout his corpus. Leaders should be educated through: 1) philosophical instruction, 2) experience in public life, or 3) literary synthesis – and, ideally, some combination of all three. Plutarch’s Lives, (...) this article contends, exemplifies the third form of education, literary synthesis, which exhibits the influence of philosophical principle and moral character on political conduct. In bioethics, the predominant categorization of various types of influence has been a tripartite classification of rational persuasion (meaning influence by reason and argument), coercion (meaning influence by irresistible threats—or on a few accounts, offers), and manipulation (meaning everything in between). The standard ethical analysis in bioethics has been that rational persuasion is always permissible, and coercion is almost always impermissible save a few cases such as imminent threat to self or others. However, many forms of influence fall into (...) the broad middle terrain—and this terrain is in desperate need of conceptual refining and ethical analysis in light of recent interest in using principles from behavioral science to influence health decisions and behaviors. This paper aims to address the neglected space between rational persuasion and coercion in bioethics. First, I argue for conceptual revisions that include removing the “manipulation” label and relabeling this space “nonargumentative]influence,” with two subtypes: “reason-bypassing” and “reason-countering.” Second, I argue that bioethicists have made the mistake of relying heavily on the conceptual categories themselves for normative work and instead should assess the ethical permissibility of a particular instance of influence by asking several key ethical questions, which I elucidate, that relate to (1) the impact of the form of influence on autonomy and (2) the relationship between the influencer and the influenced. Finally, I apply my analysis to two examples of nonargumentative influence in health care and health policy: (1) governmental agencies such as the Food and Drug Administration (FDA) trying to influence the public to be healthier using nonargumentative measures such as vivid images on cigarette packages to make more salient the negative effects of smoking, and (2) a physician framing a surgery in terms of survival rates instead of mortality rates to influence her patient to consent to the surgery. Over 50,000 youth, mostly between the ages of 13 and 17 years, migrated to the United States without familial accompaniment in the fiscal year 2018. The tripartite process of pre-flight, flight, and resettlement exposes these unaccompanied immigrant children to multiple, and often ongoing, traumatic events that can significantly and adversely impact their mental health into adulthood. However, the ethical considerations for psychologists working with this growing population, with limited exceptions, remain largely unaddressed. As more and more UIC flee their (...) home countries due to violence, abuse, and economic instability only to experience further stressors during the processes of detainment, custodial placement, and acculturative adjustment in the US, there is an increasing need for psychological services; thus, the importance of preparation of mental health providers is increasingly significant. Psychologists must have the requisite skills and knowledge of the complex experiences of UIC, and of how these intersect with salient cultural, developmental, and systemic factors, as a means of providing competent and ethical mental health treatment. The present article highlights several ethical issues that arise when providing psychological services to UIC, with particular consideration paid to the embeddedness of UIC in various organizational entities with which psychologists will likely need to interface when working with this population. Implications and recommendations for practicing psychologists and training programs are discussed. (shrink)

Technological revolutions are dissected into three stages: the introduction stage, the permeation stage, and the power stage. The information revolution is a primary example of this tripartite model. A hypothesis about ethics is proposed, namely, ethical problems increase as technological revolutions progress toward and into the power stage. Genetic technology, nanotechnology, and neurotechnology are good candidates for impending technological revolutions. Two reasons favoring their candidacy as revolutionary are their high degree of malleability and their convergence. Assuming the emerging (...) technologies develop into mutually enabling revolutionary technologies, we will need better ethical responses to cope with them. The title of our session today is “Virtue Ethics from a Global Perspective.” In my remarks, I would like to sketch out an account of what a global perspective on virtue ethics would look like. Here’s how I’ll proceed. First, I would like to explore some of the reasons why we need a global perspective on virtue ethics. This leads naturally to the second issue, which is a clarification of what we mean by a global perspective on (...) virtue ethics. I shall suggest a three part framework—consisting of the object of the virtue, the virtue itself, and the actions through which that virtue is expressed—for a global perspective on virtue ethics. This framework is a pluralistic one, striking a middle ground between absolutism and relativism. Along the way, especially in part two, I will look at several specific virtues, especially respect and courage, to see how this tripartite framework can be applied. The final result, I hope, will be an outline of what a global perspective on virtue ethics would look like. (shrink)

The article is dedicated to the application questions of a case study method known as casuistry. In its long tradition, it focuses on an influential variant of the early modern period and reconstructs its functionality. In the course of reading recent receptions, it is noted that some studies speak of a “casuistic revival” in moral case deliberation in health care. As a result of this revival, casuistry has been modified in such a way that it guides case discussions in practice (...) with the help of a tripartite methodology. However, as it turns out, casuistry, a case comparison method of ethical judgement based on reasoning logic, is less suitable for moral case deliberations in direct patient care. This stems from the fact that casuistry is a detailed procedure of ethical learning beneficial to institutionalized ethics committees or similar forms of ethics consultation in health care. (shrink)

Human capital, the knowledge, skills, and abilities of employees, can be a powerful driver of firm performance, yet the mobility of human capital raises questions over how to protect it. Employee non-compete agreements, which limit an employee’s ability to start or join a rival firm, have received recent attention. While past research considers whether non-competes are effective tools at limiting employee mobility, few have considered if non-competes should be used. Filling this gap, I propose a normative schema for when employee (...) non-competes can be considered ethical. A review of the limited existing literature on the ethics of employee non-competes finds that prior research has mostly focused on questions of property rights, which I propose as being nested within other ethical constructs. Analysis of two real-world illustrative examples of employee non-competes leads to a three-prong approach to evaluating non-competes based on ethical dimensions of power, autonomy, and fairness. I end by proposing—although further research is warranted—a measure of employee-level absorptive capacity, which is closely coupled with an employee’s pre-employment human capital, as an employee-level attribute independent of, although likely coincidental with, the tripartite requirements of power/autonomy/fairness for ethical employee non-compete agreements. What are the fundamental divisions in ethics? Which divisions capture the most important and basic options in moral theorizing? In this article, I reject the ‘Textbook View’ which takes the tripartite division between consequentialism, deontology, and virtue ethics to be fundamental. Instead, I suggest that moral theories are fundamentally divided into three independent divisions, which I call the neutral/relative division, the normative priority division, and the maximizing division. I argue that this account of the fundamental divisions of (...) ethics better captures the main concerns that normative ethicists have when assessing moral theories. It also helps us make progress in comparative ethics and makes visible theoretical possibilities obscured by the Textbook View. (shrink)

The last decade has witnessed renewed attempts to regulate the conduct of transnational corporations. One way to do this is via global ethics codes. This paper examines seven such codes (the Sullivan Principles, UN Center for Transnational Corporations’ Draft Code, OECD Guidelines, ILO's Tripartite Declaration, the Caux Round Table Principles for Business, Global Compact, and the United Nations Norms) to determine their coverage of human rights and concludes that if these initiatives succeed, particularly the more recent codes, transnational (...) corporations may emerge as a major force in promoting human rights globally. Both volumes present wonderfully rich material and invaluable resources for the study of Christian ethics. Charles Curran and James Keenan are two of the foremost Catholic ethicists in the United States today. Keenan’s case is to be applauded for convening the 2010 conference in Trento, which brought together some six hundred Roman Catholic ethicists from around the world. His book, which assembles that conference’s thirty-one plenary addresses, does justice to this tremendous feat. Curran, for his part, has produced a text that focuses acutely on the Church in the United States and will benefit ethicists for years to come.Keenan uses the introduction to Catholic Theological Ethics Past, Present, and Future to provide an overview of the Trento conference and its attendees and proceedings. Keenan expertly identifies a common theme among the 240 diverse papers at the conference, noting that ethicists “always begin with the premise that there is a deficit in our location, and, therefore, we need to work together to find a way to remedy it” (6). What follows in the remainder of the book boldly moves toward remedies for many of the world’s ills. A few of these essays deserve particular mention.The conference and the collection of essays share the basic organizational principle of looking to the past, the present, and the future of Catholic theological ethics. Unsurprisingly, the Council of Trent played a foundational role in understanding the “past” of Catholic moral theology. Laurenti Magesa [End Page 216] (Kenya) explains that the African experience of the Council of Trent has remained largely unchanged since the conclusion of that council: “The Catholic Church in Africa is essentially a Tridentine church” (57). This essay makes clear that in Africa, the dominant voices are Western males. The missing voices, then, are given attention by Antônio Moser (Brazil), Anne Nasimiyu-Wasike (Kenya), and Bryan Massingale (United States). Massingale’s essay was most impressive, addressing the role of racism in our culture and concluding that Catholic ethicists “need to lament, mourn, and grieve our history” (121). This, he claims, is both a fruitful way to act in the present and a hopeful way to look toward the future.In focusing on the present, the strongest subsection of the book attended to political ethics. Here David Kaulemu’s (Zimbabwe) essay, “Catholic Social Teaching at a Crossroad,” has the potential to open the eyes of any reader. He writes, “It is frustrating and discouraging to the lay faithful to be inspired by Catholic social teaching and yet receive no recognition or support by ‘official’ church structures” (177). This highlights a serious problem to which all Catholic ethicists must attend. As for the future, Julie Hanlon Rubio (United States) points to a tripartite vision for marriage in the twenty-first century that sets high standards not only within the marital unit itself but also for the impact of the spouses on the larger society. Julie Clague (Scotland) presents a wonderful essay on the burgeoning relationship between moral theology and gender.Among the wealth of positive features of this collection is the great geographical diversity of the authors. This affirms that Catholic theological ethics is very healthy throughout the entire world and that on each continent there are voices of women and men willing to contribute fresh ideas to the discipline. There are at least two fundamental questions in medical ethics: What constitutes the ethical components associated with medical practice?; and How are these components realized in daily medical practice? This dissertation is concerned with question . In particular, focus is on daily medical linguistic practices of physicians. Due to the entailment of question in question , however, a brief answer for is also provided. Specifically, it is argued that a tripartite theoretical ethical framework is associated with medical practice, (...) consisting of consequentialist, deontological, and virtue ethics components. Turning towards daily medical linguistic practices, two daily medical linguistic practices are examined: ways of referring to patients and referring to disease. Both are addressed as they occur in the context of physician-physician dialogues in a clinical, hospital setting. In light of a background argument concerning the theoretical connection between language, worldview, and ethical perspective, in which language is shown to play a role in defining both worldview and ethical perspective, the ethical perspective of physicians qua medical language users is addressed. It is suggested that although medical practice has the tripartite normative ethical foundation in theory, the practical influence of medical language used for diagnosis is to impose an essentially consequentialist framework within which patients are conceived. Consistent with this limited ethical framework, disease language is noted to suggest connotations of certainty. In light of the ambiguous and uncertain character of medical encounters between physicians and patients, the implication of certainty by disease language is problematic. Likewise, the limited, essentially consequentialist perspective of physicians is inappropriate. Physicians must therefore recognize the limitations of disease language and refrain from solely using the kind of medical language which conceptually reduces patients to mere disease loci. This paper sets to answering the question of how Lacan’s 1959-60 Seminar on The Ethics of Psychoanalysis[1], with its recurring critique of the Platonic idea of a moral Sovereign Good, might contribute to and improve our understanding of the Nietzschean project to diagnose the moral metaphysics instigated by Plato in philosophy, and by Christianity in religion, as a history of untruth and nihilism––opposed to life––in preparation for its overcoming. I explore the possibility that Lacan’s Ethics might make such (...) a contribution by i) its tripartite ontology of the real, the symbolic and the imaginary serving as an additional frame of reference for examining the nature of the Good and our configurations of desire beneath it; and ii) by its more detailed elaboration of the archaic, polymorphous perversity at the instinctual base of the drives, what Lacan in his Ethics will call das Ding, the somewhat diabolical Freudian Thing. I also attempt to indicate how Nietzsche’s own ethics might make a contribution to those of the Lacanian, for the purposes of further combating what I will take to be the contemporary neurosis and nihilism of a ‘life’ against life––as indicated today for instance by such phenomena as the physical destruction of the environment, along with us as amongst its earthly inhabitants. In the past few years, calls for integrating ethics modules in engineering curricula have multiplied. Despite this positive trend, a number of issues with these ‘embedded’ programs remains. First, learning goals are underspecified. A second limitation is the conflation of different dimensions under the same banner, in particular confusion between ethics curricula geared towards addressing the ethics of individual conduct and curricula geared towards addressing ethics at the societal level. In this article, we propose a (...) class='Hi'>tripartite framework to overcome these difficulties. Our framework analytically decomposes an ethics module into three dimensions. First, there is the ethical dimension, which pertains to the learning goals. Second, there is the moral dimension, which addresses the moral relevance of engineers’ conduct. Finally, there is the political dimension, which scales up issues of moral relevance at the civic level. All in all, our framework has two advantages. First, it provides analytic clarity, i.e. it enables course instructors to locate ethical dilemmas in either the moral or political realm and to make use of the tools and resources from moral and/or political philosophy. Second, it depicts a comprehensive ethical training, which enables students to both reason about moral issues in the abstract, and to socially contextualize potential solutions. (shrink)

Just as Michael Porter's five forces provided a practical analytical tool for describing the forces that shape competitive strategy, so business ethicists ought to provide business leaders with a workable framework for understanding the sources of ethical obligations. The forces that shape competitive strategy vary according to time and industry, but are anchored in an ultimate criteria of profitability. Similarily, ethics can use a set of analytical categories that identify the relevant forces to business ethics on the basis (...) of relationality.This paper first argues that relationality based on naturalism is the primary, plausible value for ethics. Second, it adapts a tripartite dialectic from scholars William Frederick and Michael Novak to describe the relational categories with which business must contend. This study addresses the nature of the contribution made by Christian feminist thinkers who claim that mutuality is a necessary part of a Christian social ethical framework. The theological method employed is analytical and comparative toward the end of illuminating, testing, and demonstrating the thesis: mutuality is a formal norm for Christian social ethics that functions along with love and justice to promote a balance of power that is required for optimum human flourishing, a flourishing set within the interdependent (...) context of the whole of creation. ;Chapter One analyzes selected primary sources of Rosemary Radford Ruether, Carter Heyward, Beverly Wildung Harrison, and Elizabeth A. Johnson isolating their definition and treatment of the term, "mutuality." A consensus definition of mutuality drawn from definitions by the four feminists. It is concluded that, similar to the tripartite nature of justice, mutuality has four forms--cosmic, gender, generative, and social. ;Chapters Two and Three illustrate several moments in the history of Christian thought wherein antecedents of the feminists' notion of mutuality are found. Selected primary works of Thomas Aquinas, John Duns Scotus, Martin Buber, and H. Richard Niebuhr are examined. ;Chapter Four compares the four feminists' definition of mutuality with definitions of formal norm by Josef Fuchs, Lisa Sowle Cahill, and Timothy E. O'Connell, determining that mutuality is a formal norm for Christian social ethics. Chapter Five is a case study. Utilizing our definition, it is shown how consideration of mutuality and its four forms influences the ethical analyses of George Weigel, Jean Bethke Elshtain, and Stanley Hauerwas in determining if the Persian Gulf War was a just war. It is concluded that the probative value of the formal norm, mutuality, is multifaceted. First and foremost, it requires the moral agent to deal concretely in moral reflection and moral decision-making. Specific and careful attention needs to be given to the reality revealing questions in the concrete, as well as in the abstract. Second, mutuality requires the moral agent to probe the dynamics of power in an ethical dilemma and to seek out ways to shape those dynamics to serve power-with. It is a complement to and corrective of love and justice. Third, engaging the norm of mutuality presses the moral agent toward inclusivity drawing into the process of moral reflection concern for the thriving and flourishing of all involved. More than the norms of love and justice, mutuality places humans in a perspective within the whole of creation. (shrink)

The purpose of Sheffield’s careful study is to increase scholarly appreciation of the Symposium as a ‘substantive work in Platonic ethics’ (3). Among the book’s highlights are a persuasive response to Vlastos’ criticism of Plato on love for individuals, an eminently reasonable assessment of the evidence for and against the presence of tripartite psychology in the Symposium, and a delightful interpretation of Alcibiades’ speech at the dialogue’s end—one that reveals elements of satyr play and corroborates rather than undermines (...) Diotima’s account of erôs. My review focuses on Sheffield’s account of Socrates’ speech. She devotes four of seven chapters to it. After summarizing her main argument, I raise two concerns: one about her account of immortality, the other about her interpretation of Plato as a rational eudaimonist. (shrink)

Cloth, $49.95.In tracing developments in Plato's views between his middle- and late-period dialogues, Plato's Utopia Recast focuses on the differences between philosophers and non-philosophers with respect to their capacities to become genuinely virtuous. The central thesis (...) of this extensive work is that the Laws reveals a degree of optimism about the prospects for non-philosophers in attaining virtue and happiness not found in dialogues of the middle period. Specifically, Bobonich describes this development in terms of four claims that he thinks Plato denies in the Phaedo and Republic but later affirms in the Laws: first, that at least some non-philosophers are capable of being virtuous; second, that they can value virtue for its own sake; third, that they can value the virtue and happiness in others for its own sake; and fourth, that these non-philosophers are capable of living happy lives.Bobonich devotes most of the first chapter to describing Plato's pessimism about non-philosophers in the middle period. The cause for this pessimism is both epistemic and psychological. In the Phaedo, non-philosophers are incapable of knowing what is genuinely valuable. Failure to grasp non-sensible value properties means that in non-philosophers, reason simply takes over the ends defined by bodily impulses. The Republic is less pessimistic, but even here, Plato's tripartitioning of the soul makes clear that the rational part of the soul in non-philosophers fails to fulfill its proper ruling function. Bobonich's claim is that the more optimistic view presented in the Laws is indicative of developments not only in Plato's political theory, but also in the areas of psychology and epistemology.The central feature of the political theory advanced in the Laws is that the proper goal of legislation is not victory in war, but the cultivation of virtue in all citizens. More importantly for Bobonich, it suggests that all citizens, both philosophers and non-philosophers, are capable of attaining some degree of genuine virtue. For evidence of this, he points to the preludes that accompany each piece of legislation designed to provide a rational justification for what the laws command. In identifying virtue as the aim of legislation, Bobonich observes that the Laws endorses a dependency thesis about goods, making the value of a dependent good such as wealth, honor or military victory dependent upon its possessor being virtuous. His position is that Plato's endorsement of this dependency thesis in the Laws implies that ordinary citizens are capable of at least a partial grasp of what is genuinely valuable, making some degree of virtue and happiness attainable.Bobonich's view that this optimism about non-philosophers has implications for Plato's later epistemology and psychology is developed in the third and fourth chapters. He argues that the Republic's partitioning of the soul into three distinct, agent-like parts is abandoned in the later dialogues in favor of a more unified conception. Researchers and non-commercial institutions negotiate complex legislation and guidance when planning and conducting research studies. The documents and processes required differ across nations and their regulatory bodies and it can be challenging to conduct an international study, especially for non-commercial organisations. In this study, colleagues from Japan and the UK worked closely together focusing on the legislation, organisations, trial processes, ethics review and quality assurance frameworks of clinical trials in two countries, the UK, demonstrated on the model of practices (...) in the University of Bristol and University Hospital Bristol NHS Foundation Trust, and Japan, based on the model in Kyoto University Hospital. Although the ICH tripartite guidelines were developed with participation from both the EU and Japan the set-up and approval processes for clinical trials are different between the two countries while the expectations for quality assurance are similar. This paper begins with a pressing question for contemporary philosophy: What does it mean to read Spinoza’s Ethics today? Before we can address this particular question, we pose another, one possibly prior, question. The question is situated within Spinozism itself. It asks, ‘What does it mean to read, for Spinoza?’ Given Spinoza’s commitment to the theory of parallelism, reading affects both the body and the mind. We first show how an explicit formulation of the three kinds of material bodies (...) allows us to understand the process by which the meaning of a text can affect the body of the reader. We then show how the three kinds of knowledge evince the order in which textual meaning can affect the mind of the reader. We then claim that these tripartite orders map directly onto each other. After demonstrating the structural parallelism at the corporeal and cognitive levels, we return to further characterize the nature of the meaning of the meaning of a text in order to understand what it means to read, for Spinoza. An alternative to the negative rights slant in animal rights, focusing on abolition and hands-off approaches, has now surfaced within critical animal studies. Indeed, Relational Animal Rights Theory lays a foundation for positive relations of care, mutuality and dependence between species. In so doing, the theory is sensitive to the multitude of ways in which human and non-human animals interact across shared territories. A set of basic static predicates, 'in itself, 'existing through itself, 'free', and others are taken to be (at least) extensionally equivalent, and some consequences are drawn in Parts A and? of the paper. Part C introduces adequate causation and adequate conceiving as extensionally equivalent. The dynamism or activism of Spinoza is reflected in the reconstruction by equating action with causing, passion (passive emotion) with being caused. The relation between conceiving (understanding) and causing is narrowed down by introducing grasping (λ (...) μβ?νω) as a basic epistemological term. Part D, 'The road to freedom through active emotion', introduces a system of grading with respect to the distinctions introduced in the foregoing, including 'being in itself, 'freedom', etc. Active emotions are seen to represent transitions to a higher degree of freedom, the stronger and more active ones being the more conducive to rapid increase in degree of freedom. Aggregative consequentialism and several other popular moral theories are threatened with paralysis: when coupled with some plausible assumptions, they seem to imply that it is always ethically indifferent what you do. Modern cosmology teaches that the world might well contain an infinite number of happy and sad people and other candidate value-bearing locations. Aggregative ethics implies that such a world contains an infinite amount of positive value and an infinite amount of negative value. You can affect only a finite (...) amount of good or bad. In standard cardinal arithmetic, an infinite quantity is unchanged by the addition or subtraction of any finite quantity. So it appears you cannot change the value of the world. Modifications of aggregationism aimed at resolving the paralysis are only partially effective and cause severe side effects, including problems of “fanaticism”, “distortion”, and erosion of the intuitions that originally motivated the theory. Opponents consider the embryo to be an early form of human life that should be respected and not destroyed. However, the majority of scientists support embryonic stem cell research, believing that it offers good prospects for the treatment of diseases that have remained incurable until now and so will benefit humankind. The Ethics Committee of the Department of Ethical, Legal, and Social Implications of the Chinese National Human Genome Center at Shanghai seriously discussed the ethical debate initiated by embryonic stem cell research. We concluded that we should support the scientists of our country in actively carrying out human embryonic stem cell research for the noble cause of "medicine being a beneficent art." Article 2. There are two ways to classify human embryonic stem cells. One way is to classify them according to their potential for differentiation. There could be three kinds of stem cells: totipotent stem cells, pluripotent stem cells, and unipotent stem cells.A totipotent stem cell has the potential to develop into a whole individual. It can differentiate into the more than 200 cell types in the whole body, construct any tissue or organ of the body, and finally develop into a whole individual.
