In this article I try to elucidate the concept of human dignity by taking a closer look at the features of a paradigmatic torture situation. After identifying the salient aspects of torture, I discuss various accounts for the moral wrongness of such acts and argue that what makes torture a violation of human dignity is the perverted moral relationship between torturer and victim. This idea is subsequently being substantiated and defended against important objections. In the final part of the chapter (...)

In this article I draw on resources from the African philosophical tradition to construct a theory of human rights grounded on dignity that presents a challenge to the globally dominant, autonomy-based approach. Whereas the latter conceives of human rights violations as degradations of our rational nature, the former does so in terms of degradations of our relational nature, specifically, our capacity to be party to harmonious or friendly relationships. Disability laws are crucial in ensuring a life of dignity for persons with disabilities. However, they remain limited and ineffective in the absence of adequate knowledge and awareness of the experiences with disability. The limitedness of disability laws has been spoken of in cases where the full realization of rights is subject to technological, philosophical, and market dynamics. In many cases, the law is also weakened by negative cultural beliefs and social perceptions of disability. And then there are cases where (...)

This argument is significant for a philosophically informed public understanding of the Internet and because it provides the basis for creating new duties. Any appeal to a right raises the question of a corresponding duty. If one bears a right, then who bears the duty to respect, protect, and enforce that right? In this essay, I contend that human rights claims need not be oriented to or reliant on the state. I start from and conclude with lessons from the 2016 protests at Standing Rock. However, for populations living far from urban centers, adequate in-person (mental) health care is often extremely costly and thus not provided. 46. Droits humains et minorités culturelles.Amandine Catala - 2015 - Philosophiques 42 (2):231-250.

  47. Philosophical Foundations of Human Rights.Rowan Cruft, S. Matthew Liao & Massimo Renzo (eds.) - 2015 - Oxford, United Kingdom: Oxford University Press UK.
What makes something a human right? What is the relationship between the moral foundations of human rights and human rights law? What are the difficulties of appealing to human rights? This book offers the first comprehensive survey of current thinking on the philosophical foundations of human rights. Divided into four parts, this book focuses firstly on the moral grounds of human rights, for example in our dignity, agency, interests or needs. Secondly, it looks at the implications that different moral perspectives (...)

  48. Posthuman Rights: Dimensions of Transhuman Worlds.Woody Evans - 2015 - Teknokultura 12 (2):373-384.
There are at least three dimensions to rights. We may have and lack freedom to 1) be, 2) do, and 3) have. These dimensions reformulate Locke’s categories, and are further complicated by placing them within the context of domains such as natural or civil rights. Here the question of the origins of rights is not addressed, but issues concerning how we may contextualize them are discussed. Within the framework developed, this paper makes use of Actor-Network Theory and Enlightenment values to (...)

  49. Human Rights, Human Dignity, and Power.Pablo Gilabert - 2015 - In Rowan Cruft, Matthew Liao & Massimo Renzo (eds.), Philosophical Foundations of Human Rights. Oxford University Press. pp. 196-213.
This paper explores the connections between human rights, human dignity, and power. The idea of human dignity is omnipresent in human rights discourse, but its meaning and point is not always clear. It is standardly used in two ways, to refer to a normative status of persons that makes their treatment in terms of human rights a proper response, and a social condition of persons in which their human rights are fulfilled. This paper pursues three tasks. First, it provides an (...)

  50. The human right to health.Nicole Hassoun - 2015 - Philosophy Compass 10 (4):275-283.
Is there a human right to health? If so, what are its grounds? Can a legal or moral human right to health provide any practical guidance when it comes to making decisions about, for instance, the allocation of scarce health resources? There are many possible answers to these questions in the literature. This article surveys some of these replies. First, however, it examines the distinctions between legal and moral human rights and rights to health vs. health care. It then surveys (...)
