In the present paper we argue that the theory of contracts embraced by many libertarian scholars and relied upon by them in sundry important debates (e.g. over morality of the fractional reserve banking or loan maturity mismatching etc.), that is, the title transfer theory of contracts (TTT) should be rejected as not being able to account for the binding force of future-oriented contracts, including contracts deemed enforceable by those scholars themselves. The TTT claims that the only contracts (...) that should be legally binding are these where the debtor’s failure to abide by them constitutes a violation of the creditor’s private property rights. However, as we argue, no default of the debtor in a future-oriented contract can in itself amount to such a violation. (shrink)

On the one hand, theories of modern physics are very successful in their areas of application. But on the other hand, the irreconcilability of General Relativity (GR) and Quantum Electrodynamics (QED) suggests that these theories of modern physics are not the final answer regarding the fundamental workings of the universe. This monograph takes the position that the key to advances in the foundations of physics lies in the hypothesis that massive systems made up of antimatter are repulsed by the gravitational (...) field of a body of ordinary matter: this hypothesis takes us to an uncharted territory where GR and QED do not hold up. From there the Elementary Process Theory (EPT) is developed: this is a collection of seven generalized process-physical principles that do hold up if the hypothesis is a fact of nature. Using four-dimensionalistic terminology, the EPT abstractly describes an elementary process in the temporal evolution of a massive system that interacts with its environment. The idea is that these elementary processes take place at Planck scale and are essentially all the same, regardless of the type of interaction that takes place: the EPT is thus intended as a candidate for a unifying scheme that applies to all four basic interactions. By mathematical modeling, the relation is explored between the EPT and classical mechanics, quantum mechanics, special relativity and GR. (shrink)

The relationship between Title IX and the Equal Protection Clause is relevant to many areas of sex discrimination law. However, most courts that have addressed cases raising both provisions as well as scholars analyzing them have not developed or understood the relationship between the two. This Article does just that and develops the theory that Title IX has broader protections from sex discrimination than the Equal Protection Clause. To reach the conclusion that Title IX offers more (...) protection, this Article proceeds in the following way. In Part II, the Article surveys court decisions and commentary that have explicitly touched on the relationship between Title IX and the Equal Protection Clause. In Part III, the Article then develops its own analysis of the relationship between Title IX and the Equal Protection Clause, using the text and history of Title IX, the jurisprudential differences between Title IX and the Equal Protection Clause, and the theoretical differences between Title IX and constitutional sex discrimination law. Finally, in Part IV, the Article looks at some of the legal issues affected by an analysis of Title IX's relationship to the Equal Protection Clause and posits solutions based on the doctrinal and theoretical conclusions reached in Part III. The professor insisted that the title is necessary to understand the piece. As a diligent student, the (...) lesson was learned, and the following semester I wrote a different paper for a different professor including the title as part of the interpretation and analysis. The professor's response asserted that the sections of the paper discussing the title should be deleted to improve the paper because a title is a name only—a linguistic referent to speak and write about the work that has no other relationship to the work. The discussions that followed with the two professors evolved into a permanent interest in the relationship between appellations and the works they represent. The debate of whether titles are or are not important is not a two-sided argument but rather a maze. This article is not a specialized theoretical argument but an explication of this maze of disjointed relationships among images, their appellations, and the theories espoused by various artists, art critics, art historians, and philosophers. Nevertheless, the clearest exits from the maze are found by treating the appellations as literature and applying literary theory to them.Between Text and ImageMuch of the world we live in is visual and linguistic in nature: visual to the extent that seeing is associated with knowing, and linguistic to the extent that we can communicate through the use of words and letters. For thousands [End Page 29] of years there has been a close relationship between images and language. Both are commonly represented through the use of pigments on a two-dimensional surface. While we know of no literary relationships in early paintings, it is extremely rare today to find paintings without a literary appellation attached. Today we study paintings through words, but only on the most elementary levels do we study words through paintings. It appears that literate cultures give dominance to textual symbols over those in paintings, while illiterate cultures reverse these relationships. The problem is that words have culturally agreed upon meanings, often more so than visual images. We read and listen and then write and speak about those things we have read and heard. Historically, it may be that the relationship between language and images has reversed itself, and perhaps even reverses itself in our own educational process as we begin teaching children letters and words through the use of pictures. After all, which came first: image or language?There has been little written on the use of word associations with iconographic images during the Middle Ages. Nevertheless, it is clear that identification characteristics other than linguistic ones existed. Hazard Adams is one of the few to raise this issue in his essay on titles: "Before I turn to literary titles it might be well to ask whether... I am correct in assuming that there has never been a nonverbal title of a literary work or of anything else for that matter, the word-objects relation of a title being irreversible. There are certainly nonverbal labels like coats of arms and crowns that imply title in a related sense."1 It may be true that titles are typically thought of as word associations identifying objects, but it may also be possible that medieval imagery was at least as communicatively accurate as our present textual system. The Gricean distinction between saying and implicating suggests a clear division of labour between semantics and pragmatics. The standard view that a semantic theory delivers truth-conditions for every well-formed sentence of a language has been grafted onto a Gricean view of the semantics-pragmatics divide. Consequently, many believe that truth-conditions can be specified in a way that is essentially free from pragmatic considerations. This view has been challenged, by those who argue for pragmatic intrusion into truth-conditional content. Others have argued (...) in favour of preserving a pragmatically untainted conception of semantics, but for a more finegrained conception of pragmatics. This debate has led to different proposals as to how to draw the boundary between semantics and pragmatics. This philosophical debate has been conducted largely independently of the debate in linguistics about the interfaces between the various sub-systems of the language faculty in the mind/brain. ‘Tool of Empowerment’: The Rhetorical Vision of Title Nine This study of the mail order catalog Title Nine, a California-based women's athletic clothing company, employs symbolic convergence theory and fantasy theme analysis through the context of third wave feminism. The catalog, named after the federal law in the United States that was intended to equalize opportunities between men's and women's participation in sports, creates a distinct social reality in an effort to empower readers. Similar studies have analyzed (...) stereotypical representations of women in magazines and advertising. However, this study offers insight into a newly emerging phenomenon in a niche market, the mail-order catalog, and in the artifact under study, it offers a medium where creators intend to do more than sell women's clothing. Within fantasy theme analysis is the fantasy type, a moral or social more that repeats itself through various actors or settings within the artifact. Four fantasy types put forth by Title Nine have been identified by the researcher, including a.) "I am superwoman," b.) "I am a mom," c.) "I am an advocate for women," and d.) "I can be anything.". The essay, ‘A renewed attempt to answer the question: “Is the human race continually improving?”’ appeared as Part II of Kant’s 1798 publication, The conflict of the faculties, where it was subordinated under a second title: ‘The conflict of the philosophy faculty with the faculty of law’. How did this new situation affects the meaning of the essay? My argument considers first, the conflict of the faculty of philosophy with the faculty of law; second, the earlier philosophy of history (...) Kant had developed; and, finally, the revision of this position in ‘A renewed attempt’. The situation of his argument in the contest between the philosophical and the legal faculties points to other veins of argumentation in Kant’s political theory, particularly his appeal to a principle of publicity, but they hardly achieve the theoretical clarity or the systematic centrality they should command. They are displaced in the quest for prediction of the future history of mankind. The question of human progress exceeds the frame of the coordination of the university, and the main question must remain: what was new in Kant’s approach to the question of human progress, and was it in fact an enhancement of his philosophy of history? In those terms, ‘A renewed attempt’ must be regarded a distinct failure. Its innovations prove problematic. Jacques Derrida’s “Signature Event Context” is one of the most famous papers in literary theory, but there are aspects of it which, in my experience, are not commented on. Why are there no commas in the title? I present a puzzle, but there is a solution which I presume many will quickly go for.

Volume II of Classical Recursion Theory describes the universe from a local (bottom-up or synthetical) point of view, and covers the whole spectrum, from the recursive to the arithmetical sets. The first half of the book provides a detailed picture of the computable sets from the perspective of Theoretical Computer Science. Besides giving a detailed description of the theories of abstract Complexity Theory and of Inductive Inference, it contributes a uniform picture of the most basic complexity classes, ranging (...) from small time and space bounds to the elementary functions, with a particular attention to polynomial time and space computability. It also deals with primitive recursive functions and larger classes, which are of interest to the proof theorist. The second half of the book starts with the classical theory of recursively enumerable sets and degrees, which constitutes the core of Recursion or Computability Theory. My title is intended to recall Terence Fine's excellent survey, Theories of Probability [1973]. I shall consider some developments that have occurred in the intervening years, and try to place some of the theories he discussed in what is now a slightly longer perspective. Completeness is not something one can reasonably hope to achieve in a journal article, and any selection is bound to reflect a view of what is salient. In a subject as prone to dispute as this, (...) there will inevitably be many who will disagree with any author's views, and I take the opportunity to apologize in advance to all such people for what they will see as the narrowness and distortion of mine. Twice in the _Journal of Business Ethics_, Walter Block provides a libertarian argument that The Civil Rights Act of 1964 is unjust because it is a violation of a business’s property rights and therefore ought to be repealed. No libertarian reply to Block has ever been given, creating the mistaken impression that his argument is the true representation of libertarian theory with regards to civil rights. This paper focuses on Title II and argues that both Block, and this (...) prevailing opinion of libertarian theory, are wrong. There are different types of libertarian theory. Block’s theory of natural rights is one of them, but there is another strain of libertarian thought that embraces the common law, at least as it existed up until the late 1800’s. This paper explicates a libertarian argument, based on the common law, which supports and defends Title II of the 1964 Civil Rights Act. Specifically, the evolution of contracts via assumpsit arguments, found in Blackstone’s _Commentaries,_ endogenously and consistently gives rise to the obligation to serve all. Title II of the 1964 Civil Rights Act is consistent with this common law tradition on public accommodations. Libertarian arguments that accept the common law on contracts ought also to accept common law doctrine on public accommodations and, _perforce_, the justness of Title II. (shrink)
